Corporal Punishment In Public Schools: Does It Violate The Eighth Amendment, Mary H. Egger Jan 1977

Corporal Punishment In Public Schools: Does It Violate The Eighth Amendment, Mary H. Egger

University of Dayton Law Review

Ingraham v. Wright, 525 F.2d 909 (5th Cir.) (en banc), cert. granted, 96 S. Ct. 2200 (1976).

Few would deny the extensive authority possessed by the states to establish, regulate, and supervise the educational systems within their respective domains. However well-established that authority may be, states and school officials unmistakably remain subject to the provisions of the Federal Constitution via the supremacy clause. The Supreme Court of the United States has voiced its unequivocal affirmance of this concept: "In our system, state-operated schools may not be enclaves of totalitarianism. School officials do not possess absolute authority over their students. Students …

Voiceprints: The Determination Of Admissibility, Terry Timblin Jan 1977

Voiceprints: The Determination Of Admissibility, Terry Timblin

University of Dayton Law Review

One of the most crucial issues facing courts in recent years is the admissibility of novel scientific evidence. There is obviously a strong temptation to use a scientific process or machine that purports to provide unbiased information free from the many competency and credibility problems associated with testimonial evidence. One such process, called spectrographic analysis, is now being favorably received by the courts despite its substantial shortcomings. Spectrographic analysis-popularly known as "voiceprints"- is a technique for the identification of voices with the aid of a machine known as the sound spectrograph. The purpose of this comment is to examine the …

Heinrich Böll's Other Rhineland, Ralph J. Ley Dec 1976

Heinrich Böll's Other Rhineland, Ralph J. Ley

University of Dayton Review

In 1958, when he was forty and an established author, Heinrich Böll undertook to write what to this day remains the "official" autobiography of his life up to the time the Nazis came to power. The sketch of his early life is a full two pages in length; yet, despite the title "Über mich selbst" the first third has seemingly little to do with the author. It is an attempt to characterize his native city, Cologne on the Rhine. This characterization takes place before Böll even announces the specific day of his entry into the world on 21 December 1917, …

Introduction To The Poetry Of Heinrich Böll, Robert C. Conard Dec 1976

Introduction To The Poetry Of Heinrich Böll, Robert C. Conard

University of Dayton Review

When the first of Böll's poems appeared under his own name in Die Zeit (27 July 1971, p. 10) most critics refused to review them, claiming the four poems (My Muse," Cologne I," "Cologne II," "Angel") were too few to indicate Böll's stature as a poet. Lev Kopelev, a Russian critic of German literature, nevertheless, published in MDie Zeit (20 July 1971, pp. 9-10) an astute commentary on the poems. Now that a volume of poetry has appeared, comprising the lyrics written between 1965-71, a more thorough assessment of Böll as a poet is appropriate.

Focus, October 1976, University Of Dayton

Focus

Focus, published by the University of Dayton public relations office from October 1967 to mid-1982, was called “a window of the University of Dayton.” The number of issues per year varied over time from four to nine. It was mailed to faculty and staff; parents of current students; benefactors; and business and industry partners. Its content was duplicated in another publication, Alumnus, which contained additional pages of interest to alumni, including a robust listing of personal updates known as class notes — a popular section of every alumni publication since.

In August 1982, Focus and Alumnus merged into one publication, …
