Law And Societies, Peter Fitzpatrick Jan 1984

Law And Societies, Peter Fitzpatrick

Osgoode Hall Law Journal

Professor Fitzpatrick offers an examination of bourgeois legality as the concrete embodiment of modern law. Citing examples from the prison system and the workplace, he finds that modern law exists in certain relations of opposition and support with other social forms. From these relations, certain modes of convergence and separation between law and other social forms are identified and explored. To test the utility of this analysis, Fitzpatrick provides an extended application to traditional scholarship about the nature of law and its relation to society. The central focus in this enquiry is the idea of integral plurality as a vehicle …

Legal Aid In The United States: The Professionalization And Politicization Of Legal Services In The 1980'S, Carrie Menkel-Meadow Jan 1984

Legal Aid In The United States: The Professionalization And Politicization Of Legal Services In The 1980'S, Carrie Menkel-Meadow

Osgoode Hall Law Journal

The provision of legal assistance for the poor has mirrored, since its first appearance in 1880, the social and political attitudes of the American people and their governments. Each of the four distinct periods, into which the history of legal aid in the United States can be divided, reflects a fundamental change in these attitudes. This paper analyzes these periods, the reasons for the change and the type of delivery system that emerged in each. The fourth of these major attitudinal shifts has only recently emerged. Concern is expressed about the future of the concept of legal aid, particularly in …

Community Legal Clinics In Ontario, Mary Jane Mossman Jan 1983

Community Legal Clinics In Ontario, Mary Jane Mossman

Articles & Book Chapters

Ontario has a system of fully funded yet independent network of community law clinics like those advocated in Rees' paper. Professor Mossman explores the forces that led to the establishment of the community clinics, their relationships to the judicare system and the purposes behind the government's assumption of responsibility for funding and defunding clinics: service to low income people, community involvement and representation and independence from funding sources. While Rees seems to suggest that government funded community clinics would automatically further these purposes, Mossman argues that scope of service, community involvement and funding decision processes must be structured very carefully …

Community Legal Clinics In Ontario: 1980, A Data Survey, Frederick H. Zemans Jan 1981

Community Legal Clinics In Ontario: 1980, A Data Survey, Frederick H. Zemans

Articles & Book Chapters

Community legal clinics have been in existence in Ontario for a decade. By employing a modified version of the questionnaire used in a similar English study in 1975, Professor Zemans has obtained a comprehensive data survey of all the community based clinics funded by the Ontario Legal Aid Plan. The data charts are preceded by an explanatory text which summarizes the data and draws comparisons with the English survey results and with the legal services movement in the United States. It is intended that this survey should provide the data base for a larger project which will study Ontario community …
