Standing Rock Sioux Tribe V. U.S. Army Corps Of Engineers, Oliver Wood

Public Land & Resources Law Review

The United States District Court for the District of Columbia partially granted the Standing Rock Sioux Tribe’s motion for partial summary judgment against the Army Corps of Engineers after the Tribe alleged the violation of required environmental analysis. While the court held that the Army Corps of Engineers mostly complied with the requirements of the National Environmental Policy Act, the court found deficiencies within its environmental analysis; the remedy is forthcoming.

The Trump administration has made “achieving American energy dominance” a central policy goal. President Trump asserts that “energy dominance” requires expanding nuclear development, increasing coal and natural gas exports, building transnational pipelines and accessing offshore oil and gas deposits. These efforts, Trump contends, will maximize the nation’s “boundless capacity” for energy production, including spreading U.S. fossil fuels around the globe, to showcase its independence from foreign oil.

An extensive body of environmental justice literature has demonstrated repeatedly what impacted communities have long known from experience, that environmental pollution including groundwater threats, diesel particulate matter, toxic releases, pesticide use, and hazardous waste sites, disproportionately burdens people of color and low-income communities. The environmental justice movement seeks to bring about equal protection of all people from environmental hazards, including equal enforcement of environmental laws and regulations. Advocacy within the movement has frequently adopted oppositional framings with respect to the state; however, collaborative approaches to environmental justice problem-solving have become more common, especially as states increasingly recognize environmental justice in …

The welfare of current and future generations is diminished due to unprecedented levels of ecological degradation that is a result of accelerating levels of per capita consumption. Sustainability education is being widely embraced as an applied strategy for addressing both unchecked consumption and environmental degradation (Brown, 2003). Bicycle Mobility In Glacier National Park: Assessing Going-To-The-Sun Road Travelers' Attitudes, Knowledge, And Perceptions Of Bicycling, Brian G. Battaglia

The central aim of this thesis assessed whether Going-to-the-Sun Road (GTSR) travelers have a positive or negative association with roadway bicycling and the degree of public support for GTSR bicycling in Glacier National Park (GNP). Secondarily, this thesis tested a control and treatment group’s knowledge of roadway cycling laws to determine the effectiveness of a “Bicycles May Use Full Lane” sign and brochure, which both reflected Montana’s cycling laws. Finally, an analysis of the necessity of GNP’s partial bicycle restriction on the GTSR was conducted by comparing the characteristics of two road segments using GIS, and by assessing the attitudes, …

Today’s global political environment places a high value on social equality and economic well- being. In this climate, emphasizing biodiversity conservation over socio-economic development through exclusionary methods of habitat protection has become ethically questioned and politically dangerous. The goal of this research was to understand the barriers and opportunities for local involvement in the management of the Nanda Devi Biosphere Reserve in Uttarakhand, India. We attempted to understand the feasibility of local community involvement in the management of the NDBR from the perspective of policy-making organizations and that of the local communities.

Tribal management of land and natural resources within the boundaries of Native American reservations is often superseded by state and federal policy. But control of land and resources is, ultimately, what makes a nation a nation. The three stories in this portfolio depict tribes establishing control of natural resources to various degrees of success. A considerable number of quantitative analyses have been conducted in the past several decades that demonstrate the existence of racial and socioeconomic disparities in the distribution of a wide variety of environmental hazards. The vast majority of these have been cross-sectional, snapshot studies employing data on hazardous facilities and population characteristics at only one point in time. Although some limited hypotheses can be tested with cross-sectional data, fully understanding how present-day disparities come about requires longitudinal analyses that examine the demographic characteristics of sites at the time of facility siting and track demographic changes after siting. Although a large body of quantitative environmental justice research exists, only a handful of studies have examined the processes by which racial and socioeconomic disparities in the location of polluting industrial facilities can occur. These studies have had mixed results, we contend, principally because of methodological differences, that is, the use of the unit-hazard coincidence method as compared to distance-based methods. This study is the first national-level environmental justice study to conduct longitudinal analyses using distance-based methods. Black Mesa is a mineral-rich area of the Navajo and Hopi Nations in Arizona; it is both the locus of the historic so-called Hopi-Navajo land conflict and the coal mines that have helped make possible the electricity usage of Las Vegas. It is also a case study in cultural change and resistance in response to pressures of industrialization and capitalism. In an interdisciplinary, creative nonfiction writing project, I am looking in particular at the pressures on sheepherding as livelihood in Black Mesa. I will examine how sheepherding has changed since the advent of the Black Mesa and Kayenta coal mines. …

In the last five years, as climate change became less abstract and more noticeable, conversations surrounding the issues have begun to change. In the past, solutions to climate change were framed in terms of how individuals can made a difference—and yet, no significant changes have occurred. Research shows that the main contributors to climate change are the fossil fuel industry, as both extraction and consumption of fossil fuel products are irresponsible and unsustainable. Thus, it is important for climate change conflict to leave the personal sphere and become more prominent as a political controversy.

Women’s Voices for the Earth (WVE), a Missoula based, nationally recognized non-profit, empowers women to advocate against toxic chemicals that cause individual and community health hazards. There is little analysis of the intersection of women’s and environmental subjugation and how these intersections influence women’s environmental organizations. My research examines the influence of ecofeminist ideology, as framed by Karen Warren’s ecofeminist and class analysis, in WVE’s online discourse, primarily social media. To do so I apply a Foucaultian discourse analysis to WVE’s online publications, and compare that to an analysis of the online presence of Toxics Action Center (TAC), a non-gendered …

The traditional concept of wilderness was a product of the time out of which it came. Times have changed. The social context of conservation, how humans affect nature, and scientific understanding of how ecosystems function have all shifted in ways that make the wilderness idea problematic. The values that people found in wilderness are still relevant, however. It is the way that they are tied together in the concept of wilderness that has become a problem.

Environmental Justice & Hidroaysén: Pristine Waters To Power Santiago, Multinational Mining Interests In Chile, David Schaad

On May 9, 2011, the Chilean national government under President Sebastián Piñera approved HidroAysén, a controversial hydroelectric megaproject to be constructed in the Aysén region of southern Chile. With HidroAysén expected to flood 5,900 hectares (15,000 acres) of ecologically unique natural reserves and displace local indigenous and working class people, its development raises major environmental justice concerns among Chileans and the international community. The project stalled in 2012 and was placed on long-term hold due to widespread public protests in which tens of thousands of Chileans took to the streets unified by the motto “Patagonia Sin Represas” (Patagonia Without Dams). …
