The importance of freshwater habitats in supporting ecological communities and human civilization is irrefutable, yet they remain amongst the most imperiled systems in the world due to factors like resource extraction, non-native species, and climate change. In the Western United States, efforts to combat stream degradation and drought have sought to increase water storage, aggrade eroded stream beds, and increase base flows by promoting dam building by beavers and through restoration projects using human-made beaver dam analogs (BDAs). Many studies have addressed the impact of climate on agriculture; however, fewer studies addressed how farmers adapt to climate change, to what extent implementation of adaptation strategies mitigates economic losses or alters the hydrologic system. Analyses of how historical climate affected not only farmer decision making, but also the economic and hydrological consequences of farmers’ adaptations to climate variations, and projections of the spatiotemporal climatic regimes at finer regional scales are critical for aiding in actionable climate change adaptations. Conceptual models of primary succession in lakes often do not match with empirical data. New lakes arising in mountain regions due to the loss of alpine glaciers offer an opportunity to study newly forming lakes. In addition to the loss of alpine glaciers, mountain lakes are currently experiencing rapid changes, including increased vegetation cover, variable snowpack, and increased nutrient deposition. In this dissertation, I used glacial and elevation gradients to investigate the ecology and biogeochemistry of early lakes and how they may change through time. Comparing Essential Components Of Transnational Jurisdiction: A Proposed Comparative Methodology, Anna C. Conley

Despite vast harmonization across many areas of private international law, approaches to transnational jurisdiction have proved resistant to harmonization. For example, the Choice of Court Convention started as large-scale attempt to unify transnational jurisdiction rules and enforcement of judgments and ended up with a significantly limited scope focused on forum selection clauses. During negotiations, deep rifts between the United States and EU delegates unearthed an unwillingness by the United States to forego common law discretionary jurisdiction doctrines such as forum non conveniens and anti-suit injunctions, and a refusal to allow such doctrines by the EU. A Challenge To "Equitable Originalism" - The History Of Injunctions As A Principle-Based Adaptable Judicial Power, Anna C. Conley

“Equitable originalism” is a judicial philosophy that only injunctions allowable in English chancery courts at the time of America’s founding in the 1780s are allowable in federal courts today. Accordingly, previously unknown types of injunctions, such as structural or nationwide injunctions, are prohibited exercises of judicial power.

This article asks whether historical analysis supports the assertion that the founders intended to crystalize federal equitable powers in the 1780s. The answer is no. Analysis of Article III, federal legislation, rules of court, treatises and caselaw in the late 1700s and 1800s illustrate that the United States received equity from the colonies …

Sacrificing Sovereignty: How Tribal-State Tax Compacts Impact Economic Development In Indian Country, Pippa S. Browde

Economic development is a critical component of tribal sovereignty. When a state asserts taxing authority within Indian Country, there is potential for overlapping, or juridical, taxation over the same transaction. Actual or even potential juridical taxation threatens economic development opportunities for tribes. For many years, tribes and states have entered into intergovernmental agreements called tax compacts to reduce or eliminate juridical taxation. Existing literature has done little more than mention tax compacts with cursory cost-benefit analyses of the agreements. This is the first Article to critically examine the role tax compacts serve in promoting tribes’ economic development.

Deep and broad work is being done by undergraduates, with a significant increase in the last three decades. The growth in undergraduate research opportunities has important effects in the STEM community. In particular, course-based research is a means toward attaining more inclusivity in the research community. This article provides some practical advice and resources for getting started, and describes the author’s own efforts to integrate sports analytics work, service-based learning and social justice research into his undergraduates’ research experiences.

This paper reports on Data Analytics Research (DAR), a course-based undergraduate research experience (CURE) in which undergraduate students conduct data analysis research on open real- world problems for industry, university, and community clients. We describe how DAR, offered by the Mathematical Sciences Department at Rensselaer Polytechnic Institute (RPI), is an essential part of an early low-barrier pipeline into data analytics studies and careers for diverse students. Students first take a foundational course, typically Introduction to Data Mathematics, that teaches linear algebra, data analytics, and R programming simultaneously using a project-based learning (PBL) approach. Math and the Mouse is an intensive, collaborative, project-driven, study away course that runs during the three-week May Experience term at Furman University and has many of the attributes of a course-based undergraduate research experience in mathematics. We take twelve students to Orlando, Florida to study the behind-the-scenes mathematics employed to make Walt Disney World operate efficiently. This article describes a course-based research experience in a cross-listed mathematical problem solving course for middle school pre-service and in-service teachers. The course was conducted entirely online due to statewide and university restrictions during the coronavirus pandemic. This study examines 4 undergraduate and 5 graduate students’ understanding of mathematical modeling. Undergraduate and graduate students were paired in groups to develop open-ended model-eliciting activities for their classmates to solve, and groups conducted educational action research to analyze their classmates’ work on the activities. Course-based Undergraduate Research Experiences (CUREs) have been well developed in the hard sciences, but math CUREs are all but absent from the literature. Like biology and chemistry, math programs suffer from a lack of research experiences and many students are not able to participate in programs like REUs (Research Experiences for Undergraduates). CUREs are a great alternative, but the current definition of CURE (see [1]) has potential barriers when applied to mathematics (e.g. time, novelty of project). This paper describes the use of scientific practices in the Passion-Driven Statistics CURE and presents the results of surveys from the implementation of this CURE at three different colleges. Overall, students experienced positive changes in thinking and working like a scientist, personal gains related to research, and gains in research skills, attitudes and behaviors. The Passion-Driven Statistics CURE aims to equip the future STEM workforce with the data analysis skills and reasoning needed across industries.

The paper describes the Applied Mathematics Laboratory (AML), a course-based model of undergraduate research engagement in applied mathematics at Towson University. Unfortunately, among U.S. undergraduate curricula, STEM has one of the highest attrition rates (Tinto 1993) with less than half of students in the U.S. that enroll in an undergraduate STEM program ultimately receiving a degree in a STEM field (Hayes 2009).
