An Analysis Of Divorce In Nebraska, Kenneth L. Cannon Jan 1954

An Analysis Of Divorce In Nebraska, Kenneth L. Cannon

Nebraska Agricultural Experiment Station: Historical Research Bulletins

Each year the State of Nebraska compiles and publishes a considerable amount of data on marriage and divorce. An analysis of these data-such as a study of the extent, increase, and rate of divorce-offers a factual basis for determining how the family is faring in certain important aspects. Some indication of the probabilities of divorce may also be gained. The areas in a state where family breakdown is least and most pronounced may be located, and by comparing these areas, factors associated with high rates of divorce may be determined. The location of the areas may point out where research …

North American Prairie, J. E. Weaver Jan 1954

North American Prairie, J. E. Weaver

Papers of John E. Weaver (1884–1956)

TO MOST AMERICANS, the word "Prairie" suggests either a romantic element in pioneer fiction or a vast expanse of level land which must be crossed in going from one coast to another. But to the botanist, the American Prairie is a wonderfully complex society of living organisms.

This book tells the story of that society-the variety of its inhabitants; the constitution of its several communities; the internal struggles for domination of the society; and the battles of the Prairie as a whole against its two most vicious enemies, drought and overgrazing. Most striking, perhaps, is the story of that portion …

Rb54-175 Farm Family Housing Needs And Preferences In Nebraska, Virginia Y. Trotter, Margaret I. Liston Jan 1954

Rb54-175 Farm Family Housing Needs And Preferences In Nebraska, Virginia Y. Trotter, Margaret I. Liston

University of Nebraska-Lincoln Extension: Historical Materials

Some farm families in Nebraska want to build new houses. Many others are planning to remodel. These families will be asking architects, engineers, builders, contractors, and dealers for plans that meet their needs. Thus, farmhouse plans should be developed that provide for the basic needs of all farm families and that are adaptable to special requirements of some families.

This 1954 bulletin reports the results of a survey of Nebraska farm family preferences, activities and possessions as they are related to housing needs. The study was part of a cooperative research project for the improvement of farm family housing in …

Self-Incrimination—Witness—Loss Of Employment By Asserting The Privilege Against Self-Incrimination: A Professor’S Dilemma, Ronald W. Hunter

Nebraska Law Review

During recent months many college professors have been subpoenaed before congressional investigating committees. The questions and answers at some of these investigations were similar to the following:

Q: Are there any instructors on the faculty who are members of the Communist Party?
A: I refuse to testify on the grounds that I may tend to incriminate myself.
Q: Have you attended any Communist meetings?
A: I refuse to testify on the same grounds.
Q: Are you a member of the Communist Party?
A: I refuse to testify on the same grounds.

After considerable dissent from organized professor groups, at least …

Some Practical Aspects Of Oil And Gas Title Examinations In Nebraska, Lowell C. Davis Jan 1954

The topics here under discussion are too broad to warrant more than a limited treatment. Eminent authors and jurists have written volumes on the subjects that will be discussed, footnote references to some of which will be made herein. These authorities and others should be consulted for a more detailed treatment of the matters herein discussed. It is intended that this article will share …

Criminal Law — Homicide — Is A Purpose Or An Intent An Indispensable Element Of Murder In Nebraska?, Robert S. Hinds Jan 1954

Criminal Law — Homicide — Is A Purpose Or An Intent An Indispensable Element Of Murder In Nebraska?, Robert S. Hinds

Nebraska Law Review

At common law every criminal homicide was considered either murder or manslaughter. There were no degrees of murder. Murder was the unlawful killing of another with "malice aforethought" and this malice could either be express or implied. Manslaughter, on the other hand, was the unlawful killing of another without malice.

In Nebraska there are two statutory degrees of murder. The first degree murder statute provides that every person who "purposely and of deliberate and premeditated malice or in the perpetration of or attempt to perpetrate any rape, arson robbery or burglary ... kill[s] another... shall be deemed guilty of murder …

Extra-Judicial Confessions — Sufficiency Of Corroboration, Lawrence L. Wilson Jan 1954

Extra-Judicial Confessions — Sufficiency Of Corroboration, Lawrence L. Wilson

Nebraska Law Review

To convict a person of a felony, the criminal law requires that the corpus delicti be established beyond a reasonable doubt. The corpus delicti is made up of three elements: (1) there must be an injury or loss; (2) the injury or loss must result from the doing of a criminal act; and (3) the accused must be identified as the doer of the criminal act. Unless the accused confesses or admits the crime, all three of these elements must be proved by competent evidence which will exclude all reasonable doubt of his guilt. Where there is an infra-judicial confession, …

Nebraska Statutory Revision Of Punishment Of Sex Offenders, James W. Hewitt

Nebraska Law Review

A recent amendment to the Nebraska statutes provides that whosoever should debauch the person or deprave the morals of a minor; fondle a child under 16 in a lewd manner; or expose his person to a child under 16 should be guilty of a felony upon the first conviction, and should be liable to fine, or imprisonment, or both. It is further provided that if the person commits a second offense of the same nature, psychiatric examination of the offender before sentencing is required. Revision Of Criminal Law — Objectives And Methods, Jerome Hall Jan 1954

Revision Of Criminal Law — Objectives And Methods, Jerome Hall

Nebraska Law Review

There are encouraging signs of the timeliness, of criminal law revision and of the recognition of its importance. For example, the current project to provide a model penal code under the auspices of the American Law Institute' has engaged the services of distinguished lawyers, judges, and scholars. And the recently announced program of the American Bar Association to survey the administration of criminal justice is sponsored by leaders of the American bar, including a Justice of the United States Supreme Court. This interest in criminal law is rooted in the traditions of the American bar. Thus, while the unparalleled economic …

The Effect Of Insurance On The Tort Immunity Of A Governmental Subdivision, Patrick W. Healey Jan 1954

The Effect Of Insurance On The Tort Immunity Of A Governmental Subdivision, Patrick W. Healey

Nebraska Law Review

American law has long afforded the state and its subdivisions of government an immunity from liability for tort. The Federal Government, the state, municipal corporations, and quasi-municipal corporations of various types, are exempted from tort accountability for their wrongful acts.

In the past, the subdivisions which are the recipients of this immunity have not been reluctant to accept it. But criticism of this immunity, both as to the social merit of casting the entire burden of injuries caused by the activities of government on the individuals harmed rather than spreading the loss among the public for whose benefit the activities …

Book Reviews: Public Accountability Of Foundations And Charitable Trusts, Eleanor K. Taylor. New York: Russell Sage Foundation, 1953, Paul A. Phillips

Nebraska Law Review

Eleanor K. Taylor, in her book Public Accountability of Foundations and Charitable Trusts sketches the regulatory machinery in some twelve states and England and Canada, with a glance at the federal machinery in the form of the Internal Revenue Code and the Service which administers it. In the preparation of her study, a questionnaire was sent to the attorneys general of 48 states and two territories inquiring into the legal machinery in their states for the performance of the attorney general's ancient duty of representing the public interest in connection with charitable trusts. Responses came from 33 states (Nebraska did …

Secretion Of Amylase By Rumex Virus Tumors In Vitro, L. G. Nickell, M. K. Brakke Jan 1954

Secretion Of Amylase By Rumex Virus Tumors In Vitro, L. G. Nickell, M. K. Brakke

Department of Plant Pathology: Faculty Publications

The secretion of extracellular enzymes by intact cells of higher plants apparently is a rare occurrence. One example of it is the secretion of an extra, cellular amylase by the tissue of a virus-induced tumor from the root of Rumex wetosa L. An amylase is secreted in sufficient quantities by this tissue to enable it to grow as well in vitro on a starch-containing medium as on one containing sucrose.

Fat Separation In Evaporated Milk. Iii. Gravity Separation And Heat Stability, R. B. Maxcy, H. H. Sommer Jan 1954

Fat Separation In Evaporated Milk. Iii. Gravity Separation And Heat Stability, R. B. Maxcy, H. H. Sommer

Department of Food Science and Technology: Faculty Publications

Fat separation is a continuous problem in the production, handling, and storage of evaporated milk. This defect becomes most objectionable during prolonged quiescent storage at high temperatures. The butterfat rises to the upper surface forming a viscous, leathery layer, which may prevent pouring of the milk from a relatively small opening.
To retard fat separation, the manufacturer attempts to obtain effective homogenization and sufficient coagulation of the proteins during sterilization to give the product a high viscosity or "heavy body" (1, 12, 14). These practical applications are aimed at three fundamental considerations: a reduction in the size of the fat …

Fat Separation In Evaporated Milk Ii. Age-Thinning Of Concentrated, Sterilized Milk, R. B. Maxcy, H. H. Sommer Jan 1954

Fat Separation In Evaporated Milk Ii. Age-Thinning Of Concentrated, Sterilized Milk, R. B. Maxcy, H. H. Sommer

Department of Food Science and Technology: Faculty Publications

During the process of sterilization of evaporated milk there is a gradual increase in the viscosity, or the body of the product. However, there is a reduction in the viscosity especially during the early phase of storage. This loss in viscosity, referred to as age-thinning, continues for a number of months.
