‘Saving The Youth’: Children And Young People As Moral Subjects In The Philippines’ Punitive Drug Regime, Gideon Lasco, Luis Emmanuel A. Abesamis

Background

The Philippines has one of the must punitive drug regimes in the world, as evidenced not just by Rodrigo Duterte’s drug war but previous anti-drug campaigns. This article examines the place of ‘the youth’ in the longstanding moral panic around drugs and drug policy in the Philippines.

Methods

This article uses critical discourse analysis to analyze figurations of young people across three distinct periods in the Philippines’ contemporary history: Ferdinand Marcos Sr.’s early dictatorship (1972–1975), Gloria Macapagal-Arroyo’s presidency (2001–2010), and Rodrigo Duterte’s administration (2016–2022).

Background: Research has found that Adverse Childhood Experiences (ACEs) have been shown to lead to a myriad of issues including struggling in school. The more ACEs a child experiences, the worse their outcome tends to be, including school outcomes. However, critics of ACE research have argued that not all ACEs weigh the same and intersectionality needs to be considered. Therefore, this study aims to analyze the relationship between ACEs and school outcome issues. The purpose of this study is to examine the relationship between adverse childhood experiences (ACEs) and alcohol use in adulthood among individuals who responded to the BRFSS 2022 study. Secondary data was used to gather information on adults. The BRFSS 2022 survey was a national survey conducted by the CDC that utilized stratified sampling to create two groups of participants based on phone number type. Black women have disproportionately alarming HSV-2 infection rates yet receive little attention in sexual health literature. Using a strengths-based resilience framework, this study sought to determine culturally relevant protective predictors of self-esteem for Black women who are justice-involved and have HSV-2. The authors conducted secondary data analysis on data from the “Black Women in the Study of Epidemics (B-WISE) Project,” a longitudinal prospective study investigating health disparities and health services utilization among Black women with justice involvement. งานวิจัยเรื่อง “การตกเป็นเหยื่อของการสะกดรอยออนไลน์ในสังคมไทย” มีวัตถุประสงค์เพื่อศึกษาพฤติกรรมของผู้กระทำผิดและผู้ที่ตกเป็นเหยื่อการสะกดรอยออนไลน์ ศึกษาสภาพปัญหาของการตกเป็นเหยื่อและเสนอแนะแนวทางในการป้องกันการตกเป็นเหยื่อการสะกดรอยออนไลน์ในสังคมไทย เป็นงานวิจัยเชิงคุณภาพด้วยการศึกษาข้อมูลจากเอกสารและการสัมภาษณ์เชิงลึกผู้ที่ตกเป็นเหยื่อการสะกดรอยออนไลน์ จำนวน 4 คน และผู้เชี่ยวชาญที่มีความรู้ความสามารถเฉพาะทางและผู้ที่มีส่วนในการช่วยเหลือเหยื่อ จำนวน 8 คน ผลการศึกษา พบว่ารูปแบบพฤติกรรมของผู้กระทำผิด มี 3 ประการ ดังนี้ 1) การพยายามติดต่อสื่อสารอย่างต่อเนื่องและส่งข้อความที่ไม่พึงประสงค์ทางออนไลน์ 2) การนำข้อมูลของเหยื่อไปใช้ในทางที่มิชอบ และ 3) การนำข้อมูลที่เฝ้าติดตามทางออนไลน์ไปสะกดรอยในทางกายภาพ สาเหตุหรือแรงจูงใจที่นำไปสู่การกระทำความผิด ดังนี้ 1) ความสะดวกในการเข้าถึงข้อมูลส่วนบุคคลและการติดต่อเหยื่อได้โดยตรง 2) ความต้องการสร้างความสัมพันธ์บางประการ และ 3) ความโกรธแค้นเมื่อถูกปฏิเสธหรือความต้องการควบคุม พฤติกรรมของบุคคลที่นำไปสู่การตกเป็นเหยื่อการสะกดรอยออนไลน์ มี 2 ประการ ดังนี้ 1) การขาดความระมัดระวังในการเผยแพร่ข้อมูลบนสื่อสังคมออนไลน์ และ 2) ลักษณะทางกายภาพของเหยื่อ นอกจากนี้ผลการศึกษา สภาพปัญหาของการตกเป็นเหยื่อการสะกดรอยออนไลน์ มี 4 ประการ ดังนี้ 1) การขาดความตระหนักรู้ 2) สภาพของเทคโนโลยีและอินเทอร์เน็ต 3) การขาดกฎหมายหรือมาตรการเฉพาะที่ใช้กับการกระทำความผิด และ 4) ขาดบุคลากรที่มีความชำนาญเฉพาะทาง สำหรับแนวทางในการป้องกันการตกเป็นเหยื่อการสะกดรอยออนไลน์ ได้แก่ 1) การสอนมารยาทการใช้งานอินเทอร์เน็ต และสร้างความตระหนักรู้ในอันตรายจากการเผยแพร่ข้อมูลส่วนบุคคลแก่คนในสังคม 2) การเริ่มป้องกันจากตนเอง 3) การพัฒนาระบบกฎหมายและการบังคับใช้ และ 4) การพัฒนาบุคลากรให้มีความรู้ความชำนาญ และพัฒนาเครื่องมือทางเทคโนโลยีที่ช่วยสืบสวนการกระทำความผิดทางออนไลน์

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและสาเหตุการเล่นพนันคาสิโนออนไลน์ของเด็กและเยาวชนในพื้นที่กรุงเทพมหานคร การศึกษาวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยดำเนินการเก็บข้อมูลจากเด็กและเยาวชน ในพื้นที่กรุงเทพมหานคร ที่เล่นพนันคาสิโนออนไลน์ จำนวน 15 คน ด้วยการสัมภาษณ์เชิงลึก รวมถึงการศึกษาจากเอกสาร และทำการวิเคราะห์ข้อมูลด้วยวิธีการวิเคราะห์สรุปอุปนัย ผลการวิจัยพบว่า 1.สภาพปัญหาการเล่นพนันคาสิโนออนไลน์ของเด็กและเยาวชนในพื้นที่กรุงเทพมหานครจำแนกได้เป็น 3 องค์ประกอบหลัก ได้แก่สาเหตุเรื่องของความล้าหลังและไม่ชัดเจนของกฎหมายที่ไม่ทันกับเทคโนโลยี รวมถึงการโฆษณาที่เข้าถึงเยาวชนได้ง่าย ทำให้ปัญหานี้ขยายตัวอย่างรวดเร็ว บริบทและสภาวะที่เกี่ยวข้องเกี่ยวกับความซับซ้อนทางวัฒนธรรม การทุจริตในระบบราชการ การพัฒนาเทคโนโลยี และวิถีชีวิตยุคใหม่ ล้วนส่งเสริมการเล่นพนัน และผลกระทบของปัญหานี้สร้างความเสียหายทั้งด้านการศึกษา จิตใจ สังคม และการเงินของเยาวชน การแก้ไขต้องอาศัยความร่วมมือจากครอบครัว โรงเรียน และสังคมในระยะยาว 2.สาเหตุการเล่นพนันคาสิโนออนไลน์ของเด็กและเยาวชนในกรุงเทพมหานครสามารถแบ่งเป็น 3 ปัจจัยหลัก ได้แก่ ปัจเจกบุคคล จิตวิทยา และสังคม พบว่าเยาวชนมักตัดสินใจเล่นพนันโดยประเมินความเสี่ยงและผลตอบแทนที่คาดว่าจะได้รับ โดยอาจได้รับอิทธิพลจากการเลียนแบบพฤติกรรมในสื่อออนไลน์หรือกลุ่มเพื่อน การโฆษณาที่ดึงดูด และการเสริมกำลังทั้งทางบวกและลบ นอกจากนี้ ปัจจัยทางสังคม เช่น ความสัมพันธ์ที่ไม่แข็งแรงกับครอบครัว การขาดกิจกรรมสร้างสรรค์ หรือความรู้สึกว่างเปล่าทางจิตใจ ล้วนมีส่วนผลักดันให้เยาวชนเข้าสู่วงจรการพนันออนไลน์มากขึ้น

การศึกษาเรื่อง กระบวนการยุติธรรมในการใช้มาตรการคุ้มครองสวัสดิภาพผู้ถูกกระทำด้วยความรุนแรงในครอบครัวต่อกลุ่มคนรุ่นใหม่ (Gen-Z) ของศาลเยาวชนและครอบครัวภายใต้บริบทสังคมไทย มีวัตถุประสงค์เพื่อศึกษาถึงทัศนะ มุมมอง ความเชื่อ ค่านิยม ของกลุ่มคนรุ่นใหม่ (Gen-Z) ต่อสถาบันครอบครัว และความรุนแรงในครอบครัว และศึกษาถึงทัศนะ มุมมอง ความเชื่อ ค่านิยม ของ บิดา มารดา ผู้ปกครอง ผู้กระทำความรุนแรง และผู้ถูกกระทำความรุนแรงที่เป็นกลุ่มคนรุ่นใหม่ (Gen-Z) ที่เข้าสู่กระบวนการคุ้มครองสวัสดิภาพของศาลเยาวชนและครอบครัว ตลอดจนศึกษาบทบาทการดำเนินงาน และปัญหาอุปสรรคของกระบวนการยุติธรรมของศาลเยาวชนและครอบครัวในการคุ้มครองสวัสดิภาพบุคคลที่ถูกกระทำด้วยความรุนแรงในครอบครัว เพื่อความเข้าใจและพัฒนาแนวทางแก้ไขป้องกันความรุนแรงในครอบครัว โดยวิธีการในการดำเนินการวิจัยเป็นแบบผสมผสาน คือการวิจัยเชิงปริมาณผ่านการสำรวจความคิดเห็นกลุ่มคนรุ่นใหม่ (Gen-Z) ที่กำลังศึกษาอยู่ในระดับมหาวิทยาลัย 400 คน และการวิจัยเชิงคุณภาพด้วยการวิเคราะห์และสังเคราะห์ข้อมูลจากการสัมภาษณ์เชิงลึก ผู้กระทำความรุนแรงในครอบครัวซึ่งเป็นบิดามารดาหรือผู้ปกครอง และ ผู้ถูกกระทำด้วยความรุนแรงในครอบครัวที่เป็นกลุ่มคนรุ่นใหม่ (Gen-Z) ซึ่งเป็นบุตรหรือผู้อยู่ภายใต้การปกครอง ตลอดจนผู้ที่เกี่ยวข้องในกระบวนการยุติธรรมในการใช้มาตรการคุ้มครองสวัสดิภาพของศาลเยาวชนและครอบครัวผลการศึกษาพบว่าทัศนะของกลุ่มคนรุ่นใหม่ Gen-Z ส่วนใหญ่มีพื้นฐานความเชื่อ ค่านิยมต่าง ๆ เกี่ยวกับครอบครัวคล้ายกับคนในยุคก่อน โดยยังเห็นว่าครอบครัวมีความสำคัญ แต่มีการรับรู้ถึงสิทธิมนุษยชนขั้นพื้นฐานในครอบครัวที่ไม่ควรมีการละเมิดทั้งทางร่างกายและจิตใจเด่นชัดขึ้น และส่วนหนึ่งมีมุมมองสะท้อนให้เห็นภาพสถาบันครอบครัวที่แตกต่างออกไป เช่น บ้านไม่ใช่พื้นที่ปลอดภัย พ่อแม่ไม่ควรคาดหวังให้ลูกมาดูแลในวัยชรา เป็นต้น ซึ่งเป็นมุมมองไปทางเดียวกันกับผู้ถูกกระทำความรุนแรงที่เข้าสู่กระบวนการคุ้มครองสวัสดิภาพของศาลเยาวชนและครอบครัวได้แสดงมุมมองต่อศาลหรือบุคคลในกระบวนการยุติธรรม สำหรับผู้กระทำความรุนแรงนั้น ส่วนใหญ่จะคิดว่าการกระทำของตนเองไม่เป็นความรุนแรง แต่เมื่อเข้าสู่กระบวนการและปฏิบัติตามคำสั่งศาลที่ออกเพื่อช่วยยับยั้งไม่ให้กระทำความรุนแรง และเพื่อแก้ไขบำบัดฟื้นฟูแล้ว ก็ยอมรับว่าช่วยให้สถานการณ์ในครอบครัวดีขึ้นสามารถเดินหน้าต่อไปได้ สะท้อนว่าบริบทของความรุนแรง ในครอบครัวได้เปลี่ยนแปลงไปตามแนวคิดใหม่ ซึ่งผู้ที่เกี่ยวข้องในกระบวนการยุติธรรมในเรื่องนี้ต้องทบทวนและตระหนักถึงบริบทที่แปรเปลี่ยนไปดังกล่าวเพื่อสร้างสมดุลและสันติภาพภายในบ้าน อีกทั้งในระดับ มหภาคเพื่อช่วยกันรณรงค์ หรือกำหนดนโยบาย หรือกฎหมาย เพื่อสร้างสรรค์สังคมที่สงบสุขไร้ความรุนแรงอย่างยั่งยืน

แนวทางเพิ่มประสิทธิภาพการป้องกันการเปิดบัญชีม้าของเด็กและเยาวชน, ธัญชนก จ้อยสำเภา

การวิจัยเรื่อง “แนวทางในการเพิ่มประสิทธิภาพการป้องกันการเปิดบัญชีม้าของเด็กและเยาวชน” มีวัตถุประสงค์ 1) เพื่อศึกษาสภาพปัญหา และสาเหตุการเปิดบัญชีม้าของเด็กและเยาวชน 2) เพื่อศึกษาปัญหาและอุปสรรคในการป้องกันปราบปรามการเปิดบัญชีม้าของเด็กและเยาวชน 3) เพื่อเสนอแนะแนวทางในการเพิ่มประสิทธิภาพการป้องกันการเปิดบัญชีม้าของเด็กและเยาวชน โดยอาศัยข้อมูลจากการวิจัยเชิงคุณภาพและใช้การสัมภาษณ์เชิงลึกกับผู้ให้ข้อมูลสำคัญจำนวน 15 คน โดยแบ่งออกเป็น 4 กลุ่ม ได้แก่ เจ้าหน้าที่รัฐที่มีหน้าที่ออกมาตรการทางกฎหมาย เจ้าหน้าที่บังคับใช้กฎหมาย พนักงานธนาคาร และผู้เชี่ยวชาญด้านเด็กและเยาวชน ผลการศึกษาพบว่า ปัจจัยที่ส่งผลให้เด็กและเยาวชนตกเป็นเหยื่อบัญชีม้า มีปัจจัยสำคัญ 3 ประการ ได้แก่ 1) การขาดความรู้ความเข้าใจเกี่ยวกับอาชญากรรมทางการเงินและผลกระทบของการเป็นบัญชีม้า 2) การขาดการดูแลและคำแนะนำจากครอบครัว ทำให้เยาวชนถูกชักจูงได้ง่าย และ 3) แรงจูงใจทางเศรษฐกิจที่เด็กและเยาวชนได้รับค่าตอบแทนเป็นที่น่าดึงดูด อย่างไรก็ตาม ผลการศึกษายังชี้ให้เห็นถึงความสำคัญของบทบาทผู้ปกครองและหน่วยงานรัฐในการให้ความรู้และการเสริมสร้างภูมิคุ้มกันให้แก่เด็กและเยาวชน รวมถึงการกำหนดนโยบายที่ชัดเจนและครอบคลุม เช่น การจำกัดการเปิดบัญชีใหม่เพื่อป้องกันการกระทำผิด การวิจัยนี้เสนอแนวทางป้องกันเด็กและเยาวชนจากการตกเป็นเหยื่อบัญชีม้า โดยการให้ความรู้เกี่ยวกับภัยที่อาจเกิดขึ้น รวมถึงการเสริมสร้างทักษะการคิดวิเคราะห์และการระวังภัยทางการเงินให้แก่เยาวชนอย่างเหมาะสมเพื่อเป็นการลดปัจจัยเสี่ยงและเสริมสร้างภูมิคุ้มกันให้เยาวชนไทย

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์การนำเทคโนโลยีปัญญาประดิษฐ์ (AI) มาใช้ในการป้องกันอาชญากรรมบนท้องถนน (Street Crime) รวมถึงการระบุปัญหาและข้อจำกัดในการใช้งานเทคโนโลยีดังกล่าว เพื่อเสนอแนะแนวทางที่มีประสิทธิภาพสำหรับการป้องกันอาชญากรรมบนท้องถนนในบริบทของกองบัญชาการตำรวจนครบาล โดยเป็นการวิจัยเชิงคุณภาพ (Qualitative Research) ที่ใช้ทั้งการศึกษาข้อมูลจากเอกสาร (Documentary Research) และการสัมภาษณ์เชิงลึก (In-depth Interview) กลุ่มตัวอย่างที่ศึกษาเป็นกลุ่มเฉพาะเจาะจง (Purposive Sampling) ประกอบด้วยเจ้าหน้าที่ตำรวจผู้ปฏิบัติหน้าที่ นักอาชญาวิทยา นักพัฒนาเทคโนโลยี AI นักวิชาการเทคโนโลยี AI และนักกฎหมายด้านเทคโนโลยี AI รวมจำนวน 13 คน ผลการวิจัยพบว่า AI ไปใช้ในการป้องกันอาชญากรรมบนท้องถนน (Street crimes) ได้ 4 ประการ ดังนี้ 1. การวิเคราะห์ข้อมูล จากกล้องวงจรปิด (CCTV Analytics) 2. การจดจำใบหน้า (Facial Recognition) 3. การติดตามยานพาหนะ (Vehicle Tracking) 4.การยับยั้งและข่มขู่ผู้กระทำความผิดด้วย การติดตั้งกล้องวงจรปิด สำนักงานตำรวจแห่งชาติได้เริ่มนำ AI มาใช้ในพื้นที่นำร่องบางแห่งในกรุงเทพมหานคร แต่ยังไม่ได้ขยายการใช้งานให้ครอบคลุมทั่วประเทศ ประเทศไทยยังขาดความพร้อมในหลายด้านสำหรับการนำ AI มาใช้ในการป้องกันอาชญากรรม การทำงานร่วมกันระหว่างมนุษย์และ AI สามารถเพิ่มประสิทธิภาพในการป้องกันอาชญากรรมได้ดีกว่าการใช้อย่างใดอย่างหนึ่งเพียงลำพัง อีกทั้งการติดตั้งกล้องวงจรปิดที่ทำงานร่วมกับ AI ยังช่วยยับยั้งอาชญากรรมผ่านผลทางจิตวิทยาต่อผู้กระทำผิด อย่างไรก็ตาม การนำเทคโนโลยี AI มาใช้ยังมีปัญหาและข้อจำกัดสำคัญ เช่น ปัญหาอุปสรรคของการป้องกันอาชญากรรมโดยใช้เทคโนโลยีปัญญาประดิษฐ์ 1) ความแม่นยำของ AI 2) ด้านกฎหมาย งบประมาณในการติดตั้งระบบ AI และกล้องวงจรปิด การฝึกอบรมเจ้าหน้าที่ตำรวจให้สามารถใช้งานเทคโนโลยีนี้ได้อย่างมีประสิทธิภาพ ความเสี่ยงต่อการเกิดอคติ (bias) การวิจัยนี้จึงข้อเสนอแนะอาทิ สำนักงานตำรวจแห่งชาติกำหนดนโยบายในการวิเคราะห์สถิติการเกิดอาชญากรรมในแต่ละกองบังคับการตำรวจนครบาลและกำหนดพื้นที่ที่มีอัตราการเกิดอาชญากรรมสูงเพื่อทดลองใช้ AI ในการตรวจจับและป้องกันอาชญากรรม รวมทั้งการพัฒนาระบบ AI และการสร้างกรอบการทำงานที่เหมาะสมเพื่อสนับสนุนการใช้งานอย่างยั่งยืนและมีประสิทธิภาพในบริบทของการป้องกันอาชญากรรมในประเทศไทย

วิทยานิพนธ์เรื่องแนวทางการป้องกันการกระทำผิดเกี่ยวกับหนังสือเดินทาง ในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาสถานการณ์การกระทำผิดเกี่ยวกับหนังสือเดินทาง ในประเทศไทย พร้อมทั้งวิเคราะห์สภาพปัญหาด้านการป้องกันการกระทำผิดเกี่ยวกับ หนังสือเดินทาง เพื่อนำไปสู่แนวทางการป้องกันการกระทำผิดเกี่ยวกับหนังสือเดินทาง ในประเทศไทย โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเอกสารและการสัมภาษณ์เชิงลึกจาก ผู้ให้ข้อมูลสำคัญ ประกอบด้วย เจ้าหน้าที่ตำรวจตรวจคนเข้าเมือง ระดับบริหารและ ระดับปฏิบัติการ จำนวนทั้งสิ้น 23 ท่าน ผลการศึกษาพบว่า สถานการณ์การกระทำผิดเกี่ยวกับหนังสือเดินทาง ในประเทศไทยที่สำคัญ ได้แก่ 1) รูปแบบการกระทำผิดเกี่ยวกับหนังสือเดินทางที่พบได้ทั่วไป 2) การกระทำผิดของแรงงาน 4 สัญชาติ 3) การใช้หนังสือเดินทางไทยโดยมิชอบ 4) การใช้ประเทศไทยเป็นทางผ่านในการกระทำผิดเกี่ยวกับหนังสือเดินทาง 5) ผลกระทบของการกระทำผิดต่อประเทศไทย และ 6) แนวโน้มการกระทำผิดและพฤติกรรมปกปิดตัวตนในประเทศไทย และเมื่อวิเคราะห์สภาพปัญหาด้านการป้องกันการกระทำผิดเกี่ยวกับหนังสือเดินทางในประเทศไทย พบสภาพปัญหา 7 ด้าน ได้แก่ 1) มุมมองของรัฐ 2) กฎหมาย 3) การบังคับใช้กฎหมาย 4) งบประมาณ 5) เทคโนโลยี 6) ความร่วมมือระหว่างประเทศ และ 7) บุคลากร ซึ่งภาพสะท้อนเหล่านี้นำไปสู่แนวทางการป้องกันการกระทำผิดเกี่ยวกับหนังสือเดินทางในประเทศไทย โดยผู้วิจัยเสนอให้สำนักงานตรวจคนเข้าเมืองจัดให้มีการฝึกอบรมแก่บุคลากร จัดตั้งศูนย์ข้อมูลหนังสือเดินทางอย่างเป็นทางการเพื่อสนับสนุนการทำงานแก่เจ้าหน้าที่ โดยเจ้าหน้าที่จะต้องมีความตระหนักในบทบาทหน้าที่ของตนอยู่เสมอ อีกทั้งการพัฒนาเทคโนโลยีด้านความปลอดภัย ที่เกี่ยวกับหนังสือเดินทางและงานตรวจคนเข้าเมืองจะช่วยเพิ่มประสิทธิภาพด้านความมั่นคง มากขึ้น รวมถึงการขยายผลการจับกุมที่จะช่วยป้องกันการกระทำความผิดซ้ำต่อไป

การวิจัยนี้มีวัตถุประสงค์เพื่อวิเคราะห์สาเหตุของปัญหา อุปสรรค และข้อขัดข้องในการบังคับใช้พระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 ในชั้นการสอบสวนของพนักงานสอบสวนในสังกัดกองบัญชาการตำรวจนครบาล โดยมุ่งเน้นศึกษาบริบทของกรุงเทพมหานคร ผู้วิจัยเลือกใช้วิธีการวิจัยเชิงคุณภาพโดยค้นคว้าข้อมูลเชิงเอกสาร และการสัมภาษณ์แบบกึ่งโครงสร้าง ซึ่งเป็นเก็บข้อมูลจากผู้ให้ข้อมูลสำคัญจำนวน 4 กลุ่ม ได้แก่ พนักงานสอบสวนที่มีประสบการณ์ในการปฏิบัติงานในกองบัญชาการตำรวจนครบาล ผู้ไกล่เกลี่ยที่มีหน้าที่ไกล่เกลี่ยในคดีอาญา พนักงานอัยการ และคณะกรรมาธิการร่างพระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 ผลการวิจัยพบว่า ถึงแม้พระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 มีเจตนารมณ์ในการลดภาระของระบบยุติธรรม ลดปริมาณคดีที่เข้าสู่ศาล และลดจำนวนผู้ต้องขังในเรือนจำ แต่ปัญหาที่พบคือพนักงานสอบสวนกลับไม่นำมาใช้จริงในทางปฏิบัติ เนื่องจากกระบวนการมีความซับซ้อนมากกว่าการดำเนินคดีโดยทั่วไป พนักงานสอบสวนขาดแรงจูงใจในการปฏิบัติโดยไม่ได้รับค่าตอบแทนจากการดำเนินสำนวนการไกล่เกลี่ย อีกทั้งประชาชนยังขาดความเข้าใจเกี่ยวกับกระบวนการไกล่เกลี่ยข้อพิพาท ซึ่งส่งผลให้พวกเขาไม่ยินยอมเข้าสู่กระบวนการไกล่เกลี่ยข้อพิพาท ดังนั้นสำนักงานตำรวจแห่งชาติจึงควรแก้ไขปัญหาโดยการให้ความรู้ประชาชน เพิ่มค่าตอบแทนให้กับพนักงานสอบสวน และจัดให้มีผู้ช่วยพนักงานสอบสวนเพื่อช่วยดำเนินการแทนพนักงานสอบสวน เพื่อเพิ่มประสิทธิภาพการทำงานและอันจะเป็นประโยชน์ต่อประชาชนต่อไป

In this paper, we discuss the challenges and rewards of carrying out qualitative research on the police in the African American1 community. Using data drawn from interviews with seventy-seven African American adults in Durham, NC, we found that community member hostility toward research(ers) and fear of both neighbors and the police lowered African Americans’ willingness to be interviewed about their perceptions of and experiences with U.S. police. These findings were observed primarily in public housing and middle-income communities. The Dobbs decision has created both opportunities and challenges in the classroom. On one hand, Dobbs animated student interest, increasing awareness of reproduction. On the other hand, media coverage of Dobbs primed students—particularly those who had not been exposed to reproductive justice—to think about abortion access in isolation from other topics and from an exclusively U.S. perspective. การวิจัยเรื่อง “แนวทางการปรับปรุงกระบวนการยุติธรรมทางอาญาเพื่อคุ้มครองสิทธิผู้เสียหายคดีข่มขืนกระทำชำเรา” มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาในการปฏิบัติต่อผู้เสียหายในการดำเนินคดีข่มขืนกระทำชำเราในประเทศไทย และศึกษาแนวทางในการปรับปรุงกระบวนการยุติธรรมทางอาญาเพื่อคุ้มครองผู้เสียหายคดีข่มขืนกระทำชำเราในประเทศไทย โดยใช้การวิจัยเชิงคุณภาพ ด้านการวิจัยเอกสารและเทคนิคการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 10 คน จากบุคลากรในกระบวนการยุติธรรม สหวิชาชีพที่เกี่ยวข้องกับกระบวนการยุติธรรม เครือข่ายภาคประชาสังคม และนักวิชาการกฎหมายและกระบวนการยุติธรรม ผลการศึกษาพบว่า สภาพปัญหาในการปฏิบัติต่อผู้เสียหายในการดำเนินคดีข่มขืนกระทำชำเราในประเทศไทย เกิดจากสภาพปัญหาหลัก 5 ด้าน คือ 1) ด้านผู้เสียหาย 2) ด้านสังคม 3) ด้านกฎหมาย 4) ด้านกระบวนการยุติธรรม 5) ด้านคุ้มครองสิทธิ ทั้งนี้ จากงานวิจัยค้นพบว่า กระบวนการยุติธรรมทางอาญาในปัจจุบันยังคุ้มครองสิทธิผู้เสียหายคดีข่มขืนกระทำชำเราไม่ครอบคลุมเพียงพอ จึงควรปรับปรุงกระบวนการยุติธรรมทางอาญา โดยเริ่มตั้งแต่การให้ความสำคัญต่อสิทธิผู้เสียหายคดีข่มขืนกระทำชำเราอย่างชัดเจน รับรองสิทธิผู้เสียหายคดีข่มขืนกระทำชำเราด้วยการบัญญัติกฎหมายไว้เป็นการเฉพาะ เพิ่มความเชื่อมโยงระหว่างหน่วยงานในกระบวนการยุติธรรมเพื่อลดขั้นตอนที่ทับซ้อน สร้างองค์ความรู้แก่บุคลากรในกระบวนการยุติธรรมด้วยการจัดทำคู่มือแนวทางการปฏิบัติงานเพื่อที่จะได้ปฏิบัติต่อผู้เสียหายคดีข่มขืนกระทำชำเราได้อย่างเหมาะสม ทำให้ผู้เสียหายคดีข่มขืนกระทำชำเราลดสภาวะการตกเป็นเหยื่ออีกครั้ง และเต็มใจให้ความร่วมมือกับกระบวนการยุติธรรมในการนำตัวผู้กระทำความผิดมาลงโทษสมดังเจตนารมณ์ของกฎหมาย

This study is a replication study of McGrath, Lasher, and Cumming's 2012 study. McGrath et al.'s population consisted of convicted Vermont sex offenders, while this replication study's population consisted of convicted Iowa sex offenders. Nearly 2,000 sex offenders are under the Iowa Department of Corrections community supervision (Daily Statistics-DOC Offender, 2023). Iowa uses SOTIPS, Static-99R, and the Iowa Risk Revised (IRR) to determine recidivism risk and supervision levels. Adolescent Black girls often experience marginalization in schools due to zero-tolerance policies, oppressive classroom curricula, and teachers who lack cultural competency. The literature on adolescent Black girls in school revealed that there are spaces within schools that can serve as homeplaces for Black girls. This study explored how adolescent Black girls experienced homeplace in an afterschool club at a predominantly White middle school in Decatur, Georgia. How to display questions that are part of a battery in self-administered surveys is an important decision. Battery items may be displayed in a grid in a mail survey or computer web survey, but are often displayed as individual items on mobile devices.
