China Maritime Report No. 21: Civilian Shipping And Maritime Militia: The Logistics Backbone Of A Taiwan Invasion, Lonnie D. Henley

Most analysts looking at the Chinese military threat to Taiwan conclude that the People’s Liberation Army (PLA) is incapable of invading the island because it lacks the landing ships to transport adequate quantities of troops and equipment across the Taiwan Strait. This report challenges that conventional wisdom, arguing that the PLA intends to meet these requirements by requisitioning civilian vessels operated by members of China’s maritime militia (海上民兵). Three ships designed in the 1930s that fought in the Pacific theater during the early months of America’s involvement in World War II represent three different ship design approaches that continue to create dissonance in the U.S. Navy’s current ship-design processes. States’ actual experience in managing nuclear crises occurred almost entirely prior to the information age. The rule book for nuclear-crisis management in this era of cyber deterrence and cyber war remains to be written. Advanced cyberwar capabilities might interfere with future crisis management, resulting in misperceptions, faulty communications, and hasty judgments.

Using existing assets, it is feasible to lay minefields in the Taiwan Strait to delay any Chinese military movement against Taiwan, providing a crisis-response option more forceful than diplomacy but less risky than kinetic operations. This option must be developed in peacetime to be available to U.S. leaders in a crisis.

Within the land, air, and cyber conflict contexts, the concept of "civilian direct participation in hostilities" has been subject to intense scrutiny, interpretive endeavor, and operational application over the last several decades. There is a risk, however, that interpretations and applications based on this experience may inappropriately permeate the law of naval warfare, where the scope of application of this concept is considerably narrower. The PLA Army’s (PLAA) amphibious units would serve as the core of any joint force charged with invading Taiwan. As a result of the 2017 reforms, the PLAA now possesses six amphibious combined arms brigades distributed across three group armies (the 72nd, 73rd, and 74th). During a cross-strait invasion, these brigades would likely receive support from other elements of the group armies to which they belong. This could include fire support, air defense, air transport, aerial fire support, and electronic warfare/cyber-attack.

Given that cyber technologies have made way for attempts to influence the affairs of other States in novel and unique ways, scholars have turned to the international legal rule which is prima facie most relevant in addressing such meddling; namely, the prohibition on intervention. Moreover, there appears to be quite a wide-ranging consensus in scholarship that the prohibition on intervention applies to a broad range of cyber operations. With the development and greater availability of counter-space capabilities, satellites are becoming a prime target of military threats. However, the legal assessment for the targeting of a satellite requires careful analysis because of its impacts on terrestrial activities and the potential to affect the rights and interests of third parties when their payloads are carried by the targeted satellite. The People’s Liberation Army (PLA) Airborne Corps would likely play an important role in a cross-strait invasion through operations behind enemy lines. During the landing campaign, the Corps would conduct paradrops or landing operations onto Taiwan, facilitated by PLA Air Force (PLAAF) aircraft. Once on island, airborne forces would seize and hold terrain and conduct a variety of operations to support the broader invasion. In recent years, the Corps has reorganized to improve its capability for mechanized maneuver and assault, leveraging the PLAAF’s larger inventories of transport aircraft, particularly the Y-20; improved the sophistication of its training at home; and …

The United States issued a statement on July 13, 2020, outlining the U.S. Position on Maritime Claims in the South China Sea. The statement supplements existing U.S. policy for the South China Sea, making clear that the People’s Republic of China’s claims to offshore resources across most of the South China Sea are unlawful. Still, the revised U.S. policy does not go far enough to contest China's faulty claims in the South China Sea. This article proposes specific issues that the revised U.S. policy should address.

"Cyberspace" is often treated as a new domain of State activity in international legal discourse. This has led to the assumption that for international law to apply to cyber operations carried out by States or non-State actors, "cyber-specific" State practice and opinio juris must be demonstrated. This article challenges that assumption on five different bases. First, it argues that rules of general international law are generally applicable to all domains, areas, or types of State activity. In their interpretation and application to purported new domains, limitations to their scope of application cannot be presumed. Second, this article demonstrates that the …
