After fifty years of implementing tribal treaty reserved rights, this article will examine how tribal courts are determining cases involving treaty reserved rights and resources and to the extent tribal courts are recognizing and utilizing tribal customary law. This analysis will include a summary of tribal treaty harvest management systems and the how in the recognition of treaty reserved rights, federal courts have often limited tribes in their ability to fully implement and utilize tribal customary law. A Most Essential Power: The Case For Restoring Comprehensive Land Use Authority In Indian Country, Michelle Bryan
Public Land & Resources Law Review
Part I of this article provides a brief overview of allotment and its lingering jurisdictional quagmire on impacted reservations. Stepping outside of Indian Country, Part II then outlines the U.S. Supreme Court’s longstanding recognition of sweeping, area-wide government land use authority—authority it considers among the “most essential” and “least limitable.” The Court has never applied this established law when determining tribal sovereignty over land use. That application is long overdue.
Part III details how we arrived at this state of affairs—how tribes, despite starting with sovereign control over land use throughout their territories, experienced losses in that authority over time …

This portfolio explores how climate-driven environmental change intersects with long-standing tensions over natural resource management, tribal sovereignty, and rural identity in Montana. It consists of three stories: a historically low water year at Flathead Lake that intensified disputes between tribal dam operators and non-tribal waterfront homeowners; the first confirmed presence of invasive smallmouth bass in the Bitterroot River, signaling warming stream conditions and ecological disruption; and a political narrative from Colstrip, where coal industry workers cling to promises of revival amid economic and regulatory decline. Wildfire risk in the western United States has intensified in recent decades due to intersecting forces of climate change, systematic fire suppression, and expanding human settlement in fire-prone regions. This thesis presents a comprehensive spatial assessment of wildfire risk in the Kootenai National Forest (KNF) and its surrounding landscape in northwestern Montana, integrating wildfire likelihood, suppression difficulty, evacuation vulnerability, and building exposure into a unified spatial statistical framework. The research addresses a critical gap in spatial wildfire risk modeling by focusing on the need to assess fire threats in relation to local operational constraints and community vulnerabilities.

In response to the failures of mass incarceration and its disproportionate impact on marginalized communities, Problem-Solving Courts (PSCs) have emerged as alternatives to traditional prosecution. These courts employ therapeutic-informed and rehabilitative practices aimed at addressing the root causes of criminal behavior. While widely regarded as more effective than traditional courts, PSCs have developed largely without a formal theoretical foundation. This is notable given their alignment with Sociological Jurisprudence (SJ) and Therapeutic Jurisprudence (TJ), which view the legal system as a vehicle for promoting individual and community well-being.

As interest in outdoor recreation grows, so does the need for effective communication in parks and protected areas. With a larger, more diverse visiting population, managers face new challenges, including intensified recreational use, staffing demands, and barriers to communication presented by cultural and linguistic diversity (Manning et al., 2017; Perry et al., 2021). It is generally understood as a matter of federal Indian law that determinations of tribal law should properly be interpreted by tribal courts. This is because tribal courts do not always adhere to the same legal philosophy as their settler colonial counterparts. Many tribal courts subscribe to traditional law, which is an “essential source” of tribal jurisprudence. Anishinaabe communities have maintained a rich body of traditional tribal law since time immemorial. However, these customary law principles are only recently being included in modern day Anishinaabe tribal court determinations.
