Devolution: The Retreat Of Government, Judith Kurland
Devolution: The Retreat Of Government, Judith Kurland
New England Journal of Public Policy
Devolution as practiced in much of the world is decentralization of program authority and responsibility to achieve greater administrative efficiency or program standards. Devolution as practiced by the Bush administration and the Republican Congress is not that, nor is it a diminution of federal power and the strengthening of states’ rights. Rather, it is a radical restructuring of government to prevent the expenditure of funds for traditional Democratic programs of the New Deal and the Great Society, and to prohibit states from being either more generous in social programs or more stringent in regulating industry than this administration desires.

Re-Examining Public Policy: A Case For Conditional Fees In Singapore?, Gary Chan
Re-Examining Public Policy: A Case For Conditional Fees In Singapore?, Gary Chan
Research Collection Yong Pung How School Of Law
Conditional fee agreements are currently prohibited in Singapore. The Singapore courts still adhere to the public policy considerations expressed in the English common law which proscribe maintenance and champerty. However, the United Kingdom as well as Ontario (Canada) and Australia have recently ‘departed’ from the old system prohibiting conditional fee agreements. It is thus timely for Singapore to re-examine the public policy arguments against conditional fee agreements and inquire whether a conditional fee based system ought to be introduced. Apart from the above jurisdictions, lessons will also be drawn from the problems and issues faced by the US and the …

The Indigent Defense System In Nebraska: An Update
The Indigent Defense System In Nebraska: An Update
University of Nebraska Public Policy Center: Publications
The Nebraska Minority and Justice Task Force was created as the joint initiative of the Nebraska State Bar Association and the Nebraska Supreme Court in October of 1999 to examine issues of racial and ethnic fairness within the Nebraska court and legal systems. The Task Force focused on four priority areas: Access to Justice, Court Personnel, Criminal and Juvenile Justice, and the Legal Profession. The results of the Task Force’s investigation, along with recommendations, were published in a report in January of 2003 (available on-line at www.nebar.com and www.unl.edu/ppc).
The major recommendation of the Final Report was to establish …

Race And Justice In Nebraska— Why Prosecutors And Criminal Defense Lawyers Should Care, Mark Young, Dennis R. Keefe
University of Nebraska Public Policy Center: Publications
“And now it’s just as bad for young black women or women of color as it is for men . . . to . . . have a public defender who is so unprepared, uncaring, and really, unsuitable, to stand before a judge, and then you have a prosecutor who comes in . . . and they sit at their table and the snickering, the way the
attitude that they go and handle a case (shows) no respect for the individual or for the system.”
The above quote comes from public hearing testimony before the Nebraska Minority and Justice Task …

The Nebraska Minority And Justice Implementation Committee Progress Report
University of Nebraska Public Policy Center: Publications
The Nebraska Minority and Justice Task Force was formed in 1999 by the Nebraska Supreme Court and the Nebraska State Bar Association (NSBA) to examine issues of racial and ethnic fairness within the Nebraska court and legal systems. Through two substantial grants from the State Justice Institute (SJI), administered through the University of Nebraska Public Policy Center, the Minority and Justice Task Force undertook a two-year research project, which culminated in a 200-page final report (the Final Report is available on-line at www.nebar.com and www.unl.edu/ppc). The report investigated topics as diverse as potential bias in criminal prosecution, sentencing, jury …
Back To The Future: The Future Of Long-Term Care In Massachusetts, Deborah H. Thomson, John J. Ford
Back To The Future: The Future Of Long-Term Care In Massachusetts, Deborah H. Thomson, John J. Ford
Gerontology Institute Publications
The state of Massachusetts, like the rest of the United States, is facing an approaching crisis in long-term care. Over the next few decades the number of Massachusetts residents age 65 and older will soar. As these numbers increase, so will the need for long-term care.
Massachusetts is ill prepared to provide the services that will be needed. Our current system of health care benefits leaves many elders with gaps in coverage. Those individuals who need long-term services often impoverish themselves and their spouses before the state pays for their care. Others languish on waiting lists to receive services. Our …

The Nebraska Legal Services Corporation (NLSC) believes that it is increasingly necessary to provide funding sources, such as the Nebraska State Legislature and other potential contributors, with factual-information that is critical in making funding decisions. To meet this necessity, NLSC contracted with the University of Nebraska at Omaha (UNO), Center for Public Affairs Research (CPAR) to conduct an economic impact study.

Real Choice Data Team Recommendations On Creating A Statewide Information Resource For Human Services
University of Nebraska Public Policy Center: Publications
Information and referral services are an important point of entry for persons seeking appropriate human services options. Across Nebraska, several key initiatives have begun laying the groundwork for statewide collaboration in data collection, sharing, and promotion activities. Consensus is emerging that developing a comprehensive, collaborative, statewide, health and human services database is both desirable and feasible.
Under the aegis of a Nebraska Health and Human Services System Real Choice grant from the Centers for Medicare and Medicaid Services, the state convened a working group to help envision the elements that should comprise a statewide resource database. The working group, the …

Surviving Against The Odds: Families’ Journeys Off Welfare And Out Of Homelessness, Donna H. Friedman, Tatjana Meschede, Michelle Hayes
Center for Social Policy Publications
Homeless families face complex challenges when making the transition from welfare to the workforce. By focusing on the experiences of homeless families participating in a Boston-based welfare-to-work program, the multimethod, longitudinal study described in this article explored factors contributing to more successful transitions as well as barriers faced by families having a harder time making the transition.
Nearly 90 percent of the families that were studied left a shelter with a housing subsidy and retained it 6 to 12 months later. Successful employment outcomes after exiting a shelter were more evident for families whose head of household was older, two-parent …

“Head Start Works Because We Do”: Head Start Programs, Community Action Agencies, And The Struggle Over Unionization, Eloise Pasachoff
Georgetown Law Faculty Publications and Other Works
In the summer of 2002, the city of Boston watched a fierce battle unfold between low-wage workers who provide child care and the social service agencies that employ them. Boston requires its city contractors to pay more than twice the federal minimum wage of $5.15 an hour to their employees, according to the terms of the city's "living wage" ordinance. The social service agencies, which receive government subsidies to run their child care programs, claimed that they could not afford to pay this rate. These agencies mounted an intense legal and political campaign, arguing that they would be forced to …
Two Cheers For Gentrification, J. Peter Byrne
Two Cheers For Gentrification, J. Peter Byrne
Georgetown Law Faculty Publications and Other Works
The very word "gentrification" implies distaste. Advocates for the poor and ethnic minorities see affluent whites bidding up the prices for urban housing to levels that force poor families out, depriving them of affordable housing, perhaps rendering them homeless, and changing the character of a neighborhood from one that reflects distinct ethnic and class needs and cultural traditions into a bland emporium for expensive consumer goods. Sometimes historic preservation laws are indicted as particular culprits in setting this dynamic in motion. A result of these perceptions is that the legal literature on gentrification, in general, and historic preservation both reflect …

The Judicial Transformation Of Social Security Disability: The Case Of Mental Disorders And Childhood Disability, Jennifer L. Erkulwater
The Judicial Transformation Of Social Security Disability: The Case Of Mental Disorders And Childhood Disability, Jennifer L. Erkulwater
Political Science Faculty Publications
A full account of the judicial influence on Social Security disability programs would require a book-length, perhaps even encyclopedia-length, treatise and would take us far afield from our present concern. This article focuses narrowly on the activities of Legal Services attorneys, mental health reformers, and children's advocates. Although mental health reformer groups are only one of many antipoverty organizations involved in advocacy efforts on behalf of the disabled poor, they have been among the most persistent, the most active, and the most successful in using a litigation strategy to achieve their larger policy goals. According to one Social Security official, …

Part 2 ("42 C.F.R. Part 2"). The crosswalk is intended to highlight the differences between the requirements of the Privacy Rule and 42 C.F.R. Part 2. In addition, this Issue Brief addresses the Privacy Rule's applicability to special populations and psychotherapy services provided by substance abuse paraprofessionals.

Three types of cases are reviewed: claims brought by managed care enrollees against managed care companies and health plans; cases related either directly or indirectly to managed care and brought by both beneficiaries and managed care organizations against state Medicaid agencies and other public agencies engaged in the purchase of managed care; and cases brought by individual health professionals against managed care organizations.

The Development Of Boston's Seaport District: Employment Opportunities And Community Strategies, O. Steven Quimby
Gastón Institute Publications
The development of Boston's Seaport District will create thousands of full-time employment opportunities over the next decade. To ensure equitable access to these opportunities for Boston's communities of color, it is imperative that organizations offering employment-training programs begin to take these opportunities into account now in their training efforts. The Center for Community Economic Development (CCED) at the University of Massachusetts Boston has prepared this report, The Development of Boston's Seaport District: Employment Opportunities and Community Strategies, as a step in becoming informed about these opportunities.
This study examines employment opportunities to be created in three industries projected to be …
