Mycoplasma hyorhinis is a significant pathogen in swine, yet its fastidious nutritional requirements present challenges for in vitro cultivation. Conventional supplements like horse serum (HS) often suffer from batch variability and potential inhibitors. This study aimed to evaluate chicken serum (CS) and chicken egg yolk (CY) as novel alternatives to develop a reliable cultivation method for M. hyorhinis. Five clinical isolates were cultured for 10 days in a basal medium supplemented with CS or CY at 10%, 20%, or 30%, with 30% HS as the control. Accurate preoperative prediction of cystic calculi composition is essential for effective treatment planning in dogs. This prospective study aims to investigate the utility of non-contrast multi-detector computed tomography (MDCT) in differentiating calcium oxalate (CaOx) and struvite calculi based on mean Hounsfield unit (HU) and HU density values. Nineteen client-owned dogs with confirmed cystic calculi underwent non-contrast MDCT imaging at 80 and 120 kilovoltage peak (kVp) settings prior to surgical removal. จากการศึกษาเปรียบเทียบการกำกับดูแลการผูกขาดในประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น ผู้เขียนได้ค้นพบว่าวัตถุประสงค์ของกฎหมายต่อต้านทรัสต์ของประเทศสหรัฐอเมริกาคือ “ประสิทธิภาพ” และ “สวัสดิการผู้บริโภค” ทำให้ในยุคเศรษฐกิจดิจิทัล หน่วยงานบังคับใช้กฎหมายต่อต้านทรัสต์ของประเทศสหรัฐ อเมริกาประสบปัญหาในการกำกับดูแลการผูกขาดโดยบริษัทแพลตฟอร์มอิเล็กทรอนิกส์ที่มีอำนาจเหนือตลาด เนื่องจากผู้บริโภคได้ประโยชน์จากการผูกขาดดังกล่าว แม้ว่าผู้มีส่วนได้เสียอื่น โดยเฉพาะอย่างยิ่งคู่ค้าที่เป็นบริษัทขนาดกลางและขนาดย่อม (Small and Medium Enterprise: SME) จะถูกเอารัดเอาเปรียบก็ตาม ส่วนในประเทศญี่ปุ่น วัตถุประสงค์ของกฎหมายป้องกันการผูกขาด คือ การสนับสนุนและรักษาไว้ซึ่ง “การแข่งขันที่เสรีและเป็นธรรม” ซึ่งหมายความรวมถึงการปกป้อง SMEs จากการถูกเอารัดเอาเปรียบและพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรม (Unfair Trade Practices) ของบริษัทขนาดใหญ่ด้วย ส่วนวัตถุประสงค์ของกฎหมายแข่งขันทางการค้าในประเทศไทยมีความคล้ายคลึงกับประเทศญี่ปุ่น จึงมีบทบัญญัติเกี่ยวกับพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรมเช่นเดียวกัน ผู้เขียนจึงเสนอแนะให้หน่วยงานบังคับใช้กฎหมายป้องกันการผูกขาดของประเทศไทยออกกฎหมายลำดับรองเพื่อกำกับดูแลพฤติกรรมของผู้ประกอบธุรกิจแพลตฟอร์มตัวกลางการซื้อขาย (E-Commerce) ที่มีอำนาจเหนือตลาดในประเทศไทย

หลักความคาดหวังอันชอบธรรมเป็นกลไกสำคัญในระบบกฎหมายปกครองสมัยใหม่ที่มุ่งคุ้มครองความไว้วางใจของประชาชนต่อการกระทำของรัฐ บทความนี้ศึกษาพัฒนาการและสาระสำคัญของหลักการดังกล่าวในระบบกฎหมายเปรียบเทียบ ได้แก่ ระบบกฎหมายเยอรมนีที่หลักความคาดหวังอันชอบธรรมได้รับการยอมรับเป็น “หลักรัฐธรรมนูญทั่วไป” ภายใต้หลักนิติรัฐ และเชื่อมโยงกับหลักความมั่นคงแน่นอนทางกฎหมายและหลักความได้สัดส่วน ในอังกฤษหลักนี้มีจุดเริ่มต้นจากแนวคิดเรื่องความเป็นธรรมในกระบวนการก่อนขยายไปสู่การคุ้มครองผลประโยชน์เชิงเนื้อหาโดยใช้หลักการถ่วงดุลกับประโยชน์สาธารณะ ส่วนประเทศอื่น เช่น ออสเตรเลีย แคนาดา โปแลนด์ อินเดีย และฝรั่งเศส ต่างมีลักษณะการปรับใช้เฉพาะที่สะท้อนเป้าหมายร่วมกันในการจำกัดอำนาจรัฐและคุ้มครองความไว้วางใจของประชาชน สำหรับประเทศไทย ศาลปกครองไทยได้วางหลักการตีความสำคัญหลายประการทั้งการคุ้มครองเชิงเนื้อหาที่รับรองฐานะทางกฎหมายแม้คำสั่งจะถูกเพิกถอนในภายหลัง การชั่งน้ำหนักระหว่างความคาดหวังส่วนบุคคลกับประโยชน์สาธารณะ การเชื่อมโยงหลักความคาดหวังอันชอบธรรมกับหลักนิติรัฐ ข้อยกเว้นกรณีประมาทเลินเล่อร้ายแรงและการปกปิดข้อเท็จจริงที่มีสาระสำคัญ อย่างไรก็ตาม การปรับใช้ยังขาดความสม่ำเสมอในสาระสำคัญของการคุ้มครองความไว้วางใจของประชาชน บทความจึงนำเสนอแนวทางการพัฒนากฎหมายปกครองไทย ทั้งการปรับปรุงกฎหมายที่มีอยู่ให้ครอบคลุมรูปแบบความคาดหวังที่หลากหลาย การพัฒนาแนวทางการตีความของศาลที่ยอมรับการคุ้มครองทั้งในเชิงกระบวนการและเชิงเนื้อหา และการสร้างกลไกทางกฎหมายใหม่ เช่น คณะกรรมการไกล่เกลี่ยข้อพิพาท อันจะนำไปสู่การพัฒนาระบบกฎหมายปกครองไทยที่เป็นธรรม โปร่งใส และสอดคล้องกับหลักนิติรัฐอย่างแท้จริง

การรอการกำหนดโทษหรือรอการลงโทษจำคุกในฐานความผิดทางอาญาร้ายแรง (Suspension Of Sentence And Suspension Of Punishment For Serious Criminal Offenses), Natha Wichien

การรอการกำหนดโทษหรือรอการลงโทษ ตามประมวลกฎหมายอาญา มาตรา 56 เป็นมาตรการที่มีความสำคัญในกระบวนการยุติธรรมทางอาญา ซึ่งเป็นมาตรการที่บัญญัติขึ้นโดยมีวัตถุประสงค์ให้ศาลใช้ดุลพินิจรอการกำหนดโทษหรือรอการลงโทษสำหรับคดีที่มีอัตราโทษจำคุกระยะสั้นหรือโทษปรับ ตามทฤษฎีการลงโทษเพื่อแก้ไขพฤติกรรมของผู้กระทำความผิด กล่าวคือ ในคดีความผิดอาญาที่มีโทษจำคุกหรือปรับ และศาลจะลงโทษจำคุกไม่เกิน 5 ปี ทั้งนี้ เพื่อมิให้ผู้กระทำความผิดเล็กน้อยนั้นเข้าไปปะปนกับผู้กระทำความผิดเป็นอาจิณและเลียนแบบพฤติกรรมนั้นจนกลับมากระทำความผิดซ้ำอีก และเพื่อให้โอกาสผู้กระทำความผิดได้รู้สำนึกถึงสิ่งที่ได้กระทำลงไป รวมถึงสามารถกลับมาดำเนินชีวิตในสังคมได้อย่างเป็นปกติ แต่ในทางกลับกันเมื่อพิจารณาจากการบังคับใช้ประมวลกฎหมายอาญา มาตรา 56 ศาลสามารถใช้ดุลพินิจได้กับทุกฐานความผิด แม้ลักษณะของฐานความผิดนั้นจะกระทบกระเทือนต่อความปลอดภัยของสังคมมากเพียงใด แต่หากโทษจำคุกที่ศาลลงมีกำหนดไม่เกิน 5 ปี ศาลก็สามารถสั่งรอการกำหนดโทษหรือรอการลงโทษได้กับทุกกรณี ซึ่งอาจจะขัดหรือแย้งกับทฤษฎีการลงโทษทางอาญาประการอื่น กล่าวคือ ทฤษฎีการลงโทษเพื่อแก้แค้น การลงโทษเพื่อข่มขู่ยับยั้ง การลงโทษเพื่อตัดผู้กระทำผิดออกจากสังคมรวมถึงการลงโทษเพื่อป้องกันอาชญากรรม อันส่งผลกระทบต่อความรู้สึกและการได้รับความยุติธรรมของผู้เสียหาย หรือเหยื่อในคดีอาญารวมทั้งประชาชนในสังคม เนื่องจากในบางกรณีเป็นฐานความผิดที่มีความร้ายแรง และเป็นอันตรายต่อสังคม แต่ผู้กระทำความผิดกลับไม่ถูกลงโทษ ยิ่งไปกว่านั้นอาจทำให้ผู้เสียหายไม่ได้รับความยุติธรรม และบุคคลทั่วไปย่อมเข้าใจว่าการกระทำร้ายแรงเช่นนั้นสามารถกระทำได้โดยไม่ต้องรับผลใด ๆ จากการกระทำดังกล่าว ฉะนั้นจึงควรปรับปรุงแก้ไข และจัดทำคำแนะนำเกี่ยวกับวิธีการรอการลงโทษหรือรอการกำหนดโทษให้มีความชัดเจนยิ่งขึ้น โดยการกำหนดแนวทาง หรือข้อพิจารณาที่ผู้ใช้กฎหมายควรให้การคำนึง และให้ความสำคัญยิ่งขึ้นเกี่ยวกับฐานความผิดร้ายแรงที่ไม่ควรรอการกำหนดโทษหรือรอการลงโทษ เพื่อให้การลงโทษเป็นไปตามสัดส่วนของการกระทำความผิด และตรงตามทฤษฎีวัตถุประสงค์ของการลงโทษ

การโฆษณาโดยเจาะจงตัวบุคคลส่งผลกระทบต่อสิทธิในความเป็นส่วนตัวของเด็กทั้งในรูปแบบของการเฝ้ามองพฤติกรรมทางออนไลน์ การเก็บรวบรวม ใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลโดยไม่ได้รับความยินยอมหรือไม่มีกฎหมายให้อำนาจไว้ การทำโปรไฟล์ หรือการนำเสนอโฆษณาที่ตอบสนองต่อความต้องการหรือลักษณะเฉพาะของตัวเด็ก สามารถชักจูงความคิดหรือกระตุ้นความต้องการของผู้รับโฆษณาได้โดยเฉพาะเพื่อแสวงหาประโยชน์ในทางเศรษฐกิจ สังคม การเมือง หรือวัตถุประสงค์อื่นใด การที่เด็กซึ่งเป็นบุคคลกลุ่มเปราะบางของสังคมอาจมีความรู้ความเข้าใจในการใช้งานเทคโนโลยีดิจิทัลและเครือข่ายออนไลน์และมีวิจารณญาณในการรับสื่อโฆษณาที่ไม่เพียงพอ ส่งผลให้เด็กมีความเสี่ยงจากการตกเป็นเป้าหมายของการแทรกแซงสิทธิในความเป็นส่วนตัวและการแสวงหาประโยชน์อันไม่ชอบจากการกระทำดังกล่าวได้โดยง่าย จากการศึกษาพิจารณาได้ว่า กฎหมายภายในของไทยในปัจจุบันอาจมีไม่เพียงพอสำหรับการคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กจากการโฆษณาโดยเจาะจงตัวบุคคลตามมาตรฐานระหว่างประเทศ ดังนั้น บทความนี้จึงมีวัตถุประสงค์ในการศึกษาแนวทางการพัฒนามาตรการทางกฎหมายที่เหมาะสมกับสถานการณ์ในปัจจุบันเพื่อคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กให้สอดคล้องกับพันธกรณีของประเทศไทยที่มีอยู่ตามกฎหมายระหว่างประเทศ

การพัฒนาที่ยั่งยืน (Sustainable Development) เป็นแนวคิดด้านการพัฒนาที่ได้รับการยอมรับในระดับสากลและมีบทบาทเป็นแนวทางการพัฒนาที่ทุกประเทศนำไปปรับใช้ โดยมีนิยามว่า การพัฒนาที่ตอบสนองความต้องการของคนรุ่นปัจจุบัน โดยไม่กระทบต่อความสามารถในการตอบสนองความต้องการของคนรุ่นอนาคต โดยมี สามเสาหลักแห่งการพัฒนาที่ยั่งยืน (The three pillars of sustainability) เป็นหัวใจสำคัญของหลักการ ซึ่งการบูรณาการมิติด้านการพัฒนาทั้งสามด้าน ได้แก่ เศรษฐกิจ สังคม และสิ่งแวดล้อม ให้สอดคล้องกัน ซึ่งประเทศไทยมีพันธกิจในระดับสากลในการนำหลักการพัฒนาที่ยั่งยืนมาปรับใช้กับการพัฒนาภายในประเทศทุกภาคส่วน รวมถึงการจัดการป่าไม้อันเป็นทรัพยากรธรรมชาติภายในประเทศ บทความฉบับนี้จึงเป็นการศึกษาและวิเคราะห์กฎหมายป่าไม้ของไทย โดยศึกษาในเชิงประวัติศาสตร์กฎหมายนับตั้งแต่ก่อนการก่อตั้งกรมป่าไม้ในสมัยรัชกาลที่ 5 ซึ่งเป็นช่วงแรกเริ่มของการตรากฎหมายป่าไม้ มาจนถึงกฎหมายป่าไม้ในช่วงเวลาปัจจุบัน เพื่อชี้ให้เห็นว่ากฎหมายป่าไม้ของไทยได้นำเอาหลักการพัฒนาที่ยั่งยืนมาปรับใช้จริงและมีความสอดคล้องกับพัฒนาการของหลักการพัฒนาที่ยั่งยืน โดยปรากฏผ่านหลักการของกฎหมายป่าไม้ในหลายภาคส่วนที่แสดงให้เห็นถึงการบูรณาการทางเศรษฐกิจ สังคม และสิ่งแวดล้อม ซึ่งเป็นหัวใจสำคัญของหลักการพัฒนาที่ยั่งยืน

A 3-year-old domestic shorthair cat presented with severe diffuse skin lacerations and cutaneous nodules with purulent discharge. Primary immune-mediated panniculitis was diagnosed. After surgical excision of the lesions, immunosuppressive therapy with prednisolone and mycophenolate mofetil was initiated. The cutaneous lesions resolved, and no recurrence was observed over a 2-year follow-up period.

A male captive-bred leopard gecko (Eublepharis macularius) presented with a history of inadvertent ingestion of a rubber tip from forceps during feeding. The foreign body was impalpable on physical examination, while radiographic evaluation confirmed its presence in the stomach. Considering the procedural risks associated with invasive surgical interventions, endoscopic retrieval under general anesthesia was pursued. An initial attempt using a 2.8 mm superfine flexible endoscope with 0.8 mm forceps was unsuccessful due to insufficient stability, which hindered effective navigation to the foreign body. The aim of the present study is to investigate the effect of azithromycin on the echocardiographic characteristics in healthy donkeys. Conjunctivitis is a common ocular condition in domestic cats, often associated with Staphylococcus aureus. Accurate detection and resistance profiling are essential for appropriate therapy. This study aimed to characterize clinical features of feline conjunctivitis, identify S. aureus using phenotypic and genotypic methods, and assess its antibiotic susceptibility. Twenty conjunctivitis-suspected cats in Sleman, Indonesia, underwent clinical examination and conjunctival swabbing. Bacterial isolates were cultured on Mannitol Salt Agar and identified by Gram stain, catalase, coagulase, biochemical tests, and PCR targeting 23S rRNA. This research aims to investigate and analyze spatial and temporal characteristics of daily rainfall which include rainfall amount, proportion of areas with heavy (35-90 mm/day) and extreme (>90 mm/day) rainfall intensity, numbers of extreme rainfall clusters, average size of extreme rainfall clusters, and orientation of extreme rainfall areas in the upper northeastern region of Thailand during the summer season (March to May) from 2017 to 2020. Rainfall data were obtained from Sakon Nakhon weather radar station. This article analyzes the development of a competency-based curriculum (CBC) through case studies of Thailand, Singapore, Germany, and South Korea, aiming to propose guidelines for enhancing high-skilled labor that corresponds to the needs of the industrial sectors. This action research aims to examine a contemplative facilitation process that fosters self-awareness among the elderly. The participants were 10 elderly people from a Social Welfare Development Center for Older Persons in Phra Nakhon Si Ayutthaya Province. Qualitative data were collected through participant observation and in-depth interviews, and data were analyzed using thematic analysis. The results revealed that the developed contemplative facilitation process, grounded in mindfulness cultivation, observation of the body, emotions, and thoughts, and deep listening, comprised eight activity sessions incorporating art-based activities and nature-connected practices.
