Nebraska Supreme Court Review, James S. Angus, Dennis W. Collins, G. Eric Lonnquist
Nebraska Law Review
The Nebraska Law Review is pleased to continue in this issue a section devoted exclusively to recent decisions of the Nebraska Supreme Court. This section contains a critical discussion of recent decisions which the Nebraska Law Review believes are either cases of first impression in our court or rulings which substantially alter previous case law in Nebraska. The purpose of the Nebraska section is (1) to provide attorneys in Nebraska and elsewhere with a comprehensive study of the holdings of selected cases and an analysis of how these decisions relate to previous Nebraska decisions, and (2) to provide a forum …

Federal Aid To State Legislatures: Problems And Potential, Walter J. Oleszek
Federal Aid To State Legislatures: Problems And Potential, Walter J. Oleszek
Nebraska Law Review
Many scholars and other observers have argued that state legislatures are ill-equipped to play a vital role in the federal system, and yet they must play such a role if pressing national problems are to be met. Government at all levels faces the difficulty of resolving such issues as air and water pollution, urban blight, traffic congestion, inadequate housing, unemployment and underemployment, racial unrest, educational and recreational deficiencies, and rising crime. National, state, and local governments are partners in the federal system. With this goal in mind, a novel idea in federal-state relations has been proposed. It concerns the use …
The Genealogy Of The Outsider's Role In Disclosure Of Equity Ownership In Corporate Acquisition, Melvin Robert Katskee
The Genealogy Of The Outsider's Role In Disclosure Of Equity Ownership In Corporate Acquisition, Melvin Robert Katskee
Nebraska Law Review
The primary issue to be analyzed in this article is the effect which Public Law 90-439, providing for full disclosure of equity ownership of securities under the Securities Act of 1934, will have on the disclosure duty of an outsider making a tender offer for control of a corporation. Resolution of this issue inevitably leads to the battle currently being fought among those learned in the area over the wisdom or lack thereof of placing any disclosure duty upon the outsider.
Validity Of Discriminatory Nonresident Tuition Charges In Public Higher Education Under The Interstate Privileges And Immunities Clause, Charles H. Clarke
Validity Of Discriminatory Nonresident Tuition Charges In Public Higher Education Under The Interstate Privileges And Immunities Clause, Charles H. Clarke
Nebraska Law Review
Nonresidents, like other persons, are entitled to equal protection of the laws. Limiting the enjoyment of state benefits to persons who have satisfied waiting period requirements can exclude nonresidents as well as new residents from state benefits in a way that violates the equal protection guaranty because the exclusion does not observe permissible standards of classification. The cluster of substantial constitutional questions created by Shapiro v. Thompson about state discrimination against nonresidents with respect to the enjoyment of state benefits may turn out to be the most phantom iceberg that the fundamental law has ever met. Moreover, whether nonresidents are …
The Conglomerate Merger Tangle, Wallace M. Rudolph
The Conglomerate Merger Tangle, Wallace M. Rudolph
Nebraska Law Review
Conglomerates such as L.T.V., I.T.T., Gulf and Western, and Litton Industries have become widely known during the sixties. Whatever else may have happened during this decade, a fundamental change has occurred in the nature of mergers. In a base period of 1948 to 1951, 38.1 percent of all mergers were conglomerate whereas in 1968, 91 percent of all mergers were conglomerate. What caused this change and what are the effects of this change for antitrust have been the subjects of much concern and analysis.
Constitutional Law: The Right Of Access To The Press, Douglas F. Duchek
Constitutional Law: The Right Of Access To The Press, Douglas F. Duchek
Nebraska Law Review
The right to publish one's views on any particular issue is protected from state infringement by the First Amendment. A problem arises when an individual who lacks printing facilities attempts to publish editorial advertisements in privately owned newspapers. Since he owns no printing press, should he have the right to rent the paper's facilities and circulation to present his views? The editorial advertisement is the same as a commercial advertisement; however, the editorial advertisement usually concerns an issue or controversy of a political nature. These advertisements are common around elections, but then they are encouraged by newspapers. The kinds of …

Blind River Dolphin: First Side-Swimming Cetacean, Earl S. Herald, Robert L. Brownell Jr., Fredric L. Frye, Elkan J. Morris, William Evans, Alan Scott
United States Department of Commerce: Staff Publications
The blind river dolphin (Platanista gangetica), first written about by Pliny the Elder in A.D. 72, was found (10 November 1968) to be the first known side-swimming cetacean. The rudimentary eye lacks the lens, but anatomical evidence suggests that the eye may serve as a light sensor. The underwater sound emissions of this species, although similar to those of the Amazon River dolphin (Inia geoffrensis), appear to be produced constantly.

Evidence On The Validity Of Management Education, Fred Luthans, James W. Walker, Richard M. Hodgetts
Department of Management: Faculty Publications
The authors feel that more attention should be given to the empirical validation of management education. In order to determine what effect a college degree and the academic major have on promotability, 3,202 marketing personnel of a major petroleum corporation were analyzed.
What effect does a college education have on executive success? Does the major area of study make any difference? Does any kind of management education or development yield tangible returns to an employing organization? In other words, have management formal education and development been empirically validated? Many organizations are seriously beginning to ask these questions. The current body …

Bibliography Of The University Of Nebraska Studies, Marilyn Irene Planer
University Studies (University of Nebraska) (1888–1984)
In this the Centennial Year of the University of Nebraska, it seems appropriate to present a bibliography of the University's Studies series, which was initiated in 1888. Works issued from that date through 1941 comprised the "Old Series"; they were identified by volume and number and by month and year of publication.
publication. Eighteen Studies in Language, Literature and Criticism were printed between 1917 and 1940, four Studies in the Humanities between 1941 and 1945, and two Studies in Science and Technology in 1941 and 1942. The "New Series," which began in 1946, continues to this day on an irregular …

Protein Synthesis During Fungal Spore Germination. Iv. Transfer Ribonucleic Acid From Germinated And Ungerminated Spores, James L. Van Etten, R. Kent Koski, Mahmoud El-Olemy
Department of Plant Pathology: Faculty Publications
Transfer ribonucleic acid (tRNA) fractions isolated from germinated and ungerminated spores of Botryodiplodia theobromae and Rhizopus stolonifer had acceptor activity for all 20 amino acids commonly found in protein, when tested with an enzyme fraction from germinated spores. Accordingly, it is unlikely that the absence of tRNA for a particular amino acid limits protein synthesis in fungal spores.

Hatching Of Sod Webworm Eggs In Relation To Low Temperatures, E. A. Heinrichs, Ellis L. Matheny
Department of Entomology: Faculty Publications
Eggs of Chrysoteuchia topiaria (Zeller), Crambus pascuellus floridus (Zeller), and Pediasia trisecta (Walker) were exposed to temperatures of 25, 15, 10, 4, and –10°C. Only those of P. trisecta hatched after exposure to 4°C for 30 days, while none hatched after exposure to –10°C. Eggs of none of the species hatched after exposure to 4 and 10°C for 60 days. Pre-exposure and post-exposure conditioning had no significant effect on percent hatch of P. trisecta eggs, while length of exposure period had a significant effect.

Lipid Content And Seasonal Activity Of Odontopus Calceatus (Coleoptera: Curculionidae) Adults, E. A. Heinrichs
Department of Entomology: Faculty Publications
Overwintering Odontopus calceatus (Say) adults were first observed feeding on April 10. Weekly collections during the activity period indicated that new-generation adults began emerging June 4. By July 23 they had entered the forest litter for hibernation. Lipid content decreased throughout the hibernation period as the weevils utilized 77% of their total lipid content during this time. The most rapid decrease during hibernation occurred from February to March, just prior to mating and oviposition in the spring. No increase in lipid content occurred during the activity period in spring and summer. A great increase in lipid content did occur within …

Transferable Drug Resistance Among Enterobacteriaceae Isolated From Cases Of Neonatal Diarrhea In Calves And Piglets, David P. Aden, Norman D. Reed, Norman R. Underdaul, Charles A. Mebus
School of Veterinary and Biomedical Sciences: Faculty Publications
Fecal specimens were collected on 22 different Nebraska ranches and at the Department of Veterinary Science from young calves and pigs with neonatal diarrhea. Enterobacteriaceae isolated from these fecal specimens were screened for resistance to tetracycline, streptomycin, sulfamethizole, kanamycin, chloramphenicol, colistin, nitrofurantoin, and nalidixic acid. Of the 92 strains studied, 57 were resistant to one or more of these antimicrobial agents. Resistant strains were obtained from all herds involved in the study. The two most common resistance patterns were tetracycline streptomycin sulfamethizole (22 of 57) and tetracycline (13 of 57). None of the strains were resistant to chloramphenicol, colistin, nitrofurantoin, …

Sweetclover Weevil Feeding Stimulants: Isolation And Identification Of Glucose, Fructose, And Sucrose, W. R. Akeson, H. J. Gorz, Francis A. Haskins
Department of Agronomy and Horticulture: Faculty Publications
The water-soluble fraction of Melilotus leaves previously referred to as Stimulant A was further fractionated by preparative paper chromatography into three factors, each having a stimulatory effect on sweetclover weevil feeding. The three factors, designated Stimulant A1, A2, and A3, were identified as sucrose, glucose, and fructose, respectively, by co-chromatography with known sugars on cellulose-coated thin-layer plates. Silver nitrate, anisidine phthalate, and anthrone were employed as detection agents. The isolated compounds and corresponding reagent grade sugars were identical in chromatographic and chemical behavior, as well as in feeding stimulant activity. Sucrose stimulated the greatest …

Parasitic Organisms In The Blood Of Arvicoline Rodents In Alaska, Francis H. Fay, Robert L. Rausch
Harold W. Manter Laboratory of Parasitology: Faculty Publications
A Grahamella-like organism (Schizomycetes: Bartonellaceae) was found in erythrocytes of laboratory-reared northern voles, Microtus oeconomus Pallas, which had been inoculated intraperitoneally with a saline suspension of ground fleas, Megabothris abantis (Roths.), from wild northern voles captured at Lower Ugashik Lake, Alaska Peninsula. A live-trapped northern vole from the same locality harbored trypanosomes referable to T. microti (Mastigasida: Trypanosomatidae). Two morphologically similar but biologically different strains of piroplasms (Piroplasmasida: Theileriidae) of uncertain generic status were isolated from northern voles of Ugashik Lake origin and from northern red-backed voles, Clethrionomys rutilus Pallas, from the vicinity of Anchorage, Alaska. In the natural …

Vibrational Excitation By Electron Impact Near Threshold In H2, D2, N2, And Co, Paul Burrow, G.J. Schulz
Paul Burrow Publications
The trapped-electron method is applied to the measurement of the slopes of the vibrational cross sections near their respective thresholds. Absolute values are obtained by normalization to positive-ion cross sections. The values obtained in H2 are 43 for v=1, 0.72, for v=2, 0.04, for v=3, and 0.003, for v=4, in units of 10-18 cm2/eV. The values for N2 are 2.5 for v=1 and about 0.02 for v=2, whereas, the values for CO are much larger, i.e., 120 for v=1 and 2.4 for v=2. Various corrections that are …
