Symposium: The Future Of Law And Development, Part Iii, Kevin Davis, Adam Feibelman, Brian Z. Tamanaha, Yuka Kaneko Nov 2009

Symposium: The Future Of Law And Development, Part Iii, Kevin Davis, Adam Feibelman, Brian Z. Tamanaha, Yuka Kaneko

NULR Online

I would like to take up Anna Gelpern’s invitation to define the study of Law and Development broadly and to reject the presumption that the inquiry will focus narrowly on the law-related projects of bilateral aid agencies and international organizations.

I am interested in the relationship between law on the one hand and, on the other hand, development (however defined), and it is not clear to me that externally directed “Law and Development” projects are always central to understanding that relationship. (Isn’t that a reasonable inference to draw from all of the studies that question the impact of those projects?) …

Symposium: The Future Of Law And Development, Part Ii, Mariana Prado, Susan D. Franck, John Cioffi

NULR Online

My comments will be mostly connected to Tom’s third question, relating to the future, and I would like to start by responding to Salil Mehra. I generally agree that there is an excessive focus on replicable “tools” and “best practices” in Law and Development studies, but I think there are a lot of questions to be asked regarding Mehra’s suggestion that the way forward involves addressing embedded cultural practices and institutions. In fact, there are currently a number of scholars (myself included) emphasizing the importance of looking at the interaction between so-called informal institutions (such as cultural practices, social norms, …

The Language Of Consent In Police Encounters, Janice Nadler, J.D. Trout Jan 2009

The Language Of Consent In Police Encounters, Janice Nadler, J.D. Trout

Faculty Working Papers

In this chapter, we examine the nature of conversations in citizen-police encounters in which police seek to conduct a search based on the citizen's consent. We argue that when police officers ask a person if they can search, citizens often feel enormous pressure to say yes. But judges routinely ignore these pressures, choosing instead to spotlight the politeness and restraint of the officers' language and demeanor. Courts often analyze the language of police encounters as if the conversation has an obvious, context-free meaning. The pragmatic features of language influence behavior, but courts routinely ignore or deny this fact. Instead, current …

Is Work The Only Thing That Pays? The Guaranteed Income And Other Alternative Anti-Poverty Policies In Historical Perspective, Felicia Kornbluh Jan 2009

Is Work The Only Thing That Pays? The Guaranteed Income And Other Alternative Anti-Poverty Policies In Historical Perspective, Felicia Kornbluh

Northwestern Journal of Law & Social Policy

This paper examines the historical alternatives to welfare reform, namely the guaranteed income. This is, in a sense, the simplest possible approach to poverty, in that it proposes that each adult citizen receive a basic adequate income from a combination of market and state resources; if someone is not earning a wage, then she or he receives substantial support from the government and, in the case of a low wage, receives a smaller supplemental grant. The paper explores the meaning and history of the idea of a minimum income for all U.S. Citizens and argues that it was an object …

Forced Marriage: A "New" Crime Against Humanity?, Jennifer Gong-Gershowitz Jan 2009

Forced Marriage: A "New" Crime Against Humanity?, Jennifer Gong-Gershowitz

Northwestern Journal of Human Rights

This paper analyzes the recent decisions of the Special Court for Sierra Leone defining forced marriage as a "new" crime under international humanitarian law. It first describes the Sierra Leonean civil war and the events leading up to the creation of the Special Court. Then it discusses the findings of the Sierra Leone Truth and Reconciliation Commission and the AFRC Trial, comparing them to a few key decisions of the tribunals for the Former Yugoslavia and Rwanda in response to crimes of sexual violence. Next, the paper examines the rationale of the AFRC Trial Chamber, which declined to recognize forced …

Forty Years Of Welfare Policy Experimentation: No Acres, No Mule, No Politics, No Rights, Julie A. Nice Jan 2009

Forty Years Of Welfare Policy Experimentation: No Acres, No Mule, No Politics, No Rights, Julie A. Nice

Northwestern Journal of Law & Social Policy

This introductory essay questions putting nearly all effort into social policywhich has failed to reduce povertyand calls instead for reinvigorating other tactics and re-imagining the unfinished dream of economic justice. Indeed, what Martin Luther King, Jr. envisioned was an actual war on poverty, not merely the abbreviated, under-funded, and ultimately unsuccessful effort of the 1960s, nor the imposter war on welfare that has dominated our social policy effort since. But our social policy has not only failed to reduce poverty, it failed to focus long-needed attention on poverty and inequality. Nor has social policy facilitated the political mobilization of poor …

Atrocity Crimes Litigation: 2008 Year-In-Review, Beth Van Schaack Jan 2009

Atrocity Crimes Litigation: 2008 Year-In-Review, Beth Van Schaack

Northwestern Journal of Human Rights

This article--prepared in connection with the annual review of atrocity crimes litigation conference hosted at Northwestern University School of Law--surveys important developments in the field of international criminal law in 2008. Although the article does feature certain key procedural developments, it primarily addresses developments in substantive law concerning the crimes of genocide, crimes against humanity, war crimes, and gender-based violence, as well as applicable forms of responsibility, including conspiracy, incitement, co-perpetration, and joint criminal enterprise. The survey identifies several trends in the jurisprudence toward better delineating the interfaces between international crimes and forms of responsibility and identifies cases with immediate …

Introduction: Symposium On The Globalization Of Private Equity: Changes In The International Market And The Impact On Private Equity Investments , David Van Zandt

Northwestern Journal of International Law & Business

The title of this year's symposium is "Globalization of Private Equity: Changes in the International Market and the Impact on Private Equity Investments." As reflected by the title, the goal of this year's symposium is to explore the changes in the private equity industry after the financial crisis. The papers in this issue examine topics such as the future of convergence between hedge funds and private equity, the legal and ethical implications of vulture funds in developing countries, and the legal, ethical, and financial implications surrounding valuation and disclosure. Additionally, this issue will explore the contentious legal and political debate …
