Emerging technologies promise to play a transformative role in our society, enabling driverless cars, enhanced accuracy and efficiency in disease mapping, greater and less expensive access to certain consumer services, including consumer financial services. Discussions regarding the role of emerging technologies increasingly center on the development and integration of artificial intelligence technologies or AI-an assemblage of technologies that rely on a variety of computational techniques. Since President Johnson passed the first federal education legislation in the 1960s, lawmakers at both the state and federal level have been searching for effective ways to hold public schools accountable. The 2015 amendments to the Elementary and Secondary Education Act gave states increased flexibility to implement their own innovative accountability measures, and with this newfound authority, Texas passed two laws: House Bill 1842 (HB 1842) in 2015 and Senate Bill 1882 (SB 1882) in 2017. The stringent measures in HB 1842 threaten struggling schools with state takeover if they consistently fail to meet standards, while SB 1882 incentivizes schools …

Psychological Intimate Partner Violence (Ipv) And Child Adjustment In A Context Of Previous Physical Ipv, Tricia Gower
Psychology Theses and Dissertations
Physical and psychological IPV often co-occur, and are both potential risk factors for child adjustment problems; however, their joint relation with child adjustment problems is not well understood. The current study examined whether previous physical IPV augmented the relation between current psychological IPV and child threat appraisals and child internalizing symptoms. Participants were 506 children aged 7-10 (Mage = 8.49; 48% female) and their mothers (Mage = 36.32) recruited from the community. Children reported on IPV between mothers and mothers’ partners, child threat appraisals, and child internalizing symptoms. Mothers reported on child internalizing symptoms. Greening the Desert brings a criminal justice lens to the phenomenon of legal deserts in small, tribal, and rural (STAR) communities—vast areas with few, if any, practicing attorneys. The report explores STAR criminal justice communities and describes strategies and initiatives to green these criminal law deserts. Using case studies, the report offers concrete examples of successful innovations. It also includes cautionary notes about risks that may arise with the implementation of strategies to recruit, train, and retain STAR practitioners.

The COVID-19 pandemic and resulting shutdowns are affecting every aspect of society. The legal profession and the justice system have been profoundly disrupted at precisely the time when there is an unprecedented need for legal services to deal with a host of legal issues generated by the pandemic, including disaster relief, health law, insurance, labor law, criminal justice, domestic violence, and civil rights. The need for lawyers to address these issues is great but the prospect of licensing new lawyers is challenging due to the serious health consequences of administering the bar examination during the pandemic.

Early Intervention By Counsel: A Multi-Site Evaluation Of The Presence Of Counsel At Defendants’ First Appearances In Court, Alisa Pollitz Worden, Andrew L. B. Davies, Reveka V. Shteynberg, Kirstin A. Morgan

Over the past decade, some states have sought to ensure that defendants are provided counsel at their first appearance in court (CAFA). The rationale for this effort is that having an attorney present at the first court hearing, which is often arraignment, will result in judges releasing more low-risk defendants on recognizance or on lower bails. Early access to legal counsel might also result in better prospects for diversion from prosecution, charge reductions before conviction, and less punitive sentences. The CAFA initiatives in the upstate New York counties have been funded by state grants to indigent defense providers. The participating …

In recent years, felon-voter disenfranchisement has received considerable attention from academics, policymakers, and the media. In turn, a number of jurisdictions have eased record-based voter restriction statutes. And while those efforts represent a significant step toward full civic reintegration for those with a felony criminal history, they are far from comprehensive, as they regularly omit citizens with certain types of felony convictions and typically address only one form of civic marginalization. Focusing on recent reform in the area of civic restrictions, this Article suggests that incomplete civic restoration comes with significant consequences that ought to be considered during legislative negotiations. …

Over the past decade, the child welfare system has expanded, with vast public and private resources being spent on the system. Despite this investment, there is scant evidence suggesting a meaningful return on investment. This Article argues that without a change in the values held by the system, increased funding will not address the public health problems of child abuse and neglect.

There is an increasing emphasis in the legal academy, the media, and the popular consciousness on how artificial intelligence and machine learning will change the foundations of legal practice. In concert with these discussions, a critical question needs to be explored—As computer programming learns to adjust itself without explicit human involvement, does machine learning impact the procedural practice of law? Civil procedure, while sensitive to technology, has been slow to adapt to change. The current discussions around algorithms, legal ethics, and expanding legal access through technological tools gravitate around two themes: (1) protection of the integrity of the legal profession and (2) a desire to ensure greater access to legal services. The hype cycle often pits the desire to protect the integrity of the legal profession against the ability to use algorithms to provide greater access to legal services, as though they are mutually exclusive. Much of the U.S. debate on Mexican immigration has focused on low-skilled immigrants, who have composed the largest share of that population, but recent data suggest that the share of college-educated immigrants among recent Mexican arrivals is rising considerably. Texas has long been a gateway for Mexican immigration in part because of proximity and its deep economic ties to Mexico.
As more Mexican immigrants settle in Texas, especially in its metropolitan areas, governments and local communities stand to gain valuable contributions of an increasingly educated work force. Knowing the profile of highly skilled Mexican immigrants can inform policy-making decisions and …

Notwithstanding the political grandstanding and legal regimes put in place to prevent the next Enron, this article explores whether attorney whistleblower provisions provided in the Standards of Professional Con- duct for Attorneys Appearing and Practicing Before the Commission in the Representation of an Issuer and in the Model Rules of Professional Con- duct are effective. When faced with attorney involvement in Enron, Congress passed § 307 of the Sarbanes Oxley Act (Sarbanes), which required the Securities and Exchange Commission (SEC) to amend its standards governing the conduct of attorneys practicing before the SEC. Protecting Children? Assessing The Treatment Of Unaccompanied Minors In The U.S., Chiara Galli

In the summer of 2014, unprecedented numbers of unaccompanied minors fleeing violence in El Salvador, Guatemala and Honduras arrived in the U.S. seeking refuge. Current U.S. immigration law affords certain legal protections to children who migrate alone from non-contiguous countries, allowing them to be initially admitted to the U.S. To avoid deportation and remain in the country long-term, however, they must successfully apply for humanitarian relief from deportation. This interview-based study traces these children’s experiences navigating this legal process and interacting with different branches of the US immigration bureaucracy.

Uniquely positioned in our American democracy, foundations hold private resources they leveraged to promote their private values within our public arena. The independence of foundations, primarily private and family foundations, allows them to exert influence over public policy down to the local delivery of public good and services. An understudied policy area pertains to understanding how philanthropic funding impacts immigration policy and local enforcement. This report focuses on studying how philanthropic funding for immigration services is associated with reducing the identification of deportable immigrants, during Secure Communities. Since 2011, the United States has seen a dramatic increase in the arrival of Central American immigrant women and their children. During the last two years, the US government apprehended more than 100,000 immigrant families, primarily Central American women traveling with their children (US Dept. of Homeland Security, 2015). Evidence suggests that Central American women’s motivations to migrate and experiences during migration are often tied to violence (Cook Heffron, 2015; UN High Commissioner for Refugees, 2015), and yet their experiences after arriving in the US do not always support their rights, recovery or healing.
