New Approaches To Customary International Law, Anthony D'Amato
New Approaches To Customary International Law, Anthony D'Amato
Faculty Working Papers
Reviews Eric A. Posner, The Perils of Global Legalism; Andrew T. Guzman, How International Law Works; Brian A. Lepard, Customary International Law.
After a century of benign neglect, international theorizing has taken off. The three contributors to legal theory reviewed here can be placed along a linear spectrum with Posner at the extreme political science end, Lepard at the opposite international law end and Andrew Guzman holding up the middle.
The Limits Of Constructivism: Can Rawls Condemn Female Genital Mutilation?, Andrew Koppelman
The Limits Of Constructivism: Can Rawls Condemn Female Genital Mutilation?, Andrew Koppelman
Faculty Working Papers
The strategy for coping with value pluralism that Rawls has proposed is to permit political decisions, at least with respect to basic rights, to depend only on those goods that can be inferred from the bare requirements of respectful relations between persons. His account offers such a parsimonious conception of the good that it cannot cognize some atrocities. I focus on one extreme human rights case: the practice of female genital mutilation (FGM), which, it is well established, violates basic human rights. Doubtless Rawls was appalled by the practice. Yet his theory cannot generate a basis for condemning it. A …
Fighting Fire With Flame: Visual Storytelling As The Antidote To Negative Media Imagery, Léna Sulpovar
Fighting Fire With Flame: Visual Storytelling As The Antidote To Negative Media Imagery, Léna Sulpovar
Capstone Collection
This paper is an examination of the power of art in building bridges between groups of people in conflict. Through two complementary case studies where theater and film are utilized as catalyst for dialogue, the paper highlights the impact of visual storytelling on the hearts and minds of participants entering the experience with certain prejudices towards and fear of the “other” group. In particular, it shows that complex visual stories and empathetic characters have the ability to increase understanding of other perspectives, transform perceptions, and even instill narratives that are contrary to the ones dominant within the given culture. Interviews …
The Mexican Cartel Debate: As Viewed Through Five Divergent Fields Of Security Studies, Robert J. Bunker
The Mexican Cartel Debate: As Viewed Through Five Divergent Fields Of Security Studies, Robert J. Bunker
CGU Faculty Publications and Research
The Mexican cartel debate is becoming increasingly more important to U.S. national security, however, it is also becoming ever more confused, heated, and at times downright nasty, with little agreement about what is taking place in Mexico or in other regions of the Americas, such as Guatemala, Honduras, and even this side of the U.S. border. To shed some light on this critical debate—a debate we need to have now and not later— it is the contention of this author that, since the Mexican cartel phenomena is being looked at by scholars from divergent fields of security studies and since …
Ambivalent Sovereignty: Inquiries Into The Dual Foundation Of Political Realism's Subject, Paul Timmermans
Ambivalent Sovereignty: Inquiries Into The Dual Foundation Of Political Realism's Subject, Paul Timmermans
Electronic Theses and Dissertations
Ambivalent Sovereignty inquires into the subject of political realism. This subject, sovereign authority, appears to have a dual foundation. It appears divided against itself, but how can realism nonetheless observe legitimate modes of sovereignty emerge? Against the liberal idea that a "synthesis" of both material-coercive and ideal-persuasive powers should be accomplished, within the world of international relations, realism gives meaning to a structural type of state power that is also constitutionally and legitimately dividing itself--against itself. Machiavelli but particularly also other realists such as Hannah Arendt, Max Weber, and Aristotle are being reinterpreted to demonstrate why each state's ultimate authority …
U.S. Foreign Policy In Lebanon: Adapting To Regional Threats Today And Promoting Stability For The Future, Robert Michael Shelala Ii
U.S. Foreign Policy In Lebanon: Adapting To Regional Threats Today And Promoting Stability For The Future, Robert Michael Shelala Ii
Electronic Theses and Dissertations
Since the 1800s, the United States has sought to advance its interests in what currently exists as the Lebanese Republic. This assessment will look at the shape that policy has taken since the 2006 Israel-Hezbollah war in the context of historical relations. After doing so, three questions will be addressed: What have been the policies of Iran and Syria toward Lebanon during this time period, how effective has U.S. policy been since 2006 in undermining Iranian and Syrian influence and what policies should the United States adopt to offset future destabilizing influence from these countries. It is concluded that the …

The Limitations Of Governance Indicators In Relation To Post-Disaster Recovery, Susan C. Paganelli
The Limitations Of Governance Indicators In Relation To Post-Disaster Recovery, Susan C. Paganelli
Electronic Theses and Dissertations
Catastrophic natural disasters remain a constant and recurring mortal threat to people around the world. Since prevention of the events themselves is impossible, it is important to examine those factors which can reduce the loss of life and enable successful recovery. We intuitively expect good governance to be one of these factors. This paper discusses the concepts of governance and long-term disaster recovery and the difficulties inherent in numerically capturing these qualities. It explores the correlation between governance indicators and three development and economic measurements of recovery. Three case studies are used to qualitatively and anecdotally address the topic.
Aware: Analyzing The Impact Of An Anti-Human Trafficking Advocacy Curriculum Using Sixth Grade Students In Colorado, Alex Kornelius Monroe
Aware: Analyzing The Impact Of An Anti-Human Trafficking Advocacy Curriculum Using Sixth Grade Students In Colorado, Alex Kornelius Monroe
Electronic Theses and Dissertations
Human trafficking is an international problem that penetrates every society on the globe. Trafficking in children for the purposes of commercial sexual exploitation, forced labor, and domestic servitude occurs in every state of the United States. Education is key in preventing human trafficking and American students lack proper knowledge of the issue. This study seeks to bridge this shortcoming through the creation and implementation of a holistic anti-trafficking advocacy curriculum that not only informs and motivates students and educators toward advocacy, but also meets Colorado state academic standards. Case studies using sixth grade students in Denver show the impact that …

A Comparative Analysis Of Genocidal Rape In Rwanda And The Former Yugoslavia: Implications For The Future, Jessica Kruger
A Comparative Analysis Of Genocidal Rape In Rwanda And The Former Yugoslavia: Implications For The Future, Jessica Kruger
Master's Theses and Doctoral Dissertations
This work examines the genocidal rape policies that occurred in the Rwandan and former Yugoslavian conflicts. Traditionally, rape has been considered an unfortunate yet inescapable consequence of war. In the early 1990s, the Hutu and Serbian regimes developed a new tactic and utilized rape as a genocidal weapon. Following a comparative analysis framework, the present study will examine the similarities and differences of the genocidal rape in Rwanda and the former Yugoslavia. Five points of comparison were established: perpetrators, victims, global economics, social disorder, and militias. Results of this analysis show that Rwanda and the former Yugoslavia possessed common pre-genocidal …
Oppositional Identities: The Military Peace Movement’S Challenge To Pro-Iraq War Frames, Lisa A. Leitz
Oppositional Identities: The Military Peace Movement’S Challenge To Pro-Iraq War Frames, Lisa A. Leitz
Peace Studies Faculty Articles and Research
In the United States, rhetoric in support of the Iraq War often focuses on discourses of patriotism and supporting the troops. These discourses hold enormous sway over the American public because of the discursive legacies of the Vietnam War and the September 11, 2001 terrorist attacks. In response, members of the peace movement who are veterans, soldiers, and military families stress their military identities during activism. These individuals have organized as an important branch of the U.S. antiwar movement that challenges the pro-war framing of patriotism and troop support by strategically deploying 'oppositional identities.' The oppositional identity strategy involves highlighting …

The Deep Ecology Movement: Origins, Development, And Future Prospects (Toward A Transpersonal Ecosophy), Alan Drengson, Bill Devall, Mark A. Schroll
International Journal of Transpersonal Studies
The deep ecology movement, which began with Arne Naess’ introduction of the term in
1972, is compared with other movements for social responsibility that developed in the
20th century. The paper discusses Naess’ cross-cultural approach to characterizing grassroots
movements via platform principles that can be supported from a diversity of cultures,
worldviews, and personal philosophies, and explains his use of “ecosophy.” The deep ecology
movement’s relationship with ecopsychology, ecocriticism, and humanistic and transpersonal
psychology is described as part of an emerging synthesis referred to as transpersonal ecosophy.
The inquiry concludes with a technical discussion of Naess’ Apron Diagram and reflections …

Seeing The Forest For The Trees: Managing Social Conflict And Forest Restoration, Steven E. Daniels, Jens Emborg, Greg B. Walker
Seeing The Forest For The Trees: Managing Social Conflict And Forest Restoration, Steven E. Daniels, Jens Emborg, Greg B. Walker
Sociology, Social Work and Anthropology Faculty Publications
This paper examines the role that social conflict is likely to play in forest restoration projects. A definition of conflict as “perceived goal interference among interdependent parties” serves as a point of departure for the discussion, and the nature of forest restoration conflict is systematically examined by focusing on each aspect of the definition: perceptions, goal interference, the parties, and their interdependence. Agencies undertaking restoration projects are encouraged to adopt a discourse orientation, wherein they recognize that 1) their public involvement efforts are creating a discourse that can incorporate a wide array of values and voices and 2) groups may …
Emmanuel Edeh: Inspiring Twenty-First-Century Africans To Serve-First, Peter O. Amah
Emmanuel Edeh: Inspiring Twenty-First-Century Africans To Serve-First, Peter O. Amah
International Journal of Servant-Leadership
Edeh (1985) articulated a theory of being as mma-di-the good that is. This mma-di participates in the absolute goodness of God, who creates and sustains it. Every human being deserves sustenance and to have his/her dignity preserved. To serve the interests of mma-di as a priority, a leader devotes his/ her energy, resources, and life to prove in theory and practice that each individual, according to Ferch (2003), has "inherent worth, a dignity not only to be strived for, but beneath this striving, a dignity irrevocably connected to the reality of being human" (p. 2). It was with a similar …

As Good As It Gets: A Review And Consideration Of "Healing Prayer", Its Theological And Ministry Implications, And The Hope For Change It Evokes., Henry Kranenburg
CTS Master of Theology (ThM) Theses
If healing is possible, and Christian prayer is a means to achieve it, how do Christians 'make it happen'? The answer to this question has had renewed and increasing interest for Christians in Reformed circles (Chapter I). While different healing 'ministries' have claimed to unlock (some aspect) of healing, there has been limited assessment of these ministries in both their methodologies and their claims. This paper reviews four of these ministries, first looking at aspects of their teaching and methodology (Chapter 2). It then reflects on these from a behavioural-psychological perspective by asking a number of questions (Chapter 3) before …
Book Review: Mao Zedong And China In The Twentieth-Century World, Jeremy Tai
Book Review: Mao Zedong And China In The Twentieth-Century World, Jeremy Tai
China Beat Blog: Archive 2008-2012
Mao Zedong may no longer be the sublime object of desire in China, but in recent decades his image has been continuously invoked and consumed in countless guises – both familiar and new – ranging from pop art portraits to the ubiquitous face of Chinese banknotes, from Cultural Revolution kitsch to the ObaMao souvenirs currently found in tourist traps around China. The reproduction of Mao in his various postmodern manifestations suggests a loss of meaning and depoliticization; at the same time, however, the deep-seated clash between sentimental and polemical cultural representations also makes clear that there is still much at …
Hardiness As A Predictor Of Success For Marine Corps First Responders In Training, Jason James Bogden
Hardiness As A Predictor Of Success For Marine Corps First Responders In Training, Jason James Bogden
Walden Dissertations and Doctoral Studies
Military personnel and first responders operate in complex operational environments, and must be able to perform under physical, psychological, and emotional stress. Research suggests that resiliency assuages stress and improves the performance of military personnel and first responders. However, there are no studies examining the effects of resiliency on military first responders in training. The purpose of this research was to determine whether the dispositional hardiness traits of commitment, control and challenge displayed by Marine aircraft rescue and firefighting (ARFF) specialist trainees correlated to success in classroom performance, success during practical exercises, higher graduation rates. The theoretical foundation for this …

Effects Of 3d Stereoscopy, Visuo-Spatial Working Memory, And Perceptions Of Simulation Experience On The Memorization Of Confusable Objects, Joseph R. Keebler
Electronic Theses and Dissertations
This dissertation investigated the impact of active stereoscopic 3-dimensional (3D) imagery equipment and individual differences in visuo-spatial working memory (VSWM) capacity on retention of a set of similar, novel objects (i.e., armored military vehicles). Seventy-one participants were assessed on their visuo-spatial working memory using the Visual Patterns Test (Della Sala, Gray, Baddeley, & Wilson, 1997). They were then assigned to one of four different conditions (3D high VSWM, 3D low VSWM, 2D high VSWM, 2D low VSWM) based upon their visuo-spatial working memory. Participants were then trained to identify military vehicles using a simulation that presented the training stimuli in …
Evaluating Changes In Families With Members On Military Deployment, Jill Brink
Evaluating Changes In Families With Members On Military Deployment, Jill Brink
All Graduate Theses, Dissertations, and Other Capstone Projects
With ongoing operations in the Middle East, military families face a large amount of stress surrounding deployment. While many studies have been conducted on soldier mental health, few have been published on the health of their families and even less on their children. The present case studies examine the mental health of military children, the change in family environment, and the social supports dependent spouses use during deployment. Two families are presented in this study. One family represents an Army Reserve family and the other an Air Force family. By comparing scores to standardized scores, it was shown that mental …
Internal Colonization And The International System: Gender Stratification In The U. S. And Its Global Implications, Muhammed Asadi
Internal Colonization And The International System: Gender Stratification In The U. S. And Its Global Implications, Muhammed Asadi
Societies Without Borders
My purpose in this paper is to critically review various theoretical perspectives contained in the literature to come up with implications for a comprehensive model that captures the intersectionality of race, gender and class in the International System with special emphasis on gender. My theoretical model links the U.S. gender ‘project’ post World War II: the construction of the post war ‘nuclear family’ and the reinvention of women’s ‘sacred domestic sphere’ to the maintenance of gender oppression globally by the U.S. in a world dominated by it. The common ingredient in such oppression is the use of women as productive …
Sociology And Human Rights Education: Beyond The Three Generations?, Mark Frezzo
Sociology And Human Rights Education: Beyond The Three Generations?, Mark Frezzo
Societies Without Borders
This article examines the uses and limitations of the prevailing classificatory schema in the field of human rights—a tripartite framework that delineates first-generation civil and political rights ensuring liberty, second-generation economic and social rights promoting equality, and third-generation group and cultural rights supporting solidarity. When applied strictly, the framework runs the risk of reifying the three categories, exaggerating the impact of the European Enlightenment on contemporary norms, and overlooking the historical contexts in which rights-claims emerge. Though useful for analytic and pedagogical purposes, the existing paradigm fails to capture the full spectrum of human rights violations and solutions in the …

Patient Navigation Through The Justice System: A Response To The High Infant Mortality Rate In One Community, Susan Holsapple
Societies Without Borders
The purpose of this evaluative study was two-fold; one was to evaluate a grant supported program that used the justice system to offer patient navigation services and the second goal was to provide a qualitative evaluation of the women’s health care experiences as they went through a court mandated drug program. Primary data was obtained from interviews with forty-seven program participants (n=47) from March, 2008 until January, 2010, and participant observation was used to explore treatment modalities and options available to these women. Secondary data was obtained from program staff as well as a review of the survey evaluation process …
Military Neoliberalism: Endless War And Humanitarian Crisis In The Twenty-First Century, Michael Schwartz
Military Neoliberalism: Endless War And Humanitarian Crisis In The Twenty-First Century, Michael Schwartz
Societies Without Borders
This article seeks to understand the dynamics of twenty-first century military intervention by the United States and its allies. Based on an analysis of Bush and Obama administration policy documents, we note that these wars are new departures from previous interventions, calling on the military to undertake post-conflict reconstruction in ways that was previously left to indigenous government or to the civilian aspects of the occupation. This military-primary reconstruction is harnessed to ambitious neoliberal economics aimed at transforming the host country’s political economy. Utilizing the Iraq and Afghanistan interventions as case studies, the study analyzes the dynamics set in motion …
