Nearly 25 years since its passage, the Ontario Class Proceedings Act has become one of the most frequently debated procedural mechanisms of its kind. The CPA came about following the release of the Attorney Generals Advisory Committee (AGAC) Report in 1990. None of the current narratives explain how this Report pulled together so many divergent interests where previous attempts had failed. My thesis answers this question with reference to the historical sources and the legal, political and social changes that took place throughout this period.

What values do national curricular statements communicate related to peace, conflict, violence and nonviolence? Schools are places that teach morals and mind-sets—transmission belts—cultural establishments that can contribute to how a student learns (pedagogy) and what a student learns (curriculum). Informed by Curriculum Theory and Peace Education Theory this mixed-method study utilizes directive and summative content analysis to inspect the General Statement, Teachers Guide and Shari’a national curricular statements at the elementary and preparatory level (mandatory education) for the Kingdom of Saudi Arabia (KSA). In this paper, we assess the evolution of 32 state constitutions and the U.S. Constitution over a 100+ year time period (1776-1907). We construct an original sectionlevel dataset containing the text of every section within a constitution for every year between the adoption of the state’s first constitution and 1907. We classify each section by topic and compare the content of each new constitution as well as the impact of amendments. With a subset of these data, we analyze the extent to which sections were added, deleted, modified and remained the same over time using a novel approach that relies …

This study explores a series of events that occurred in the spring of 1876. The relationship between the Indianapolis city government, the Marion County Courts, the Indianapolis Police Department, and the African American community came together to usher in changes never before envisioned. The Indianapolis Police Department (IPD) was formed in 1855, then disbanded 12 months later in a political dispute. From 1857-to-1876, the IPD was all white. These changes took place as the Reconstruction era was coming to a close. The first Ku Klux Klan was at its apex, terrorizing black communities, and Jim Crow was coming into its …

Nearly 25,000 graduating high school students across California have earned state recognition for achieving proficiency in multiple languages in 2014. This exploratory, mixed-methods study investigated the early implementation of the State Seal of Biliteracy (SSB) in California. Sixty-two district personnel were surveyed, three SSB directors were interviewed, and a document review was conducted. Overall, the study revealed four themes that influence the implementation of the SSB at the district level: Intentional Creation of an Ecology of Biliteracy, Developing Notions for Biliteracy Scripts and Assessment, Privileging Sequential Biliteracy Development—Scarcity of Biliteracy Pathways, and Individual and Collective Agency for Biliteracy. What barriers remain in the progress towards achieving Universal Primary Education (UPE), and how does the UPE agenda affect out-of-school children? Through a mixture of historical, quantitative and qualitative methods of analysis, this study examines these questions using the developing context of Sierra Leone as a case study.
Findings from over 100 interviews show that first of all, the most salient barrier that prevents children from participating in primary school is the fact that school is not free de facto in spite of the national abolishment of primary school fees in 2004. In order to perform their duties, airline pilots must have no clinical diagnosis of mental illness or any substance use disorder. However, provisions have been in place since the 1970s that provide for a return to work for airline pilots with alcohol problems. To date, over 5,000 airline pilots have undergone rehabilitation for Alcohol Use Disorder (AUD) and successfully returned to work. An important gap in the literature remains with regard to what extent improvements in cognitive performance may be experienced by airline pilots who complete treatment and to what extent age influences the amount of change. Research about siblings where one has a disability has historically focused on the psychological outcomes of siblings of people with disabilities and has very rarely asked people with disabilities about their sibling relationships. This research focus represents the common individualizing approach and under-representation of people with disabilities that disability studies has argued against. Tracing the history of research about siblings and disability through de/institutionalization and towards current broader theories in disability studies, this article suggests that a range of disability studies perspectives can usefully de-individualize and expand research about siblings where one has a disability. African Americans as a group tend to have numerous health issues, and by the time they seek healthcare, the conditions often advance into more serious ailments. Researchers have shown that cultural distrust of the U.S. healthcare system coupled with some discriminatory practices has hindered African Americans seeking care and taking full advantage of the healthcare system. Background: Previous research and quality improvement initiatives have underscored the prevalence of healthcare acquired conditions (HACs) and their associated costs in American hospitals. In response to these findings, in 2008, The Centers for Medicare and Medicaid Services identified 10 condition categories that they would no longer pay for if acquired during hospitalization. The conditions were selected based on high cost, high volume, or both, assigned to a higher paying medical severity diagnostic related group (MS-DRG), and were deemed preventable through application of evidence-based guidelines. The Health Quality Outcomes Model and a Path Model guided the study.

Protecting The Stranger: The Origins Of Us Immigration Regulation In Nineteenth-Century New York, Brendan P. O'Malley

From 1847 to 1890, a state authority--not a federal one--oversaw the entry of most immigrants arriving in the United States. The New York State Board of the Commissioners of Emigration supervised the landing of over eight million newcomers in nation's busiest entry point, the Port of New York, during the second half of the nineteenth century. Most were processed at the Board's Castle Garden Emigrant Depot in Battery Park, which opened in 1855. This study demonstrates why and how New York State developed a complex regulatory regime well before the federalization of immigration authority in 1882.

Anglo-French disagreements over Cameroon during World War I and the efforts to resolve them both during the Allied campaigns in the territory and at the end of the war suggest that negotiation can occur even in wartime successfully. At the outbreak of the war Cameroon was a German territory like Tanganyika, South West Africa, and Togoland. The Anglo-French grand strategy and war aims were to seize these territories and oust the Germans from them. This paper interrogates the influence of Western forms of democracy on ethnic conflicts in Africa through a case study of Ghana’s adoption of multiparty democracy between 1992 and 2012. It discusses the transition of African traditional systems of government before, during, and after colonization. The paper also shows how democracy, by definition and in terms of governance, cannot solely be a Western idea since many African societies had democratic elements in their systems of government before the arrival of the Europeans. The United States has always administered territorial governments and the primary entity entrusted with this authority is the United States Congress. This dissertation, using an American Political Development framework, seeks to uncover the variety of ways in which Congressional decision-making over territorial policy has shifted. The goal is to understand how the United States Congress worked toward establishing and maintaining an American Empire via the use of territorial policy. While recent literature on social welfare has included Asian countries, less is known about low-income and former socialist countries in Central Asia. This article combines a documentary-historical method with a value-critical approach to analyze Mongolia’s social policy response to poverty. Mongolia is unique in Asia because it transformed from nomadic pastoralism to socialism without a phase of capitalist industrial development. The case study found that Mongolia lost social welfare when it transitioned from socialism, a statist model, to market liberalism and multiparty democracy. Since 2008, more than 50% of the world's population has lived in cities and it is projected that by 2050 around 87% will do so. Designing infrastructure in urban spaces has become increasingly critical for achieving human well-being. This dissertation examines socio-spatial transformation processes related to urbanization, economic development and the marginalization of utilitarian cycling in Cali, Colombia, as a particular expression of the struggle for transportation space occurring in urban areas. Federalism often creates additional decisions for interest groups in determining how best to advocate for their policy recommendations in the legislative process. Should they focus their advocacy at the local, state, or national level of government? What activities should they use at each level of government? This dissertation examines interest group behaviors in water quality policy in the Great Lakes region from 1940 to 2000, in oil policy in the Beaufort Sea region from 1970 to 2000, and in both policy areas in 2010-2013. Many developing countries depend on the World Bank for development assistance, which the Bank often provides with policy reform conditions. Resistance to World Bank’s conditionality caused the Bank to posit “ownership” as a country’s real assent to its development policies. The combination of ownership and conditionality invalidates the neocolonial, false-paradigm and dualism theses in explaining the international dependence development model. This study explains this model by investigating how the relationship between conditionality and ownership in the context of this model impacts forest management in Cameroon.

The purpose of this study was to consider the influences of the American Boxer Indemnity Reparations Remissions (ABIRR) on Chinese higher education. These remissions were used to establish two universities, to establish the American Boxer Indemnity Scholarship Program (ABISP) to support Chinese students’ studying in America, and to support other higher education- related projects.
This study focused on higher education considering ABISP as an individual case. The ABISP students were selected from all the students who studied in America in the corresponding period in part because of the inconsistencies of research before 1949.

Recent changes in German foreign policy behavior have led to questions about Germany's European vocation. At the center of this inquiry is Germany's struggle to resolve the intersection between historical memory and present day international responsibility, especially in cases involving the use of force. This dissertation examines how and when historical memory has influenced, shaped, and informed contemporary German foreign and security policy and rhetoric by examining cases within two policy areas: out of area operations and nuclear nonproliferation. Attempting An Affirmative Approach To American Broadcasting: Ideology, Politics, And The Public Telecommunications Facilities Program, Michael W. Huntsberger

The Public Telecommunications Facilities Program (PTFP) was the largest source of capital funding for U.S. public broadcasters for nearly fifty years. Between 1963 and 2010, the PTFP distributed more than $800 million to support the construction of public broadcasting facilities. Though the PTFP itself was generally noncontroversial, the fortunes of the program were complicated by the partisan politics of public broadcasting and federal fiscal policy. This study provides evidence of the ambiguous and contingent nature of the American approach to public broadcasting, and demonstrates some of the problems associated with affirmative efforts by government to advance public communication.

Military conflicts have become nonlinear and the interrelated political and socio-economic changes within these conflicts have created new challenges for American policymakers. A tool called Wallis' Propositional Analysis (PA) suggests a new paradigm that includes thinking about complexity and robustness/systemicity in a policy. The purpose of this single case study was to determine how the PA paradigm adds heuristic value to complex policy decision-making. A backdrop of Wallerstein's complexity theory and complex adaptive systems (CAS) guided this study. Today's Western European countries have the world's most extensive government Social welfare systems, beginning with Germany as the forerunner. Prior to the eventual 20th century German welfare state, Germany was not devoid of distributing aid to combat the effects of poverty. Religious and public benevolent institutions, several centuries earlier, managed local poverty, resulting in an interesting relationship between the German citizens and these charities. The willingness of these institutions to address the poverty issue opened the door for the 20th century German welfare state to emerge.
