Normative Dynamics Of Competition Laws, Piyabutr Bunaramrueang Dec 2009

Normative Dynamics Of Competition Laws, Piyabutr Bunaramrueang

piyabutr bunaramrueang

This article aims at providing a review on normative dynamics of competition laws. Although legal norms seem to be very stable, those norms governing economic activities are changing relatively fast. It is therefore an attempt to illustrate dynamic quality of laws by using competition laws as a major example of laws governing economic activities. I would like to discuss mainly over U.S. antitrust laws as the major model of competition laws, perhaps, for all other countries pursuing economic growth of free market. The dynamic quality of U.S. antitrust laws is essentially derived from its legal tradition that invites legal reasoning …

Breast And Cervical Cancer Screening Among Asian American Women And Latinas: Does Race=Ethnicity Matter?, Pa Der Vang, Hee Yun Lee, Melissa Lundquist Dec 2009

Breast And Cervical Cancer Screening Among Asian American Women And Latinas: Does Race=Ethnicity Matter?, Pa Der Vang, Hee Yun Lee, Melissa Lundquist

Pa Der Vang, PhD, MSW, LICSW

Background: Ethnic minorities are frequently considered as one homogeneous group in research, and this trend
is particularly true for Asian Americans. This article seeks to uncover the intragroup differences in cancer
screening behavior among subgroups of Asian American women by disaggregating them into six subgroups.
The subgroups were compared with non-Latina white women to examine differences in breast and cancer
screening rates and relevant factors associated with receiving these screenings.
Methods: Three-year merged data from the 2001, 2003, and 2005 California Health Interview Survey (CHIS)
were used to investigate the subgroup differences. Samples for the current study were restricted to …

Forensic Analysis Of A Playstation 3 Console, Scott Conrad, Greg Dorn, Philip Craiger Dec 2009

Forensic Analysis Of A Playstation 3 Console, Scott Conrad, Greg Dorn, Philip Craiger

J. Philip Craiger, Ph.D.

The Sony PlayStation 3 (PS3) is a powerful gaming console that supports Internet-related activities, local file storage and the playing of Blu-ray movies. The PS3 also allows users to partition and install a secondary operating system on the hard drive. This “desktop-like” functionality along with the encryption of the primary hard drive containing the gaming software raises significant issues related to the forensic analysis of PS3 systems. This paper discusses the PS3 architecture and behavior, and provides recommendations for conducting forensic investigations of PS3 systems.

Chapter 7 - Restricting Fair Use To Save The News, Ryan T. Holte

Prof. Ryan T. Holte

Ryan T. Holte in “Restricting Fair Use to Save the News: A Proposed Change in Copyright Law to Bring More Profit to News Reporting” examines the present condition of the media and the economic and public policies behind protecting news. He further discusses current means of protecting information through copyright and misappropriation law, before proposing a change in the Copyright Act to better allow the news industry to reap profits from news reporting.

Revealing Iberian Woodcraft: Conserved Wooden Artefacts From South-East Spain, Pablo Rosser Dec 2009

Revealing Iberian Woodcraft: Conserved Wooden Artefacts From South-East Spain, Pablo Rosser

pablo rosser

Yolanda Carrion & Pablo Rosser Six wells at Tossal de les Basses in Spain captured a large assemblage of Iberian woodworking debris. The authors’ analysis distinguishes a wide variety of boxes, handles, staves, pegs and joinery made in different and appropriate types of wood, some – like cypress – imported from some distance away. We have here a glimpse of a sophisticated and little known industry of the fourth century BC.

Production Of Jet And Diesel Fuel Range Alkanes From Waste Hemicellulose-Derived Aqueous Solutions, George W. Huber, R. Xing, A. V. Subrahmanyam, H. Olcay, W. Qi, G. P. Van Walsum, H. P. Pendse

George W. Huber

In this paper we report a novel four-step process for the production of jet and diesel fuel range alkanes from hemicellulose extracts derived from northeastern hardwood trees. The extract is representative of a byproduct that could be produced by wood-processing industries such as biomass boilers or pulp mills in the northeastern U.S. The hemicellulose extract tested in this study contained mainly xylose oligomers (21.2 g/l xylose after the acid hydrolysis) as well as 0.31 g/l glucose, 0.91 g/l arabinose, 0.2 g/l lactic acid, 2.39 g/l acetic acid, 0.31 g/l formic acid, and other minor products. The first step in this …

Human Rights, Anti-Discrimination And Social Security Benefits: Recent Uk Case Law, Mel Cousins Dec 2009

Human Rights, Anti-Discrimination And Social Security Benefits: Recent Uk Case Law, Mel Cousins

Mel Cousins

Since the adoption of the Human Rights Act 1998, challenges to UK social security law on the basis of the European Convention on Human Rights have become common - especially under the anti-discrimination provisions of Article 14. However, few of these challenges have been successful and, in general, the English courts have shown a poor understanding of the principles of human rights law. The recent decisions of the European Court of Human Rights in Stec (2005) 41 EHRR SE 295 and the House of Lords in RJM (2008) UKHL 63 have clarified important issues including the material scope of the …

Racial/Ethnic Composition, Social Disorganization, And Offsite Alcohol Availability In San Diego County, California, Michael T. French, Amie L. Nielsen, Terrence D. Hill, Monique N. Hernandez Dec 2009

Racial/Ethnic Composition, Social Disorganization, And Offsite Alcohol Availability In San Diego County, California, Michael T. French, Amie L. Nielsen, Terrence D. Hill, Monique N. Hernandez

Michael T. French

We draw upon social disorganization theory to examine the effects of community characteristics on the distribution of offsite alcohol outlets in San Diego County, California. Of particular interest is whether alcohol availability varies according to neighborhood racial/ethnic composition once measures of social disorganization (socioeconomic disadvantage, residential instability, and racial/ethnic heterogeneity) are controlled. Using data from the 1990 Census and 1993 alcohol license reports, we estimate a series of negative binomial regression models with corrections for spatial autocorrelation. The results show that percent Asian is associated with lower offsite alcohol outlet density. Once socioeconomic disadvantage is controlled, percent Latino is related …

In Defense Of Intellectual Property Anxiety: A Response To Professor Fagundes, Aaron K. Perzanowski Dec 2009

In Defense Of Intellectual Property Anxiety: A Response To Professor Fagundes, Aaron K. Perzanowski

Aaron K. Perzanowski

In this Response to Professor Fagundes’s Property Rhetoric and the Public Domain, Professor Perzanowski expresses skepticism about two assumptions underlying the argument for embracing property rhetoric to promote the public domain. This argument assumes, first, public recognition of social discourse theory as an account of property and, second, rhetorical advantages of social discourse theory that are comparable to those of more familiar notions of private property. Perzanowski concludes that the simple intuitive appeal of Blackstonian property cautions against styling the struggle for balanced copyright and patent policy as a debate over competing property interests.

An Empirical Study Of The Use Of Mixed Methods In Doctor Of Business Administration (Dba) Curriculum Within An Australian University, Roslyn Cameron, Peter Miller Dec 2009

An Empirical Study Of The Use Of Mixed Methods In Doctor Of Business Administration (Dba) Curriculum Within An Australian University, Roslyn Cameron, Peter Miller

Peter Miller

Business disciplines have traditionally been undertaken within the quantitative paradigm however, mixed methods approaches have recently been introduced and utilised within applied business research. The purpose of this paper is to map the experience of introducing the teaching of mixed research methods in an international Doctor of Business Administration (DBA) curriculum within an Australian University. This paper begins with a professional reflective piece on the experience of introducing the teaching of mixed methods. This is followed by a brief overview of the literature on mixed methods as a third methodological movement. The paper will then present empirical data into the …

Popularizing Achievement: The Role Of An Hbcu In Supporting Academic Success For Underprepared Black Males, Robert T. Palmer, Phd, Ryan J. Davis, Dina C. Maramba, Phd

Robert T. Palmer, PhD

Both predominantly White institutions (PWIs) and historically Black colleges and universities (HBCUs) are experiencing low academic persistence rates among Black males. While researchers have focused on factors facilitating the retention and persistence for Black males at PWIs, a paucity of contemporary research has focused on the academic and social experiences of Black males at HBCUs. We used in-depth interview methods to investigate the academic and social experiences of 11 Black males, who entered a public HBCU through its remedial or developmental studies program and persisted to graduation. Although several themes emerged from this study, special attention was placed on the …

From Artifacts To Aggregations: Modeling Scientific Life Cycles On The Semantic Web, Alberto Pepe, Matthew Mayernik, Christine Borgman, Herbert Van De Sompel Jul 2009

From Artifacts To Aggregations: Modeling Scientific Life Cycles On The Semantic Web, Alberto Pepe, Matthew Mayernik, Christine Borgman, Herbert Van De Sompel

Alberto Pepe

In the process of scientific research, many information objects are generated, all of which may remain valuable indefinitely. However, artifacts such as instrument data and associated calibration information may have little value in isolation; their meaning is derived from their relationships to each other. Individual artifacts are best represented as components of a life cycle that is specific to a scientific research domain or project. Current cataloging practices do not describe objects at a sufficient level of granularity nor do they offer the globally persistent identifiers necessary to discover and manage scholarly products with World Wide Web standards. The Open …
