Gift Tax Consequences Of Interest-Free Loans Between Family Members, Victoria Wilson, Thomas M. Poulton

The recently decided case of Crown v. Commissioner reinforced the tax court's position that imputed interest on an interest-free loan is not a taxable gift. The Internal Revenue Service (IRS) continues to take the contrary position that interest-free loans do constitute gifts of an amount equal to the interest charge that it usually made for the use of that amount of money.

The IRS position on the taxation of interest-free loans is consistent with both economic reality and gift tax principles. An examination of the economic substance of interest-free loans highlights the court's reliance on the form of the transaction. …

The False Claims Act: Potential Application To Members Of Congress, Trienah A. Meyers

The False Claims Act is a civil remedy for the restitution to the government of monies fraudulently obtained from the government. The Act provides for a civil suit, by either the federal government or a private plaintiff, for restitution plus a $2,000 statutory penalty where allegedly fraudulent claims have been presented for payment from the United States Treasury. Section 231 is the substantive provision of the Act delineating the circumstances in which a remedy will be available. Section 232 is the major procedural provision, and outlines the parties and the steps necessary to pursue a suit under the Act. Taken …

Reducing Administrative Delay: Timeliness Procedures, Judicial Review Of Agency Procedurees, Procedural Reform, And Legislative Oversight, Gregory L. Ogden

Delay in administrative decisionmaking is a serious problem that can be resolved only by the combined efforts of the courts, the agencies, and the legislatures that have created the agencies. The gravity of the delay problem at the federal agency level is indicated by the recent statement of the Senate Committee on Governmental Affairs, in a major study, that "[m]ost federal regulatory proceedings are characterized by seemingly interminable delays." Agency delay adds additional costs and imposes additional burdens on both the regulated industries and the consuming and taxpaying public. In 1974 Congress enacted the Employee Retirement Income Security Act, which was hailed as landmark social legislation in the area of pension and welfare plan reform. It has been characterized as the "greatest development in the life of the American worker since social security."

ERISA was enacted to remedy many of the defects and problems associated with employee pension and welfare benefit plans. A primary objective was to strengthen the private employee benefit plan system to provide for the retirement and financial security of employees and their families and, no less importantly, to encourage the growth of this system. Water Needs For The Future (By Ved P. Nanda), Ralph B. Lake

Although the importance of water as a natural resource has long been recognized in the arid Western states and in the Middle East, recent disastrous droughts in the African Sahel region, and the United Kingdom have focused worldwide attention on the fact that inadequate supplies of water are a major international problem. Indeed, the specter of a "water crisis" akin to the much discussed energy crisis has been raised, with a warning from the U.S. Secretary of the Interior of possible cutbacks in residential construction and a decline in the quality of drinking water by the late 1980's.
