Thinking Ahead: Ranking Substantive Canons To Protect Loper Bright, Tanner Macdonald

After forty-two years, the Supreme Court overturned Chevron deference in their decision Loper Bright Enterprises v. Raimondo (2024). The decision suggested a rising inclination towards legal formalism in cases of statutory interpretation. This Note argues that if the Court intends statutes to be interpreted in accordance with formalism, clarification is needed. Loper Bright was not sufficient to clear up the inconsistencies in statutory interpretation that the Court used to overrule Chevron. Without a strong prescription, Loper Bright will eventually collapse on itself. A formal ranking of substantive canons is one type of structure that would support Loper Bright and enable …

This study investigates the impact of a computer-based divided attention task on spoken language and compares the impact between younger (18–30 years) and older (55–82 years) adults. Sixty adults participated in a speaking task and two computer tasks which varied in difficulty. The Level 1 computer task involved highlighting each instance of the word “the” and the Level 2 computer task involved highlighting each instance of the word “the” while also underlining each instance of the word “a”. The four standard works of The Church of Jesus Christ of Latter-day Saints contain numerous accounts in which individuals exhibit intellectual capacities — of perception, reasoning, problem-solving, and articulation — that demonstrably exceed their natural endowments and circumstances. This essay identifies twenty such accounts, organizes them into five conceptual typologies, and draws from each typology a set of concrete, actionable proposals for faculty at Brigham Young University who seek to integrate divine assistance into their scholarly and pedagogical work. This study examines graphic design in the Lower Rio Grande Valley (LRGV) as a site of cultural hybridity, shaped by transnational histories and bilingual practice. It explores how Mexican and Anglo design markers intersect and are negotiated in daily life through analysis of 2,180 visual artifacts, interviews with ten local creatives, and a survey of fifty residents. Historical research traces influences like nineteenth-century wood type and rótulo signage to contemporary advertising. Interviews reveal that local creatives navigate hybrid identities through code-switching, bilingual fluency, and borderlands experiences. Survey results show that participants’ language preferences predict how they categorize and rank typographic …

Silicosis is a lung disease caused by inhalation of respirable silica particles. Silicosis is usually characterized by high occupational exposure to silica in industries like mining, sandblasting, construction, and stone fabrication. Recent research showing increasing rates of silicosis among native Spanish-speaking workers demonstrates the need for improved silicosis diagnosis and patient education. While research has been done to understand the epidemiological distribution of silicosis and native Spanish-speaking workers, there has been limited research evaluating occupational medicine providers’ clinical practices related to the diagnosis of silicosis among this population.

This thesis thoroughly examines the Apostle Paul’s use of the Greek term πορνεία within the Pauline corpus to challenge the normative translation of sexual immorality and the accompanying assumptions connected to this broad phrase. Modern scholarship continually isolates individual occurrences of πορνεία leading to inconsistent and reductionistic interpretations. Rather, through sustained philological analysis of πορνεία and its cognates, this thesis aims to situate Paul’s πορνεία within its contemporary cultural, historical, and lexical milieu with the objective of making Paul’s πορνεία distinct. Facial motion, particularly lip movement, carries rich information about human speech that can be leveraged for a variety of computer vision and speech-processing tasks. Unlike other pixel-based methods, this work investigates the use of facial landmarks as a compact, privacy- preserving, and computationally efficient representation for lip-motion analysis. We evaluate landmark-based models across multiple tasks, including visual voice activity detection (VVAD), lip–audio synchroniza- tion, and visual speech recognition (VSR) for liveness detection. Using LRS3-VVAD1 and LRS22 datasets, we demonstrate that landmark-only models can achieve performance comparable to pixel-based systems for VVAD and synchronization, while significantly reducing parameter counts and inference …

Martinez, a Filipino-American living and working in diversity education at a castle museum near Bern, Switzerland, highlights how cultural connections are maintained even when one is geographically distant from one’s country of origin. In addition to Ms. Martinez’s Filipino-American perspective, I met and interviewed others who shared their stories as Filipino or Filipino-Swiss migrants. The migration of Filipinos from the islands of the Philippines to the mountains of Switzerland illustrates a dynamic journey that began with labor migration in the early 1970s and reflects a vibrant diaspora today. The purpose of this study is to examine prosodic speech pause across two groups: neurotypical and autistic young adults. Conversational speech samples were collected from 11 neurotypical and 11 autistic young adults between the ages of 18 and 26. Speech samples were subsequently transcribed and analyzed using Praat Software. The boundaries of between- and within-utterance pauses were identified, as well as acoustically determining if the pause was filled, silent, or a combination of both. Results found a significant difference in the frequency of pauses as a function of location, pause type, and neurological status. As expected, combination pauses were the …

The purpose of this study was to determine the perception that neurotypical individuals have of autistic individuals’ speech, including their speech prosody. Speech samples were collected from four neurotypical and four autistic young adults as they answered interview questions. Then, 50 neurotypical listeners (28 female, 22 male) were recruited to listen to the speech samples and rate the speech on visual analogy scales on their likeability and ability to communicate. Participants were told prior to listening to the speech samples whether or not the speaker had autism; however, there were both deceptive and truthful listening conditions, with some autistic speakers …

Braj Kachru suggested that one way of understanding the role and use of English around the world was to distinguish among three concentric “circles”: the inner circle, the outer circle, and the expanding circle. This forum piece invites readers to consider how Bakhtin’s concept of dialogue can reshape the teaching of elementary Russian. Instead of treating beginners as passive recipients of rules and forms, a neo-Bakhtinian, constructivist approach views them as active co-creators of meaning whose prior experiences, beliefs, and anxieties matter for learning. The author argues that engaging students in genuine dialogue—about their assumptions, about English–Russian contrasts, and about how grammar is named and presented—can reduce intimidation, increase confidence, and make Russian feel more accessible. In this way, Bakhtin’s ideas move beyond literary theory into the practical realities of the introductory language classroom.

With the development of cognitive psychology and psycholinguistics, the view of individual differences has been evolving and now includes concepts such as cognitive processing and Working Memory (WM) (e.g., Doughty, 2019; Jackson, 2020; McConnell, 2023; Wen & Teng, 2023). The practice of foreign language teaching is paradoxical in nature. On the one hand, such teaching is communicative; on the other hand, it often continues to rely on structuralist linguistic theory, which contradicts its communicative nature. In the case of teaching Russian verbs of motion to second-language learners, the dynamic nature of these verbs is often considered not dynamically, but statically—in the form of abstract textual examples or static images—which is also paradoxical. Understanding what shapes student motivation is essential to improving second language (L2) programs. While motivation is among the widely studied individual differences (IDs) in second language acquisition (SLA), research has largely focused on commonly taught languages, limiting broader applicability. This mixed-methods study, grounded in Dynamic Systems Theory (DST), explores the motivational development of learners studying a less commonly taught language (LCTL), Russian, during an eight-week summer immersion program. Data were collected from 52 students across four instructional levels. Motivation was assessed through two brief online surveys, developed based on research by Gardner, Dörnyei, Lanvers, Thompson, and others, and administered during …
