Zoning Laws As Evidence Of Negligence, Leroy W. Orton Jan 1968

Zoning Laws As Evidence Of Negligence, Leroy W. Orton

Nebraska Law Review

The purpose of this comment is to present the idea that zoning laws should be construed as safety ordinances and that, as such, violations of them should be admissible as evidence of negligence in civil actions. A brief history of zoning and a discussion of the purposes of zoning presently recognized by the courts are followed by a consideration of recognized safety statutes and the evidentiary significance given them by the courts as related to modern zoning laws.

"Institutional" Theory And A New Private "Club": Court Enforcement Of Union Fines, Albert Broderick Jan 1968

"Institutional" Theory And A New Private "Club": Court Enforcement Of Union Fines, Albert Broderick

Nebraska Law Review

In England and in the United States the association of working men in labor unions has been traditionally legally analyzed in terms of "contract." The hypothesis considered here is that recent developments in American labor law make it timely for purposes of administrative law, at least, to discard the legal analysis of the labor association as a "contract" among members, and to substitute a theory of "institution" as more in accord with the existing facts. The adoption of such an analysis would open up a new field of administrative law, one that sociologists (more frequently than lawyers) have referred to …

Nebraska Law Review

Deliberate acts of violence in purported support of a social cause doubtlessly will not be tolerated by bar committees and reviewing courts from a present or prospective member of the bar. But the credentials of a lawyer need not necessarily be denied to one who sincerely and peaceably participates in an act of civil disobedience after it becomes apparent that normal methods of petitioning for improvement through established private or government channels have proved useless.

Implications of the Growth of Corporate Farming (Dorothy Switzer)

Economic studies of farm size have shown that, as farm size increases, average costs either decrease, remain about the same, or increase slightly for very large farms- but still remain below average returns. If this were always so, large farms would be the most profitable, and it might be expected that the size distribution of farms would rapidly shift in this direction. But, as Wilcox reported to the Subcommittee on Antitrust and Monopoly, farm size has been increasing almost uniformly for all size categories. Of all farms, the largest 10 percent …

Relevance And Higher Education: Proceedings Of The Third Annual Meeting Of The National Collegiate Honors Council, 1968, Walter D. Weir

National Collegiate Honors Council Monographs

The papers in this volume were presented at the third annual meeting of the National Collegiate Honors Council at the Olympic Hotel in Seattle, Washington, October 18-20, 1968. The papers indicate our focus on the problems of the relevance of curricula to learning and the relevance of higher education to the world. Black and white students alike urged us to make our programs, our curricula, and our concerns more relevant to the moral and social issues of our time, more relevant to a truly liberal education.

Sociological Studies Of The Alpine Vegetation On Long Peak, Walter Kiener Jun 1967

Sociological Studies Of The Alpine Vegetation On Long Peak, Walter Kiener

University Studies (University of Nebraska) (1888–1984)

General. On this continent no investigation is on record that had for its purpose the structural study of a whole unit complex of alpine vegetation. From Colorado several works are available that treat of the problem in part only. There was very little in the available literature on the biology, structure, and floristic composition of the complete vegetation when the writer, as a ranger for the United States National Park Service, was stationed for five summers on a ranger station located in the alpine zone facing Longs Peak. A desire to increase the knowledge of alpine vegetation led to this …

Epizootic Ecology In The Training Program Of The Vector-Borne Disease Section, Harold E. Stark Mar 1967

Epizootic Ecology In The Training Program Of The Vector-Borne Disease Section, Harold E. Stark

Vertebrate Pest Conference Proceedings: 3rd (1967)

To fulfill the primary objective of the Vector-Borne Disease Section of NCDC to reduce the incidence of vector-borne diseases - a series of courses on vertebrates and arthropods and their role as reservoirs, vectors, and disease-causing agents is presented. Literature is prepared and a museum is maintained. One of these courses, Epizootic Ecology, illustrates some of the aspects dealt with in these courses. Definitions and concepts are presented followed by a brief review of principles of epidemiology and ecology. Specific examples constitute the bulk of the course. One of these, tularemia, is especially useful for the purposes of this course …

The Future of the Plains (James Allcott)

The logical starting point for a regional analysis of this kind is with population, because people are both the basic ingredient and the object of economic growth. The six states selected for this study - Nebraska, Iowa, Kansas, Missouri, Oklahoma, and Arkansas - have grown. and will continue to grow, less rapidly than the rest of the nation. A significant point to note. however, is that the rate of growth is increasing. while the rate of growth for the nation as a whole is not. During the 1950's, they grew at about 0.6 …

Retreat From "Fault"? An English Lawyer's Views, J. Neville Turner Jan 1967

Retreat From "Fault"? An English Lawyer's Views, J. Neville Turner

Nebraska Law Review

European scholars have in the past tended to look askance at the more permissive American divorce laws, but of late influential voices have been heard advocating a change in the basis of divorce law. The present climate of opinion suggests that there is a real possibility of a "non-fault" statute being seriously canvassed in the United Kingdom Parliament in the immediate future. Recent articles suggest that English jurists too favour "departure from fault." The subject of this dialogue is thus a very live issue in England, as well as in some states of the United States and some provinces of …

Some Thoughts On The Future Course Of American Antitrust Law Policy, David Dale Martin Jan 1967

Some Thoughts On The Future Course Of American Antitrust Law Policy, David Dale Martin

Nebraska Law Review

Since the very beginnings of capitalism, the law in our society has embodied a policy with respect to restraint of trade, monopolization, and unfair competition. Many characteristics of that policy have evolved steadily over time, while others have remained essentially unchanged. In the next ten to fifteen years we may expect further development of the policy implicit in the antitrust law. In a world in which technology as well as political, social, and economic institutions are rapidly changing, it would be surprising if the antitrust policy component of American political and economic institutions remained static. To forecast in detail the …

An Academic Lawyer Plays Armchair Analyst: Some Speculations On The Relevance Of Psychoanalysis To The Law, Leonard V. Kaplan Jan 1967

An Academic Lawyer Plays Armchair Analyst: Some Speculations On The Relevance Of Psychoanalysis To The Law, Leonard V. Kaplan

Nebraska Law Review

The purpose of this paper is to briefly analyze two levels of potential and actual interrelationship between psychoanalytic insights and legal working. The first is psychoanalysis as a total philosophy of man, descriptive of man and all his institutions including legal ones; the second is psychoanalysis as a tool for the law where legal institutions seek for value reasons to intervene in a particular situation where the psychology of an individual(s) is at issue. The latter use of psychological theorems and methods covers the legal spectrum from cases of "undue influence" in wills to questions of "mens rea" in criminal, …

The Criminal Law System, Karl Menninger M.D. Jan 1966

The Criminal Law System, Karl Menninger M.D.

Nebraska Law Review

Our highly civilized nation has the most crime of any country in the world. Our beloved President was only recently assassinated by a nonentity who was himself assassinated before a trial could be held. Our jails are full, our court dockets are jammed. Every state is enlarging its prison "facilities" at the very moment that all progressive states are reducing the capacities and populations of their state hospitals. While four-fifths of the patients in our state hospitals are now discharged within a few months of their admission, seventy per cent of the people in jail receiving the standard penological "treatment" …

Staff And Client Participation: A New Approach To Correctional Research, J. Douglas Grant, Joan Grant Jan 1966

Staff And Client Participation: A New Approach To Correctional Research, J. Douglas Grant, Joan Grant

Nebraska Law Review

Research in corrections is no longer something done sporadically. Professional research staffs are now permanent parts of most major correctional organizations and correctional research has become routinized. A good deal of this change can be attributed to the demands of state legislators and other budget-controlling bodies for evidence of payoff in the programs they are asked to support. There are three crucial questions concerning this expansion: (1) Where is the manpower coming from? Who will do the innovating, data collecting, evaluating, and monitoring necessary for effective research? (2) Who will determine what program innovations should be studied? and (3) How …

Development And Accomplishments Of Sentencing Institutes In The Federal Judicial System, Luther W. Youngdahl Jan 1966

Development And Accomplishments Of Sentencing Institutes In The Federal Judicial System, Luther W. Youngdahl

Nebraska Law Review

The judges of the United States courts long have been concerned with the improvement of the administration of criminal justice in the federal courts. Over the years one problem in particular—the wide-spread differences in sentencing philosophies and practices—has eluded solution. Deliberations of the Judicial Conference of Senior Circuit Judges jointly with the Committee on the Administration of the Criminal Law of the Judicial Conference of the United States gave rise to a proposal for legislation to permit the establishment of institutes and joint councils on sentencing. Legislation (H.R.J. Res. 424) was approved by the President on August 25, 1958, as …

International Concern With Crime And Corrections, Frank Loveland Jan 1966

International Concern With Crime And Corrections, Frank Loveland

Nebraska Law Review

International concern with crime and corrections is not a recent phenomenon. The first International Penal and Penitentiary Congress (IPPC) was held in London in 1872. When the United Nations was established, it was decided that its role should include a program for the prevention of crime and treatment of offenders. The IPPC at the time of its last Congress, held at The Hague in 1950, agreed to the transfer of its functions to the United Nations. The first of the quinquennial Congresses on the Prevention of Crime and the Treatment of Offenders was held in Geneva in 1955, the second …

The Watershed Look ...At Soil And Conservation : Extension Circular 5-35-65, John W. Neuberger, Harold H. Gilman

Nebraska 4-H Clubs: Historical Materials and Publications

INTRODUCTION Why This Project Is Important to the 4-H Member Soil and water conservation is wise use and care of the two most important natural resources—soil and water—for the greatest good, for the most people, for the longest time. How wisely our soil and water conservation problems are solved will be reflected in the wealth and spirit of tomorrow's people. A working knowledge of the watershed approach to land protection and flood reduction is important for planning community size programs. Those who practice soil and water conservation on the land have taken the first step toward solving their water problems …
