Al Hanafia School used the Istihsan principle until they became famous for it, where Abu Hanifa was incomparable with it. Istihsan in all its forms is nothing but an alteration of a general rule, texts, an analogy, or an extracted origin for legal evidence that requires modification. This act of Istihsan was not an opinion, preference, self-distance, or derogation of legal evidence, rather the Istihsan was based on evidence that may be a hidden analogy, text, consensus, necessity, custom, interest, or a general jurisprudential rule.

يستعرض هذا البحث موضوعاً في غاية الأهمية ألا وهو تبرع المرأة بمالها دون إذن زوجها، وهي دراسة فقهية قانونية، سعت لإظهار أحكام هذا الموضوع، ولأجل تحقيق هدف الدراسة اتبعت الباحثة المنهج الاستنباطي، والمنهج التحليلي من أجل تجلية مفردات البحث، والخروج برؤية شرعية عن موضوع الدراسة، وقد بيّن البحث أن للمرأة البالغة العاقلة الراشدة ذمة مالية مستقلة، وأن لها حرية التصرف بمالها في عقود التبرعات المالية دون اعتبار إذن الزوج في ذلك، حتى وإن زاد المال عن الثلث، وقد جاءت نصوص القانون الأردني مؤيدة لهذا الأمر.

ملخص

هدفت هذه الدراسة التعرف إلى الفكر التربوي الإسلامي لدى الإمام محمد بن عبد البر القرطبي وتطبيقاته في العملية التربوية وقد استخدم الباحث المنهج التاريخي الوصفي التحليلي البنائي، وبينت نتائج الدراسة أن لدى ابن عبد البر تصوراً فكرياً وتربوياً متكاملاً عن جوانب الطبيعية الإنسانية المختلفة النفس، والجسم، والعقل، والروح، والخير والشر، والجبر والاختيار، والفرد والمجتمع، والوراثة والبيئة، والأخلاق. وبينت نتائج الدراسة أن هناك تطبيقات تربوية عملية للفكر التربوي تشتمل على الأهداف التربوية، وآداب المعلم، وآداب المتعلم، والمنهج الدراسي، وطرق التدريس وبينت الدراسة وجود مجموعة من المبادئ التربوية التي تعزز العملية التربوية، وأوصى الباحث بضرورة إجراء دراسة عن الفكر التربوي الإسلامي …
