Arkansas Law Review

The Eighth Circuit upheld preliminary injunctive relief in favor of the plaintiffs who challenged Arkansas's anti-loitering law for violating their free speech rights. Though Arkansas claimed that it would not enforce the anti-loitering statute against "'polite' and 'courteous' beggars like [plaintiffs]," because the law's plain language applied to the plaintiffs' intended activities, they had an objectively reasonable fear of prosecution.' Thus, they had a constitutional injury as required for standing.

An Af(Fur)Mative Defense: Using Intellectual Property As A Defense To Employment Discrimination In Mascot Hiring, Taylor Farr

Arkansas Law Review

"Until a character becomes a personality, it cannot be believed. Without personality, the character may do funny or interesting things, but unless people are able to identify themselves with the character, its actions seem unreal. And without personality, a story cannot ring true to the audience." Walt Disney

Mascots are different animals. They bring some of our favorite characters from screens, packages, and comic book pages to life. Moreover, mascots serve a particularly important role on university campuses, offering a point of communal continuity amid inevitable organizational changes. Although university buildings, athletes, faculty, and staff will eventually change, a mascot …

Pandora's Cake, Mark R. Killenbeck Aug 2020

Pandora's Cake, Mark R. Killenbeck

Arkansas Law Review

Most of us are familiar with the spectre of Pandora's Box, the "present which seems valuable, but which in reality is a curse." Robert Graves described Pandora as "the most beautiful [woman] ever created.", She was sent by Zeus as a gift to Epimetheus, who initially "respectfully" declined to marry her. But chastened by the fate of his brother Prometheus, he changed his mind and wed a women who was "as foolish, mischievous, and idle as she was beautiful.", She opened a jar that she and her husband had been "warned. .. to keep closed in which" Prometheus had "imprison[ed …

Crypto And Blockchain Fundamentals, Mary C. Lacity

Arkansas Law Review

"I believe blockchain will do for trusted transactions what the Internet has done for information." - Ginni Rometty, CEO of IBM Since the 1990s, we have had an "Internet of Information" that allows us to seamlessly share information such as documents, images, emails, and videos over the Internet. While most Internet users do not need to understand the details of the technical protocols operating underneath user-friendly software interfaces, it is helpful to understand how they work at a high-level. With the "Internet of Information," copies of information are routed over the Internet. If a sender emails a friend, the sender …

Evaluation Of A Novel Shallow Aggregate Ebb-And-Flood Culture System And Transplant Size Effects On Hydroponic Basil Yield, Samuel Doty, Ryan W. Dickson, Michael Evans

Horticulture Faculty Publications and Presentations

Ornamental bedding plant operations transitioning to leafy greens and herb production must decide whether to invest in new hydroponic equipment or modify existing culture systems for edible crops. In addition, common practices used to increase space-use and production efficiencies during bedding plant production may be modified for hydroponic leafy greens and herbs, such as purchasing large seedlings for transplant. The objective of the first experiment was to evaluate plant growth in a modified and novel shallow aggregate ebb-and-flood (SAEF) system intended for bedding plant growers with an emphasis on comparing yield across four basil (Ocimum basilicum) cultivars grown …

Testing Flowering Perennial Plants In A Bermudagrass (Cynodon Spp.) Lawn, Paige Elizabeth Boyle, Michelle Wisdom

Horticulture Faculty Publications and Presentations

Most pollinating insects require a season-long succession of floral resources to fulfill life-cycle requirements. Incorporating forbs into turfgrass sites may create a season-long sequence of flowers to support foraging pollinators. However, persistence of forbs in warm-season turfgrasses such as bermudagrass (Cynodon spp.) may be affected by the competitive nature of the turfgrass and routine management practices such as mowing. A 2-year study was conducted to evaluate seven forbs (Bellis perennis L., Lotus corniculatus L., Prunella vulgaris L., Trifolium fragiferum L. ‘Fresa’, Trifolium repens L. ‘Durana’ and ‘Resolute’, Trifolium subterraneum L.) for persistence and ability to produce floral resources …

Commodity-Based Freight Activity On Inland Waterways Through The Fusion Of Public Datasets For Multimodal Transportation Planning, Magdalena I. Asborno Jul 2020

Commodity-Based Freight Activity On Inland Waterways Through The Fusion Of Public Datasets For Multimodal Transportation Planning, Magdalena I. Asborno

Graduate Theses and Dissertations

Within the U.S., the 18.6 billion tons of goods currently moved along the multimodal transportation system are expected to grow 51% by 2045. Most of those goods are transported by roadways. However, several benefits can be realized by shippers and consumers by shifting freight to more efficient modes, such as inland waterways, or adopting a multimodal scheme. To support such freight growth sustainably and efficiently, federal legislation calls for the development of plans, methods, and tools to identify and prioritize future multimodal transportation infrastructure needs. However, given the historical mode-specific approach to freight data collection, analysis, and modeling, challenges remain …

Dissecting The Cellular Control Of Septin Organization In A Global Cereal Killer, Nawaraj Dulal Jul 2020

Dissecting The Cellular Control Of Septin Organization In A Global Cereal Killer, Nawaraj Dulal

Graduate Theses and Dissertations

Rice blast disease, caused by the filamentous fungus Magnaporthe oryzae, destroys sufficient rice each year to feed 60 million people, and is a serious threat to global food security. A wheat-adapted lineage of M. oryzae now poses threat to global wheat production. Rice blast disease is currently controlled using limited fungicides, and the emergence of fungicide resistance within M. oryzae populations is a growing concern. There is a pressing need to identify new classes of fungicides to control the disease, which requires better understanding of the basic biology of the pathogen. To establish disease, M. oryzae forms a specialized dome …

The Role Of Designers In Promoting Healthy Masculinity With An Approach To Stopping Violence Against Women And Girls, Fatemeh Abolbashari Jul 2020

The Role Of Designers In Promoting Healthy Masculinity With An Approach To Stopping Violence Against Women And Girls, Fatemeh Abolbashari

Graduate Theses and Dissertations

While awareness about violence against women and girls is growing, there is still a lack of evidence about what changes behavior to prevent it from happening. As a graphic designer, I wanted to find the root problem of this issue and work towards a solution. Through my research and questioning, I concluded that this problem begins with men’s thoughts on hierarchy, language, and behavior, and supported by a prevalence of toxic masculinity in men’s culture.

Where does this violence come from? What has society done to raise this kind of man? Violence against women and girls is being couched in …

Taxonomic And Genetic Diversity, And Pathogenicity Of Diaporthe Species Associated With Soybean, Fakhir Eraheem Hameed Al Shuwaili Jul 2020

Taxonomic And Genetic Diversity, And Pathogenicity Of Diaporthe Species Associated With Soybean, Fakhir Eraheem Hameed Al Shuwaili

Graduate Theses and Dissertations

Diaporthe species (anamorph: Phomopsis) are associated with a wide range of plant hosts as plant pathogens, asymptomatic endophytes, and saprobes. One of these hosts is soybean, which is one of the most important crops in U.S. agriculture. Several Diaporthe species cause important diseases on soybean in the U.S., and specifically in Arkansas. The taxonomy, genetic diversity, and pathogenicity of Diaporthe species associated with asymptomatic infection of soybean are rarely studied with accurate molecular tools. Therefore, this dissertation aimed to assess the diversity and boundaries of Diaporthe associated with soybean in Arkansas. Furthermore, pathogenicity and alternative lifestyles were assessed among Diaporthe …

Mitochondrial Contributions To Disuse Atrophy: Let’S Talk About Sex, Megan Rosa-Caldwell

Graduate Theses and Dissertations

Skeletal muscle atrophy is a hallmark of many pathologies and is associated with disease prognosis, quality of life, and mortality. Specifically, lack of contractile activity of the muscle can result in disuse-associated atrophy. Disuse-induced atrophy is a common phenomenon in intensive care unit (ICU) patients and significantly impacts patient prognosis and ability to transition of out of intensive care. However, effective therapeutics to mitigate disuse-associated atrophy do not exist, clearly demonstrating the scientific and clinical need to further understand mechanisms contributing to disuse atrophy. In particular, a significant portion of the scientific literature has utilized male models, yet there is …

The objective of this research is to measure the changes occurring in microbiome inside intestinal ilium of NE affected broilers which were treated with tributyrin supplement. This supplement is an anti-inflammatory metabolite that stabilizes intestinal integrity. The experimental design consisted of two challenge groups (No -Challenge, Clostridium Perfringens (CP) - Challenge) and one treatment group (tributyrin). To our knowledge, this …

The Defense Of Principates: The English Appropriation Of Marsilius Of Padua's 'Defensor Pacis', Nathan Harkey Jul 2020

The Defense Of Principates: The English Appropriation Of Marsilius Of Padua's 'Defensor Pacis', Nathan Harkey

Graduate Theses and Dissertations

Marsilius of Padua’s Defensor pacis is widely thought to be one of the most important texts to emerge in late medieval Europe. Initially purposed as a defense of Holy Roman Emperor Ludwig IV’s rights against the claim of the papacy’s claim to possess a ‘plenitude of power’, Defensor pacis is one of the most sophisticated arguments against the centuries of abuse of papal authority. Marsilius, though condemned as a heretic during his lifetime, remains a pivotal figure for medieval and early modern European historians, and is perhaps best remembered by the ways that his ideology influenced subsequent generations of political …

Consumer Food Socialization In The School And Home, Ashley Deutsch Cermin Jul 2020

Consumer Food Socialization In The School And Home, Ashley Deutsch Cermin

Graduate Theses and Dissertations

Consumer socialization literature has focused on individual socialization agents and their isolated effects. However, as John (1999) pointed out, children do not grow up in a social vacuum. Instead, the multitude of agents socializing children find their narratives interacting and their effects continually shaped and co-created. To understand how school-age children learn about food, I interrogate the complexity of socialization in three essays.

In the first essay, I take an ethnographic approach to investigate the interactive effect peers and adults, namely service workers, have on children’s food socialization in a public-school lunchroom. By combining a Loseke’s (2007) layered narrative model …

The Relationship Between Leadership Practices And Organizational Commitment Of Telecommunicators, André Lanier Jul 2020

The Relationship Between Leadership Practices And Organizational Commitment Of Telecommunicators, André Lanier

Graduate Theses and Dissertations

The performance of 9-1-1 telecommunicators can mean the difference between life and death for the person on the other end of a phone. Effective leadership is critical to the success of the public safety answer point (PSAP) and the organizational commitment of the 9-1-1 telecommunicator. Bass and Riggio’s (2006) Full Range of Leadership Theory (FLRT) is the basis for the current study. The FRLT covers leadership styles from laissez-faire to transformational (Matikainen, 2019).

The purpose of conducting the study was to identify and describe the 9-1-1 telecommunicator’s organizational commitment based on the PSAP leadership categories. The study made use of …

Effects Of Supplementing Crystalline L-Valine And L-Isoleucine And A Novel Threonine Biomass In Reduced Crude Protein Diets Fed To Broilers, Derrell Trevor Lee Jul 2020

Effects Of Supplementing Crystalline L-Valine And L-Isoleucine And A Novel Threonine Biomass In Reduced Crude Protein Diets Fed To Broilers, Derrell Trevor Lee

Graduate Theses and Dissertations

Poultry nutritionists continue to identify methods to lower feed price without compromising broiler growth performance, processing yields, or animal well-being. A common approach is to reduce dietary crude protein (CP), the second most expensive component in a broiler diet. Subsequently, reducing CP will reduce the inclusion levels of intact protein sources (e.g., soybean meal [SBM]), which can be accomplished by supplementing individual amino acids (AA). This methodology not only reduces diet cost, pending if feed-grade AA are more economical, but can contribute to improving broiler health and environmental sustainability. Therefore, two experiments were conducted to evaluate individual feed-grade AA in …

Phenotypic Switching Of Bacterial Cells In Extreme Environments, Sudip Nepal Jul 2020

Phenotypic Switching Of Bacterial Cells In Extreme Environments, Sudip Nepal

Graduate Theses and Dissertations

A large number of terrestrial microbial lives thrive in extremes of environmental conditions, including extremes of pressure, temperature, salinity, pH, and a combination of them. For example, all the marine biomass thrive at high hydrostatic pressure depending on depth. The temperature in the ocean can be very high near the hydrothermal vents and salinity and pH depends on the composition of salt in the surrounding areas. On the surface, hot springs, lakes and geysers provide high temperature conditions, while many places are permafrost regions with subzero temperatures. There is an emerging body of work on the viability, genomics, and metagenomics …

Distillers Dried Grains With Solubles: Determination Of Metabolizable Energy Values Using Regression-Based Assays And Their Correlation With Chemical Composition, Kenia Mitre Jul 2020

Distillers Dried Grains With Solubles: Determination Of Metabolizable Energy Values Using Regression-Based Assays And Their Correlation With Chemical Composition, Kenia Mitre

Graduate Theses and Dissertations

The inherent variability and lack of standardization of in vivo assays to determine the metabolizable energy (ME) of DDGS has led to inconsistent values and limited its potential to use in broiler diets. Therefore, two experiments were conducted to characterize the content of nitrogen-corrected ME (MEn) in 11 DDGS sources obtained from various ethanol plants using a regression-based broiler assay and to attempt to develop equations to predict MEn based on its chemical composition. In experiment 1, the objectives were to determine the influence of inclusion level and feed intake on the resulting ME and MEn values of a single …

The Impact Of Dietary Egg Intake On Metabolic Health In Food Insecure Households, Sam Walker Jul 2020

The Impact Of Dietary Egg Intake On Metabolic Health In Food Insecure Households, Sam Walker

Graduate Theses and Dissertations

Food Insecurity (FI) is defined as a condition in which individuals lack access to adequate food due to limited financial resources. FI is estimated to impact 12% of households in United States. Adults and children who experience FI are an increased risk for developing metabolic disease such as type 2 diabetes, obesity, hypertension, and cardiovascular disease. The negative health outcomes associated with FI are multi-factorial, however, many of them may be caused by limited nutritional intake and poor diet quality. Efforts to better understand the obstacles food insecure populations face is critical in order to improve nutrient intake and minimize …

A Macroevolutionary View On Extinction In Aves, Chiroptera, And Odonata, Peter Hasik Jul 2020

A Macroevolutionary View On Extinction In Aves, Chiroptera, And Odonata, Peter Hasik

Graduate Theses and Dissertations

A central goal of conservation biology is to identify and understand the factors that lead to extinction. The Earth is currently undergoing a 6th mass extinction event, in large part because of human activity. In the last century, rates of extinction have increased anywhere from 8-100 times the background rate of 2 extinctions per 10,000 species every 100 years. However, there remains a debate over whether certain species are predisposed to a higher extinction risk. In particular, it is not known if the macroevolutionary history of a lineage is a major contributor to the probability of extinction, nor is it …
