There are few doctrines in the English common law of contract that have raised as much theoretical discussion as the doctrine of frustration. The present article attempts a reappraisal of the doctrine, its central thesis being that many of the major controversies centring on the doctrine have been unnecessary as they stem from an omission to view the doctrine in a holistic fashion. Indeed, it is submitted that a more coherent view must proceed from a theoretical reappraisal, which reappraisal would, ironically, lead to a more cogent practical application of the doctrine itself. The sampling technique called controlled selection was f'irst described by Goodman and Kish (1950). It was found to be a very useful sampling technique among practicing survey samplers, especially in selecting first-stage units in multi-stage sampling. Hess, Riedel and Fitzpatrick (1961, 1975) have given a simple illustration on how it can be implemented in the sampling of hospitals in the state of Michigan. In this paper, we show how the Groves-Hess algorithm can be improved and how further controls which are useful to survey practitioners can be built into the algorithm. What is the conservative committed to? According to some, the answer is quite simply nothing. Certainly, the argument goes, they are not committed to individual freedom: they defend only order, morality, religion and virtue - all 'traditionally' conceived. So it seemed to many classical liberals, libertarians and 'Old Whigs' in the early 1960s when they denounced traditionalists in the name of individual liberty, private property and reason. And so it also seems to many classical liberals and libertarians today.

Hayek's essay 'Why I am not a Concervative' first appeared in 1960 as the final chapter of his treatise, The Constitution of Liberty. Strictly speaking, it was not really a concluding chapter; it was presented as a 'postscript' to the main text-a text whose concern was to articulate and elaborate upon the fundamental principles of classical liberalism. In this postscript Hayek attempted a task which the main treatise did not take up: to explain how the principles of classical liberalism set it apart from the conservatism with which it seemed to have so much in common.

Measurement Of The Tau Lepton Electronic Branching Fraction, D. Akerib, M. Thulasidas

The tau lepton electron branching fraction has been measured with the CLEO II detector at the Cornell Electron Storage Ring as Be=0.1749±0.0014±0.0022, with the first error statistical and the second systematic. The measurement involves counting electron-positron annihilation events in which both taus decay to electrons, and normalizing to the number of tau-pair decays expected from the measured luminosity. Detected photons in these events constitute a definitive observation of tau decay radiation.

Using data accumulated by the CLEO I detector operating at the Cornell Electron Storage Ring, we have measured the ratio R=Γ(τ→eν¯eντ)Γ1 where Γ1 is the τ decay rate to final states with one charged particle. We find R=0.2231±0.0044±0.0073 where the first error is statistical and the second is systematic. Together with the measured topological one-charged-particle branching fraction, this yields the branching fraction of the τ lepton to electrons, Be=0.192±0.004±0.006.

A number of training methods has been used within the offshore industry to impart safety knowledge and safe operating skills. In this paper a Knowledge-Based Safety Training architecture is proposed. The architecture uses both expert system and hypertext methods and is also applicable to plants other than offshore platforms. Special attention is given to the types of knowledge dealt with in safety training and how to represent this knowledge and teach it using various teaching strategies.

Event-Study Methodology Under Conditions Of Event-Induced Variance, Ekkehart Boehmer, Jim Masumeci, Annette B. Poulsen

Many authors have identified the hazards of ignoring event-induced variance in event studies. To determine the practical extent of the problem, we simulate an event with stochastic effects. We find that when an event causes even minor increases in variance, the most commonly-used methods reject the null hypothesis of zero average abnormal return too frequently when it is true, although they are reasonably powerful when it is false. We demonstrate that a simple adjustment to the cross-sectional techniques produces appropriate rejection rates when the null is true and equally powerful tests when it is false.

This paper develops a two-country Heckscher-Ohlin model with endogenous equilibrium involuntary unemployment to examine the question: What is the effect of free trade on the equilibrium rates of unemployment in the labor abundant and labor-scarce countries? It is shown that free trade leads to a decline in the equilibrium rate of unemployment in the labor-abundant country but to a rise in unemployment in the labor-scarce country.

The recent decision by Mr John Mowbray QC in Micklefield v SAC Technology Ltd brings into focus the thorny problems inherent within, first, the continuing uncertainty surrounding termination of employment contracts and, secondly, the much more general issue as to the status as well as application of the proposition that a contracting party ought not to be allowed to take advantage of his own wrong. There was a third issue taken in the case with regard to the applicability of the Unfair Contract Terms Act 1977 which will be briefly commented upon.

Relational query languages like SQL and QUEL require the users to understand the complex database structure. This is a burden on end users, especially novice end users who access the database on a casual and infrequent basis. To alleviate the need to know the logical database organization, this paper proposes the use of a semantic data model, known as the Enhanced Entity-Relationship (EER) model, as a front-end to the relational systems. A formal, high-level Visual Knowledge Query Language (VKQL) has also been designed for this interface. This research hypothesizes important individual differences in response to promotions and tests for them using a cross-sectional multinomial logit choice model. Our hypotheses suggest interactions between individual brand preference and the effects of current promotion and past promotional purchase. To test for these interactions, we introduce a new method of measuring brand preference from past purchase data. The new method seeks to incorporate competitive purchase conditions as modifiers to observed brand purchase behavior in estimating consumer brand preference. A neural network expert system called adaptive connectionist expert system (ACES) which will learn adaptively from past experience is described. ACES is based on the neural logic network, which is capable of doing both pattern processing and logical inferencing. The authors discuss two strategies, pattern matching ACES and rule inferencing ACES. The pattern matching ACES makes use of past examples to construct its neural logic network and fine-tunes itself adaptively during its use by further examples supplied. Perceptions of environmental uncertainty and organizational control influence strategic behavior. As national culture influences these perceptions we expect to find cultural differences in interpretation and response to strategic issues. Given a case describing an issue concerning deregulation of the U.S. banking industry, managers completed questionnaires rating interpretations and responses to that issue. National culture was found to influence interpretation and responses. In particular, Latin European managers when compared with other managers were more likely to interpret the issue as a crisis and as a threat. Latin Europeans were also more likely to recommend proactive behavior. This study indicates that different …

This paper examines the nature, composition and determinants of Singapore's early stage technology exports. The pattern of these exports reflects the quite unique mix of policy and institutional features in Singapore's environment - remarkably high growth, very open economy, rapid structural change, particularly intense economic relations with neighboring Southeast Asian nations, and a pervasive and paternalistic state role. The bases of Singapore's comparative advantage in these service exports are identified, and some general implications from its experience are analyzed.

An efficient semantic query optimization algorithm is proposed, in which all possible transformations are tentatively applied to the query. Instead of physically modifying the query, the transformation process classifies the predicates into imperative, optional or redundant. At the end of the transformation process, all the imperative predicates are retained while the redundant predicates are eliminated. Optional predicates are retrained or discarded based on the estimated cost/benefit of retaining them. The issue of the grouping of semantic constraints to reduce the overhead of retrieving constraints and checking whether each constraint is relevant to the current query is also addressed. This paper investigates empirically the term structure of interest rates in the Singapore Asian Dollar Market. We consider extended versions of the ARCH-M model of Engle, Lilien, and Robins (1987). The extended models permit autocorrelation, skewness and leptokurtosis in the residuals. The robustness of the empirical tests with respect to alternative specifications of the ARCH process is examined. It turns out that there is significant time-varying term premium, and this conclusion is independent of the hypothesized ARCH model.

In 1818, the Governor of the Chinese province of Shansi reported the case of Chan Lin who, while gatekeeper for the district magistrate, maintained "external criminal connections". Using his position he endeavoured to get a money changer to accept for exchange more than 300 ounces of sub-standard silver. Upon being rebuffed he took steps to have the money changer locked up. His work is admirable in its technical details as well as in its use for the practitioner. I wish to add but a few brief comments about 2 chronic difficulties with the enforcement of force majeure clauses.
