Flunked Out: A Comparative Look At State Educational Code, Title Vi Of The Civil Rights Act, And Slavery Education, Emory French-Folsom, Maryn Rolfson

Brigham Young University Prelaw Review

In 2017, a mock slave auction was held in a 5th grade classroom at

South Orange Elementary School in New Jersey, which included the

‘sale’ of a black child by white students. A few weeks after this incident,

students from another elementary school in the same district

made posters advertising the sale of African American slaves, which

were displayed in school hallways. Wisconsin 4th graders in 2018

were given a homework assignment which asked them to explain

“three good reasons for slavery.”

Evolving Standards Of Decency: A View Of 8th Amendment Jurisprudence And The Death Penalty, Jared Lockhart, Madeline Hill Apr 2020

Evolving Standards Of Decency: A View Of 8th Amendment Jurisprudence And The Death Penalty, Jared Lockhart, Madeline Hill

Brigham Young University Prelaw Review

In July 1997, Kenneth Foster was indicted on capital murder charges

and sentenced to death even though he had only committed robbery.

3 On August 14, 1996, Kenneth Foster and his friends, Mauriceo

Brown, DeWayne Dillard, and Julius Steen, rented a car and

drove to downtown San Antonio, Texas. Later that night, Brown

suggested that the men rob a few people in order to make up for the

money they had lost while partying. After their second robbery that

evening, Foster did not want to continue breaking the law, according

to Dillard’s courtroom testimony four years later. Dismissing

his request, …

A Mindfulness And Contemplative Inquiry Coursefor Pre-Service Art Educators, Rebecca Sue Lewis

Theses and Dissertations

This research project incorporates a series of mindfulness and contemplative workshops withinthe established curriculum of an advanced art studio methods course for pre-service arteducators. Educational research studies suggest that individuals who complete a mindfulnesscourse of study experience increased mental and physical stamina; enhanced memory retention;and decreased irritability, anxiety, depression, and chronic stress. Research also indicates thatindividuals who practice mindfulness have improved relationships and bolstered immunesystems (Williams & Penman, 2012. These studies suggest that mindfulness training can makepositive contributions to teaching and learning, enabling teachers and students to perform at theirbest capacity in their respective roles. Many studies hypothesized that mindfulness …

Wildfire In The West: How Megafires And Storm Events Affect Stream Chemistry And Nutrient Dynamics In Semi-Arid Watersheds, Trevor William Crandall Mar 2020

Wildfire In The West: How Megafires And Storm Events Affect Stream Chemistry And Nutrient Dynamics In Semi-Arid Watersheds, Trevor William Crandall

Theses and Dissertations

Climate change is causing larger wildfires and more extreme precipitation events throughout the world. As these ecological disturbances increasingly coincide, they are altering lateral fluxes of sediment, organic matter, and nutrients. Increased lateral flux of nutrients could exacerbate eutrophication and associated harmful algal blooms, and increased sediment and organic matter flux could degrade the water supply. Here, we report the immediate stream chemistry response of watersheds in central Utah (USA) that were affected by a megafire followed by an extreme precipitation event in 2018. The wildfires burned throughout the summer of 2018 until the remnants of Hurricane Rosa released torrential …

The Full Forecast: A Gender And Racial Analysis Of Broadcast Tv Weathercasters, Danielle Wardinsky Hallows Mar 2020

The Full Forecast: A Gender And Racial Analysis Of Broadcast Tv Weathercasters, Danielle Wardinsky Hallows

Undergraduate Honors Theses

This thesis analyzes the representation of women and minorities working as broadcast television weathercasters by examining eight randomly selected television markets. Individual biography web pages from each of the four local syndicate station websites (ABC, CBS, FOX, NBC) were used for data collection. Information was collected about gender, race, number of twitter followers, chief meteorologist position, certificate type (AMS Seal of Approval or Certificate of Broadcast Meteorology) and the show shift for each individual meteorologist. Results indicate that while white males still dominate the majority of positions in smaller markets, women are more equally represented in larger markets. Minorities are …

Trends In Hospital Prices: Evidence From Hospital Chargemasters, Ulysse G. Mccann Iii

Undergraduate Honors Theses

In light of recent price transparency laws, this paper examines evidence from hospital list prices, contained on “chargemasters,” with regard to price trends over time, price variation between hospitals, and price variation between categories of goods and services provided by hospitals. I use data from California’s Office of Statewide Health Planning and Development (OSHPD) for 32 general acute care hospitals in Los Angeles County from 2011–2019. The data shows that the average list price for hospitals in the sample rises by about 3% annually. Prices between hospitals in the sample, which are similar in geography and the population served, vary …

Forgetting The Mine Wars: Erasing Insurrection In West Virginia History, Samuel Heywood Mar 2020

Forgetting The Mine Wars: Erasing Insurrection In West Virginia History, Samuel Heywood

Undergraduate Honors Theses

This thesis examines the concerted effort in the West Virginia school system to forget a massive labor movement in the early 20th century. Business leaders and government leaders turned to the classroom to try and control the memory of future generations to ensure a positive perception of the coal industry and avoid any more violent confrontations. After a brief summary of the Mine Wars for context, this thesis uses textbooks to analyze how the authors omitted the conflict and instead used patriotic propaganda to create loyal citizens. Although the Mine Wars have since been included in state history textbooks, …

Species Composition And Hybridization Among Native And Nonnative Catostomid Fishes In Two Streams Of The Gunnison River Basin, Colorado, Michael R. Schwemm, Kevin G. Thompson, Evan W. Carson, Megan J. Osborne, Thomas F. Turner Mar 2020

Species Composition And Hybridization Among Native And Nonnative Catostomid Fishes In Two Streams Of The Gunnison River Basin, Colorado, Michael R. Schwemm, Kevin G. Thompson, Evan W. Carson, Megan J. Osborne, Thomas F. Turner

Western North American Naturalist

We report results from a 3-year field investigation to limit hybridization between native and nonnative suckers in 2 small tributaries of the Gunnison River basin, Delta County, Colorado. Upstream movement to spawning habitat was selectively impeded by picket weir in intermittent Cottonwood Creek. There, native suckers were identified based on morphological characters in the field and were transferred upstream of the weir, whereas nonnative fishes were excluded from upstream movement. Another stream, Potter Creek, was not impeded by weir. Genetic identification of adult fishes in both streams was consistent with morphological identification in the field. Larval genetic identification was consistent …

Distributions Of Eastern And Western Red Bats In Western North America, Donald I. Solick, Robert M.R. Barclay, Larisa Bishop-Boros, Quentin R. Hays, Cori L. Lausen

Western North American Naturalist

The known distributions of eastern red bats and western red bats in western North America have changed greatly over the past 2 decades, resulting in inaccurate range maps and uncertainty regarding the presence or probable absence of these species within states and provinces. We obtained capture and specimen records from the western United States and Canada for 276 eastern red bats and for 863 western red bats. We documented the expansion of the range of eastern red bats in northwestern Canada and clarified the northern and eastern limits of western red bat distribution in the United States. We found that …

Honoring A Giant: Immanuel Wallerstein And His Contributions To Social Sciences, Vladimir Alalykin-Izvekov

Comparative Civilizations Review

As a salute to a preeminent social scholar of our times, Immanuel M. Wallerstein (1930-2019), this paper briefly highlights his biography, education, and academic career; however, it is mainly concerned with his scholarly concepts and theories. The author attempts to follow the development process of one of his main contributions to social sciences, the world-systems approach, as well as to analyze various important aspects of it, including its historic and philosophic significance. All efforts have been made to keep the paper informative yet also accessible and transparent, deferring, when appropriate, to Immanuel Wallerstein himself to expound his ideas to the …

The Manifestation Of Neighborhood Effects: A Pattern For Community Growth?, Michael R. Cope, Jorden E. Jackson, Scott R. Sanders, Lance D. Erickson, Tippe Morlan, Ralph B. Brown

Faculty Publications

Neighborhood effects, or the development of community by neighborhoods, are often studied in an urban context. Previous research has neglected to examine the influence of neighborhoods in nonurban settings. Our case study, however, contributes to the existing literature as it takes place in a small, rural-to-urban town at an important point in time where the town was urbanizing. We find that neighborhood effects also influence community satisfaction and attachment in Creekdale, an urbanizing town. Using survey data (N = 1006) drawn from the Creekdale Community Citizens Viewpoint Survey (CCVS), we find that, contrary to conventional wisdom, population size and density …

Recovering The World Of The Bible, Dana M. Pike

The pillar of light that fell upon Joseph Smith in the woods near Palmyra, New York, in the spring of 1820 ushered in a new dispensation of the gospel.1 But that light, which shone “above the brightness of the sun” (Joseph Smith–History 1:16), did not just enlighten the world as far as religion is concerned. The light emanating from the pillar in which the Father and Son stood symbolically represents the latter-day, divine illumination of many aspects of life on this earth—past, present, and future.

To Move Home Or Move On? Investigating The Impact Of Recovery Aid On Migration Status As A Potential Tool For Disaster Risk Reduction In The Aftermath Of Volcanic Eruptions In Merapi, Indonesia, Jonathan A. Muir, Michael R. Cope, Leslie R. Angeningish, Jorden E. Jackson Jan 2020

Jackson

Faculty Publications

Disasters are associated strongly with forced migration. Indeed, migration is a standard survival strategy for those facing disruptions of this kind. Such is the case with Mt. Merapi, Indonesia, where a series of eruptions occurred in 2010. Mechanisms related to forced migration in such scenarios are fairly well understood, yet it remains less clear what factors may influence return migration. Given local interest in facilitating resettlement out of hazardous areas as a means of risk reduction, our objective in this study is to explore the extent to which recovery aid may create incentives for households to move on rather than …

“Estamos Aquí Pero No Soy De Aqui”: American Mexican Youth, Belonging And Schooling In Rural, Central Mexico, Eric Ruiz Bybee, Erin Feinauer Whiting, Bryant Jensen, Victoria Savage, Alisa Baker, Emma Holdaway

Faculty Publications

This article explores notions of belonging and citizenship for “American Mexican” students— Mexican-heritage youth born in the United States who return to Mexico with their families. Our findings reveal belonging as a sociocultural practice that participants negotiated spatially and relationally, chiefly by making their US-born status more and less visible within particular spaces at school. The experiences of American-Mexican youth reveal the crucial roles of migration and belonging in shaping civic identities and future potentials in a transnational world.

The Sparrow Hawk Castle - A Mostly Ignored Literary Motif Across The Cultures And The Centuries, Albrecht Classen Jan 2020

The Sparrow Hawk Castle - A Mostly Ignored Literary Motif Across The Cultures And The Centuries, Albrecht Classen

Quidditas

Johann Schiltberger included a curious episode about the ‘Sparrow Hawk Mountain’ in his famous travelogue Reisebericht from 1427. This episode can be traced back to John Mandeville’s Travels in the German translation by Michel Velser. This study examines the similarities between Mandeville’s text and Schiltberger’s account, but then also the use of this motif in the tradition of the Melusine novel (Jean d’Arras and Thüring von Ringoltingen). Further attempts are made to identify sources for this episode Mandeville might have drawn from, including an Armenian chronicle and even the love treatise De amore by Andreas Capellanus.

Theories And Assumptions: A Review Of William L. Davis’S Visions In A Seer Stone, Brian C. Hales Jan 2020

Theories And Assumptions: A Review Of William L. Davis’S Visions In A Seer Stone, Brian C. Hales

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Within the genre of Book of Mormon studies, William L. Davis’s Visions in a Seer Stone presents readers with an innovative message that reports how Joseph Smith was able to produce the words of the Book of Mormon without supernatural assistance. Using oral performance skills that Smith ostensibly gained prior to 1829, his three-month “prodigious flow of verbal art and narrative creation” (7) became the Book of Mormon. Davis’s theory describes a two-part literary pattern in the Book of Mormon where summary outlines (called “heads) in the text are consistently expanded in subsequent sections of the narrative. Termed “laying down …

Is Decrypting The Genetic Legacy Of America’S Indigenous Populations Key To The Historicity Of The Book Of Mormon?, Ugo A. Perego, Jayne E. Ekins

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Some critics of the Book of Mormon suppose that the DNA characteristics of modern Native Americans should be compatible with “Israelite” rather than with Asian genetics. The authors point out that while DNA is a valid tool to study ancient and modern populations, we must be careful about drawing absolute conclusions. They show that many of the conclusions of critics are based on unwarranted assumptions. There are specific limitations that cannot be ignored when using the available genetic data to infer conclusions regarding the DNA of Book of Mormon peoples. Such conclusions are not founded on solid science but are …

Two Essays On Sustaining And Enlarging The Doctrine, Daniel C. Peterson Jan 2020

Two Essays On Sustaining And Enlarging The Doctrine, Daniel C. Peterson

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

In a pair of recent books, Patrick Mason and Terryl and Fiona Givens seek to revitalize, reinvigorate, and deepen our understanding of basic terms and concepts of the Restoration. I welcome such efforts, convinced (even where I sometimes quibble) that the conversations they will engender among faithful and committed believers can be very healthy. Now that “the times of refreshing [have] come from the presence of the Lord” (Acts 3:18), it is imperative, both for ourselves and for a world that needs to hear the news, that we not lose sight of the radical freshness of the divine gift and …

Musings On The Birth Of The Savior Jesus Christ, Kristine Wardle Frederickson

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

In this essay, Kristine Wardle Frederickson muses about “the babe born in Bethlehem,” and who he was — and is — in consideration of those who nurtured, loved, and welcomed the infant Jehovah to Earth. Certain women played critical roles in preparing him for his infinite and eternal Atonement, and that preparation began long before Jesus came to Earth. Four women stand out as devoted mentors, disciples, and witnesses of Jesus Christ’s mission, and of his sublime perfection even on that first Christmas day: Heavenly Mother, Mary, Elisabeth, and Anna. At Christmastime, their witnesses are worthy of deep contemplation as …

Chapter 14: Book Of Alma, Brant Gardner

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Alma Chapter I (1–3) [Book Header] When Mormon introduces a new book, he provides a synoptic header: The account of Alma, who was the son of Alma, the first and chief judge over the people of Nephi, and also the high priest over the Church. An account of the reign of the judges, and the wars and contentions among the people. And also an account of a war between the Nephites and the Lamanites, according to the record of Alma, the first and chief judge.

Section 2: Nephi The Writer Chapter 7: Nephi Preparing, Brant Gardner

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

We have the Book of Mormon people because of Lehi. Nephi began the tradition that eventually allowed Mormon to create the Book of Mormon. Lehi led his family to the New World, but Nephi defined his descendants as a record-keeping people. The Nephites were a people of the Book both because Nephi (and his brothers) preserved a record-keeping tradition (the brass plates) and because he began a new one after arriving in the New World. Mormon may be most directly responsible for the Book of Mormon, but the records Mormon used (and many of the organizational structures that Mormon used) …
