In Canada collective bargaining is shaped by a tight statutory structure used to regulate almost every aspect

of of the union-manangement relationship. Such legislation closely regulates the formation of the collective

bargaining relationship, governs the conduct and timing of the bargaining process, places restrictions on economic

conflict, and may, in some cases, mandate certain terms of the collective agreement. The legislation confers broad

administrative powers on labour relations boards or tribunals, which play a major role in the application of the

legislation (Carter 1995). Labour tribunals regulate both management and union activity and may restrain some

forms of employer interference …

In the academic year 2000-2001, the University of Hawaii Professional Assembly (UHPA) sought to

bargain a contract on its conventional cycle for the period 2002-2003 with the State of Hawaii. The effort

failed, leading to a two-week strike in April, coinciding with a state-wide strike of the Hawaii State

Teachers Association (HSTA). For the first time in U.S. history the entirety of a state’s public education

system was on strike with its state employer. For UHPA the strike had been provoked primarily by the gap

Supply And Demand For Unequal Education: The Case Of Part-Time Faculty At Public Community Colleges, Dan Jacoby

Journal of Collective Bargaining in the Academy

Interest in contingent academic labor has increased, especially after recent studies reporting that graduation rates fall with increases in the percentage of an institution’s faculty hired on a part-time or non-tenure track basis (Ehrenberg & Zhang, 2005; Jacoby 2005). So far however, there has been little quantitative research on the determinants of demand and supply for part-time academic labor. In this study we look at employment patterns at public community colleges; it is among these institutions that we find the most intensive use of part-time faculty.

Lessons Learned From The Virginia Tech Tragedy, Marcus L. Martin

On April 16, 2007, Seung Hui Cho, a psychologically disturbed student at Virginia Tech, shot to death 32 students and faculty, wounded 17 more, and then killed himself. Three days later, Virginia Governor Tim Kaine appointed a panel to review the events leading up to this tragedy; the handling of the incident by public safety officials, emergency services providers, and the University; and the services subsequently provided to families, survivors, caregivers and the community.

At campuses across the country jackbooted university managers

have trod all over faculty rights for a decade. Shared governance is at best the object of administrative contempt.

Faculty control over the curriculum is whittled away by online degrees designed by bureaucrats. Academic freedom

is simultaneously compromised by policies for e-mail use and campus servers and threatened by continuous rightwing

assaults from outside the university. Independent faculty research in science, engineering, and agriculture is

increasingly undermined by reliance on product-oriented commercial support. Tolerance for "unprofitable"

humanities and social science research is on the wane. And the burgeoning class of contingent faculty …

As I contemplate the decline in public financial support for my institution over the sixteen years since I arrived as president in 1992, I can state without fear of contradiction the following Assertion: California University of Pennsylvania is being privatized without a plan. The truth of this Assertion has implications for our University, our students, and most especially for our faculty, and those implications are challenging, inexorable and increasingly obvious.

The “Academic Bill of Rights” movement, launched by right wing activists in

2003, has sought to legislate control over student rights, the hiring of faculty members,

and curricula. It activists claims to seek academic freedom in an academy that has been

In December 2002 the University of Michigan received notice from the Michigan

Employment Relations Commission (MERC) that a petition had been filed for

representation of the non-tenure track instructional faculty. The petitioning union was

the Lecturers’ Employee Organization (LEO), an affiliate of what is now called AFT

Michigan. The petition asked to cover all non-tenure track instructional faculty (lecturers,

adjunct faculty, visiting faculty and clinical track faculty) at all three campuses (Ann

Arbor, Dearborn and Flint) except for the Medical School, Dental School, Business

School and Law School at Ann Arbor.

Organizing of professionals at institutions of higher education presents a number of unique issues. More than 25 years ago, the Supreme Court ruled in the Yeshiva University case that faculty members at that school were managers, exempt from the National Labor Relations Act (“NLRA”), because of their authority in the academic governance of the University. Since that time, there have been numerous cases applying the Yeshiva decision and further developing the factors used by the National Labor Relations Board (“NLRB”) and the courts in determining whether full time faculty are managerial.
