Genetics, Genetic Testing, And The Specter Of Discrimination: A Discussion Using Hypothetical Cases, Richard H. Underwood, Ronald C. Cadle
Law Faculty Scholarly Articles
A "genetic revolution" is upon us. Techniques for genetic testing have increased in sophistication, and an international effort to map and sequence human DNA—The Human Genome Project ("HGP")—is now well under way. We are beginning to exploit our new found genetic knowledge. Recognition of the relationship between developments in genetic science, law, and public policy, is creeping into the "literature" and into the law school curriculum. Even the popular 60 Minutes television "news magazine" recently did a program on the perils of genetic testing. Still, for lawyers and policymakers at least, the material is not all that accessible.

Hydrogeology And Ground-Water Monitoring Of Coal-Ash Disposal Sites In A Karst Terrane Near Burnside, South-Central Kentucky, Shelley Minns Hutcheson, Lyle V. A. Sendlein, James S. Dinger, James C. Currens, Arsin M. Sahba
Hydrogeology And Ground-Water Monitoring Of Coal-Ash Disposal Sites In A Karst Terrane Near Burnside, South-Central Kentucky, Shelley Minns Hutcheson, Lyle V. A. Sendlein, James S. Dinger, James C. Currens, Arsin M. Sahba
Report of Investigations--KGS
The effects of two coal-ash disposal facilities on ground-water quality at the John Sherman Cooper Power Plant, located in a karst region of south-central Kentucky, were evaluated using dye traces in springs. Springs were used for monitoring rather than wells, because in a karst terrane wells are unlikely to intercept individual conduits.
A closed-out ash pond located over a conduit-flow system discharges to three springs in the upper Salem and Warsaw Formations along Lake Cumberland. Water discharging from these downgradient springs is similar to springs unaffected by ash-disposal facilities and is a calcium-bicarbonate type. No constituent concentrations found in this …
Fresh-Water Aquifer In The Knox Group (Cambrian–Ordovician) Of Central Kentucky, James A. Kipp
Fresh-Water Aquifer In The Knox Group (Cambrian–Ordovician) Of Central Kentucky, James A. Kipp
Report of Investigations--KGS
Fresh water can be found in Cambrian and Ordovician carbonate rocks of the Knox Group in central Kentucky. The top of the aquifer is as much as 300 ft above mean sea level (m.s.l.) on the crest of the Cincinnati Arch, but descends off the flanks of the arch. Water is normally found in the upper 100 to 250 ft of the Knox, primarily in secondary porosity apparently associated with the unconformity at the top of the unit. Knox wells commonly exceed 750 ft in total depth, but because the aquifer is artesian, water rises to an elevation of about …

Library Instruction Vs. Information Competency: It's Not Just Bibliographic Instruction Anymore, Antoinette Paris Powell, Patricia S. Wilson

The Agriculture Library at the University of Kentucky has offered library instruction in some form for the past 23 years. The program began in 1974 with the Library Literacy program that offered on demand workshops, an undergraduate for-credit course, graduate workshops and programs to extension personnel. By 1988 the program had moved into a library literacy program that was proactive, provided individualized presentations, and provided a mix of electronic and paper sources. This program gave way to the information literacy program of 1994 which expanded target groups and collaborated with other areas. A shift in the teaching emphasis in the …

Evaluation Of Incident Management Techniques (Lexington, Kentucky), Kenneth R. Agent, Jerry G. Pigman, Nikiforos Stamatiadis, Eugene Culton
Kentucky Transportation Center Research Report
The objective of this project was to evaluate and document the various incident management techniques used by the Lexington Fayette Urban County Government (LFUCG) to alleviate the impact of incidents on highways in Fayette County. Components included in the evaluation included: 1) establishment and use of traffic diversion routes, 2) use of variable message signs, 3) use of detour signing, 4) use of arrow board signs, 5) improvement of existing incident detection and verification through enhanced computerized mapping, 6) use of linked motion detection equipment, and 7) development of a public information program. The methods used to incorporate each of …

Perjury: An Anthology, Richard H. Underwood
Perjury: An Anthology, Richard H. Underwood
Law Faculty Scholarly Articles
Professor Underwood takes an in-depth look at the occurrence of perjury from ancient Rome to the O.J. Simpson trial. This journey through time provides insight into the motives of perjurers, the difficulties involved in catching them; and the alarming frequency with which they succeed, unchastised.

We reexamine the spectroscopic underpinnings of recent suggestions that [O I] and [Fe II] lines from the Orion H II region are produced in gas where the iron-carrying grains have been destroyed and the electron density is surprisingly high. Our new observations show that previous detections of [O I] 5577 were dominated by telluric emission. Our limits are consistent with a moderate density (≈ 104 cm-3) photoionized gas. We show that a previously proposed model of the Orion H II region reproduces the observed [O I] and [Fe II] spectrum. These lines are fully consistent with formation …

Celluloid Death: Cinematic Depictions Of Capital Punishment, Roberta M. Harding
Celluloid Death: Cinematic Depictions Of Capital Punishment, Roberta M. Harding
Law Faculty Scholarly Articles
This essay will examine how two filmmakers used the cinema to investigate death penalty issues through the films Dead Man Walking and Last Light. These films were selected because of their similarities: capital punishment is the central theme of both films; the presence of a strong principal character who is the condemned inmate; the utilization of a character who undergoes a spiritual transformation due to interaction with the condemned inmate; the decision to have this character facilitate the humanization of the condemned individual; and the additional role this character plays as the audiences' conscience. There are, however, differences in the …

Cooperative Implementation Of Federal Regulations, Douglas C. Michael
Cooperative Implementation Of Federal Regulations, Douglas C. Michael
Law Faculty Scholarly Articles
Professor Michael examines regulatory programs in which the federal government leaves many compliance decisions up to the regulated entities themselves. Drawing on prior research and theory in the area, he concludes that such "cooperative implementation" is feasible if three principles are observed: (1) regulatory standards are written to leave discretion in methods of compliance and that discretion is within the competence of the regulated entities; (2) there are economic incentives to offset the additional costs to these entities; and (3) the entities self-report their own compliance, the agency closely monitors the program, and the agency maintains a residual program of …
Cost Estimating And Forecasting For Highway Work In Kentucky [1996], James D. Stevens, Jennifer R. Walton
Cost Estimating And Forecasting For Highway Work In Kentucky [1996], James D. Stevens, Jennifer R. Walton
Kentucky Transportation Center Research Report
There is a need for better cost estimating and forecasting for highway work in the Commonwealth of Kentucky. KRS45.245 grants the Interim Joint Committee on Transportation oversight of the biennial highway plan, including a review of all authorized highway project phases that exceed their estimates by 15%. In recent years, the Kentucky Transportation Cabinet has suffered the loss of many resources necessary to produce good cost estimates.
Estimates developed using current methods are not sufficiently accurate to preclude cost overruns in excess of 15%. Over the 1992 and 1994 bienniums, 362 overruns totaling $162,487,511 have been submitted to the Committee. …

Development Of A Critical Path Method Specification And A Training Program For Use Of Cpm And Ktc, James D. Stevens, Donn E. Hancher, Ihab M. Hamdi
Kentucky Transportation Center Research Report
The Critical Path Method is a proven management technique used for determining the critical activities that would need additional care in any type of construction projects. The KTC requires that CPM schedules be used on selected highway projects. This research project offers a detailed idea on CPM scheduling application in highway construction projects, as well as current practices in other departments of transportation nationwide, together with specifications for proper application of CPM scheduling.
