In the decade since Kentucky's adoption of the Uniform Marriage and Divorce Act, the state's courts have faced the task of interpreting it in domestic relations litigation. This past year was no exception. A number of problems before Kentucky courts were recurrent issues. For example, the divisibility of educational degrees acquired by one spouse again required court assessment. Similarly, issues surrounding both maintenance and child support reappeared. These recurrent issues, along with new issues requiring court solution, heavily burdened trial and appellate courts. In 1977, Congress enacted the Surface Mining Control and Reclamation Act. The Act, designed to protect the environment and society from the adverse effects of surface coal mining and to insure uniform minimum nationwide regulatory standards, established a comprehensive regulatory scheme for surface mining and reclamation operations of both federal and non-federal lands within the United States.

The Secretary of the Interior, acting through the Office of Surface Mining and Reclamation within the Department of the Interior, is charged with administering and implementing the Act. Implementation is divided into two stages. During the initial, or interim phase, all surface mining …

Soil pH is related to the hydrogen ion (H+) activity of the soil-water system. The chemical definition of pH is as follows: pH=-log (H+). In other words, for a pH drop of 1 unit (e. g. from pH 6 to pH 5) there will be a ten~fold increase in H+ activity in the soil solution. If pH 1 rises by 1 unit, only one-tenth as much acidity will be present in solution. As such, pH is only a measure of the active acidity in the soil water solution bathing plant roots. Curbing Litigation Abuses: Judicial Control Of Adversary Ethics—The Model Rules Of Professional Conduct And Proposed Amendments To The Rules Of Civil Procedure, Richard H. Underwood

This Article addresses the effectiveness of recent developments and proposals related to abusive litigation, and discusses them in the context of recent opinions illustrating the power of the trial judge to control the excesses of the adversary system. It rejects the countersuit as a time-consuming and costly means of controlling litigation abuses, and concludes that “tinkering changes” in the rules of procedure cannot bring about true reform. It is urged here that the burden resulting from abuse of litigation can only be relieved by changes which foster stronger judicial control of adversarial ethics, and greater judicial involvement in the pretrial …

To determine if excessive systemic exposure to aluminum would be reflected in increased aluminum concentration in hair, rabbits were given a series of aluminum lactate injections. Hair was collected before the aluminum lactate administration from the site of injections and twice after the injections from this site as well as from an area adjoining the injection site. Aluminum was determined by flameless atomic absorption analysis of acid-digested samples. The concentration of aluminum in the hair increased after the injections in samples taken at both times from both sites. This Article will not survey and catalog all available cases dealing with the "insurance counsel's tightrope." Instead, it will focus on the identification and resolution of conflicts of interest that may arise at various stages of the litigation of a medical malpractice action in which a lawyer has been retained to represent the interests of both the physician policy-holder and his insurance carrier. The Aquatic Toxicity Of Organic Compounds To Embryo-Larval Stages Of Fish And Amphibians, Jeffrey A. Black, Wesley J. Birge, Willaim E. Mcdonnell, Albert G. Westerman, Barbara A. Ramey, Donald M. Bruser

Aquatic toxicity tests were conducted on 11 organic compounds considered hazardous to water resources. The toxicity of each compound was evaluated using embryo-larval stages of two to eight fish and amphibian species. Exposure was initiated at fertilization and maintained through 4 days posthatching. The animal test species exhibited varying degrees of sensitivity to the selected toxicants. Combined frequencies for mortality and teratogenesis at 4 days posthatching gave LC50 ranges of 3.66 to 8.25 mg/L for benzene, 1.16 to 22.42 mg/L for carbon tetrachloride, 0.11 to 1.20 mg/L for chlorobenzene, 2.03 to > 68 mg/L for chloroform, 3.01 to 5.56 mg/L …

Classification And Management Of Wetlands In The Western Kentucky Coal Field, William J. Mitsch, Robert W. Bosserman, Paul L. Hill Jr., Jan R. Taylor

This is the first research report of a three-year project on wetland identification and management criteria in the western Kentucky coal field. The region is approximately 12,000 square kilometers and, due to its slight relief, contains many wetlands, some contiguous with surface coal mining operations. The overall objectives of the research project are 1) to identify, classify, and map wetlands in the western Kentucky coal field; 2) to evaluate the major biotic and abiotic factors that affect those wetlands; and 3) to develop strategies for the proper management of those wetlands.

The invention relates to a novel method of administering the natural female sex hormones, 17 β- estradiol and progesterone, to achieve enhanced bioavailability thereof. The invention further relates to novel dosage forms of 17 β- estradiol and/or progesterone which are adapted for nasal administration, such as solutions, suspensions, gels and ointments. The dosage forms containing a combination of 17 β-estradiol and progesterone are particularly useful as contraceptives, while the dosage forms containing only one of the hormonal components find utility in the treatment of conditions such as menopause, menstrual disorders, etc., which are known to respond to administration of a …

Modern swine production confinement systems have brought about significant improvements in the quantity and quality of meat products for human consumption. This has been achieved because of the ability to maintain good environmental conditions and to apply sound management techniques, therefore, allowing the animals to achieve maximum performance.
