Public Land & Resources Law Review
In Natural Resources Defense Council, Inc. v. Pritzker, the Ninth Circuit dealt with the conflict of science in making legal and policy decisions. NMFS was held to a stringent mitigation standard to protect marine mammals against the Navy’s use of LFA sonar for military operations. In this decision the court held that agencies are required to apply the least practicable adverse impact on marine mammals in these types of operations and agencies must listen to their own experts when making these decisions.

In 2007 the governor’s Montana Tourism Advisory Council adopted the Montana Tourism and Recreation Charter. Its guiding principle of geotourism pledges to sustain and enhance the character of the places that the people of Montana call home. How can the state’s efforts to keep this pledge be assessed when “character of place” has never been defined in detail? To keep this pledge, and chart the future of geotourism in the state, it was important to clarify what is meant by character of place and identify the full range of present and potential problems that threaten the integrity of a character. …

Is it possible to achieve such a proof that is independent of both acts and dispositions of the human mind? Plato is one of the great contributors to the foundations of mathematics. He discussed, 2400 years ago, the importance of clear and precise definitions as fundamental entities in mathematics, independent of the human mind. In the seventh book of his masterpiece, The Republic, Plato states “arithmetic has a very great and elevating effect, compelling the soul to reason about abstract number, and rebelling against the introduction of visible or tangible objects into the argument” (525c). The most popular method used to gain an understanding of population trends or of differences in bird abundance among land condition categories is to use information derived from point counts. Unfortunately, various factors can affect one’s ability to detect birds, and those factors need to be controlled or accounted for so that any difference in one’s index among time periods or locations is an accurate reflection of differences in bird abundance and not differences in detectability. Avian ecologists could use appropriately sized fixed-area surveys to minimize the chance that they might be deceived by distance-based detectability bias, but the current …

This article explores the nuances in the development of environmental standing, looking especially at the cases that can inform animal law. Because animals are part of the natural environment and some statutes protecting animals, like the ESA and MMPA, are often characterized as environmental law statutes, several of the critical cases are already animal law cases, including the fundamental case of Lujan v. Defenders of Wildlife.12 For the purposes of understanding the development of standing for natural objects, Part I examines these cases in addition to traditional environmental standing cases. The law governing the quantification and use of tribal water rights is complex and inconsistent, creating major challenges for tribes working to gain control over and make use of their water resources. There are even greater challenges a tribe must overcome if it wishes to safeguard non- consumptive water uses not generally protected under Western water law regimes. Non-consumptive water uses include any use that does not require removing water from the natural water body. Such uses include protecting in-stream water flows for fisheries, riparian habitat, traditional plants, ceremonial uses, or recreation. There are legal tools available to tribes, however, …

In the fall of 2012, leaders from Columbia Basin First Nations and tribes participated, along with about 150 other people, in the 4th transboundary symposium convened by the Universities Consortium on Columbia River Governance. Gathered on the shores of Flathead Lake in Polson, Montana, the participants explored the interests, rights, roles, and responsibilities of indigenous people in the international Columbia River Basin. This symposium generated two notable outcomes: first, The Columbia River Basin: A Sense of the Future—a synthesis of interests and concerns with regard to the future of the transboundary river basin as captured by the Universities Consortium during …

Understanding Park Support: Philanthropy And Other Support For Yellowstone National Park, Geoffrey G. Havens, Norma P. Nickerson
Institute for Tourism and Recreation Research Publications
This report was conducted as one piece of a larger project on visitor support for Yellowstone National Park. Twenty-eight interviews were conducted with park non-profit supporters and repeat visitors to determine how these participants support the park and the reasons behind doing so. Additionally, other causes supported by participants were examined to place park support in a broader philanthropic context. Results revealed that beyond monetary support, activities such as sharing experiences, introducing newcomers to Yellowstone, and educating others about Yellowstone were common support activities utilized by all three groups. Repeat visitors were less likely to give monetary contributions, but otherwise …

The Mass of Men Lead Lives of Quiet Desperation, a novel-in-progress written by the researcher, examines the phenomenon of unconventional point of view and narrative structures within contemporary fiction. The project consists of the creation of a novel that implements an unconventional narrative structure and a literature review that examines the tradition of unconventional narratives in contemporary fiction, while also analyzing how these unconventional narratives work in relationship with reader at psychological and emotional level.
