Government-funded adult English as a second language (ESL) programs in Anglophone countries increasingly encounter students with histories of trauma, displacement, and structural adversity due to existing and emerging geopolitical conflicts and unsettling sociopolitical realities. These conditions shaping English language teaching (ELT) inevitably influence learners’ cognitive and emotional engagement in language learning, as well as their relationships with teachers and peers. This study examines the visibility and invisibility of sexuality-related terms in four Asian Englishes using data from the International Corpus of English (ICE). Drawing on Wilkinson’s (2022) sexuality-related lexical set and informed by scholarship on heteronormativity, the study analyzes the proportional visibility of 19 target lexemes across Englishes in Hong Kong, the Philippines, Singapore, and India. The findings show that only a small subset of terms (gay, lesbian, same sex, sexual preference, bisexual, and sexual orientation) appear in the corpora, and even these occur at low frequencies. ในช่วงของการเปลี่ยนผ่านจากการใช้วิธีพิจารณาความแบบโบราณตามกฎหมายตราสามดวงมาสู่การจัดทำประมวลกฎหมายวิธีพิจารณาความแพ่ง สยามในยุคปฏิรูประบบกฎหมายได้ใช้วิธีการตรากฎหมายวิธีพิจารณาความใช้ไปพลางก่อนในการชำระคดีแพ่ง เช่น พระราชบัญญัติลักษณะพยาน ร.ศ. 113 และ พระราชบัญญัติกระบวนพิจารณาความแพ่ง ร.ศ. 115 จากการศึกษาพบว่ากฎหมายวิธีพิจารณาความดังกล่าวได้รับอิทธิพลอย่างมากจากกฎหมายวิธีพิจารณาความของอังกฤษ ทั้งนี้ เนื่องจากปัจจัยหลายประการ เช่น สนธิสัญญาเบาว์ริงและการเกิดขึ้นของศาลกงสุลอังกฤษ อิทธิพลของกฎหมายอังกฤษต่อนักกฎหมายชาวไทยผ่านระบบการศึกษา ตลอดจนอิทธิพลของประเทศอังกฤษเหนือดินแดนบางส่วนของสยาม แนวคิดวิธีพิจารณาความตามแบบกฎหมายอังกฤษจึงได้รับการส่งต่อเรื่อยมาในกฎหมายวิธีพิจารณาความแพ่งของไทยตั้งแต่ในอดีตจนกระทั่งในประมวลกฎหมายวิธีพิจารณาความแพ่งฉบับปัจจุบัน บทความนี้มีวัตถุประสงค์ในการศึกษาความเป็นมาเชิงประวัติศาสตร์ของกฎหมายวิธีพิจารณาความแพ่งของไทยตั้งแต่วิธีพิจารณาความแบบโบราณตามกฎหมายตราสามดวงจนถึงการจัดทำประมวลกฎหมายวิธีพิจารณาความแพ่ง เพื่อชี้ให้เห็นถึงอิทธิพลของกฎหมายอังกฤษที่มีต่อกฎหมายวิธีพิจารณาความแพ่งของไทย

บทความนี้ศึกษาวิวัฒนาการของความรับผิดทางอาญาของนิติบุคคลในประเทศฝรั่งเศสผ่านแนวคิด personnes morales ซึ่งบัญญัติไว้ในมาตรา 121-2 แห่งประมวลกฎหมายอาญาฝรั่งเศส โดยศึกษาแนวคิดนี้ภายใต้กรอบของความรับผิดของนิติบุคคลต่ออาชญากรรมร้ายแรง โดยเฉพาะอย่างยิ่งในบริบทของกฎหมายอาญาระหว่างประเทศ ซึ่งโดยหลักแล้วกำหนดความรับผิดแก่บุคคลธรรมดาเท่านั้น คำถามวิจัยหลักของการศึกษานี้คือ แนวคิด personnes morales ของฝรั่งเศสช่วยอุดช่องว่างของความรับผิดทางอาญาในกรณีที่นิติบุคคลได้เข้ามามีส่วนร่วมในการกระทำความผิดอาญาร้ายแรงตามธรรมนูญกรุงโรมได้หรือไม่ และแนวคิดนี้สามารถนำมาใช้กับความรับผิดทางอาญาระหว่างประเทศได้เพียงใด บทความได้วิเคราะห์คดีสำคัญ เช่น คดีอื้อฉาวทางเภสัชกรรม Mediator คดี Lafarge S.A. ในซีเรีย และคำพิพากษา Association Sportive ซึ่งตัดสินโดยศาลอาญาของฝรั่งเศส โดยที่ศาลได้วางหลักเกี่ยวกับเจตนาของนิติบุคคล (corporate mens rea) ผสมผสานกับความรับผิดโดยอาศัยการเป็นตัวแทนและความรับผิดโดยอิสระขององค์กร รวมถึงวิธีที่ศาลฝรั่งเศสบังคับใช้บทลงโทษกับนิติบุคคลได้อย่างมีประสิทธิภาพ นอกจากนี้ ยังมีการอ้างอิงเปรียบเทียบกับสหราชอาณาจักรและสวีเดนเพื่อแสดงให้เห็นแนวทางทางเลือกอื่น ๆ และเน้นย้ำว่าระบบฝรั่งเศสมีส่วนช่วยในการพัฒนาแนวคิดความรับผิดทางอาญาของนิติบุคคลอย่างไร ท้ายที่สุด บทความนี้ชี้ให้เห็นว่าหลักคำสอนของ personnes morales ไม่เพียงแต่เป็นกรอบแนวคิดเชิงปฏิบัติเท่านั้น แต่ยังเป็นแนวทางเชิงทฤษฎีที่สามารถแก้ไขปัญหาช่องว่างของความรับผิดในกฎหมายอาญาระหว่างประเทศได้และเสนอข้อคิดสำคัญสำหรับการปฏิรูปในอนาคตเพื่อเสริมสร้างความรับผิดชอบของภาคธุรกิจในระดับข้ามเขตอำนาจศาล

บทความวิจัยนี้มุ่งศึกษาความสัมพันธ์ระหว่างหลักกฎหมายว่าด้วยหนี้ตามประมวลกฎหมายแพ่งและพาณิชย์ กับหลักเกณฑ์การเสนอคดีตามประมวลกฎหมายวิธีพิจารณาความแพ่ง อันเป็นกลไกสำคัญในการบังคับใช้สิทธิของเจ้าหนี้ในทางปฏิบัติ เนื่องจาก “หนี้” เป็นบุคคลสิทธิ เจ้าหนี้จึงไม่อาจบังคับชำระหนี้ได้ด้วยตนเอง แต่ต้องเสนอคดีต่อศาลเพื่อบังคับให้ชำระหนี้ การวิจัยนี้เป็นการวิจัยเชิงหลักกฎหมาย (Doctrinal Legal Research) โดยวิเคราะห์ประเด็นสำคัญเกี่ยวกับหนี้ 7 ประการ ได้แก่ การบอกกล่าวลูกหนี้กับอำนาจฟ้อง การบังคับชำระหนี้ การเรียกดอกเบี้ยกรณีลูกหนี้ผิดนัด การใช้สิทธิเรียกร้องของลูกหนี้ การโอนสิทธิเรียกร้อง การเพิกถอนการฉ้อฉล และอายุความบังคับจำนอง ทั้งนี้ ผู้วิจัยได้จำแนกบทบัญญัติว่าด้วยหนี้ออกเป็น 3 ประเภท ได้แก่ (1) บทบัญญัติที่มีเนื้อหาไม่ครอบคลุมเกี่ยวกับการเสนอคดี (2) บทบัญญัติที่กำหนดวิธีไว้แต่ไม่ครบถ้วนหรือมีปัญหาในการตีความ และ (3) บทบัญญัติที่ไม่สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง แล้วนำมาวิเคราะห์เชื่อมโยงกับบทบัญญัติในประมวลกฎหมายวิธีพิจารณาความแพ่ง รวมถึงศึกษาจากตำราและแนวคำพิพากษาศาลฎีกา ผลการศึกษาพบว่า การบังคับใช้กฎหมายว่าด้วยหนี้ให้มีประสิทธิภาพ จำเป็นต้องตีความและบังคับใช้สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง ซึ่งผลลัพธ์ของงานวิจัยนี้จะช่วยลดปัญหาทางปฏิบัติและเสริมสร้างความเข้าใจที่ถูกต้องแก่ผู้ศึกษากฎหมายและผู้ปฏิบัติงานในคดีแพ่ง

คำชี้ขาดที่เกิดจากกระบวนการอนุญาโตตุลาการระหว่างประเทศมักจะลงท้ายด้วยส่วนที่เป็นประกาศิต 2 ส่วน ส่วนแรกเป็นคำชี้ขาดที่ว่าด้วยจำนวนค่าเสียหาย ค่าสินไหมทดแทนที่ฝ่ายแพ้คดีจะต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดีหรือปฏิบัติการชำระหนี้รูปแบบอื่นให้แก่ฝ่ายที่ชนะคดี รวมเรียกว่าเป็นคำชี้ขาดในเนื้อความแห่งคดี ส่วนที่สองเป็นคำชี้ขาดในเรื่องค่าใช้จ่ายซึ่งมักกำหนดจำนวนค่าใช้จ่ายในการอนุญาโตตุลาการที่ฝ่ายแพ้คดีต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดี เรียกว่าคำชี้ขาดในส่วนค่าใช้จ่าย ค่าใช้จ่ายในการอนุญาโตตุลาการมีจำนวนสูงขึ้นอย่างสม่ำเสมอ แม้ว่าเทคโนโลยีจะได้รับการพัฒนาให้ก้าวหน้าอย่างต่อเนื่องและมีการนำเอาเทคโนโลยีมาใช้ในกระบวนการอนุญาโตตุลาการอย่างกว้างขวางก็ตาม คู่พิพาทฝ่ายที่แพ้คดีอนุญาโตตุลาการระหว่างประเทศนอกจากต้องแบกรับภาระค่าใช้จ่ายของตนแล้วยังจะถูกบังคับโดยคำชี้ขาดให้เข้ารับภาระหรือชดใช้ค่าใช้จ่ายของฝ่ายที่ชนะคดีด้วย ทั้งนี้เป็นไปตามหลักเกณฑ์ที่ว่า “Costs follow the event” หรือ “ผู้แพ้เป็นผู้รับผิดชอบค่าใช้จ่าย” ที่ถือปฏิบัติกันอยู่ในวงการอนุญาโตตุลาการระหว่างประเทศ หลักเกณฑ์นี้กำเนิดขึ้นในประเทศอังกฤษ ต่อมาถูกนำไปใช้กันอย่างแพร่หลายทั่วโลกทั้งในประเทศคอมมอนลอว์และประเทศซิวิลลอว์ คู่พิพาทที่หวั่นวิตกว่าจะต้องรับภาระค่าใช้จ่ายที่สูงลิ่วหากตนตกเป็นฝ่ายแพ้คดี สามารถนำเอาวิธีการยื่นคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทมาใช้เป็นเครื่องมือจำกัดหรือลดค่าใช้จ่ายดังกล่าว หลักปฏิบัติในเรื่องการทำคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทถือเป็นเรื่องใหม่สำหรับประเทศไทย ผู้เขียนมีความประสงค์ที่จะนำเสนอหลักกฎหมายและประเพณีปฏิบัติในเรื่องดังกล่าวที่แพร่หลายอยู่ในสถาบันอนุญาโตตุลาการหลักของโลกให้ผู้ประกอบธุรกิจและนักกฎหมายไทยได้รับทราบและนำไปใช้ให้เป็นประโยชน์หากต้องเข้าไปเกี่ยวพันกับการอนุญาโตตุลาการระหว่างประเทศ

บทความวิจัยนี้มุ่งศึกษาถึงแนวคิดและหลักความรับผิดเพื่อละเมิด โดยเฉพาะความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นอันเกิดจากข้อสันนิษฐานความรับผิดตามกฎหมายภายใต้แนวคิดที่ว่าบุคคลนั้นอาจมีส่วนผิดอยู่ด้วยในการที่เกิดความเสียหายแก่บุคคลอื่น หรือมีความบกพร่องในการควบคุมดูแลจึงเกิดความเสียหายขึ้น การศึกษาวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยเน้นการวิจัยเอกสารโดยศึกษาค้นคว้าจากหนังสือ งานวิจัย วิทยานิพนธ์ ตลอดจนบทบัญญัติกฎหมายที่เกี่ยวข้องกับความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นทั้งภาษาไทยและภาษาต่างประเทศ โดยนำข้อมูลต่าง ๆ มาศึกษาและวิเคราะห์เพื่อนำมาพัฒนากฎหมายความรับผิดเพื่อละเมิด จากการศึกษาพบว่ากฎหมายได้กำหนดความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นเอาไว้หลายกรณีโดยพิจารณาจากความสัมพันธ์ตามกฎหมาย ตามสัญญา ตามหน้าที่ในฐานะพิเศษ เช่น ความรับผิดของนายจ้างลูกจ้าง ความรับผิดของตัวการตัวแทน ความรับผิดของบิดามารดา ความรับผิดของครูบาอาจารย์ แต่ไม่พบกรณีความรับผิดของคู่สมรส ซึ่งคู่สมรสนั้นถือว่าเป็นบุคคลที่มีนิติสัมพันธ์ระหว่างกันตามกฎหมายอันก่อให้เกิดสิทธิ หน้าที่ และความรับผิด ด้วยเหตุนี้ จึงสมควรแก้ไขปรับปรุงกฎหมายโดยเฉพาะในเรื่องความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นของคู่สมรสเพื่อให้พัฒนาและสอดคล้องกับสภาพสังคม เพิ่มความระมัดระวังของบุคคลที่มีความสัมพันธ์เกี่ยวข้องในการดำเนินชีวิตทางสังคม ตลอดจนมุ่งเยียวยาและเพิ่มโอกาสให้ผู้ที่ได้รับความเสียหายได้รับการชดใช้ค่าสินไหมทดแทนอย่างเป็นธรรมอันเป็นไปตามเจตนารมณ์ของกฎหมายละเมิด

ภาษีทรัมป์กับองค์การการค้าโลก: ระบบการค้าเสรีแบบพหุภาคีล่มสลายแล้ว? (Trump Tariffs And The World Trade Organization: Has The Multilateral Free Trade System Collapsed?), Sakda Thanitcul

แม้ว่าองค์การการค้าโลกจะไม่สามารถทำอะไรกับภาษีทรัมป์ได้และปล่อยให้สหรัฐอเมริกาขึ้นอัตราภาษีกับประเทศคู่ค้า 59 ประเทศ ในรูปแบบการเจรจาแบบทวิภาคีก็ตาม แต่ระบบการค้าเสรีแบบพหุภาคีก็อาจยังไม่ถึงขั้นล่มสลาย เนื่องจากเหตุผลสองประการ ประการแรก คือ ประเทศคู่ค้า (ยกเว้นจีนและแคนาดา) ไม่ได้ขึ้นอัตราภาษีนำเข้าตอบโต้และสัดส่วนการค้าของสหรัฐอเมริกาในการค้าโลกคิดเป็นเพียงร้อยละ 11 เท่านั้น ประการที่สอง คือ ภาษีทรัมป์ที่มีพื้นฐานแนวคิดของลัทธิกีดกันทางการค้ามีความขัดแย้งอย่างมากกับแนวคิดพื้นฐานของเศรษฐศาสตร์กระแสหลักที่เชื่อในการค้าเสรีแบบพหุภาคี ทำให้เชื่อได้ว่าภาษีทรัมป์จะไม่ยั่งยืนตลอดไป อย่างไรก็ตาม มี “การแตกร้าว” ในระบบการค้าเสรีแบบพหุภาคีที่มีองค์การการค้าโลกเป็นผู้กำกับดูแลและบริหารกฎเกณฑ์ กล่าวคือ การไม่มีผู้ตัดสินในองค์กรอุทธรณ์ ส่งผลให้กลไกการระงับข้อพิพาทขององค์การการค้าโลกกลายเป็นอัมพาตและสหรัฐอเมริกาเป็นประเทศเดียวที่มีสถานะเหนือประเทศสมาชิกอื่น ๆ อีก 165 ประเทศ เนื่องจากเป็นสมาชิกประเทศเดียวในองค์การการค้าโลกที่สามารถกำหนดอัตราภาษีนำเข้าได้ตามอำเภอใจโดยอ้างเหตุผลด้านความมั่นคงของชาติ

Protecting Graduate Students From Burnout With Self-Compassion And Authenticity, Michael S. Leeman, Joshua J. Castleberry, Anna A. Ellenson, Morgan Wallbrown

This study investigated whether practicing self-compassion and embracing one's authentic self could protect graduate students from burnout. Researchers also empirically examined the mediating effect of authenticity in the relationship between self-compassion and burnout. A total of 318 master's degree students in a helping profession completed surveys assessing their levels of self-compassion, authenticity, and burnout. Results found that graduate students with higher levels of self-compassion and authenticity tended to have lower levels of burnout. Additionally, authenticity mediated the relationship between self-compassion and burnout. The findings suggest that practicing self-compassion and embracing one's authentic self may lead to lower levels of burnout …

Religious Trauma And Social Identity Af Santri: A Qualitative Study In A Pesantren Environment, Himmatuz Zakiyah

This qualitative study examines religious trauma experiences among Santri in a modern Indonesian pesantren, focusing on how teachers weaponize Qur'anic verses and hadiths as tools of symbolic violence. Data were collected through semi structured interviews with five Santri and alumni from Bumi Shalawat Islamic Boarding School, a pseudonym. Findings reveal that selective quotation, decontextualization, and threat based hermeneutics, which I term scriptural violence, are systematically used to enforce conformity, suppress doubt, and induce shame. This scriptural violence operates through three mechanisms. Theological gaslighting denies Santri's interpretive agency. Eschatological blackmail threatens divine punishment. Prophetic proof texting misuses hadiths to legitimize authoritarian …

Low levels of biological literacy among students, particularly in biotechnology, highlight the need for innovative digital learning media that facilitate meaningful and contextual learning experiences. This study aimed to develop and evaluate an interactive biotechnology e-module based on in silico vaccine design to improve students’ biological literacy. The study employed Educational Design Research (EDR) using the Hannafin and Peck model, which consists of three phases: needs assessment, development, and implementation. The participants included 73 tenth-grade science students and one biology teacher from SMAN 68 Jakarta, Indonesia. Parents often cite location and convenience as important factors in choosing a child care provider. We use data on individual mobility from GPS in cell phones to study commutes to each licensed early childhood care and education (ECE) provider in 14 states separately for center customers, center workers, and customers of home-based child care providers. We document five key facts about ECE customer and worker commutes. One, center customers and workers commute farther than home-based customers to ECE providers. Corporate borrowing creates safe claims for some households and concentrates residual risk in equity for others. This portfolio heterogeneity drives a supply-side channel through which corporate leverage conditions monetary transmission. Tightening erodes equity holders’ wealth while safe-asset holders are cushioned; the resulting income effect makes aggregate labor fall more at high leverage, raising the sacrifice ratio. A static model yields a closed-form hump in leverage, with the US range on the rising side, disciplined by Survey of Consumer Finances portfolio shares. A calibrated dynamic model roughly doubles the sacrifice ratio, and US local projections agree in sign, shape, and timing.

The Palestinian-Israeli conflict remains one of the major challenges in building sustainable peace through diplomacy. This study analyzes the role of emotions and perceptions in Palestinian-Israeli peace negotiations through the perspective of diplomacy psychology. Using an integrative literature review and an integrated theory approach that combines psychological theories and international relations theories, this study synthesizes empirical and conceptual findings on the Palestinian-Israeli peace negotiation process. The results of the analysis show that negative emotions such as fear, hatred, and anger worsen diplomatic relations and hinder peace deals. A study was carried out to examine the economic performance of small-scale vegetable farmers and how effectively they are using their resources in Ido Local Government Area of Oyo State. The study involved eighty vegetable farmers who were chosen randomly, and information was gathered from them using structured questionnaires. Different tools such as budget analysis, linear regression, frequency distribution, percentages, and the stochastic frontier production function were used to examine the data that was collected. The purpose of this study was to evaluate the effects of different class wide interdependent group contingencies on unsafe playground behavior and student preferences for each intervention. In Experiment 1, we assessed the effects of the Good Behavior Game (GBG) on unsafe behavior across three third-grade classes. The GBG effectively reduced unsafe playground behavior relative to baseline, though student-choice data indicated that students did not prefer the intervention. This finding prompted Experiment 2, in which we evaluated synchronous schedule of reinforcement (SSR) as a classwide interdependent group contingency and compared its effectiveness and preference to the GBG. This essay explores the figure of the tragic mulatta in Lydia Maria Child’s The Quadroons and Dion Boucicault’s The Octoroon, analyzing how mixed-race female characters critique the racial and gender hierarchies of 19th-century America. Using an intersectional lens, it examines how race, gender, and class shape the identities and tragic fates of Xarifa and Zoe—women who were socially excluded from both Black and White communities. The study aimed to explore the experiences of intellectual education teachers with behavioural problems among adolescent students with intellectual disabilities within intellectual education programmes. The study adopted a qualitative methodology by conducting interviews with a sample of intellectual education teachers in Riyadh city, analysing the data using thematic analysis following the framework proposed by Braun and Clarke.
