The Legalization Of The Family: Towards A Policy Of Supportive Neutrality, David Chambers Jan 1982

The Legalization Of The Family: Towards A Policy Of Supportive Neutrality, David Chambers

Law Quadrangle (formerly Law Quad Notes)

In recent years government has withdrawn control from some family matters, while initiating intervention into others. Paradoxically, the intention behind such new regulation has often been to increase individual liberty

Nevertheless, increased government involvement created- the "sense that law had seeped into every crevice of American life and that sensible people ought to be asking whether we have gone too far," that underlies this conference. Support for Ronald Reagan's presidential candidacy represents a different kind of response to this feeling, as does such Republican legislation as the proposed Family Protection Act of 1981. Intended to 'reemphasize the values that made …

Special Problems Of Custody For Unaccompanied Refugee Children In The United States, Ellen J. Durkee Jan 1982

Special Problems Of Custody For Unaccompanied Refugee Children In The United States, Ellen J. Durkee

Michigan Journal of International Law

Part I of this note provides an overview of federal legislation regarding admissions of unaccompanied refugee children. Part II describes various obstacles to a smooth transition from the child's admission into the United States to his or her placement by a state court with a permanent legal custodian who ensures that the child receives care and supervision. Problems in this area frequently result from uncertainties regarding long-term financial responsibility for the child. Also common are procedural difficulties in introducing unaccompanied refugee children into state child welfare systems. Part III then focuses on conflicts arising after the child's placement, when the …

Legitimacy In Social Reform Litigation: An Empirical Study, Timothy Wilton Jan 1982

Legitimacy In Social Reform Litigation: An Empirical Study, Timothy Wilton

University of Michigan Journal of Law Reform

This Article undertakes a detailed examination of a single lawsuit, Martin Luther King Junior Elementary School Children v. Ann Arbor School District Board. This study first explores the diversity of interests present among both the plaintiff and defendant groups in King, and analyzes the performance of the attorneys in representing these interests. The Article then turns to the problems of resistance that arise at the decree stage in social reform litigation, and presents an empirical evaluation of the factors influencing the response to judicially mandated relief.

Private Lawyers And Public Responsibilities, Carl Mcgowan Dec 1981

Private Lawyers And Public Responsibilities, Carl Mcgowan

Michigan Law Review

A half-century ago when this Law Quadrangle was conceived and constructed, it was surely an act of faith on the part of its wise and generous donor. So it was also of this University which undertook the challenge to make of his vision a reality - to provide, in the most magnificent plant for legal education this country has ever seen, instruction in the law and constant refinement of its ideals worthy of the most rigorous traditions of the higher learning.

Corporate Indemnification Of Directors And Officers: Time For A Reappraisal, K.G. Jan Pillai, Craig Tractenberg Oct 1981

Corporate Indemnification Of Directors And Officers: Time For A Reappraisal, K.G. Jan Pillai, Craig Tractenberg

University of Michigan Journal of Law Reform

This Article evaluates the benefits and burdens of shifting litigation risk from management to the enterprise. The Article begins by considering the nature of the legal risks confronting the corporate executive, and the principles of common law that developed to counter those risks. The Article proceeds to assess the two statutory responses to threats of personal liability against the corporate executive: indemnification statutes, and director and officer insurance. Finally, after comparing the effective absolute immunity available to corporate executives with the qualified immunity enjoyed by high-level government officials, the Article concludes that indemnification practices have overinsulated the corporate officer from …

The Nonprofit Health Care Corporation Reform Act Of 1980, David L. Hollister, Patience A. Drake Apr 1981

The Nonprofit Health Care Corporation Reform Act Of 1980, David L. Hollister, Patience A. Drake

University of Michigan Journal of Law Reform

In recent years, Blue Cross/Blue Shield has been the subject of considerable controversy. Its critics charge the non-profit, tax-exempt corporation with being unduly secretive, arrogantly unresponsive to consumer interest and not vigorous in its cost containment efforts. These criticisms, along with a variety of other factors, led to the legislative reform I am here to talk to you about this evening.

Workers' Compensation Reform: A Case Study Of The Legislative Process In Michigan, Robert Vanderlaan, Richard K. Studley

University of Michigan Journal of Law Reform

At a 1979 workers' compensation seminar for the Michigan Legislature, University of Michigan law professor Marcus Plant closed by noting that "[m]y intent was to sketch in broad strokes the background of our workers' disability compensation law. It is my firm belief that wise decisions as to where we should go cannot be made unless we know how we got where we are. " I share Professor Plant's belief. I feel strongly that wise public policy decisions about where we should go next in the reform process depend substantially on a good understanding of how we got where we are …

Change And Continuity In Legal Education, Roger C. Cramton Jan 1981

Change And Continuity In Legal Education, Roger C. Cramton

Michigan Law Review

Within this maelstrom of accelerating change, the American law school remains, by comparison, an island of stability. Change there has been; one of the purposes of this piece is to chronicle some major recent changes. But in broad outline the structure, method, and content of American legal education has remained remarkably untouched. Whether this demonstrates that American legal education is remarkably flexible in its adaptation to a changing legal environment or that it is irrelevant to social change, I leave to the reader.
