“What Kind Of Teacher Are You?”: Critical Communication Pedagogy In Abbott Elementary, India Hagen-Gates
“What Kind Of Teacher Are You?”: Critical Communication Pedagogy In Abbott Elementary, India Hagen-Gates
Kaleidoscope: A Graduate Journal of Qualitative Communication Research
In December 2021, Abbott Elementary debuted their first episode, following a cast of diverse teachers at an underfunded elementary school in Philadelphia. While there is previous research on the importance of tv representation and pedagogical practices in the media, this show presents a unique opportunity for analysis. Using Fassett and Warren’s (2007) commitments of Critical Communication Pedagogy as my main theoretical guide, I argue that Abbott Elementary showcases the ongoing process to improve pedagogy, specifically in the commitments of culture as central, language as constitutive, and reflexivity as essential.
Decision-Making As Communicated Narrative Sense-Making: Resilient Experiences Of Mormon Adoptive Parents, Blake Harms
Decision-Making As Communicated Narrative Sense-Making: Resilient Experiences Of Mormon Adoptive Parents, Blake Harms
Kaleidoscope: A Graduate Journal of Qualitative Communication Research
Adopting a child is a consequential decision with many effects on the wellbeing of individuals and families which is no less true within Mormon contexts. As such, scholarship within decision-making around adoption continues to focus on empirical, rational and other modernist frameworks to account for these vital decisions. In order to more fully account for a wholistic framework of how these decisions are made, this study proposes an narrative approach to decision-making to uncover the lived decision-making experience of Mormon adoptive parents holistically. Mormon adoptive parents were interviewed to understand their decision-making experience as process of communicated narrative sense-making (Koneig-Kellas, …
Becoming The Protagonist: Finding Oneself Through Studying Abroad In Japan, Clara N. Barnhardt
Becoming The Protagonist: Finding Oneself Through Studying Abroad In Japan, Clara N. Barnhardt
Kaleidoscope: A Graduate Journal of Qualitative Communication Research
International experiences, including studying abroad, can impact individuals’ identities in many ways. What is this like in the case of an anime fan studying abroad in Japan for six weeks? What are potential ways in which anime fans can be transformed? Throughout this autoethnography, I make sense of the ways in which I personally navigated and was transformed by studying abroad in Japan. It is my hope that making sense of my journey will allow other anime fans traveling to Japan to make sense of their own adventures.
The Case Of Cronos: A Study Of Familial Resilience And Transnational Political Critique, Nicole Tanquary
The Case Of Cronos: A Study Of Familial Resilience And Transnational Political Critique, Nicole Tanquary
Kaleidoscope: A Graduate Journal of Qualitative Communication Research
Resilience as a trope is often associated with the neoliberal ideal of individualized personal success, an ideal that is frequently used to deny the existence of structural oppression (Phipps, 2014). Analyzing cultural artefacts, however, can offer a reappraisal of how publics understand resilience in relation to neoliberal economic policy. In this paper, I analyze a 1993 film by Guillermo del Toro, titled Cronos, to understand how resilience can be presented as familial rather than individual, as well as the trickiness of using film to critique neoliberalism while under the influence of state agencies. In examining Cronos, I argue that …

Co-Ethnic Voting And The Analysis Of Trust Levels In Nigeria, Ayorinde Olanrewaju
Co-Ethnic Voting And The Analysis Of Trust Levels In Nigeria, Ayorinde Olanrewaju
Research Papers
Hale's (2008) relational theory posits that when less politically relevant ethnic groups experience marginalization and exploitation from the dominant ethnic groups, it creates an orientation in which these groups trust only their co-ethnics in distributing patronage and public goods. To what extent do variations in institutional trust among ethnic groups influence co-ethnic voting behavior? I argue that levels of trust in the president can be understood as one of the conditions under which voters use ethnic identity to decide their vote choice. When trust in a co-ethnic candidate is high, members of an ethnic group will prefer to vote along …

Renewable Energy In Illinois: The Agrivoltaics Contribution, Quin E. Karhoff, A. Bryan Enders, Jessica L. Guarino, Tyler J. Swanson
Southern Illinois University Law Journal
Siting of renewable energy production facilities on agricultural land often engenders conflict at the community level. The desire to preserve productive farmland and protect aesthetic connections to the rural landscape can be a significant impediment to renewable energy development. With respect to solar energy production, agrivoltaics— the colocation of solar power structures and agriculture—is a potential alternative to traditional binary approaches of characterizing land use. As a novel technological and land use strategy, a better understanding of the agrivoltaic policy environment is necessary to actualize implications for rural communities and progress toward renewable energy goals. Illinois, with its abundance in …
The Illinois Medical Studies Act: A Practical Guide To Its Understanding And Application, Marc D. Ginsberg
The Illinois Medical Studies Act: A Practical Guide To Its Understanding And Application, Marc D. Ginsberg
Southern Illinois University Law Journal
Medical negligence lawsuits are fairly considered occupational hazards. Illinois is not a tort reform state; therefore, physicians and hospitals here are rather routinely confronted with this litigation. During the pre-trial discovery process, defendant physicians and hospitals (and non-party discovery respondents) are required to respond to discovery requests seeking information that the respondents may believe is confidential, pursuant to the Illinois Medical Studies Act (MSA). This Article endeavors to explore the legislative history of the MSA and its jurisprudence. The Article also cautions the reader that the MSA is subject to contradictory interpretations by Illinois courts insofar as Illinois does not …
Deepfakes Under Copyright Law—A Necessary Legal Innovation, Scott Lu
Deepfakes Under Copyright Law—A Necessary Legal Innovation, Scott Lu
Southern Illinois University Law Journal
The current landscape of copyright law fails to adequately address the ever-evolving rise of Artificial Intelligence (AI). If left untouched, the legal framework risks falling behind the swift advancements in AI technology and will forever be left in a perpetual state. To address this challenge, copyright law should be amended to grant limited rights to the inventor/commissioner of the work of an AI system to reward them for the fruits of their labor. Alternative approaches, such as assigning rights to the AI itself or placing the work directly into the public domain, present their own shortcomings. Nevertheless, these methods fail …
Walking Billboards: The Copyright Landscape Of Tattoos In Professional Athletics, Taylor Ingram
Walking Billboards: The Copyright Landscape Of Tattoos In Professional Athletics, Taylor Ingram
Southern Illinois University Law Journal
Though tattoos have traditionally been viewed negatively, in the last decade, tattoos have become a popular form of self-expression. Thus, the increasing prevalence of athletes adorned with body art has sparked legal debate on tattoo ownership, protection, and commercialization. This Note briefly outlines tattooing and copyright law histories and provides an overview of copyright law today. As copyright claims by tattoo artists have, until recently, been widely settled out of court, this Note will provide an analysis of the only case to proceed to a jury trial. Based on the above, this Note asserts that tattoos are copyrightable. It further …
Evaluating Malaysia’S Fake News Laws Through The Lens Of International Human Rights Standards, Bevis Hsin-Yu Chen
Evaluating Malaysia’S Fake News Laws Through The Lens Of International Human Rights Standards, Bevis Hsin-Yu Chen
Southern Illinois University Law Journal
Recently, the proliferation of fake news online has raised significant alarm globally, prompting numerous governments to take legal action to address the issue. In 2018 and 2021, Malaysia enacted two distinct laws to address the issue of fake news: the Anti-Fake News Act 2018 and the Emergency (Essential Powers) (No. 2) Ordinance 2021. These two laws have garnered significant attention and criticism, particularly regarding their negative impact on freedom of speech. This Article employs the standards of freedom of expression outlined in the International Covenant on Civil and Political Rights to assess Malaysia's fake news laws regarding legality, necessity, and …

Pic-Wrap: A Picture Is Worth A Thousand Terms In Online Contracting, Emily Smoot
Southern Illinois University Law Journal
Modern online contracts—often categorized as click-wrap, scroll-wrap, and browse-wrap agreements—are rarely read by users. Even if users attempt to read them, the use of long paragraphs and complex language creates a barrier for the average user to understand what they are agreeing to. Issues surrounding online contract formation have sparked litigation in recent years to determine the enforceability of these agreements. The current standard used by courts to determine the enforceability of online contact terms is whether the design of the interface would put the reasonably prudent user on inquiry notice of their existence. The standard of adequate notice has …
Shareholder Proposals And Social Policy, Creighton R. Meland Jr.
Shareholder Proposals And Social Policy, Creighton R. Meland Jr.
Southern Illinois University Law Journal
Social policy’s role in shareholder proposals is the focal point of this Article. The SEC sets standards for the social policy issues allowed to be submitted to a shareholder vote but will not define social policy or describe the agency’s methods. The SEC determines whether a proposal appears on a range of environmental and social matters, such as climate change, human rights, and corporate political activities. Generally, shareholder proposals related to a company’s ordinary business operations are matters reserved for the board of directors. However, when these same matters trigger SEC-determined social policy questions, they must often be put to …
A Comparative Analysis Of Mental Health Professionals’ Duty To Warn Across The United States: The Need For Clearly Defined Laws In Light Of Recent Mass Shootings, Alexis M. Hulfachor
A Comparative Analysis Of Mental Health Professionals’ Duty To Warn Across The United States: The Need For Clearly Defined Laws In Light Of Recent Mass Shootings, Alexis M. Hulfachor
Southern Illinois University Law Journal
As rates of mass shootings continue to rise in the United States, the public and legislatures have searched for solutions to curb such violence. Many public officials have turned to mental health professionals’ duty to warn as a way to prevent acts of mass violence in the future. In light of the critical role mental health professionals play in preventing harm to the public, this Note addresses whether clearly defined duty-to-warn laws could help mental health professionals identify serious threats and interrupt acts of violence in the future. This Note explores the various types of duty-to-warn statutes across the United …

Feeding The Cats: The Corruption Conundrum In The Failed Arab Spring-Egypt, Mohamed 'Arafa
Southern Illinois University Law Journal
The Egyptian civil society, across generational, religious, gender, and economic lines and without a charismatic leader, has organized itself at the grassroots level, evidencing the people's power in the face of a strong regime. Public order, security, and stability have deteriorated during the past two decades, with increased crime rates and other forms of abuses of power by individuals (e.g., thugs and small criminal bands), which the police have left somewhat unchecked. The people hold the military in high esteem because, in the last forty years, it has never acted against the general public. To prevent manipulation during the investigations …

Power Shift: Evaluating Corporate Bylaws That Add Fee-Shifting Provisions After The Decision In Atp Tour Inc. V. Deutscher Tennis Bund, 91 A.3d 554 (Del. 2014), Alixander Pishghadamian
Southern Illinois University Law Journal
Fee-shifting provisions are controversial because they shift the costs of litigation to a non-prevailing party, contrary to the widely accepted American Rule of litigation in which parties generally pay their own attorney’s fees and costs. In a case of first impression, the Delaware Supreme Court had to determine whether a fee-shifting provision within a non-stock corporation’s bylaws, also known as a fee-shifting bylaw, was valid and enforceable. In ATP Tour v. Deutscher Tennis Bund, the Delaware Supreme Court held that fee-shifting bylaws are permissible under Delaware law because a corporation’s bylaws are presumed to be valid. This Note argues that …

Can Public Servants Retire?: Analyzing The Illinois Supreme Court’S Decision In Kanerva V. Weems, 2014 Il 115811, 13 N.E.3d 1228, Adam M. Riley
Southern Illinois University Law Journal
In response to the State’s failure to consistently fund its pension systems, delegates to Illinois’ Sixth Constitutional Convention adopted the pension protection clause of the 1970 Illinois Constitution, which constitutionally protects the state employee pension benefits. In 2012, during a period of serious financial hardship, the General Assembly passed legislation eliminating the state’s requirement to pay health insurance subsidies to members of a state retirement system. Members of the retirement systems challenged the constitutionality of the Act, and in Kanerva v. Weems, the Illinois Supreme Court held that health insurance subsidies are “benefits” under the pension protection clause, and therefore …
All Is Fair In Law And Warfare In The Ukrainian Crisis: A Look At The Growing Increase Of Economic Sanctions As A Weapon Of War And The Effects On The International Community, Nicholas Martin
Southern Illinois University Law Journal
The Russian parliament authorized the use of military force in Ukraine in March, 2014, ostensibly to protect “Russian interests,” and soon thereafter, Russia seized the entire Crimean region from Ukraine and annexed it into the Russian Federation. The United States and Europe have refused military intervention in the region, instead relying on legal measures, or “lawfare,” including economic sanctions against both Russian nationals and Russian businesses, including government entities. Economic sanctions, which have become the United States’ foreign policy tool of choice, often have unintended consequences. This comment acknowledges the advantages of economic sanctions, while explaining the frequent unintended consequences …
Religious Liberty Vs. Discrimination: Striking A Balance When Business Owners Refuse Service To Same-Sex Couples Due To Religious Beliefs, Alex Riley
Southern Illinois University Law Journal
Same-sex marriage is now legal in all fifty states, which has created a same-sex wedding industry. Some business owners, who do not believe in discrimination based on sexual orientation, nevertheless have religious beliefs that forbid them from participating in same-sex marriage ceremonies and celebrations by providing goods and services for those ceremonies and celebrations. This comment argues for passage of a statute which adequately protects business owners who have religious objections to same-sex marriage, but does not provide for blanket discrimination against the LGBT community. The comment argues this goal is feasible if the statute is narrowly tailored to encompass …
Why U.S. States Need Pension Waiver Credits, Randall Johnson
Why U.S. States Need Pension Waiver Credits, Randall Johnson
Southern Illinois University Law Journal
This article identifies a novel approach to public pension reform, which takes into account existing political and legal constraints. It does its work in at least four ways. First, the article encourages better use of public sector resources by calling for the elimination of public pension inefficiencies. Next, it explains how to limit public pension inefficiencies, at least on a prospective basis, by moving away from defined-benefit pension plans. Third, the article describes one way to move beyond defined-benefit pension plans through the creation of a new tax expenditure program, specifically, a Pension Waiver Credits Program. Finally, it explains how …
The Role Of Apologies In Labor Arbitration Outcomes, Michele Hoyman, Lamont Stallworth, David Kershaw
The Role Of Apologies In Labor Arbitration Outcomes, Michele Hoyman, Lamont Stallworth, David Kershaw
Southern Illinois University Law Journal
This article considers the extent to which apologies provided by grievants affect the rulings of labor arbitrators in discipline and discharge cases. We used an experimental survey design which asked respondents to render awards on hypothetical arbitration cases. Hypothetical cases varied across four variables of importance: (1) the (perceived) sincerity of an apology, (2) the timing of the apology, (3) the issue in the case—sexual harassment, insubordination due to refusal to work, and insubordination due to profanity, and (4) the seniority of the grievant. All members of the National Academy of Arbitrators were surveyed, which provided a total of 177 …
To The Dictionary And Beyond! The Personification Of Corporations In Burwell V. Hobby Lobby Stores, Inc., 134 S. Ct. 2751 (2014), Alex Riley
Southern Illinois University Law Journal
In March of 2010, President Obama signed the Patient Protection and Affordable Care Act, which provides that group health plans must provide coverage for certain forms of preventative care and screenings for women. Regulations promulgated pursuant to this provision, commonly known as the contraceptive mandate, required coverage for all FDA-approved contraceptive methods without cost sharing. Two closely held corporations sued the U.S. Department of Health and Human Services under the Religious Freedom Restoration Act (RFRA). The suit was based on the owners’ opposition to abortion, which was rooted in their sincerely held religious beliefs. The plaintiffs sought to enjoin enforcement …
Only [_] Can Judge: Analyzing Which Courts Have Jurisdiction Over Isis, Andrew Solis
Only [_] Can Judge: Analyzing Which Courts Have Jurisdiction Over Isis, Andrew Solis
Southern Illinois University Law Journal
While many world leaders are developing plans to defeat ISIS, some thought should be given to what structures will be in place to manage the aftermath. Defeating ISIS will likely require international cooperation and there will be a need for a judicial structure to try ISIS war criminals that is acceptable to the international community. In preparing for future judicial structures, leaders should consider cost, efficiency, legitimacy, and scope of the desired judicial structure. Past and present international courts provide important case studies for which type of court system would best try ISIS war criminals. Some courts, like the ICC …

Nsa Metadata Collection & Storage: An Internment Camp For Citizens' "Effects", David J. Robinson, Julia Kaye Wykoff
Southern Illinois University Law Journal
The Fourth Amendment to the United States Constitution provides the people the right to be “secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,” which means the people have the right to freedom from warrantless government intrusion, or trespass, into their persons, houses, papers, and effects. Most people are familiar with persons, houses and papers, but the term “effects” is unfamiliar to many. The United States Supreme Court recently explained that personal property, such as one’s vehicle, constitutes an effect under the Fourth Amendment. The government of the United States has not always lived up to …
Changing Residency For Illinois Tax Purposes, Ronald Z. Domsky
Changing Residency For Illinois Tax Purposes, Ronald Z. Domsky
Southern Illinois University Law Journal
The State of Illinois assesses a tax on every individual who has the “privilege of earning or receiving income in or as a resident of this State.” Three categories of people are subject to the taxing statute: those who are live in another state but receive income from specified sources in Illinois, those who become or cease to be a resident during a taxable year, and those who are considered residents of Illinois. The term resident includes people who are in the state during a taxable year for a purpose that is not temporary or transitory and those who are …

During the Qajar era, photography was exclusively in the hands of the king and the courtiers. After many years, it first made its way into the studios of the capital and then into studios in other major cities. The revolution, the war, and the subsequent years brought about various social and cultural conditions in Iran. Following the emergence of new intellectual and ideological movements, artistic trends also underwent changes, leading to the teaching of various art disciplines, including photography, in art universities and the pursuit of artistic photography in a new form. As a result of these changes, women were …
New Electrochemical Platforms For The Detection Of Neurodegenerative Disease Biomarkers, Omair Adil
New Electrochemical Platforms For The Detection Of Neurodegenerative Disease Biomarkers, Omair Adil
Dissertations
Neurodegenerative disease (ND) is a collection of progressive disorders which is marked by gradual degeneration of the central nervous system (CNS). The damage of brain and nervous system causes diminishing of brain and nerve cell which lead to body dysfunction, organ failure, paralysis and ultimately death of a patient. Neurodegenerative diseases affect millions of people worldwide. United States of America is among highest ND prevailing disease countries. Yet the number of cases is underreported because of the complexity of disease diagnosis. With the increase in aging population the rate of ND cases is also increasing. Another important concern is that …
A Constructivist Grounded Theory Exploration Of Intergenerational Trauma Among Lgbtq+ Bipoc Individuals, Satveer Kler
A Constructivist Grounded Theory Exploration Of Intergenerational Trauma Among Lgbtq+ Bipoc Individuals, Satveer Kler
Dissertations
Many scholars have argued that existing conceptualizations of trauma such as the Diagnostic and Statistical Manual of Mental Disorders (5th Ed.; DSM-5) conceptualization are inapplicable for individuals of marginalized communities. Individuals of marginalized communities may experience historical trauma, racial trauma, identity-related trauma, or collective trauma. Moreover, the effects of these forms of trauma may persist throughout different generations via biological transmission (e.g., epigenetics) or via interpersonal transmission (e.g., emotion socialization, cultural socialization, attachment, communication styles, behavioral socialization). The generational effects of these forms of trauma are referred to as intergenerational trauma. There has been a paucity of empirical explorations of …
