Kent V. City Of Columbia Falls: All For One—How Eroding The Public Duty Doctrine Threatens Modern Society, Megan Timm Sep 2018

Kent V. City Of Columbia Falls: All For One—How Eroding The Public Duty Doctrine Threatens Modern Society, Megan Timm

Montana Law Review Online

Defining the scope of a defendant’s duty of care has sparked heated debate for decades, and rightfully so. The obligations we have to one another dictate our societal structure at its core, for “in the absence of a duty, there can be no negligence.” Tort law, serving as a “deterrence of antisocial conduct,” purposefully molds our behaviors by making us financially accountable for our choices. That which we choose to do—and refrain from doing—is directly impacted by both our duty and the cost of breaching it. As a result, positive behaviors may be indirectly deterred by demanding compensation when they …

Genetics Of A De Novo Origin Of Undifferentiated Multicellularity, Matthew D. Herron, William C. Ratcliff, Jacob Boswell, Frank Rosenzweig Aug 2018

Genetics Of A De Novo Origin Of Undifferentiated Multicellularity, Matthew D. Herron, William C. Ratcliff, Jacob Boswell, Frank Rosenzweig

Biological Sciences Faculty Publications

The evolution of multicellularity was a major transition in evolution and set the stage for unprecedented increases in complexity, especially in land plants and animals. Here, we explore the genetics underlying a de novo origin of multicellularity in a microbial evolution experiment carried out on the green alga Chlamydomonas reinhardtii. We show that large-scale changes in gene expression underlie the transition to a multicellular life cycle. Among these, changes to genes involved in cell cycle and reproductive processes were overrepresented, as were changes to C. reinhardtii-specific and volvocine-specific genes. These results suggest that the genetic basis for the experimental evolution …

Understanding Teacher Noticing Of Students’ Prior Knowledge: Challenges And Possibilities, Gloriana Gonzalez Jul 2018

Understanding Teacher Noticing Of Students’ Prior Knowledge: Challenges And Possibilities, Gloriana Gonzalez

The Mathematics Enthusiast

I propose a new construct, teacher noticing of students’ prior knowledge, and provide examples of a professional development intervention with the goal of supporting teacher learning. The examples demonstrate that combining discussions of animations of classroom instruction, video clubs, and lesson study can help teachers to attend to students’ prior knowledge and anticipate actions that use that knowledge for promoting mathematical understanding. I discuss challenges and new questions for mathematics education researchers brought about by the new construct. I suggest that the construct is valuable for developing teachers’ professional knowledge.

Drawing Off The Page: How New 3d Technologies Provide Insight Into Cognitive And Pedagogical Assumptions About Mathematics, Oi-Lam Ng, Nathalie Sinclair, Brent Davis

The Mathematics Enthusiast

Mathematics has a history of being a two-dimensional inscribing practice. We describe the potential evolution in doing, thinking, and learning mathematics with the emergence of a technological innovation that enables real-time 3D virtual and material interactions. Using the 3D drawing pen as a simple and recently available technology, we highlight how it helps re-think long-standing assumptions and dichotomies in mathematics education including, for example, the material distinction between diagram and manipulative, the semiotic distinction between icon and index, and the developmental progression of action-icon-symbol. We then speculate on the future possibilities of the shift in technological infrastructure that 3D pens …

Markle Interest, L.L.C. V. U. S. Fish & Wildlife Service, Peter B. Taylor May 2018

Markle Interest, L.L.C. V. U. S. Fish & Wildlife Service, Peter B. Taylor

Public Land & Resources Law Review

This action is an appeal of a grant of summary judgment to the United States Fish and Wildlife Service on the designation of critical-habitat for the dusky gopher frog under the ESA. Landowner appellants originally sought declaratory and injunctive relief against the Service, the Department of Interior, and agency officials challenging the designation of their private property as critical-habitat for the dusky gopher frog. The court’s holdings recognize loss of property value as a “particularized injury” for standing under the ESA in addition to addressing the landowners’ three principal arguments: 1) the critical habitat designation violated the ESA and the …

The chemical composition of aerosol particles is a key aspect in determining their impact on the environment. For example, nitrogen-containing particles impact atmospheric chemistry, air quality, and ecological N deposition. Instruments that measure total reactive nitrogen (Nr Combining double low line all nitrogen compounds except for N2 and N2O) focus on gas-phase nitrogen and very few studies directly discuss the instrument capacity to measure the mass of Nr-containing particles. Here, we investigate the mass quantification of particle-bound nitrogen using a custom Nr system that involves total conversion to nitric oxide (NO) across platinum and molybdenum catalysts followed by NOĝ'O3 chemiluminescence …

Native Ecosystems Council V. Marten, Rebecca A. Newsom May 2018

Native Ecosystems Council V. Marten, Rebecca A. Newsom

Public Land & Resources Law Review

In Native Ecosystems Council v. Marten, the Ninth Circuit found that the United States Forest Service did not violate the Endangered Species Act, National Forest Management Act, or National Environmental Policy Act, when it proposed the Lonesome Wood Vegetation Management 2 Project in the Gallatin National Forest of Montana, even though the decision was inconsistent with the United States Forest Service’s reports. The Ninth Circuit’s holding demonstrated the wide amount of deference the courts will give the Forest Service when determining the best available scientific data.

Measuring Transmissibility Of Sin Nombre Hantavirus In Deermice, Angela Luis May 2018

Measuring Transmissibility Of Sin Nombre Hantavirus In Deermice, Angela Luis

University Grant Program Reports

The purpose of this UGP proposal was to develop methods to measure transmissibility of SNV in deermice. Transmissibility is the probability of transmission of the virus to a susceptible mouse, given contact with an infected mouse, and is a function of each animal’s physiological stress level and immunity. If an animal is more stressed, its immunity will be depressed, which will increase susceptibility (of uninfected mice) and infectiousness (of infected mice). Therefore, in order to measure transmissibility, we need to develop methods to measure stress levels, immune function, and viral loads in deermice. With this UGP seed grant, we developed …

Where There's A Will, There's A Way: Young People And Climate Change, Emma H. Kiefer Apr 2018

Where There's A Will, There's A Way: Young People And Climate Change, Emma H. Kiefer

University of Montana Conference on Undergraduate Research (UMCUR)

Climate change is the defining issue of our time. It will disproportionately impact young people, less developed and impoverished nations, global agricultural systems, and vulnerable ecosystems across the globe. Current and future generations of students must be educated and empowered to tackle the problem. My research looks at the experience of students learning about climate change in an introductory climate change class, CCS 103X, at the University of Montana. I evaluate data from survey questionnaires taken at the beginning and the end of the class, and comments made during and after each class, to evaluate the relationship between the attitudes …

Social Learning Of Safety In Degus, Dorothy Young Apr 2018

Social Learning Of Safety In Degus, Dorothy Young

University of Montana Conference on Undergraduate Research (UMCUR)

Learning to fear a dangerous situation is an essential survival skill. However, the inability to extinguish a learned fear response can lead to anxiety disorders. In this study we attempted to determine whether fear memories could be extinguished through social learning. We analyzed data collected in an experiment using degus (Octodon degus) in which one experienced individual observed a naive cagemate entering and exploring a dangerous environment. The experienced degu was conditioned in a chamber which contained a “danger” side (a partition in which they could receive a foot shock) and a “safe” side (where they would receive no shock), …

Children’S Understanding Of Robots: A New Ontological Category Or Just Pretend?, Rachele L. Barker, Rachel L. Severson, Bethany Lindner Apr 2018

Children’S Understanding Of Robots: A New Ontological Category Or Just Pretend?, Rachele L. Barker, Rachel L. Severson, Bethany Lindner

University of Montana Conference on Undergraduate Research (UMCUR)

Children attribute a unique constellation of animate and inanimate characteristics to personified robots, e.g., judging them to have emotions, thoughts, and capable of being a friend, while also being a piece of technology. Do children truly believe robots have animate characteristics or are they just engaging in pretend play? The latter is certainly plausible as children readily endow objects with personas. The present study sought to address this question by investigating children’s judgments and behavioral interactions with a robot compared to a stuffed animal (a classic object of pretense). Ninety participants (5, 7, and 9 years) engaged with each entity …

Sometimes Hesitancy Is Key: Effects Of Moral Deliberations On Children's Interpretation Of Credibility Cues, Kali Taylor, Dennis Schuster, Shelby Rosston, Caitlin Gillespie, Shailee Woodard, Rachel L. Severson Apr 2018

Sometimes Hesitancy Is Key: Effects Of Moral Deliberations On Children's Interpretation Of Credibility Cues, Kali Taylor, Dennis Schuster, Shelby Rosston, Caitlin Gillespie, Shailee Woodard, Rachel L. Severson

University of Montana Conference on Undergraduate Research (UMCUR)

Children often treat confident individuals as credible sources of information. Yet, confidence may differentially signify credibility depending upon the domain of knowledge. For example, when dealing with factual information, confident responses indicate greater credibility. However, when deliberating about moral issues, hesitancy may reflect a deeper level of thoughtfulness, and therefore credibility. This study investigated children’s credibility judgments of individuals who differed in the level of confidence (confident vs. hesitant) in two domains of knowledge (factual, moral).

In a between-subjects design, children 3-8 years (N=96 planned with 52 participants thus far) listened to a confident and hesitant model make either novel …

Branching Out: Generating An Evolutionary Tree Of Southeast Asian Plants With Computational Tools, Conner J. Copeland, Travis Wheeler, Jedediah Brodie Apr 2018

Branching Out: Generating An Evolutionary Tree Of Southeast Asian Plants With Computational Tools, Conner J. Copeland, Travis Wheeler, Jedediah Brodie

University of Montana Conference on Undergraduate Research (UMCUR)

Plants in Southeast Asia are historically understudied, and their evolutionary relationships are poorly understood. This lack of an evolutionary history has proven to be an obstacle to further investigation of these species, so this research seeks to create a phylogeny, or evolutionary tree, of these plants using molecular data and computational tools. To accomplish this, I downloaded amino acid and DNA sequences from respected databases. I determined which sequences are best recorded in the species of interest, and utilized a blend of pre-existing tools and scripts written in the Perl programming language to eliminate sequences that could lead to inaccurate …

Of Betta Splendens And Speed Dating: An Analytical View, Sarah Hecht, Susan Green, Allen Szalda-Petree Apr 2018

Of Betta Splendens And Speed Dating: An Analytical View, Sarah Hecht, Susan Green, Allen Szalda-Petree

University of Montana Conference on Undergraduate Research (UMCUR)

Beta splendens have been the animal subject to test several, non-invasive drug therapies. The results can then be examined as to what effect they will have on humans. In the main experiment, B. splendens’ innate aggressive behavior was examined when the subject were exposed to Fluoxetine, an antidepressant. Data collection comparing the male species of B. splendens involved exposure to a female of B. splendens and dosage of Fluoxetine to observe the effects on their innate aggressive behavior. My part of the experiment is centered around examining whether there was any female bias among the male subjects that would go …
