Guide To The Preparation Of Military Reports Of A Technical Nature, The Engineer School, Fort Belvoir, Virginia, Robert L. Bolin Depositor
United States Army: Publications
This is a brief text prepared for instructional purposes at the US Army Engineer School at Fort Belvoir, VA.
The manuscript covering the preparation of a technical report has been prepared for two reasons: first, to serve as a basic text for instructing student officers in the techniques of report writing and second, to serve as a means of reference. Student officers cannot be expected to retain in their minds all the minute details of report writing to which they are exposed during their period of school training. Considerable time may elapse after graduation and before they are called on …

Criminal Law Revision Codification Vs. Piecemeal Amendment, Frank J. Remington
Criminal Law Revision Codification Vs. Piecemeal Amendment, Frank J. Remington
Nebraska Law Review
I. Introduction
This symposium issue of the Nebraska Law Review affords additional evidence of the growing interest in criminal law revision. Not only is there interest, but, more important, there are indications that steps are being taken to translate that interest into tangible contributions to the improvement of criminal justice, and particularly toward the improvement of the substantive criminal law which has for so long been ignored.1 It is with revision of the substantive statutory law that this article is primarily concerned.

Habeas Corpus — Coram Nobis — Remedies Available To Validly Sentenced Prisoners Who Are Mistreated By State Penal Authorities, Jerrold L. Strashiem, Donn E. Davis
Habeas Corpus — Coram Nobis — Remedies Available To Validly Sentenced Prisoners Who Are Mistreated By State Penal Authorities, Jerrold L. Strashiem, Donn E. Davis
Nebraska Law Review
Where a person is deprived of certain rights by penal authorities after he has been imprisoned pursuant to a valid trial and sentencing, what remedies are available to him to obtain judicial relief? An increasing number of recent cases have suggested a variety of answers, depending partly upon (1) whether the prisoner shows infringement of constitutional or merely non-constitutional rights, and (2) the type of remedy sought. The decisions may further be classified according to the different grounds for relief raised by prisoners in these situations.
1. Discriminatory denial of access to the courts.
2. Infliction of "cruel and unusual" …
Individualized Treatment Of Criminal Offenders, Allan J. Garfinkle, Charles H. Beatty
Individualized Treatment Of Criminal Offenders, Allan J. Garfinkle, Charles H. Beatty
Nebraska Law Review
For many years the nation's criminologists and penologists have denounced the present system of treatment of criminal offenders as unrealistic and unproductive of desirable results. Dissatisfied with legislative tinkering at the peripheries of the problem, they have called for a sweeping re-examination of the basic procedures which appear untenable in the light of modern psychological knowledge.
In prior times the prime motive of society in its treatment of criminals was retribution; today it is still present, although in much reduced form. Deterrence from criminal acts and isolation of dangerous persons are present goals of criminal justice. Primarily, however, the aim …
A Case On Appeal — The Advocate's Point Of View, Clarence A. Davis
A Case On Appeal — The Advocate's Point Of View, Clarence A. Davis
Nebraska Law Review
This is a subject which so distinguished an advocate as John W. Davis has characterized as "well-worn," and if there can be any justification for my discussing it with you today, it must lie in such applicability as I may make to our local courts in Nebraska, or in such things as I may say to the younger lawyers who have not yet had the time (or to the older ones who have not had the diligence) to read some of the tremendous literature that exists on the subject. When Judge Goodrich, John W. Davis, Mr. Justice Jackson, Chief Justice …
Caveat Promissee: Nebraska’S “New Consideration” Test And The Anachronistic Statute Of Frauds, Henry M. Grether
Caveat Promissee: Nebraska’S “New Consideration” Test And The Anachronistic Statute Of Frauds, Henry M. Grether
Nebraska Law Review
Nearly a quarter of a century ago Professor Maurice H. Merrill made an exhaustive and analytical study of the Nebraska cases regarding suretyship. Reading his work on this subject leads to the conclusion that in most instances the rules of suretyship in Nebraska followed the views expressed by a majority of the other states and text writers. One of the areas in which Professor Merrill discovered confusion and need for greater clarity concerned the so-called "leading object" or "main purpose" rule, a doctrine which will take out of the Statute of Frauds a promise to answer for another's debt. Professor …

North American Prairie, J. E. Weaver
North American Prairie, J. E. Weaver
Papers of John E. Weaver (1884–1956)
TO MOST AMERICANS, the word "Prairie" suggests either a romantic element in pioneer fiction or a vast expanse of level land which must be crossed in going from one coast to another. But to the botanist, the American Prairie is a wonderfully complex society of living organisms.
This book tells the story of that society-the variety of its inhabitants; the constitution of its several communities; the internal struggles for domination of the society; and the battles of the Prairie as a whole against its two most vicious enemies, drought and overgrazing. Most striking, perhaps, is the story of that portion …

Some Aspects Of The Taxation Of Partners And Partnerships Under The New Internal Revenue Code, Paul A. Phillips
Some Aspects Of The Taxation Of Partners And Partnerships Under The New Internal Revenue Code, Paul A. Phillips
Nebraska Law Review
With the Internal Revenue Code of 1954 not yet three months old, reams have already been written about it, more reams are being written and more will be written. It would be interesting to speculate with the statisticians, the “believe-it-or-not” and the “strange-as-it-seems” boys as to how many times around the globe all the lines written and to be written on that Code would stretch, if laid end to end.
It seems doubtful whether any substantial contribution to the understanding of the partnership provisions of that Code can be contributed by these lines. This is particularly true in view of …
Nebraska Statutory Revision Of Punishment Of Sex Offenders, James W. Hewitt
Nebraska Statutory Revision Of Punishment Of Sex Offenders, James W. Hewitt
Nebraska Law Review
A recent amendment to the Nebraska statutes provides that whosoever should debauch the person or deprave the morals of a minor; fondle a child under 16 in a lewd manner; or expose his person to a child under 16 should be guilty of a felony upon the first conviction, and should be liable to fine, or imprisonment, or both. It is further provided that if the person commits a second offense of the same nature, psychiatric examination of the offender before sentencing is required. If examination discloses sexual perversion, the offender is to be confined in a mental institution; if …
Revision Of Criminal Law — Objectives And Methods, Jerome Hall
Revision Of Criminal Law — Objectives And Methods, Jerome Hall
Nebraska Law Review
There are encouraging signs of the timeliness, of criminal law revision and of the recognition of its importance. For example, the current project to provide a model penal code under the auspices of the American Law Institute' has engaged the services of distinguished lawyers, judges, and scholars. And the recently announced program of the American Bar Association to survey the administration of criminal justice is sponsored by leaders of the American bar, including a Justice of the United States Supreme Court. This interest in criminal law is rooted in the traditions of the American bar. Thus, while the unparalleled economic …
