Statewide Injunction: State Judicial Power And Meaningful Remedies, Constance C. Van Kley Jul 2025

Statewide Injunction: State Judicial Power And Meaningful Remedies, Constance C. Van Kley

Faculty Law Review Articles

As federal courts increasingly limit the scope of constitutional remedies, state courts have begun issuing statewide injunctions that extend protections beyond individual litigants. This article examines the doctrinal foundations and implications of such injunctions, arguing that they represent a legitimate exercise of state judicial power. By analyzing historical practices, procedural norms, and recent case law, the author contends that statewide injunctions can serve as essential tools for enforcing civil rights and ensuring meaningful relief. The piece calls for a reevaluation of remedial doctrines to better accommodate the evolving role of state courts in safeguarding constitutional guarantees.

Abandoning The Iron Horse: Railroad Rights-Of-Way And The Implied Doctrine Of Reverter On Indian Reservations, Arthur B. Macomber Jun 2025

Abandoning The Iron Horse: Railroad Rights-Of-Way And The Implied Doctrine Of Reverter On Indian Reservations, Arthur B. Macomber

Public Land & Resources Law Review

Land title issues on Indian Reservations are notoriously but unnecessarily complex. Unsettled land titles and the resulting fragile land ownership status on Indian Reservations are well-known factors impeding productive land uses, the cure of environmental degradation, and Indian sovereignty, ownership, and control over sustainable land uses. Some lawsuits even question the existence of a Reservation itself. Land titles to many parcels on Indian Reservations have been split into thousands of owners. Using existing law and principles of equity, abandoned Reservation rights-of-way of many types do not have to sit unused and economically unproductive. Future lawsuits and other wasteful societal friction …

No Evidence For Warming Effects On Tallgrass Prairie Plant Extirpation In Kalamazoo Michigan, Emily D. Horner Apr 2025

No Evidence For Warming Effects On Tallgrass Prairie Plant Extirpation In Kalamazoo Michigan, Emily D. Horner

University of Montana Conference on Undergraduate Research (UMCUR)

Title: No evidence for warming effects on tallgrass prairie plant extirpation in Kalamazoo Michigan

Author list: Emily Horner, Meredith Zettlemoyer

Abstract:

More and more species face extinction as our climate warms. Understanding how climate change influences local extinctions may help us comprehend and predict global extinctions. Ultimately, local extinction originates from declines in vital rates such as survival, growth, and reproduction. One way to examine how warming affects local extinctions is to compare responses between locally extinct (or “extirpated”) versus still present (or “extant”) species. In this comparative framework, more negative effects of warming on extirpated species’ vital rates would …

Life In The Pow, Hope Marie Ensminger

University of Montana Conference on Undergraduate Research (UMCUR)

This ethnography examines the deeper cultural and environmental aspects of skiing, focusing on the dynamic between experienced and new skiers at Lookout Pass, a ski resort found on the border of Idaho and Montana. My core focus that was explored is how skiing fosters a sense of community and environmental stewardship, which transcends material aspects such as equipment and gear. My guiding question for this study is “How do interactions between experienced and newer skiers at Lookout Pass shape their relationship with themselves and their environment?” To carry out this project, I employed participant observation and detailed field notes in …

Geographic Context And Spatial Analysis Of Montana's Missing And Murdered Indigenous Persons, Madalyn Rose Gabel

University of Montana Conference on Undergraduate Research (UMCUR)

This project focuses on the issue of Missing and Murdered Indigenous Persons (MMIP) in the state of Montana, specifically in the geographic and spatial context.

In the United States, Indigenous people have long faced discrimination that exposes them to higher rates of violence and a greater likelihood of going missing (Department of Justice, 2016). This study builds upon scholarship within geography and allied social sciences to better understand the geography of missing and murdered Indigenous People in Montana. This study in particular draws on the theoretical underpinnings of ‘cultural cycles’ by linking this concept with

relationships to physical environment, culture, …

Rewilding Rattlesnake Creek, Cameron M. Kirwan, Ethaniel Marshall Apr 2025

Rewilding Rattlesnake Creek, Cameron M. Kirwan, Ethaniel Marshall

University of Montana Conference on Undergraduate Research (UMCUR)

Rattlesnake Creek north of Missoula lacks significant in-stream structure in the form of large wood downstream of the National Recreation Area. The natural introduction of large wood from the “derecho” wind event in July of 2024 has the potential to provide much needed aquatic habitat and stream complexity.

The focus of this project is monitoring the process of “rewilding” on Rattlesnake Creek through surveys of large wood and pool habitat. The Rattlesnake has historically been subject to various forms of degradation. It was dammed in 1904, with the dam being removed 116 years later in 2020 as part of stream …

Consuming The Tropics In The 'Age Of The Insect': Imperial Imaginaries Of Frontier Ecologies In Spectacular Expositions, Adria Capozzoli

University of Montana Conference on Undergraduate Research (UMCUR)

By surveying representations of 'exotic' landscapes and 'monstrous' other-than-human creatures of the tropics featured in exhibits of the fin de siecle and early interwar period, including visual displays and descriptive language at the World's Columbian Exposition in Chicago (1893) and the Panama-Pacific International Exposition (PPIE) in San Francisco (1915), this project examines tropical frontiers as conceived in the geographical imaginaries of the United States to explore how metropolitan audiences related to those environments encountered at the imperial periphery. Between 1890 and 1920, were the infamously exaggerated characterizations of nineteenth-century spectacle tempered by the advent of twentieth-century cultural and scientific discourses, …

Application Of The Fast Marching Method To The Reconstruction Of Greenland Ice Sheet Retreat Across The Early Holocene Period, Ryan M. Fleetwood Apr 2025

Application Of The Fast Marching Method To The Reconstruction Of Greenland Ice Sheet Retreat Across The Early Holocene Period, Ryan M. Fleetwood

University of Montana Conference on Undergraduate Research (UMCUR)

As the Greenland Ice Sheet retreats, it has become an increasingly large contributor to global sea level rise. As such, it has become important to study the geologic past of Greenland to understand the projected acceleration of mass loss, and where the ice sheet is heading in the future. In this research, we utilize the PaleoGrIS database, which contains 12 contours at 500-1000 year intervals, ranging between 14,000 years ago and 6,500 years ago. The contours were constructed by a team at the University of Sheffield using geochronological methods, mainly terrestrial cosmogenic nuclide surface exposure and radiocarbon dating. These methods …

Implementing Studio-Style Learning In Geographic Information System And Cartography Education, Ryan M. Fleetwood

University of Montana Conference on Undergraduate Research (UMCUR)

As the professional world evolves, the higher-education sector needs to improve classroom experiences to prepare students for the modern workforce. Higher education traditionally utilizes the lecture as a primary teaching strategy; however, modern pedagogical research suggests active learning-based classrooms improve student engagement, participation, and learning. Studio-style course design, a research-based instructional practice first implemented in Physics and Calculus courses, aims to provide students a place to apply knowledge and practice skills through a collaborative and hands-on environment. Applications of GIS, an upper-division geographic information systems (GIS) course at the University of Montana, has traditionally employed lectures and step-by-step instructional labs …

Bronze And Bulletin Boards: Indigenous Language In Formal And Informal Campus Space, Adria Capozzoli

University of Montana Conference on Undergraduate Research (UMCUR)

What histories and lives are acknowledged in officially sanctioned institutional memorials and place-names? In recent years, academic institutions in the United States and other Anglophone nations have installed a significant amount of Indigenous-language signage on their campuses. Administrators at the University of Montana have installed a number of signs in Indigenous languages, including an intended new "centerpiece" monument at the Oval due to be installed in 2025. Also in 2025, UM is simultaneously finalizing installation of an expensive three-meter-tall sign at a new "gateway" to campus. This project seeks to inquire where, and in what contexts, acknowledgement of Indigenous languages …
