Recent Florida Capital Decisions, Gary Caldwell

Nova Law Review

The death penalty applies to two offenses under Florida law; first

degree murder' and capital drug trafficking.2 Although Florida law also

defines sexual battery of a minor as a capital offense, the Florida Supreme

Court has ruled that the death penalty does not apply to that

offense.

Payne V. Tennessee: The Arbitrary Imposition Of The Death Penalty And A Review Of Florida Case Law Since: Booth V. Maryland, Michael P. Koller

Nova Law Review

In Booth v. Maryland,1 the United States Supreme Court decided

that evidence relating to a victim's character and the extent of harm

caused to the victim's family and community was inadmissible to deter-

mine whether a defendant convicted of a capital crime should be put to

death. The majority in Booth, while empathizing with the grief of a

victim's family, recognized the potential danger such evidence has on a

jury to sentence defendants to death based on such arbitrary factors as

what kind of person the victim was and the unforeseeable harm the

victim's death had on others.

concerned with law enforcement and punishment.

The secondary goal was to adjust the curriculum to meet the learning style of the slow learner. Subgoals included decreasing absenteeism, detention, and suspension. Increased parental involvement in school functions and conferences, as well as peer acceptance and approval were also objectives of the practicum.

Abraham S. Fischler College of Education ETD Archive

Campus crime is an Important issue within the State University System of Florida. While the publication of campus crime data at Florida universities has taken place for almost twenty years, there has been an increase in public attention to this a. a, due primarily to media attention.
