Kentucky's Doctrine Of Advancements: A Time For Reform, Carolyn S. Bratt Jan 1987

Kentucky's Doctrine Of Advancements: A Time For Reform, Carolyn S. Bratt

Law Faculty Scholarly Articles

The act of giving a gift is accomplished so easily that the legal consequences often escape the donor. Even when a donor stops to contemplate the legal significance of her or his act, a parental donor probably is unaware that a gift to a child may affect the child's inheritance rights in the parent's estate. Kentucky is among the minority of states which continue to presume that a parental gift is intended as an advancement to the child donee. Moreover, Kentucky is one of only two states which make the presumption irrebutable. The value of the gift is charged against …

Victim Participation In Plea Bargains, Sarah N. Welling Jan 1987

Victim Participation In Plea Bargains, Sarah N. Welling

Law Faculty Scholarly Articles

There is a trend in the criminal law today to focus on the rights of victims. This trend has been manifested in actions by legislatures, courts, the President of the United States and others. Various programs have been implemented to ameliorate the crime victim's experience. For example, many states now provide compensation for victims, and victim/witness assistance programs have sprung up around the country. It has also been suggested that the victim's lot should be improved by granting them a right to participate in the prosecution of the defendant. This article examines whether victims should be accorded a right to …

Strict Liability For Chattel Leasing, Richard C. Ausness Jan 1987

Strict Liability For Chattel Leasing, Richard C. Ausness

Law Faculty Scholarly Articles

Leasing has become an increasingly popular substitute for outright purchases as a means of acquiring products for use. Few courts and commentators, however, have addressed the question of whether the principles of strict products liability which apply to sellers also apply to lessors. In this Article, Professor Ausness reviews the historical basis for imposing strict liability in tort on sellers and applies these rationales to five basic kinds of lease transactions. He concludes that strict liability should not apply when a product defect arises after the leased product is placed in the hands of the lessee (as contrasted with the …

Sucker Control In Burley And Dark Tobaccos, Gary K. Palmer, Jones H. Smiley, Jimmie R. Calvert Nov 1986

Sucker Control In Burley And Dark Tobaccos, Gary K. Palmer, Jones H. Smiley, Jimmie R. Calvert

Agriculture and Natural Resources Publications

Removing the tops of tobacco plants removes the dominant influence of the terminal shoot over lateral shoots or "suckers." If left unchecked, suckers can severely reduce yield and quality of tobacco. Manual control of suckers has almost totally given way to less expensive and more efficient chemical control. Three types of chemical sprays for controlling sucker growth on tobacco plants are:

  • Systemic--These chemicals are absorbed by plants and move inside the plant to active growth sites,
  • Contact--These chemicals are not absorbed by plants and must be used so as to contact the suckers directly.

  • Local systemic--This chemical runs down the …

Vegetable Oil As An Emergency Fuel, E. Holmes, Joseph L. Taraba, George M. Turner Nov 1986

Vegetable Oil As An Emergency Fuel, E. Holmes, Joseph L. Taraba, George M. Turner

Agricultural Engineering Energy Series

The unstable world political situation combined with the fact that a large amount of the world's oil reserves is located in the Middle East means we must continue to search for an alternate fuel source for our agricultural machinery. It is well-known that there is a limited amount of fossil fuels and even with no world political problems the demand will exceed supply in the not-too-distant future. The United States currently imports fossil fuels because we use more than we produce. Vegetable oils are a renewable resource. They offer a means of keeping our agricultural equipment operating in an oil …

Slack-Water Deposits And The Magnitude And Frequency Of Flash Floods, Eastern Kentucky, Russell G. Shepherd, Lisa K. Bienkowski Nov 1986

Slack-Water Deposits And The Magnitude And Frequency Of Flash Floods, Eastern Kentucky, Russell G. Shepherd, Lisa K. Bienkowski

KWRRI Research Reports

The potential for predicting flood magnitude and frequency using sediments deposited in backwater areas during flash floods was investigated on the Cumberland Plateau of eastern Kentucky, a region n9torious for flash flooding. Slack-water deposits are abundant in the area at tributary mouths and bedrock channel expansions. They are identifiable on geologic quandrangle maps, and are locally good potential indicators of maximum flood-crest elevations. However, in this humid region, flash floods could not be distinguished from non-flash floods using slack-water sedimentology.

The results from the slack-water deposits studied indicate that they offer limited potential for predicting flash floods because 1) intense …

Impact Evaluation Of The Lexington-Fayette County Traffic Alcohol Program (1982-1986), Jerry G. Pigman, Kenneth R. Agent Nov 1986

Impact Evaluation Of The Lexington-Fayette County Traffic Alcohol Program (1982-1986), Jerry G. Pigman, Kenneth R. Agent

Kentucky Transportation Center Research Report

This report is a final evaluation of four years of increased police enforcement to reduce alcohol-related accidents in Lexington-Fayette County, Kentucky. Three types of data were collected as a means of evaluating the Traffic Alcohol Program; accident data, arrest and adjudication data, and cost-effectiveness data.

Results from before-and-after comparisons and time-series analysis show alcohol-related accidents decreased significantly during the study period. When comparing two years before with four years during the increased enforcement, the reduction in alcohol-related accidents during hours of increased enforcement was 37.3 percent using standard before and after analysis and 36.4 percent using time-series analysis. For all …

Investigation Of Collapse Of Long-Span Structure Under Ky 80 In Floyd County, Ronald D. Hughes, David L. Allen, Robert C. Deen

Kentucky Transportation Center Research Report

The Kentucky Transportation Research Program (KTRP) was requested to obtain and review design, construction, and post construction documents relative to the long-span structure under KY 80 in Floyd County. Telephone and in-person contacts were made with various agency officials involved with the structure in an endeavor to collect pertinent data. Documents that were initially presented to KTRP staff were thoroughly reviewed and a draft report based upon information submitted was prepared. The draft report included a scenario relating to a probable sequence of events that could have been significant in the ultimate collapse of the structure.

Soon after distribution of …
