Family Protection Under Kentucky's Inheritance Laws: Is The Family Really Protected?, Carolyn S. Bratt

Law Faculty Scholarly Articles

Courts and legislatures always have granted widows some protection from the economic hardships that their husbands' deaths cause. At the earliest common law, a surviving wife was entitled to dower in the form of a right to remain in her husband's home along with the other heirs after the husband's death. Today, the states have enacted a variety of statutory devices that provide protection for families who might otherwise experience financial hardship upon the death of a spouse or parent. The older types of statutory safeguards take the form of homestead and personal property exemptions. Typically, the probate homestead exemption …

Private Enforcement And The Fair Housing Act, Robert G. Schwemm Jan 1988

Private Enforcement And The Fair Housing Act, Robert G. Schwemm

Law Faculty Scholarly Articles

The first section of the Fair Housing Act declares that "[i]t is the policy of the United States to provide, within constitutional limitations, for fair housing throughout the United States." If the United States has been officially committed to providing for fair housing for the past 20 years, why is segregated housing still the prevailing norm throughout our nation? Why does discrimination still regularly occur when minority homeseekers venture into white areas? Why are the opportunities for living in stable, integrated neighborhoods only marginally better now than they were a generation ago in the days of Lyndon Johnson, Everett McKinley …

Victims In The Criminal Process: A Utilitarian Analysis Of Victim Participation In The Charging Decision, Sarah N. Welling Jan 1988

Victims In The Criminal Process: A Utilitarian Analysis Of Victim Participation In The Charging Decision, Sarah N. Welling

Law Faculty Scholarly Articles

Crime victims are currently being given the right to participate in criminal prosecutions at both the sentencing and plea bargaining stages. These are important steps in a criminal prosecution, but both the sentence and the plea bargain are dependent on the initial charging decision which determines what crime is to be prosecuted or whether there is to be any prosecution at all. As a prerequisite to both a plea bargain or a sentence, the charging decision is the crux of the prosecution.

Given the importance of the charging decision, and the fact that some jurisdictions have granted victims a right …

Creating A Traditional Reference Tool In The Age Of Electronics: The Changing Art Of Bibliography Preparation, Antoinette Paris Powell Dec 1987

Creating A Traditional Reference Tool In The Age Of Electronics: The Changing Art Of Bibliography Preparation, Antoinette Paris Powell

Library Faculty and Staff Publications

Bibliographies are still a convenient, compact format for retrospective information on a topic. Modern technology does not diminish the need for comprehensive bibliOgraphies, although the creation of a bibliography can be made easier by putting some of the technology to work. The intellectual effort remains, and so does the laborious task of verification, but the mechanics of producing such a work can be streamlined. A word processor can replace the beleaguered secretary who must type and retype the effort; a database management program can aid in the restructuring of the bibliography; and the commercial databases can provide access to collections …

Development Of Dynamic Non-Hortonian Watershed Models For Steeply Sloping Forested Watersheds: Application To Eastern Kentucky, Lindell E. Ormsbee, Abdul Q. Khan Aug 1987

Development Of Dynamic Non-Hortonian Watershed Models For Steeply Sloping Forested Watersheds: Application To Eastern Kentucky, Lindell E. Ormsbee, Abdul Q. Khan

KWRRI Research Reports

A comprehensive conceptual watershed model is developed to simulate the hydrologic response of steeply sloping forested watersheds. Two non-Hortonian and two Hortonian models were first tested with data from selected watersheds in West Virginia and eastern Kentucky in order to understand the different mechanisms of flow responsible for storm hydrograph generation in this type of watersheds. The two non-Hortonian models tested were the kinematic storage model (Sloan et al. 1983) and the saturation deficit model (Beven and Wood, 1983). Both models were unable to adequately reproduce the observed hydrographs in the four forested watersheds considered in this research. The two …
