An Open Attack On The Nonsense Of Blue Sky Regulation, Rutheford B. Campbell Jr. Apr 1985

An Open Attack On The Nonsense Of Blue Sky Regulation, Rutheford B. Campbell Jr.

Law Faculty Scholarly Articles

The evolution of state securities laws (hereinafter "blue sky laws") in this country is a classic example of regulation that was, perhaps, initially justified and that was apparently promulgated with the best of motives, but which now is actually harmful to society. Today, blue sky laws are ineffective, philosophically unsound, and unnecessarily expensive, and they should be substantially eliminated. Because of the vested interests that have developed, however, it is unlikely that states will respond to this problem, and it will probably take action by the United States Congress to preempt the area. Such an action is appropriate and, indeed, …

Efficient Use Of Fertilizer On Tobacco, J. L. Sims Apr 1985

Efficient Use Of Fertilizer On Tobacco, J. L. Sims

Soil Science News and Views

Recent increases in fertilizer prices and other productions costs have stimulated interest in ways to increase the efficiency of fertilizer use while maintaining or increasing yields and quality of tobacco. Growers currently spend about $250 per acre for fertilizer. Although this represents only 15 to 20 percent of the total cash costs per acre, it is one category of cash expenses that can be decreased.

Analysis Of Movements And Forces On Bridge Approaches: A Case Study (Bridge Over Chesapeake Ave. On Interstate 471 In Campbell County, Kentucky), David L. Allen, Bobby W. Meade, Tommy C. Hopkins Apr 1985

Analysis Of Movements And Forces On Bridge Approaches: A Case Study (Bridge Over Chesapeake Ave. On Interstate 471 In Campbell County, Kentucky), David L. Allen, Bobby W. Meade, Tommy C. Hopkins

Kentucky Transportation Center Research Report

A case study is presented of a bridge on Interstate 471 in Campbell County, Kentucky. The south approach to the bridge is a side-hill fill. During construction, the south intermediate piers tilted as a result of movement in the south approach foundation. Construction was temporarily halted on the south approach embankment, allowing pore pressures in the foundation to dissipate and slowing the movement. The piers were than reconstructed.

The south approach end bents were instrumented with earth pressure meters. The piles were instrumented with slope inclinometers. Most recent data show that movement is continuing and the present factor of safety …

Long-Term Movements Of Highway Bridge Approach Embankments And Pavements, Tommy C. Hopkins Apr 1985

Long-Term Movements Of Highway Bridge Approach Embankments And Pavements, Tommy C. Hopkins

Kentucky Transportation Center Research Report

Long-term movements of highway bridge approach embankments and pavements are described and factors that may lead to settlement of highway bridge approach pavements are discussed. Six case histories are presented. The bridge approach sites were observed at different times during the period 1966 to 1985. At four sites, lateral movements, measured from slope inclinometers, of the approach embankments were monitored over time periods ranging from 8 to 14 years. Settlements of the highway bridge approaches were monitored some three to four years after paving. Estimated and observed settlements of the foundations at the study sites were obtained for a length …

Separation Of Powers, Legislative Vetoes, And The Public Lands, Eugene R. Gaetke Apr 1985

Separation Of Powers, Legislative Vetoes, And The Public Lands, Eugene R. Gaetke

Law Faculty Scholarly Articles

The Supreme Court's decision in Immigration and Naturalization Service v. Chadha struck a serious, if not fatal, blow to the constitutional acceptability of the legislative veto. In Chadha the Court held that a provision of the Immigration and Naturalization Act, which permitted one House of Congress to reverse a decision by the Attorney

General not to deport an alien, was a violation of the doctrine of separation of powers since it did not comply with the requirements of passage by both Houses of Congress and presentment to the President. In light of that decision, the constitutionality of nearly 200 statutes …

Fly Ash Stabilized Bases In Kentucky, Gary W. Sharpe, Larry Epley Mar 1985

Fly Ash Stabilized Bases In Kentucky, Gary W. Sharpe, Larry Epley

Kentucky Transportation Center Research Report

With the escalating costs of materials and construction for highways and streets, many agencies charged with the responsibility of designing and constructing highways are utilizing byproduct stabilized (pozzolanic) materials. Low-strength (pozzolanic) materials have been used fairly extensively in some areas of the United States as well as abroad. In general, pozzolanic materials have been used to stabilize an aggregate base or subbase by addition of fly ash and a source of lime to develop a cementitious reaction. Additionally, portland cement or cement kiln dust have been used to stabilize aggregate subbase and (or) base materials.

Until recently, the use of …

Agronomic And Animal Performance Of Different Tall Fescue Varieties, Robert C. Buckner, James A. Boling, Paul B. Burrus Ii, Lowell P. Bush, Nelson Gay, R. W. Hemken, Garry D. Lacefield, M. R. Siegel Mar 1985

Agronomic And Animal Performance Of Different Tall Fescue Varieties, Robert C. Buckner, James A. Boling, Paul B. Burrus Ii, Lowell P. Bush, Nelson Gay, R. W. Hemken, Garry D. Lacefield, M. R. Siegel

Agronomy Notes

The objective of the tall fescue breeding program is the development of varieties characterized by superior nutritive value (including reduced contents of perloline and loline alkaloids and minimal infestation of the fungal endophyte, Acremonium coenophialum), palatability, disease resistance, and adaptation through the utilization of intergeneric and interspecific hybrid derivatives of ryegrass and tall fescue species. Kentucky 31, Kenwell, and Kenhy were previously released from this breeding program. Johnstone tall fescue, developed cooperatively by the Kentucky Agricultural Experiment Station and USDA-ARS, was released March 1, 1982 as a new variety. Johnstone is characterized as having low levels of perloline alkaloid and …

Mineralogy And Soil Productivity, Anastasios D. Karathanasis Mar 1985

Mineralogy And Soil Productivity, Anastasios D. Karathanasis

Agronomy Notes

The soil that is often called "dirt" is not as dirty as many people think. If we remove the 5 to 10% of the soil material, composed of organic matter and amorphous Fe, Al and Si hydrous oxides, the remaining 90 to 95% is a mixture of crystalline or subcrystalline minerals. We are able to see and identify with the naked eye, the large crystalline particles of the sand fraction. For the smaller mineral particles of the silt and clay fractions microscopic or other more sensitive methods (x=ray diffraction, thermal) are needed for their identification and quantification. While little attention …

Spring Nitrogen Management For Winter Wheat, John H. Grove Mar 1985

Spring Nitrogen Management For Winter Wheat, John H. Grove

Soil Science News and Views

Wheat producers commonly plan their nitrogen fertilizer management during winter months. The crop begins to break dormancy in many parts of the state in late February and early March and soon begins tillering and growing rapidly if nutrition is adequate. Nitrogen is the nutrient most often required and for which annual costs are the greatest for most wheat growers. Consideration of the following basic principles will help wheat producers improve the efficiency and effectiveness of their nitrogen fertilizer dollars.

Assessment And Recommendations Regarding Bks-B Libraries, Antoinette Paris Powell Mar 1985

In addition to the charge to assess the current situation and make recorrmendat ions for improvement, the consultant was requested to identify several of the more highly trained and experienced librarians within the BKS-B to form the nucleus for a library network. This, also, was accomplished, and the first network meeting was held in Palembang.

Ms. Powell was well suited to this …
