Fish And Wildlife Management On Federal Lands: Debunking State Supremacy, Sandra B. Zellmer, Martin Nie, Christopher Barnes, Jonathan Haber, Julie Joly, Kenneth Pitt

This Article reviews the authority of federal and state governments to manage wildlife on federal lands. It first describes the most common assertions made by state governments regarding state powers over wildlife and then analyzes the relevant powers and limitations of the United States Constitution and federal land laws, regulations, and polices. Wildlife-specific provisions applicable within the National Park System, National Wildlife Refuge System, National Forest System, Bureau of Land Management, the special case of Alaska, and the National Wilderness Preservation System are covered, as is the Endangered Species Act. The ESA protects threatened or endangered species, and species likely to become threatened or endangered within the foreseeable future, throughout all or a significant portion of their range. In Center for Biological Diversity v. Jewell, the United States District Court for the District of Arizona overturned a Fish and Wildlife Service policy defining the significant portion of range language in the ESA. The policy interpretation limited ESA protections to apply only when a species faced risk of extinction throughout its entire range. The court deemed this policy impermissible because it effectively rendered the significant portion of range language meaningless. …

Multi-walled carbon nanotubes (MWCNT) are engineered nano-materials being developed and used in a wide variety of medical, engineering, and personal products with many potential benefits [1]. However, MWCNT have been shown to cause significant pathological changes in animal models, particularly in the airways, raising the concern that adverse human health effects will emerge with increasing use and exposure to these materials [2-4]. Potential bioactivity of MWCNT, including in vitro and in vivo toxicity and increased inflammation and pathology, has been attributed to their unique physical and chemical characteristics such as length, diameter, contaminants and rigidity [5]. Residents of rural and frontier counties experience significant disparities in healthcare access and outcomes when compared to their urban counterparts. The organization of health care delivery contributes significantly to these disparities. Simply put, rural residents can face many challenges when they have to go to a hospital in a distant city for treatment and then return home to recover. The transition back home is also problematic because discharge planning generally does not adequately account for limited access to care in rural areas. Existing fire policy encourages the maintenance of ecosystem integrity in fire management, yet this is difficult to implement on lands managed for competing economic, human safety, and air quality concerns. We discuss a fire management approach in the mid-elevations of the Sierra Nevada, California, USA, that may exemplify similar challenges in other fire-adapted regions of the western USA. We also discuss how managing for pyrodiversity through mixed-severity fires can promote ecosystem integrity in Sierran mixed conifer and ponderosa pine (Pinus ponderosa Laws) forests. To illustrate, we show how coarse-filter (landscape-level) and complementary fine-filter (species-level) approaches can enhance forest management …

Reply To Marques Et Al. (2017): How To Best Handle Potential Detectability Bias, Richard L. Hutto

Marques et al. (2017) write in response to a communications paper in which I (Hutto 2016) question whether a model-based approach is the only way to deal with the detectability problem inherent in bird survey work. The model-based approach to dealing with potential detectability bias is widely viewed as the operational gold standard, and I welcome the comments from experts in this field. The authors did uncover some errors on my part, which I address below, but they also misrepresented my most important points, so I am glad to have the opportunity to respond here. [1st paragraph]

The northeast region of Montana receives by far the least amount of nonresident visitation to the state and is slowly losing population. While the oil boom related to the Bakken Shale improved the economic outlook for a few counties between 2010 and 2014, its sustainability as a consistent economic driver is questionable as demonstrated by the substantial drop in production since 2015 when oil prices globally declined. Wyoming was the final holdout of protections for wolves under the Endangered Species Act, and a recent decision by the United States Circuit for the District of Columbia has finally overturned those protections. After years of court battles, this decision marks the final adjudication removing federal protections, and places the management of the wolves in the Greater Yellowstone Area back in the hands of the states surrounding Yellowstone National Park. Complete deference to state regulatory systems may be a new trend in the adjudication of cases under the ESA, and this case could have significant impacts on future deference given …

Analyzing Economic And Social Opportunities And Challenges Related To Bison Conservation In Northeast Montana, Jeremy L. Sage

This report provides a review of the current socioeconomic trends in northeast Montana in comparison to the state as a whole, followed by an economic analysis of the potential impacts of an expanded recreation amenity. The amenity is characterized by a large, intact grassland prairie ecosystem replete with a large bison herd. Results suggest significant latent demand for nonresident visitation to the region. To begin to capture this demand and ensure continued vitality of other economic sectors will require collaborative efforts between conservation proponents, tourism professionals, and the community at large.
