A New Methodology For The Analysis Of Visuals In Legal Works, Michael D. Murray Jan 2022

A New Methodology For The Analysis Of Visuals In Legal Works, Michael D. Murray

Law Faculty Scholarly Articles

The goal of this Article is to introduce a comprehensive methodology for the analysis of visuals used for communication in legal works, by which I mean transactional and litigation documents, legal instruments, primary and secondary sources of law, and legal informational materials. To date, the scholarship on visuals in legal communications has been heavily descriptive, with some forays into the ethical and practical considerations of the use of “visualized” legal works. No one has yet devised a comprehensive analytical methodology that draws upon the disciplines of visual literacy, visual cultural studies, visual rhetoric, and mise en scène analysis to evaluate …

The Mixed Legacy Of The January 6 Investigation For Executive Privilege And Congressional Oversight, Jonathan Shaub Jan 2022

The Mixed Legacy Of The January 6 Investigation For Executive Privilege And Congressional Oversight, Jonathan Shaub

Law Faculty Scholarly Articles

The attack on the Capitol on January 6 was an unprecedented event in U.S. history. Across a wide swath of constitutional law, January 6 will have significant implications and consequences, most of which are likely not yet known. That is particularly true of constitutional doctrines governing congressional oversight and executive privilege. The select committee established by the House of Representatives to investigate the events on and leading up to January 6 has undertaken a monumental task of investigating, collecting, and reporting the facts surrounding the attack, and the January 6 committee has doggedly pursued an exhaustive investigation in furtherance of …

A Pathway For Inclusive Innovation In Pediatric Mental Health: Prevention And Intervention Using Technology, Kate Corinne Bennett Jan 2022

A Pathway For Inclusive Innovation In Pediatric Mental Health: Prevention And Intervention Using Technology, Kate Corinne Bennett

DSW Capstone Projects

It is no secret that access to quality healthcare is difficult for citizens to achieve in the United States. Racism, discrimination, and oppression further exist at the root of compounding social problems, including limits in minority access to mental health services. The COVID-19 pandemic has also exacerbated mental health problems for young children, especially those who are already underserved and at risk. For these reasons, it is imperative that the social work profession emphasizes innovative approaches to equitable treatment access, including a focus on early intervention and the use of technology. Product one of this capstone engages a systematic review …

The Impact Of Bias And Historical Racial Trauma On Black Girls’ Education: Using Theory To Better Understand Benefits, Angela Fisher-Williams Jan 2022

The Impact Of Bias And Historical Racial Trauma On Black Girls’ Education: Using Theory To Better Understand Benefits, Angela Fisher-Williams

DSW Capstone Projects

ABSTRACT OF CAPSTONE

Implicit biases are among the most unfair discriminating microaggressive habits; Black students face within the compulsory educational system. However, college institutions are not sufficiently preparing social work students to work with this marginalized group to help manage these needs through diversity training courses. The researcher wrote a synthesis paper that synthesized two theories, the Critical Race Theory (CRT) and Post Traumatic Slave Syndrome (PTSS). This research will determine if social work students who take part in diversity training embedded in their coursework could better prepare social workers for the field. This research employed a descriptive design while …

Leadership & Innovation: The Keys To Solving Wicked Social Problems, Kaye Mooney Jan 2022

Leadership & Innovation: The Keys To Solving Wicked Social Problems, Kaye Mooney

DSW Capstone Projects

Social work leaders must utilize unique leadership styles and innovative activities to enhance human well-being and meet the basic needs of all people (NASW, 2008). Social work leaders must value and actively seek input from all people, strengthening the solutions' chance to work. Wicked social problems (WSP) plague our country, especially among marginalized groups. We must utilize a new combination of social work leadership styles to resolve WSP.

The capstone project presents significant social work leadership and social innovation findings. First, a systematic literature review synthesized how transformational, anti-oppressive, and ubuntu leadership styles impact social service organizations. The conceptual paper …

Disproportionality In School Discipline: The Use Of Critical Race Theory And Attachment Theory Interventions In Action, Phaecia Ward Jan 2022

Disproportionality In School Discipline: The Use Of Critical Race Theory And Attachment Theory Interventions In Action, Phaecia Ward

DSW Capstone Projects

Two primary focuses of schools have been to educate and keep children safe. Although exclusionary discipline practices are and should be the last resort for dealing with safety in schools, research indicates that preschool-aged children are being expelled or suspended at rates that are at least three times that of children in grades K-12.

The central problem is why are Black children being disciplined disproportionately in early childhood settings? What are the identified risk factors because of exclusionary discipline for children in their early years? What are the identified protective factors that can be employed to help prevent the statistics …

Vicarious Trauma In The Black Community Due To Police Brutality And Aggressive Policing: How Social Work Clinicians Can Understand And Mitigate The Problem, Sharrion Brown Jan 2022

Vicarious Trauma In The Black Community Due To Police Brutality And Aggressive Policing: How Social Work Clinicians Can Understand And Mitigate The Problem, Sharrion Brown

DSW Capstone Projects

Police brutality and aggressive policing impacts the Black community. Social media and new outlets allow visuals of police brutality and aggressive policing to be shared rapidly. This form of second-hand exposure can cause trauma. The purpose of this study is to explore the adverse mental health outcomes in the Black community due to police brutality and aggressive policing and find ways that social work clinicians can understand and mitigate the problem. This study was conducted because when Black people seek therapeutic services, they are often met with clinicians who invalidate their racial trauma and racial experiences due to second-hand exposure …

Huddle Implementation In The Perioperative Setting, Tina Thomas Jan 2022

Huddle Implementation In The Perioperative Setting, Tina Thomas

DNP Projects

Background: Communication is essential for safe and effective patient care. In the perioperative setting, information sharing is critical to care coordination. Lack of communication between caregivers can lead to medical errors. Evidence shows that huddles lead to increased communication, satisfaction, and engagement between team members resulting in better patient outcomes. Huddles are short, less than 10-minute gatherings that focus on the daily schedule, identify potential obstacles, explain unique needs, and discuss preceding day issues.

Objectives: This project aimed to evaluate the effectiveness of huddles on employee satisfaction, engagement, and communication of healthcare workers while also determining if huddles were …

Examining The Impact Of A Protein Intervention To Improve Outcomes In Frail Perioperative Candidates: A Feasibility Study, Anna M. Rose Jan 2022

Examining The Impact Of A Protein Intervention To Improve Outcomes In Frail Perioperative Candidates: A Feasibility Study, Anna M. Rose

DNP Projects

Background: Frailty is a syndrome or grouping of clinical characteristics that collectively increases one’s vulnerability to acute and external health stressors. Higher rates of frailty are present in oncology surgical patients and is a predictor of postoperative complications, as well as increased morbidity and mortality. Long- and short-term survival of surgical oncology patients is worse in frail patients than robust patients. Prehabilitation interventions during the planning phase of surgical intervention may serve to mitigate already known health concerns prior to inflicting the stressor that is surgical intervention.

Purpose: To measure the feasibility of an educational prehabilitative nutritional intervention aimed at …

The Isolated As The Revolutionary: How “Leftover” Men In China Challenge Heteronormativity, Ruwen Chang Jan 2022

The Isolated As The Revolutionary: How “Leftover” Men In China Challenge Heteronormativity, Ruwen Chang

Theses and Dissertations--Gender and Women's Studies

In contemporary China, demographers estimate that 30 million men are single because there are simply not enough women in the Chinese population, and the 2020 Chinese census shows that there are 34.9 million more men than women. These men are called guanggun, which can be directly translated to “bare sticks/branches,” a slur that indicates a lack of marriage and sex. In this project, I demonstrate that guanggun’s singlehood marks them as the marginalized at the intersection of heteronormativity, patriarchy, globalizing capitalism, and pronatalist governmentality. In a highly heteronormative and patrilineal culture, guanggun are branded as abnormal/incomplete. However, because …

Adapting Through Organizational Change In Capital Projects Organizations, Mahmoud El Jazzar Jan 2022

Adapting Through Organizational Change In Capital Projects Organizations, Mahmoud El Jazzar

Theses and Dissertations--Civil Engineering

Organizational change can be defined as an alteration of a core aspect of an organization’s operation, structure, or culture. Previous research on organizational change mainly has focused on different types of technical changes, such as alternative project delivery methods and strategies to adopt the design-build approach successfully. Also, previous studies have focused on the project level changes instead of organizational level responses. Here I show using a proposed change model and performing thematic, and analysis, that there exist common responses, and challenges across different types of capital projects organizations studied. The results show that responses to change will differ as …

Investigation Of Pfas Exposure Risks In Kentucky Using Mapping Tools, Sweta Ojha Jan 2022

Investigation Of Pfas Exposure Risks In Kentucky Using Mapping Tools, Sweta Ojha

Theses and Dissertations--Civil Engineering

Per- and polyfluoroalkyl substances (PFAS), a group of environmentally-persistent compounds, are environmentally ubiquitous and challenging to remediate. Several studies show that PFAS are detected in drinking water systems when sampling is conducted, making human exposure via drinking water an important health consideration. This research: 1) develops a mapping tool for prioritizing sampling locations; 2) establishes a method for making GIS data and meta(data) in the mapping tool accessible; 3) fosters decision making by integrating knowledge brokering and the alignment interest and influence matrix (AIIM). The tool developed is this research is a geospatial and statistical PFAS hot-spot screening model that …

Understanding The Differences Between Industry Objectives And Institutional Learning, Kristen Schell Jan 2022

Understanding The Differences Between Industry Objectives And Institutional Learning, Kristen Schell

Theses and Dissertations--Civil Engineering

To combat understaffing in the construction industry, it is necessary to employ the best candidates possible. By identifying the most desirable skills in a construction employee from an industry perspective, institutional learning can better prepare graduates for the construction workforce. Currently there exists an information gap in the objectives of the construction industry and institutional learning. This gap produces graduates, professors, and employers with expectations that do not align. Reducing this gap will aid in the success of hiring recently graduated construction students who can meet the ever-changing demands of the industry. Construction students who are fresh out of college …

Don't Give Me That Story! -- A Human-Centered Framework For Usable Narrative Planning, Rachelyn Farrell Jan 2022

Don't Give Me That Story! -- A Human-Centered Framework For Usable Narrative Planning, Rachelyn Farrell

Theses and Dissertations--Computer Science

Interactive or branching stories are engaging and can be embedded into digital systems for a variety of purposes, but their size and complexity makes it difficult and time-consuming for humans to author them. Narrative planning algorithms can automatically generate large branching stories with guaranteed causal consistency, using a hand-authored library of story content pieces. The usability of such a system depends on both the quality of the narrative model upon which it is built and the ability of the user to create the story content library.

Current narrative planning algorithms use either a limited or no model of character belief, …

Perilous Times: Reading The Apocalypse In Nineteenth-Century Black Women's Religious Writing, Brittany Sulzener Jan 2022

Perilous Times: Reading The Apocalypse In Nineteenth-Century Black Women's Religious Writing, Brittany Sulzener

Theses and Dissertations--English

During the time of war, rebellion, and political upheaval in the early American nation, apocalyptic imagery featured prominently in the rhetoric of preachers, abolitionists, writers, and orators. As nineteenth-century, white, American men like George Lippard proleptically envisioned the ruins of America as a source of future longing for those looking back on a great nation, many Black religious women writing in the antebellum era imagined an apocalyptic event so cataclysmic that it would destroy and remake the nation. Apocalyptic discourse in the nineteenth century allowed Black women to eschew social constraints and deliver scathing critiques of the American sociopolitical landscape, …

Warriors, Mothers, And Queens: Weighty Women Of Myths And Legends, Betsy Packard Jan 2022

Warriors, Mothers, And Queens: Weighty Women Of Myths And Legends, Betsy Packard

Theses and Dissertations--English

Because traditional stories, myths, and legends have a patriarchal orientation, often portraying women as negative or weak characters, post-modern literary criticism calls for a feminist response. These poems are written in the genre of feminist revisionist mythology. Through the medium of poetry, women in these stories are provided with voices outside of the previously accepted patriarchal framework and challenge the exclusionary theories of Joseph Campbell. The stories are told through a perspective informed by feminist theory.

(Dis)Possessed Black Youth: How America's Architecture Challenges Coming Of Age In Twentieth And Twenty-First Century African American Women's Literature, Margaret Frymire Kelly Jan 2022

(Dis)Possessed Black Youth: How America's Architecture Challenges Coming Of Age In Twentieth And Twenty-First Century African American Women's Literature, Margaret Frymire Kelly

Theses and Dissertations--English

This dissertation advances studies of Black childhood, particularly Black girlhood, by examining how African American women writers depict the troubled journey to adulthood in stories of segregation, immigration, and incarceration. I argue that authors of four representative literary works emphasize architectural structures as well as ancestral hauntings among which Black children grow up. Without examining the material structures, we cannot understand the strategies these haunted Black youth deploy to reach adulthood. Examining the architectural structures that the protagonists of Maud Martha (1953), Brown Girl, Brownstones (1959), Zami (1982), and Sing, Unburied, Sing (2017) grow up in and around, I demonstrate …

The Ecology And Evolution Of Human Reproductive Behavior, Kaylynne Glover Jan 2022

The Ecology And Evolution Of Human Reproductive Behavior, Kaylynne Glover

Theses and Dissertations--Biology

The complexity of human reproductive behavior has necessitated its examination through a variety of scientific disciplines, each focusing on specific elements of our biology, behavior, and society. However, this complexity also necessitates that we reintegrate the information learned from each discipline into a single framework, one rooted in the evolutionary principles that have shaped the development of all life on earth. In this dissertation, I use this framework to explore human reproductive behavior, with a particular focus on sexual coercion and fertility-mediated sexual behavior.

In Chapter 1, I introduce the approach taken in this document, identify several key limitations, and …

Tryptophan-Like Fluorescence And Non-Point Source Pollution In Karst Basins, Inner Bluegrass Region, Kentucky, Ryan Dapkus Jan 2022

Tryptophan-Like Fluorescence And Non-Point Source Pollution In Karst Basins, Inner Bluegrass Region, Kentucky, Ryan Dapkus

Theses and Dissertations--Earth and Environmental Sciences

Typically, the degree of fecal contamination of water is assessed by the concentration of thermotolerant coliforms, like E. coli. This method is time-consuming, taking > 18 hours between the start of incubation and subsequent enumeration. The current study examines the utility of monitoring tryptophan-like fluorescence (TLF) using in-situ fluorometers as a proxy for fecal contamination, particularly E. coli. Relative timing of discharge peaks and TLF peaks is considered, as well as differences in E. coli concentrations and major anion concentrations between two different basins that were monitored weekly. Results indicate that TLF is somewhat useful in the prediction of …

Gender And Remittances: Lived Experiences Of Women In Oaxaca, Mexico, Araby Smyth

Theses and Dissertations--Geography

This dissertation project analyzes the ways that migration and remittances, the money that migrants send to people in their place of origin, intersect with the political and social dynamics in an Indigenous community in the Isthmus of Tehuantepec region of Oaxaca, Mexico. Drawing on 16 months of ethnographic fieldwork, which included semi-structured interviews and participant observation alongside historical archival investigation, this dissertation examines the following questions: What international organizations, national government, and private sector policies govern remittances? How does Indigenous collective work and communal governance shape remittance management? How do the responsibilities of family members shift with migration and how …

Affective Registers Of Displacement: Eviction And Gentrification In Post-Earthquake Mexico City, Jess Linz Jan 2022

Affective Registers Of Displacement: Eviction And Gentrification In Post-Earthquake Mexico City, Jess Linz

Theses and Dissertations--Geography

This dissertation contributes to understandings of the affective and emotional register of urban politics by analyzing how affective dynamics influence struggles over displacement in Mexico City amid rapid gentrification and in the wake of the 2017 earthquake. Drawing primarily on feminist and queer/cuir theory and trauma studies, I aim to show the relevance of an often-overlooked dimension of urban political struggles. This dissertation is based on data collected through ethnographic methods over the course of 2018-2021. The primary source of data is long-form semi-structured interviews, supported by participant observation in meetings, protests, and WhatsApp groups. The dissertation studies the following …

Elephants In The Room: Covid-19 Pandemic Political Ecologies Of Tourism In Tanzania, Helen C. Richardson Jan 2022

Elephants In The Room: Covid-19 Pandemic Political Ecologies Of Tourism In Tanzania, Helen C. Richardson

Theses and Dissertations--Geography

The COVID-19 pandemic brought forth unprecedented and ever-changing crisis and disruption to societies and economies around the globe.[1] As the COVID-19 pandemic continues to interrupt travel worldwide, the tourism industry, and the countries who rely on it as a major source of income, are in crisis. These processes have reconfigured economic capital flows and foreign investment in the global south. This is particularly the case in Tanzania, as tourism was Tanzania’s highest foreign exchange earner and accounted for 17% of Tanzania’s gross domestic product in 2019.[2] This project draws upon a political ecology framework to examine the Tanzanian …

A Corpus Study Of The Development Of The Adjective Phrase In French Children, Avery Elizabeth Baggett Jan 2022

A Corpus Study Of The Development Of The Adjective Phrase In French Children, Avery Elizabeth Baggett

Theses and Dissertations--Linguistics

In this thesis I attempt to answer three questions:

H1) Do children use proportionally more prenominal or post-nominal placement of adjectives than adults?

H2) Are children more conservative or more creative in their behavior in alternating prenominal and post-nominal placement of adjectives?

H3) If colored terms are more frequent in child speech will they pattern more like prenominal adjectives or more like post nominal adjectives, as in adult speech?

To do this, I examine two general semantic viewpoints, opting to use Scontras & Goodman (2017) subjectivity hypothesis. Next, I provide a general overview of First Language Acquisition research and then …

Fighting 'Stance': The Role Of Conversational Positioning In League Of Legends (Multiplayer Online Battle Arena) Discourse, William Breslove

Theses and Dissertations--Linguistics

For researchers, the study of video game players - how they behave, interact, and cooperate in a virtual world – presents a challenge: what methodologies are best suited to approaching these interactions? From a sociolinguistic approach, how do gamers converse, and what do these conversations reveal about epistemic, affective, and political relationships? This study uses John DuBois’ Stance Theory (2007) and recent modifications of it (Kiesling 2022), to analyze data gathered from the popular multiplayer online battle-arena (MOBA) game League of Legends. It focuses on in-game interlocutors’ conversation samples to show their positioning, intersubjective alignment, and evaluation of a …

Theses and Dissertations--Hispanic Studies

This project investigates the strategies of Latin/x American women who have used their voices and influence in the media to break barriers, enter spaces that have excluded them, and advocate for changes so that young girls like them do not have to face these same limitations. Chapter One investigates politicians who, from their political power positions, interweave personal stories with their accomplishments to provide role models for these careers. Chapter Two identifies actors who combine their personal stories with activist causes to alter representation in TV and film. The YouTubers in Chapter Three bolster a rhetoric of empowerment to encourage …

The Ideal Religious Community: Articulating The Possibility Of Collaborative Community Within Religious Contexts, Kayla Bohannon Jan 2022

The Ideal Religious Community: Articulating The Possibility Of Collaborative Community Within Religious Contexts, Kayla Bohannon

Theses and Dissertations--Philosophy

This dissertation seeks to explain a certain instability that characterizes many contemporary religious communities. Why are people abandoning organized religion at an unprecedented rate? And why do so many religious people behave in vicious ways, even as they claim to preach a message of love? These phenomena are related, and they are both usually explained on epistemological grounds. According to many of religion’s recent critics, religious belief requires the suspension of rational thought, and those who abandon it have simply seen the light of reason. Meanwhile, those who remain religious do so despite the testimony of their reason, and the …
