This Commentary examines the summons form currently in use in California and suggests that a more intelligible summons is necessary if legally unsophisticated individuals are to be made fully aware of the legal options and consequences that confront them.

Attorney Discipline For Offensive Personality In California, Robert C. Black

UC Law Journal

This Article examines California Business and Professions Code section 6068(f), which somewhat archaically provides that an attorney shall "abstain from all offensive personality .... ", and finds that this rather obscure statute has potentially profound ramifications for all attorneys practicing in the state. The author extrapolates a functional definition of the term "offensive personality" and constructs a number of hypothetical situations illustrating that conduct prohibited by the offensive personality statute is potentially broader than past application indicates. The Indian Child Welfare Act Of 1978: A Critical Analysis, Russel Lawrence Barsh

UC Law Journal

In response to an increasing frequency of often unwarranted removals of Indian children from their homes, resulting in a continuing breakup of Indian families, Congress enacted the Indian Child Welfare Act of 1978. The Act was intended to diminish the problem by, among other things, modifying child removal procedures and by providing for greater tribal involvement m the proceedings and placements. This Article analyzes the effectiveness of the Act in achieving the intended goals. The British tribunal system is viewed as an independent extension of the court system with adjudicative powers over a broad range of government activities. This Note proposes a system to control punitive damages, assuring adequate punishment and deterrence while preventing economic destruction.

Legal Malpractice And Compulsory Client Protection, Benjamin Franklin Boyer, Gary Conner

The authors discuss the need for a compulsory professional liability insurance plan for attorneys as a means of protecting members of the public from legal malpractice. The proposed plan would be on a claims-made basis by a public corporation. The authors suggest that such a plan would complete the present professional responsibility scheme, while benefiting both the profession and the public. The authors state that a Professional Liability Fund may be imposed through the inherent power of the court over attorneys or through the police power of the state.

Justice In The Slough Of Equality, Julius Stone

The problem of how best to resolve "reverse discrimination" questions under the equal protection clause is currently receiving much attention. The author closely examines the widely accepted belief that equality is the same thing as justice. He demonstrates that there is no a priori or empirical justification for this identification and rejects it as an analytical touchstone whose usefulness is over. Something more flexible must be created to help define the relationship between "equal treatment' and "justice." Discovery Of Plaintiffs' Financial Situation In Federal Class Actions: Heading 'Em Off At The Passbook, Betty C. Bullock

As part of their attack on Rule 23 class certification, defendants have asserted various theories to support discovery of the representative plaintiffs' financial resources. This Note examines the underlying reasons for these discovery requests and the mixed reactions of the federal courts. The author then advances an approach that balances the legitimate interests of both plaintiffs and defendants while not unduly discouraging class suits.
