The Andromache Of Euripides, Keith M. Aldrich
The Andromache Of Euripides, Keith M. Aldrich
University Studies (University of Nebraska) (1888–1984)
There seems now to be widespread agreement in the otherwise disputatious world of letters that literary criticism is one of the most difficult and one of the least generally successful of all undertakings. 1 As a science it is (and has always been) constantly frustrated by the absence of principles and applicable theories. As a service it has been regularly ignored. As an art it has usually found recognition only in disguise. The reasons underlying this undistinguished record are many: ignorance, shortsightedness, bigotry-all such imperfections on the part of the critics have contributed their share; they, with the passage of …
A Fugitive And Gracious Light: The Relation Of Joseph Joubert To Matthew Arnold's Thought, G. Thomas Fairclough
A Fugitive And Gracious Light: The Relation Of Joseph Joubert To Matthew Arnold's Thought, G. Thomas Fairclough
University Studies (University of Nebraska) (1888–1984)
Of the many literary and critical influences which combined to mold the thought and achievement of Matthew Arnold, few are more pronounced or more pervasive than those emanating from nineteenth-century France. French writers of Arnold's own time and of that immediately preceding were to him masters and companions whose aid he fully and frequently acknowledged.
Yet the number of scholarly studies devoted to Arnold's French sympathies are few. The only book-length study in existence is Iris Esther Sells's Matthew Arnold and France: the Poet (New York, 1935). As the title indicates, this book confines itself to an investigation of Arnold's …
Tones And Intervals Of Hindu Classical Music, Donald A. Lentz
Tones And Intervals Of Hindu Classical Music, Donald A. Lentz
University Studies (University of Nebraska) (1888–1984)
ART IS ALL ENDURING and limitless, and defies positive, unvariable classification. No attempt is being made in this book to compare artistic, subjective or emotional factors. Only the objective elements, techniques and procedures of music that are tangible and definite are being compared and classified. Western music, having reached a plateau under the present harmonic system, is projecting into new channels for textural inspiration. Composers have exploited the present system, using existing intervals in every conceivable manner under existing tonal and atonal theories. Devices such as smaller intervals (example: tempered quarter tones), electronic combinations, aleatonic principles, etc. are being dealt …

Streamlining The Executive In Nebraska, Frank B. Morrison
Streamlining The Executive In Nebraska, Frank B. Morrison
Nebraska Law Review
In the third of three articles on the branches of Nebraska government and their relationship to revising the state constitution, Governor Frank Morrison concludes the section with a number of provocative proposals for streamlining the executive branch of state government through amendments to the constitution. The major areas in need of change are the boards and commissions created in the executive section of the Constitution; that is, the Railway Commission, Board of Control, Board of Pardons, and other areas of executive responsibility, such as the Highway Commission and executive officers. The Unicameral has made significant strides in the area of …

Responsibility Of Teacher Educators To Youth Entering Non-Farm Agricultural Occupations, James T. Horner
Responsibility Of Teacher Educators To Youth Entering Non-Farm Agricultural Occupations, James T. Horner
Department of Agricultural Leadership, Education, and Communication: Faculty Publications
(1) Employers in farm related occupations are not assuming the responsibility of educating their employees, (2) the proportion of workers able to secure unskilled employment is decreasing, (3) the numbers of skilled, technical, clerical, managerial and sales jobs are increasing, {4) many rural youth will inevitably enter non-farming agricultural jobs and (5) although their farm backgrounds and experiences are valuable, they will require considerable education to qualify for and advance in satisfactory employment.
Whether it be supplementing of high school courses, area schools at the post-high school level, community colleges, on-the-job cooperative training, or some other method, it is apparent …

Nebraska's Workmen's Compensation For Aggravation Of Pre-Existing Infirmities By Exertion Or Strain, John M. Gradwohl
Nebraska's Workmen's Compensation For Aggravation Of Pre-Existing Infirmities By Exertion Or Strain, John M. Gradwohl
Nebraska Law Review
The recent United States National Health Survey indicates that almost one out of six workers has some sort of known chronic or permanent physical impairment. On any given work day, an undetermined number of additional workers would have various sorts of lesser physical infirmities ranging from minor ailments, such as small cuts or common colds, to really serious physical limitations. Many more workers would have undetected and unknown physical infirmities. This article examines the extent to which these workers may be entitled to compensation under the Nebraska Workmen's Compensation Law for work-connected aggravation of their pre-existing infirmities by exertion or …

Recent Problems In Obscene Publication Regulation And Motion Picture Censorship: Obscene Publication Prohibition [Shipley] And Motion Picture Censorship [Cook], Parker L. Shipley, G. Bradford Cook
Nebraska Law Review
There has been growing interest in the field of obscenity and its regulation, and these two comments discuss some recent problems in the areas of obscene publications and motion pictures. The first discusses local problems in regulation of publication and sale of obscene materials, and analyzes our present state laws, two local ordinances, and recent Nebraska Supreme Court decisions. The second discusses current problems of motion picture censorship and includes a historical review of the development of modern screen censorship.

A Survey Of The Status Of Speech In The Public Junior Colleges Of The United States, Jacquelyn Miller Kitzelman
Open Access Master's Theses (through 2010)
This study was conducted for the purpose of determining so far as possible the status of the speech programs of the public junior colleges of the United States. The problem was twofold: first to determine the status of both curricular and co-curricular speech offerings in the public junior college; and second, to determine, if any growth has taken place in the junior college speech programs in the past thirty years.
In order to carry out the objectives, a survey was conducted. Questionnaires were sent to 236 public junior colleges in all parts of the United States. One hundred ten usable questionnaires were …
An Analysis Of The Compositional Devices In Wozzek By Alban Berg, John Charles Nelson
An Analysis Of The Compositional Devices In Wozzek By Alban Berg, John Charles Nelson
Open Access Master's Theses (through 2010)
One of the most significant trends in twentieth-century music is that which embodies an abandonment of all of the traditional concepts of tonality.Since it is conceivable that complete freedom of the twelve tones without some logical organization may result in a form of musical anarchy, any investigation of works in the atonal medium should, first of all, determine what devices are used to give order and logic to the work. These devices may then substitute for the cohesive force of tonality which is lacking in atonal works. In order to investigate the compositional devices of the atonalist writers, Wozzeck by Alban Berg …

Pamela-Shamela: A Study Of The Criticisms, Burlesques, Parodies, And Adaptations Of Richardson's "Pamela", Bernard Kreissman
University Studies (University of Nebraska) (1888–1984)
The English novel traces its roots beyond the medieval romance, but it first began to assume recognizable form early in the eighteenth century with such books as Defoe's Robinson Crusoe, Roxanna, and Moll Flanders; Mrs. Behn's Oroonoko and Swift's Gulliver's Travels. It was not until mid-century, however, that it took on its fun lineaments in the works of Richardson, Fielding, Smollett, Sterne, and their followers. The first of these "true" novels, published on November 6, 1740, was Richardson's Pamela: or, Virtue Rewarded. Pamela caught on, enjoyed a great popular vogue, started several schools of fiction, and was directly responsible for …

A Mountain Mystery, Robert S. Haller
Department of English: Faculty Publications
A Mountain Mystery is a poem written by Robert S. Haller and the spring 1960 issue of Shenandoah: The Washington and Lee University Review, volume 11, number 3, page 41.
The published version contains two typos (there should have been no period at the end of the first line and "stopped" in the fourth line should have been "stooped"). This version is republished as the author intended it to read.
The General Power Of Appointment As An Interest In Property, Lawrence Berger
The General Power Of Appointment As An Interest In Property, Lawrence Berger
Nebraska Law Review
The commentators in the field of future interests have, for the most part, agreed there is a trend in the law toward piercing the fictional veil that a general power is a mere mandate or authority to dispose of property. The purpose of this article is to explore, in summary, the historical basis for the general power and the reasons for the current prevalence of its use. The question of whether the general power does have peculiar characteristics and advantages in intent effectuation is evaluated in more detail. In addition, the law as it relates to the rights of third …

This law is specific in its treatment of all questionable species. The joint regulations of the Fish and Game Commission and the Department of Agriculture governing the importation of wild birds and animals, and conditions under which same may be kept in confinement are set forth in Part 3, Chapter 3, Section 671, Title 14 of the California Administrative Code.

The Dispersal And Acclimatization Of The Muskrat, Ondatra Zibethicus (L.), In Finland, Atso Artimo
Other Publications in Wildlife Management
The natural range of the muskrat, Ondatra zibethicus (L.), comprises the major part of the North American continent (Fig. 1). In the northern and eastern parts of its range its distribution is more or less continuous, but in the arid west it is very patchy. The species is absent from some areas which, according to Storer (1938), are suitable for it. This writer assumes (op.cit. pp. 159-160) that »Muskrats probably reached some of the now isolated waters of the West during a period when aquatic and palustrine habitats were more widespread, in late Pleistocene or postglacial times. With subsequent contraction …
News Media Coverage Of Criminal Cases And The Right To A Fair Trial, Warren Freedman
News Media Coverage Of Criminal Cases And The Right To A Fair Trial, Warren Freedman
Nebraska Law Review
The right to an open or public trial, the right to a speedy trial, and the right to a fair trial are guaranteed under the Sixth Amendment to the United States Constitution, and the fair administration of justice is the cherished right of all US citizens. It is agreed that our traditional concept of a presumption of innocence until proof of guilt must not be placed in jeopardy, yet this human want is occasionally in conflict with the freedom of the press and the right of the people to know and participate in the governmental process. Such a conflict, stemming …

A Movement West, Robert Katz
A Movement West, Robert Katz

I did not discover that I had any interest in teaching or in academic life until late in my twenties, and then only through a sequence of unrelated circumstances.
I was born in 1917. My parents were Russian-Jewish immigrants who came to New York City at about the turn of the century.
At sixteen I enrolled in Brooklyn College, a recently organized, tuition-free, municipal college, then housed in rented office buildings in downtown Brooklyn. It took an hour to get to or from school on the subway. I managed to choose this inconvenient location because this school seemed most likely …

Silence And Perjury Before Police Officers: An Examination Of The Criminal Law Risks, Dale W. Broeder
Silence And Perjury Before Police Officers: An Examination Of The Criminal Law Risks, Dale W. Broeder
Nebraska Law Review
The purpose of this article is to review and to synthesize those areas of the law bearing on the nature and extent of the citizen's modern-day responsibilities to inform on the criminal activities of others and to discuss the criminal law risks involved in lying to police officers during the course of their investigations of crime. Policy considerations, of course, are also advanced. These subjects, it is realized, constitute only a portion, and that a comparatively small one, of the broad area of the extent of the citizen's duty to cooperate with police officers, but, it is hoped, a sufficiently …

A "conservative" taxonomic character is one which preserves evidence of evolutionary relationships. As Mayr (1942: 296) points out such characters are rare because structures are usually lost quickly when no longer needed and selection seldom neglects a functional structure for very long but continually modifies it as adaptive fitness is increased. However, because different characters evolve at different rates it is possible to find some characters which have changed more slowly than others and to use these as phylogenetic indicators. In birds, for example, plumage color and structure apparently change more rapidly than the skeleton or the muscular system. This …
Corpus Delicti Proof Requirements In Nebraska Aliunde Defendant’S Confession, Richard A. Huebner
Corpus Delicti Proof Requirements In Nebraska Aliunde Defendant’S Confession, Richard A. Huebner
Nebraska Law Review
Proof of crime may be divided into three parts: (1) a specific kind of injury or loss, the burned dwelling house in arson, for example, or the body in homicide; (2) the criminal agency of another as the means; and (3) the identity of the defendant as the perpetrator. Only the first two elements, however, constitute the corpus delicti, and it is only the corpus delicti which need be established by “some evidence” in addition to defendant’s extra-judicial confession or admission. No jurisdiction requires proof in addition to defendant’s extra-judicial confession or admission that defendant was the perpetrator.
The central …
