Prison Overcrowding In Nebraska: The Feasibility Of Intensive Supervision Probation, Dennis Hoffman, Vincent J. Webb

This chapter analyzes the magnitude and causes of Nebraska's prison overcrowding problem. Nebraska's response to this problem has been to expand prison capacity and to implement programs to decrease length of stay. Another policy option - reducing prison admissions through intensive supervision probation - is examined in this chapter. Data from Nebraska Parole Board files indicate there is a category of current prison inmates that are not sufficiently dangerous to require imprisonment. Many of these nonviolent offenders with marginal criminal histories could be diverted into intensive probation programs that are more cost·effective than incarceration.

ADC transferred to the U.S. Department of Agriculture by Public Law 99-190. Parameters of ADC in USDA are that the program is biologically sound, environmentally acceptable, and economically feasible. Major program components are cooperative operational control, education and information, and research. The National Animal Damage Control Advisory Committee is being formed. The American Society for Testing and Materials is helping on research priorities. A line-staff organization has been put in place within the Animal and Plant Health Inspection Service in USDA.

The occurrence of widespread, severe drought in Africa, India, North America, China, the USSR, Australia, and western Europe has once again underscored the vulnerability of developed and developing societies to drought The occurrence of severe drought during 1982-83 is shown in Fig. 1. These recent droughts have emphasized the need for more research on the causes as well as the impacts of drought and the need for additional planning to help mitigate the possible worst effects of future droughts. Using adult jails and lockups for confining youths is a major issue in juvenile justice. Proponents of removing children from these facilities are concerned with the conditions of confinement, the .ate of suicide among youths held in adult facilities, the excessive use of secure confinement for youths, and the legal liability of jurisdictions that hold juveniles in adult facilities. Nebraska has made significant progress in reducing the number of youths confined in adult jails and lockups, but has yet to pass legislation or develop programs and facilities to complete the task. This paper introduces the sociological and experiential studies included in this special issue of Man-Environment Systems. Sociological and experiential perspectives and their interconnections are briefly explored. A sociology of sociology perspective is adopted and argues that architects, planners, engineers and other managers of vested, status guo interests fail to systematically incorporate the burgeoning social scientific work on pedestrianism due to the inherent and unavoidable political character of walking.

Mountain lions (Felis concolor) symbolize wilderness. The "wild west," a supreme predator, supreme quarry, destroyer of wildlife (game and nongame), livestock, and "trophy" hunting. They are the epitomy of controversy in California. In this paper we will review the history of management and present legal status of mountain lions in California, the political situation leading to the present status, and some of the biological factors that have been controversial, particularly relating to population status and trends.

Social theorists in earlier periods have looked at credentialing from the perspective of its service to the economic or social system as opposed to its “protection of the public interest.” Adam Smith regarded the long education and the performance tests that the guilds required as monopolistic constraints on production; Karl Marx saw the same guild system as controlled by the propertied classes and uselessly exclusionary; and Emile Durkheim, unlike both Smith and Marx, regarded the occupational group with its entrance requirements as central to the stability of modern society. Influences On Early Twentieth Century Bungalow Housing In Lincoln, Nebraska, Madeleine F. Panarelli

Open Access Master's Theses (through 2010)

Housing publications of the Bungalow era (1900 to 1930) containing over 1200 illustrated Bungalows and derivations, were compared with 717 photographed representatives in Lincoln, Nebraska. These samples were categorized by 10 types first described by writer Henry Saylor (1911). Interpretations of the style by local builders and architects in Lincoln, Nebraska, were traced to house pattern books, national and local publications, and state and city records, to determine how the style evolved locally. The search led to regional design features of the Bungalow, nearly square forms, and composite types.

Double Jeopardy: Government Appeals Of Sentences: United States V. Difrancesco, 449 U.S. 117 (1980), David M. Lofholm

In the landmark decision of United States v. DiFrancesco, the Supreme Court, in a five-to-four decision, reversed the Court of Appeals for the Second Circuit, and held that the appeal provision of 18 U.S.C. § 3576 (1976) did not violate the double jeopardy clause of the fifth amendment. This Note analyzes the DiFrancesco decision in the context of double jeopardy law and discusses the decision's effect on double jeopardy principles. This note also suggests that the majority opinion in DiFrancesco, ignoring as it does the tradition of double jeopardy protection, was not a completely satisfactory response to the issues …

Zoning ordinances restrict the use of property in order to achieve and promote the goals of a city or county in protecting the public health, safety and welfare. Nebraska, Iowa, Kansas, and Missouri, which make up EPA Region VII, are among the leading corn and wheat producing States in the Nation_ These States also produce a significant share of the soybean, grain sorghum, fat cattle, and finished hogs that are supplied to American and foreign markets.

Although the States in Region VII can best be characterized as rural, 65 percent of their nearly 12 million people live in urban areas. In Nebraska, metropolitan areas such as Omaha 4 have environmental problems resulting from major industrial operations, municipal services, transportation, and energy production. Frightening devices and other methods of dispersing roosting blackbirds and starlings are described along with the techniques for their proper application. In a study in the southeastern United States, exploding shotgun shells and noise bombs were used to disperse roosts of up to 1 million birds. Five roosts containing up to 1 million blackbirds and starlings were 96 to 100% dispersed by two to five people during three to eight evenings of harassment. Dispersal cost between $80 and $535 per roost.

A major effect of World War I on American social history was that it focused attention on the nation's apparent difficulty in assimilating the millions of immigrants and their children who had streamed to the United States during the preceding two decades. The national mood, darkened by fears and resentments of long standing and deepened by systematic wartime propaganda, favored the adoption of stringent laws limiting the use of foreign languages, especially in the schools. During the war itself, restrictions were usually extralegal and often the consequences of intense social pressure recklessly applied. After the war, however, many state legislatures …

This article aims to provide a statement of the law relating to trial and pretrial publicity in England. The discussion is limited to criminal cases because it is in this area that there has been the greatest controversy in the United States—and Nebraska in particular. English courts are not bound by entrenched constitutional principles, and it may appear to the American reader that when the English courts balance conflicting interests of a free press and a fair trial, they are rather arbitrary in their preference for the latter.
