This study aims to explore the feasibility of implementing safe harbors in transfer pricing regulations in Indonesia. Safe harbors are alternative tax policies for taxpayers on specific transactions, which can exempt them from general provisions if meets certain specific regulations set by the tax authority (United Nations, 2017). Using a qualitative methodology, this study explores data from various literature and the results of interviews with experts in the field of transfer pricing. In an increasingly competitive and socially conscious marketplace, Diversity, Equity, and Inclusion (DEI) initiatives are emerging as powerful strategic tools for brand differentiation and consumer engagement. This study investigates the influence of DEI-driven marketing strategies on brand image and brand connection, and their subsequent impact on brand loyalty, with brand love examined as a moderating variable within the beauty industry. Employing a quantitative, explanatory research design, data were collected from 250 respondents using purposive sampling and analyzed through Partial Least Squares Structural Equation Modeling (PLS-SEM). This article examines how young people in a mid-sized Indonesian city participate in producing the meaning of urban space, and how far a participatory communication intervention succeeds in opening dialogue with city stakeholders. Urban communication scholarship has developed primarily around metropolitan cities in the Global North, while participatory communication research often assumes that facilitated dialogue leads to empowerment. This article addresses both gaps through a Photovoice study conducted in Kediri, East Java, involving 37 young people from three social typologies: pelajar (students), santri (Islamic boarding school-affiliated youth), and pekerja/wirausaha (young workers and entrepreneurs). We examine financial stress among low- and moderate-income Latino adults in California during a period of elevated prices and the 2025 holiday season. Participants from the Mobile Financial Diary cohort (n = 69; 218 person-wave observations) completed four monthly surveys covering November 2025 through February 2026. We compare four measures of financial health, wellbeing, stress, and anxiety across income groups and analyze open-ended responses using the RADaR technique. Respondents below the sample median income had lower financial health and higher financial stress and anxiety, whereas perceived financial wellbeing did not differ significantly. Artificial intelligence now drives core corporate decision, such as loan approvals and hiring screens, yet corporate boards have largely treated its governance as a management-level policy questions rather than a fiduciary obligation. This paper argues that this framing is mistaken, using Delaware's Caremark doctrine, as refined by Marchand v. Barnhill, In re Boeing, and In re McDonald's. The relevant cases already impose an enforceable duty on boards to actively oversee mission algorithmic systems, and by applying Marchand's mission-critical standard, this paper demonstrates that AI performs core business functions that expose companies to anti-discrimination, consumer protection, and …

ABSTRACT. Decentralized archipelagic states face governance challenges in translating national security frameworks into localized institutional practices. This paper analyses the formalization of coastal community participation into maritime security governance in Batam, Indonesia through multi-layered political mechanisms. The study uses a qualitative case study design incorporating insights from securitization theory and multi-level governance frameworks. Data were collected between March and July 2025, comprising 18 semi-structured interviews, policy document analysis, mapping of institutional coordination, and field observations. The findings reveal a persistent multi-level securitization gap: national threat narratives, particularly those articulated in terms of sovereignty, have not been proportionally translated into regional …

This study examines the political communication models behind the success of "newcomer" candidates from Partai Gerakan Indonesia Raya (Gerindra) and Partai Demokrasi Indonesia-Perjuangan (PDI-P) in the 2024 legislative election in Tasikmalaya Regency. The research addresses a gap in existing literature which tends to analyze political marketing, digital campaigns, candidate image, or incumbent efforts in isolation by highlighting how newcomers integrate various assets such as credibility, emotional connection, and rational approaches. Objectives. This study aims to explore the factors underlying the use of GenAI as a storytelling companion among young adults. Method. A qualitative approach was employed within an interpretivist paradigm, using an open-ended questionnaire as the primary data collection instrument. A total of 412 participants aged 19–33 years were recruited through purposive sampling. Data were analyzed using data-driven thematic analysis following Braun and Clarke's six-phase framework. Results. Two major themes emerged: Driving Factors and Barriers to Continuing Interaction. Artificial intelligence systems designed around continuous affirmation and minimal friction are becoming increasingly prominent as social and relational partners in everyday life. This article examines how sustained interaction with such frictionless AI systems may reshape the developmental conditions under which social selfhood forms and is maintained. Drawing on Cooley's (1902) looking glass self, Kohut's (1971) concept of optimal frustration, and the developmental literature on social competence, the article argues that frictionless AI may distort the social mirror through which identity forms, remove the manageable frustration that appears necessary for psychological growth, weaken empathic capacity, and erode the social stakes that …

Background: Theory of mind (ToM) refers to the ability to understand one’s own and others’ mental states and is closely related to children’s prosocial behavior. Previous research has linked ToM to language skills and sibling factors; however, findings remain inconsistent. Siblings may function as early social partners who support language use and social–cognitive development, thereby influencing ToM. This study examined whether sibling presence moderates the relationship between language skills and ToM in children. This systematic literature review (SLR) employs a bibliometric analysis approach to synthesize global research on mathematical models applied to predator-prey network optimization, with an emphasis on their ecological implications, computational approaches, and modelling strategies. Maintaining water quality in surface waters, including ponds and irrigation reservoirs, is essential for safe water use and is challenging. Mitigating and reducing nutrient levels is critical for managing risks of harmful algal blooms for agricultural operations, municipal drinking water suppliers, stormwater managers, and other water resource professionals. This article presents economic information about three best management practices (BMPs) treatment technologies well-suited to improving water quality for agricultural operations and small pond owners.

This study examines the post-2021 NCAA Name, Image, and Likeness (NIL) era by synthesizing scholarship on how NIL policies have transformed collegiate athletics. Specifically, it explores the regulatory, economic, governance, and equity dynamics emerging from a decentralized policy environment and the rapid expansion of athlete commercialization. An AI-assisted scoping review and content analysis were conducted on NIL-related studies published in leading sport management and sport law journals since July 1, 2021. Using large language model–supported searches, thematic coding, and reliability and validity procedures, the selected studies were systematically analyzed across legal, governance, commercialization, athlete experience, and equity dimensions. Between 2002 and 2022, over 125 college athletes died by suicide, and Division I athletes represented 45% of these deaths. In 2023, Black women college athletes at Division I universities identified racism as a mental health stressor at a higher rate than their non-Black peers. The intersectional nature of social identities and athlete status may create gendered and racialized stressors that are uniquely experienced by Black women athletes. Given the underrepresentation of Black students (i.e., athletes and nonathletes), coaches, faculty, and staff at historically white institutions (HWIs), Black women athletes are likely navigating campus relationships and environments that are shaped …

Background: The rapid rise of competitive esports has sparked concerns over the physical health of elite players. Prolonged sedentary behaviour, repetitive movements, and poor ergonomic practices may predispose these athletes to injuries, musculoskeletal pain, and unfavourable body composition. Materials and methods: A systematic review following PRISMA guidelines was conducted by searching Pub-Med, Scopus, EBSCOhost, and Web of Science for cross-sectional studies on physical activity (PA), body composition, physical fitness, and musculoskeletal health in elite esports players. To address gaps between research and psychotherapeutic intervention for trauma and trauma-related issues, the current study elicited and analyzed the perspectives of licensed trauma therapists via a concept mapping process. A literature review was conducted to explore the history and limitations of trauma’s current medical use as outlined by Criterion A of posttraumatic stress disorder in the DSM-5-TR. To answer the research question regarding how practitioners understand trauma, the researcher recruited licensed trauma therapists (n = 17) to participate in concept mapping. ธุรกิจธนาคารพาณิชย์เป็นธุรกิจประเภทหนึ่งที่มีการประมวลผลข้อมูลส่วนบุคคลของลูกค้าเป็นจำนวนมาก โดยภายหลังจากที่พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“PDPA”) มีผลใช้บังคับโดยสมบูรณ์ ธนาคารพาณิชย์หลายแห่งมีการกำหนดมาตรการและนโยบายในการประมวลผลข้อมูลส่วนบุคคลของลูกค้าเพื่อคุ้มครองข้อมูลส่วนบุคคลอย่างเคร่งครัด แต่ถึงอย่างไรก็ดี ในปัจจุบัน เนื่องจากการตีความตาม PDPA รวมถึงกฎหมายที่เกี่ยวข้องยังไม่มีคำพิพากษาของศาลที่ครอบคลุมในทุกประเด็นเป็นบรรทัดฐาน จึงทำให้ในทางปฏิบัติแล้วอาจเกิดปัญหาในการตีความและใช้ PDPA รวมถึงกฎหมายที่เกี่ยวข้องเพื่อดำเนินธุรกิจของธนาคารพาณิชย์ได้ ในบทความนี้ ผู้เขียนจึงจะหยิบยกและนำเสนอข้อพิจารณาหรือประเด็นที่น่าสนใจในเชิงปฏิบัติของการประมวลผลข้อมูลส่วนบุคคล (การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล) ของลูกค้าในธุรกิจของธนาคารพาณิชย์โดยพิจารณาตามฐานการประมวลผลข้อมูลตามกฎหมายของ PDPA ที่ผู้เขียนมีความคิดเห็นว่า ประเด็นที่จะนำเสนอในบทความนี้อาจถูกนำไปใช้พัฒนาและต่อยอดในการกำหนดแนวปฏิบัติหรือมาตรการการคุ้มครองข้อมูลส่วนบุคคลของลูกค้าโดยธนาคารพาณิชย์ เพื่อให้ธนาคารพาณิชย์สามารถให้บริการลูกค้าได้อย่างมีประสิทธิภาพโดยที่ลูกค้าได้รับการคุ้มครองข้อมูลส่วนบุคคลตามกฎหมายอย่างเต็มที่ หรือป้องกันปัญหาต่าง ๆ ที่อาจเกิดขึ้นได้ในอนาคต

การเผยแพร่ข้อมูลบนสื่อออนไลน์มีลักษณะคงอยู่อย่างถาวรและสามารถเข้าถึงได้ตลอดเวลา เมื่อข้อความอันอาจเป็นการหมิ่นประมาทถูกเผยแพร่ผ่านแพลตฟอร์มดิจิทัล ปัญหาทางกฎหมายจึงเกิดขึ้นว่าควรเริ่มนับอายุความเมื่อใด เนื่องจากภายใต้หลักการเผยแพร่หลายครั้ง (Multiple Publication Rule) การเข้าถึงเนื้อหาแต่ละครั้งอาจถูกตีความว่าเป็นการกระทำความผิดใหม่ ส่งผลให้อายุความถูกขยายออกไปอย่างไม่มีที่สิ้นสุด ทำให้ผู้เผยแพร่ต้องเผชิญความเสี่ยงทางกฎหมายอย่างไม่มีกำหนด อันก่อให้เกิดผลกระทบเชิงยับยั้ง (chilling effect) ต่อเสรีภาพในการแสดงความคิดเห็น และเกิดความไม่สมดุลระหว่างเสรีภาพในการแสดงความคิดเห็นกับสิทธิในชื่อเสียงของบุคคล บทความวิจัยนี้ศึกษาวิเคราะห์มิติปัญหาทางกฎหมายว่าด้วยการกำหนดจุดเริ่มต้นการนับอายุความของความผิดฐานหมิ่นประมาทที่กระทำผ่านสื่อออนไลน์ โดยมีขอบเขตการศึกษาครอบคลุมถึงแนวคิดว่าด้วยการสร้างดุลยภาพระหว่างเสรีภาพในการแสดงความคิดเห็นกับการคุ้มครองชื่อเสียง การตรวจสอบหลักเกณฑ์การนับอายุความตามประมวลกฎหมายอาญาและประมวลกฎหมายแพ่งและพาณิชย์ของไทย และการศึกษาเปรียบเทียบพัฒนาการ บรรทัดฐานคำพิพากษา และบทบัญญัติทางกฎหมายของประเทศอังกฤษและสหรัฐอเมริกาที่นำหลัก Single Publication Rule มาปรับใช้ ผลการศึกษาพบว่า การปรับใช้หลักการนับอายุความแบบเดิมที่ถือว่าการเผยแพร่ซ้ำแต่ละครั้งเป็นความผิดใหม่ไม่สอดคล้องกับลักษณะของสื่อออนไลน์ และก่อให้เกิดภาระเกินสมควรแก่ผู้เผยแพร่ จึงควรนำหลัก Single Publication Rule มาใช้ โดยถือว่าการเผยแพร่เนื้อหาที่มีสาระสำคัญเดียวกันเป็นการกระทำเพียงครั้งเดียวและเริ่มนับอายุความนับแต่วันที่เผยแพร่ครั้งแรก เว้นแต่การเผยแพร่ครั้งหลังจะมีความแตกต่างอย่างมีนัยสำคัญจึงจะถือเป็นการเผยแพร่ใหม่ อย่างไรก็ดี การนำหลักดังกล่าวมาใช้ควรกำหนดรายละเอียดและกลไกทางกฎหมายเพิ่มเติม อาทิ การให้ดุลพินิจแก่ศาลในการขยายอายุความ การกำหนดขอบเขตระยะเวลาและการนับอายุความจากวันที่เผยแพร่ครั้งแรกให้ชัดเจน ตลอดจนมาตรการที่ใช้บังคับกับคลังข้อมูล แพลตฟอร์ม และผู้เผยแพร่ เพื่อสร้างความสมดุลระหว่างเสรีภาพในการแสดงความคิดเห็นกับสิทธิในชื่อเสียง ให้สอดคล้องกับบริบทของสังคมดิจิทัล

การใช้มาตรการควบคุมตัวผู้กระทำความผิดเกินกว่าความจำเป็นอาจก่อให้เกิดผลกระทบต่อสิทธิและเสรีภาพของบุคคล ตลอดจนเป็นปัจจัยหนึ่งที่นำไปสู่ปัญหาความแออัดในเรือนจำและยังมีข้อจำกัดในการแก้ไขฟื้นฟูผู้กระทำความผิด แนวคิดเกี่ยวกับมาตรการปฏิบัติต่อผู้กระทำความผิดแทนการควบคุมตัว (Non-custodial Measures) จึงมีความสำคัญในฐานะแนวทางที่มุ่งลดการใช้การควบคุมตัวและการจำคุกที่ไม่จำเป็นในกระบวนการยุติธรรมทางอาญา ทั้งยังสอดคล้องกับหลักสิทธิมนุษยชนและมาตรฐานสากล โดยเฉพาะหลักเกณฑ์ตามข้อกำหนดมาตรฐานขั้นต่ำแห่งสหประชาชาติว่าด้วยมาตรการไม่ควบคุมตัว หรือ ข้อกำหนดโตเกียว (Tokyo Rules) บทความวิจัยนี้มุ่งศึกษาการพัฒนามาตรการปฏิบัติต่อผู้กระทำความผิดแทนการควบคุมตัวในกฎหมายไทยในสองประเด็นสำคัญ ได้แก่ การปล่อยชั่วคราวในระหว่างการพิจารณาคดี และ มาตรการควบคุมตัวผู้กระทำความผิดในสังคม โดยศึกษาหลักเกณฑ์ตามกฎหมายไทยประกอบกับการศึกษาเปรียบเทียบกรอบกฎหมายของประเทศสหรัฐอเมริกา ประเทศอังกฤษ และประเทศออสเตรเลีย เพื่อนำเสนอแนวทางที่เหมาะสมสำหรับการพัฒนามาตรการของประเทศไทย

บทความนี้มุ่งศึกษาถึงการคุ้มครองสิทธิอนามัยเจริญพันธุ์ของสตรีและผู้มีความหลากหลายทางเพศในบริบทประเทศไทย ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน เช่น อนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) หลักการยอกยาการ์ตา และเป้าหมายการพัฒนาที่ยั่งยืนข้อที่ 5 ซึ่งต่างยืนยันถึงสิทธิในการเข้าถึงสุขภาพทางเพศและอนามัยเจริญพันธุ์อย่างเสมอภาคและปราศจากการเลือกปฏิบัติ จากการศึกษาพบว่า แม้ประเทศไทยจะมีความก้าวหน้าในเชิงกฎหมายและนโยบาย แต่ยังคงเผชิญอุปสรรคสำคัญ อาทิ อคติจากผู้ให้บริการ ความเหลื่อมล้ำทางเศรษฐกิจและภูมิศาสตร์ ตลอดจนข้อจำกัดทางกฎหมายที่ยังไม่สอดคล้องกับมาตรฐานสิทธิมนุษยชนสากล การศึกษาวิจัยนี้จึงมุ่งศึกษาพัฒนาการและปัญหาทางกฎหมายและนโยบายของประเทศไทยที่เกี่ยวข้อง เช่น การยุติการตั้งครรภ์ การขยายสิทธิประโยชน์ด้านการคุมกำเนิด การบริการอนามัยเจริญพันธุ์ รวมถึงสิทธิในการเข้าถึงบริการยาฮอร์โมนและการยืนยันเพศสภาพ โดยศึกษาเปรียบเทียบกับการคุ้มครองสิทธิอนามัยเจริญพันธุ์ในสหราชอาณาจักร เยอรมนี และอินเดีย อันเป็นตัวอย่างการพัฒนากลไกกฎหมายและนโยบายที่ช่วยลดความเหลื่อมล้ำและสร้างระบบบริการที่เป็นมิตร เพื่อยกระดับกลไกทางกฎหมายและนโยบายสาธารณะของไทยให้สามารถส่งเสริมและสนับสนุนสิทธิอนามัยเจริญพันธุ์เกิดขึ้นจริง ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน และบรรลุเป้าหมายการพัฒนาอย่างยั่งยืนได้ต่อไป

บทความนี้มีวัตถุประสงค์เพื่อศึกษาขอบเขตความรับผิดทางกฎหมายของกรรมการตรวจสอบในบริษัทจดทะเบียนของไทย โดยครอบคลุมทั้งความรับผิดทางแพ่งและความรับผิดทางอาญา ทั้งในช่วงระหว่างดำรงตำแหน่งและภายหลังพ้นจากตำแหน่ง โดยมุ่งวิเคราะห์ฐานความรับผิดภายใต้พระราชบัญญัติบริษัทมหาชนจำกัด พ.ศ. 2535 และพระราชบัญญัติหลักทรัพย์และตลาดหลักทรัพย์ พ.ศ. 2535 ตลอดจนหลักกฎหมายทั่วไปเกี่ยวกับหน้าที่และความรับผิดของกรรมการบริษัท งานวิจัยนี้ใช้วิธีการศึกษาวิเคราะห์เชิงนิติศาสตร์ (doctrinal research) โดยพิจารณาบทบัญญัติกฎหมาย แนวคำพิพากษา และหลักเกณฑ์กำกับดูแลกิจการที่ดี ผลการศึกษาพบว่า กรรมการตรวจสอบอาจต้องรับผิดทั้งในทางแพ่งและทางอาญา หากการกระทำหรือการละเลยต่อหน้าที่ในระหว่างดำรงตำแหน่งก่อให้เกิดความเสียหายแก่บริษัท ผู้ถือหุ้น หรือบุคคล ภายนอก โดยความรับผิดดังกล่าวมิได้สิ้นสุดลงโดยอัตโนมัติเมื่อพ้นจากตำแหน่ง ทั้งนี้ ความรับผิดทางแพ่งอาจเกิดจากการฝ่าฝืนหน้าที่ความระมัดระวังและความซื่อสัตย์สุจริต ส่วนความรับผิดทางอาญาอาจเกิดขึ้นในกรณีที่มีการกระทำอันเป็นความผิดตามกฎหมายหลักทรัพย์ เช่น การเปิดเผยข้อมูลอันเป็นเท็จหรือปกปิดข้อเท็จจริงอันควรต้องแจ้ง อย่างไรก็ดี กฎหมายไทยยังขาดบทบัญญัติที่กำหนดขอบเขตความรับผิดของกรรมการตรวจสอบอย่างชัดเจน โดยเฉพาะในกรณีภายหลังพ้นตำแหน่ง ส่งผลให้เกิดความไม่แน่นอนในการบังคับใช้กฎหมาย บทความวิจัยนี้เสนอให้มีการกำหนดหลักเกณฑ์ที่ชัดเจนเกี่ยวกับขอบเขตและระยะเวลาความรับผิดทั้งทางแพ่งและทางอาญาของกรรมการตรวจสอบ รวมถึงการพัฒนามาตรฐานการใช้ดุลพินิจและกลไกคุ้มครองกรรมการที่ปฏิบัติหน้าที่โดยสุจริต เพื่อสร้างความสมดุลระหว่างการคุ้มครองผู้ลงทุนและการส่งเสริมธรรมาภิบาลในบริษัทจดทะเบียน

วิจัยฉบับนี้พบว่า บทบัญญัติของพระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 เป็นอุปสรรคต่อการร่วมกันเพื่อพัฒนาเงื่อนไขการทำงานของผู้ทำงานผ่านทางแพลตฟอร์มแรงงานดิจิตัล จึงมีความจำเป็นที่จะต้องมีการแก้ไขปรับปรุงพระราชบัญญัติฉบับนี้เพื่อเป็นการรื้อถอนอุปสรรคดังกล่าว โดยการเพิ่มเติมมาตรา 56/1 อันเป็นบทบัญญัติที่ยกเว้นการบังคับใช้มาตรา 54 และ 55 ให้แก่การร่วมกันอันมีวัตถุประสงค์ในการพัฒนาเงื่อนไขการทำงานของผู้ทำงานผ่านทางแพลตฟอร์มแรงงานดิจิตัล
