Combining the lens of the political economic theories of Racial Capitalism and the Precariat, and applying them to a historical analysis of the US immigration system and its modern implications in US States, we are better able to understand to manner in which the immigration regime works to provide a cheap, exploitable labor force for US industry elites. This dissertation consists of three essays that explore different dimensions of financial dynamics in the public and nonprofit sectors. Each chapter examines how the fiscal behavior of neighboring jurisdictions, policy interventions, and financial practices influence fiscal decision-making and financial performance within these entities.

In the first essay, I investigate yardstick competition in local government spending in South Korea by leveraging the exogenous variation introduced by by-elections. This approach allows me to estimate the influence of neighboring jurisdictions on local expenditures. Contrary to previous empirical studies from other countries, my findings reveal no significant interdependence in spending among South Korean municipalities, …

บทความวิจัยนี้มีเป้าหมายเพื่อสำรวจแนววิเคราะห์หลังสังคมนิยมหรือหลังคอมมิวนิสต์กับการอธิบายการเปลี่ยนผ่านทางการเมืองและเศรษฐกิจของประเทศอดีตสังคมนิยมและประเทศสังคมนิยม และการปรับตัวเพื่อการอยู่รอดของระบอบสังคมนิยมในประเทศสังคมนิยม ผ่านการศึกษาประเทศสังคมนิยมในเอเชียตะวันออกเฉียงใต้ ได้แก่ สปป.ลาวและเวียดนาม ด้วยการทบทวนเอกสารและงานวิจัยที่เกี่ยวข้อง ผลการศึกษาพบว่า หลังสังคมนิยม หรือ หลังคอมมิวนิสต์ เกิดขึ้นในยุคปลายสงครามเย็นที่หลายประเทศสังคมนิยมปฏิรูประบบเศรษฐกิจและพัฒนาประชาธิปไตย จนนำไปสู่การศึกษาการเปลี่ยนผ่านและการทำให้(ประชาธิปไตย)เข้มแข็ง ที่เชื่อเรื่องความเป็นสากล โดยนักรัฐศาสตร์การเมืองเปรียบเทียบ แต่แนวทางดังกล่าวกลับได้รับการโต้แย้งโดยนักวิชาการด้านอาณาบริเวณศึกษาที่เชื่อเรื่องความหลากหลายและการเปลี่ยนผ่านครั้งใหญ่ หลังจากนั้นการศึกษาหลังสังคมนิยมจึงมุ่งเน้นการเปลี่ยนแปลงทางเศรษฐกิจ การเมืองและสังคมที่เกิดขึ้นในประเทศอดีตสังคมนิยมและสังคมนิยมปัจจุบัน

ขบวนการเคลื่อนไหวของคนรุ่นใหม่ไทยปี 2563-2564 เป็นตัวอย่างขบวนการเคลื่อนไหวที่สามารถระดมการสนับสนุนของมวลชนคนรุ่นใหม่ได้จำนวนมาก แต่ไม่สามารถผลักดันข้อเรียกร้องในการรื้อถอนโครงสร้างและความเป็นอนุรักษ์นิยมของรัฐไทยได้อย่างเป็นรูปธรรมดังที่ตั้งใจไว้ในช่วงเริ่มต้นการชุมนุม ไม่ว่าจะเป็นการล้มรัฐบาลที่นำโดยอดีตผู้นำการรัฐประหาร การแก้ไขรัฐธรรมนูญ หรือการปฏิรูปสถาบันกษัตริย์ แต่จากการวิจัยกลับพบว่า การเคลื่อนไหวของคนรุ่นใหม่ส่งผลกระทบและสร้างการเปลี่ยนแปลงต่อสังคมและการเมืองไทยในมิติอื่น ๆใน 5 มิติ ได้แก่ หนึ่ง การสร้างพลเมืองหนุ่มสาวที่มีความตื่นตัวและพร้อมผลักดันการเปลี่ยนแปลงทางการเมืองในระยะยาว สอง ความตื่นตัวอย่างต่อเนื่องของแกนนำเก่าและการสร้างแกนนำการเคลื่อนไหวทางการเมืองรุ่นใหม่ในการผลักดันการเคลื่อนไหวทางการเมืองในระยะต่อ ๆไป สาม ความสำเร็จในการผลักดันแนวคิดเสรีนิยมให้กลายเป็นแนวคิดกระแสหลักในสังคมวงกว้างทั้งในสื่อมวลชนและคนรุ่นอื่น ๆ สี่ ความสำเร็จในการสร้างความเป็นสถาบันให้กับพรรคการเมืองที่เป็นตัวแทนของคนรุ่นใหม่ และ ห้า การเปลี่ยนแปลงด้านกฎหมายและนโยบายในระยะยาว

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาประวัติพัฒนาการแนวคิดและหลักพื้นฐานของพันธกรณีภายใต้ความตกลงอาเซียนทางด้านสิ่งแวดล้อมในประชาคมสังคมและวัฒนธรรมอาเซียนเพื่ออนุวัติการความตกลงอาเซียนดังกล่าว ศึกษามาตรการของการบังคับใช้กฎหมายไทยตามพันธกรณีตามความตกลงอาเซียนทางด้านสิ่งแวดล้อมและพันธกรณีตามความตกลงสิ่งแวดล้อมพหุภาคี (MEAs) วิเคราะห์กลไกบังคับใช้กฎหมายไทยและกลไกระงับกรณีพิพาททางด้านสิ่งแวดล้อมตามพันธกรณีภายใต้ความตกลงอาเซียนทางด้านสิ่งแวดล้อมของประชาคมอาเซียนเปรียบเทียบกับสหภาพยุโรป รวมทั้งเสนอแนะนโยบายและมาตรการเพื่อพัฒนาปรับปรุงกฎหมายไทยในการอนุวัติตามความตกลงอาเซียนทางด้านสิ่งแวดล้อมให้มีการบังคับใช้ได้อย่างมีประสิทธิภาพและสัมฤทธิผลในบริบทของประเทศไทยและประชาคมอาเซียน การวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยใช้ระเบียบวิธีวิจัยเอกสารในการเก็บรวบรวมข้อมูลเอกสารทั้งภาษาไทยและภาษาอังกฤษ กับวิธีการประชุมสนทนากลุ่มย่อยในการรับฟังความคิดเห็นของหน่วยงานและผู้ทรงคุณวุฒิที่เกี่ยวข้อง โดยใช้แบบสัมภาษณ์เชิงลึกเก็บรวบรวมข้อมูลจากผู้ให้ข้อมูลสำคัญ ซึ่งมีการสุ่มกลุ่มตัวอย่างตามวัตถุประสงค์ของการวิจัยจำนวน 27 คน แบ่งเป็น 3 กลุ่ม คือ (1) กลุ่มหน่วยงานภาครัฐ (2) กลุ่มหน่วยงานภาคเอกชน และ (3) กลุ่มผู้ทรงคุณวุฒิภาควิชาการ ทั้งนี้ เพื่อให้เกิดการตรวจสอบแหล่งข้อมูลแบบสามเส้า ในการเก็บรวบรวมจากผู้ให้ข้อมูลสำคัญทั้ง 3 กลุ่มตามระเบียบวิธีวิจัยเชิงคุณภาพแล้วนำมาวิเคราะห์ข้อมูลเชิงเนื้อหา วิเคราะห์เชิงตรรกวิทยา และการวิเคราะห์เปรียบเทียบเกี่ยวกับการบังคับใช้กฎหมายไทยตามพันธกรณีภายใต้ความตกลงอาเซียนทางด้านสิ่งแวดล้อม กลไกบังคับใช้กฎหมาย และกลไกระงับข้อพิพาทสิ่งแวดล้อมให้มีประสิทธิภาพและสัมฤทธิผลในบริบทของประเทศไทยและประชาคมอาเซียน รวมทั้งยังได้จัดการประชุมสัมมนาวิชาการเพื่อรับฟังความคิดเห็นและข้อเสนอแนะจากผู้ทรงคุณวุฒิและหน่วยงานที่เกี่ยวข้องเพื่อปรับปรุงสรุปผลการวิจัยและข้อเสนอแนะให้มีความถูกต้องและสมบูรณ์มากยิ่งขึ้น ผลการวิจัยพบว่า ประเทศไทยได้ดำเนินการปฏิบัติตามพันธกรณีภายใต้ความตกลงอาเซียนทางด้านสิ่งแวดล้อมในระดับภูมิภาค และการปฏิบัติตามพันธกรณีภายใต้ความความร่วมมืออาเซียนทางด้านสิ่งแวดล้อมและความตกลงสิ่งแวดล้อมพหุภาคี (MEAs) หากเกิดปัญหาข้อพิพาทสิ่งแวดล้อมตามพันธกรณีก็ยังมีกลไกบังคับใช้กฎหมายภายในของประเทศไทยและสมาชิกอาเซียนอื่น กฎหมายระหว่างประเทศ รวมทั้งกลไกระงับข้อพิพาททางสิ่งแวดล้อมตามพันธกรณีภายใต้ความตกลงอาเซียนทางด้านสิ่งแวดล้อมทั้งในระดับภูมิภาคอาเซียน คือ กลไกระงับข้อพิพาทภายใต้กฎบัตรอาเซียน ค.ศ. 2008 และพิธีสารว่าด้วยกลไกระงับข้อพิพาทของอาเซียน ค.ศ. 2004 รวมทั้งกลไกระงับข้อพิพาทในระดับโลก เช่น กลไกระงับข้อพิพาทขององค์การการค้าโลก อนุญาโตตุลาการระหว่างประเทศ หรือ ศาลยุติธรรมระหว่างประเทศ

Since the Civil War, American folk and country music have become deeply political cultural mediums. This thesis posits that the history of the folk-country family can be broken down into three distinct “eras.” During the first era, the post-Civil War South gave rise to a new form of “Dixie,” or “hillbilly” folk music derived from traditional European folk ballads. In the second era, the Dust Bowl migrants of Southern California pioneered the “Okie” sound, which built upon Dixie/hillbilly music. The U.S. Constitution does not enshrine socioeconomic rights. Why does this matter? Many argue that socioeconomic rights have value in and of themselves because they secure certain minimum conditions of human dignity, but socioeconomic rights also have instrumental value because abject material deprivation often makes traditional political and civil rights meaningless. In this thesis, I explore the relationship between U.S. constitutional law and socioeconomic rights through an analysis of the Warren Court’s decisions regarding socioeconomic class. This Article makes three main contributions. First, it fleshes out the theory of separation of structures as distinct from contemporary scholarly approaches. Second, it writes the intellectual history of separation of structures, which has been an integral part of the separation of powers enterprise since its inception, including at the Founding. Third, it explores the scholarly and doctrinal implications of structural separation of powers. In particular, adjudicating the constitutionality of agency structures requires methodological pluralism that incorporates the normative values underlying the structural design. สารนิพนธ์ฉบับนี้ศึกษาความสัมพันธ์ระหว่างนโยบายเปลี่ยนผ่านพลังงานกับความมั่นคงทางการเมืองของจีน โดยพรรคคอมมิวนิสต์จีนเลือกปรับใช้นโยบายดังกล่าวเพื่อจัดการแก้ไขกับปัญหาสิ่งแวดล้อมอันเป็นผลลัพธ์จากการเติบโตของภาคอุตสาหกรรมอย่างก้าวกระโดดภายหลังจากการเปิดประเทศใน ค.ศ. 1978 ซึ่งจีนพึ่งพาอาศัยเชื้อเพลิงฟอสซิลจากภาคพลังงานในการขับเคลื่อนการเติบโตทางเศรษฐกิจมาโดยตลอด การศึกษาวิจัยนี้อาศัยทฤษฎีสัจนิยมคลาสสิกใหม่ (Neoclassical Realism) ของ กิดเด็น โรส เป็นกรอบในการวิเคราะห์ โดยพบว่าพรรคคอมมิวนิสต์จีนเล็งเห็นว่าปัญหาสิ่งแวดล้อมเป็นอุปสรรคต่อการเติบโตทางเศรษฐกิจและส่งผลร้ายแรงต่อคุณภาพชีวิตของประชาชนจีน อีกทั้งยังเป็นสาเหตุหลักของการเกิดก๊าซเรือนกระจกที่ทำให้เกิดการเปลี่ยนแปลงสภาพภูมิอากาศของโลก ปัญหาดังกล่าวสร้างผลกระทบต่อความเชื่อมั่นของพรรคคอมมิวนิสต์จีนในฐานะองค์กรที่มีอำนาจรัฐสูงสุดและพรรครัฐบาลเดียวของจีน ทำให้จีนเลือกดำเนินนโยบายเปลี่ยนผ่านพลังงานสู่พลังงานสะอาดเพื่อบรรเทาปัญหาสิ่งแวดล้อมภายในประเทศ สร้างบรรยากาศระหว่างประเทศที่เอื้อให้จีนส่งออกเทคโนโลยีพลังงานสะอาดภายใต้การดำเนินนโยบายต่างประเทศได้อย่างคล่องตัว รวมถึงส่งเสริมบทบาทของจีนในฐานะรัฐมหาอำนาจที่มีความรับผิดชอบและเป็นแบบอย่างที่ดี โดยการดำเนินการทั้งหมดเป็นไปเพื่อเสริมสร้างความชอบธรรมในการปกครองของพรรคคอมมิวนิสต์จีนและระบบการปกครองแบบสังคมนิยมที่มีเอกลักษณ์แบบจีนอันเป็นองค์ประกอบสองประการที่ช่วยเสริมสร้างความมั่นคงทางการเมืองของจีนซึ่งเป็นแก่นหลักของความมั่นคงแห่งชาติจีน

This study articulates the importance of the audience in Buzan’s securitization framework by analyzing the case of climate securitization in the United States under the Biden Administration between 2021 and 2025. The role of the audience is demonstrated as a coequal piece of the securitization framework through a new process of analysis in which securitizing speech acts are examined and paired with an analysis of audience acceptance to determine the extent to which those acts were successful. สารนิพนธ์ฉบับนี้มุ่งศึกษาความสัมพันธ์ระหว่างกองทัพปลดปล่อยแห่งชาติตะอาง (TNLA) และจีน ภายใต้สภาวะรัฐล้มเหลวของรัฐบาลทหารเมียนมา โดยมีวัตถุประสงค์เพื่อวิเคราะห์ปัจจัย ที่ส่งผลต่อการขยายอิทธิพลของ TNLA ในรัฐฉานเหนือและกลายเป็นหนึ่งในกองกำลังหลักในการต่อต้านรัฐบาลทหารเมียนมาในช่วงต้นทศวรรษ 2550 จนถึงปัจจุบัน รวมทั้งศึกษาความสัมพันธ์ระหว่างจีนและ TNLA ในด้านการเมือง การทหาร และเศรษฐกิจ ว่ามีผลต่อพลวัตการเติบโตและความเปลี่ยนแปลงของ TNLA อย่างไร โดยใช้กรอบแนวคิดรัฐล้มเหลว (failed states) ในการวิเคราะห์ ผลการศึกษาพบว่า การเติบโตของ TNLA มิได้เป็นผลจากปัจจัยใดปัจจัยหนึ่งโดยเฉพาะ แต่เป็นผลจากกระบวนการที่ดำเนินมาอย่างต่อเนื่องตั้งแต่การก่อตั้งอย่างเป็นทางการในปี พ.ศ. 2552 TNLA ได้พัฒนาศักยภาพอย่างค่อยเป็นค่อยไป ทั้งในด้านศักยภาพทางการทหาร โครงสร้างการปกครองในพื้นที่ควบคุม และเครือข่ายเศรษฐกิจข้ามพรมแดน โดยเฉพาะหลังการรัฐประหารเมื่อปี พ.ศ. 2564 ที่ส่งผลให้เมียนมาเข้าสู่ภาวะรัฐล้มเหลวอย่างชัดเจน รัฐบาลทหารเมียนมาสูญเสียความสามารถในการควบคุมพื้นที่ชายแดน การจัดบริการสาธารณะ และความชอบธรรมทางการเมือง เปิดโอกาสให้ TNLA สถาปนาอำนาจควบคุมพื้นที่อย่างเป็นรูปธรรม ในบริบทดังกล่าว จีนซึ่งมีผลประโยชน์เชิงยุทธศาสตร์ในรัฐฉานเหนือ ได้ดำรงความสัมพันธ์กับ TNLA ในลักษณะที่ไม่เป็นทางการ ผ่านกลไกเศรษฐกิจชายแดน การค้า การลงทุน และการสนับสนุนทางทหารทางอ้อม ซึ่งช่วยเสริมสร้างขีดความสามารถของ TNLA ทั้งในมิติทางทหารและการเมืองอย่างต่อเนื่อง ขณะเดียวกันจีนก็ได้ใช้กลุ่มชาติพันธุ์ติดอาวุธอย่าง TNLA เป็นเครื่องมือในการรักษาเสถียรภาพตามแนวชายแดนและคุ้มครองผลประโยชน์ของตนในรัฐฉานเหนือ ดังนั้น พลวัตของความสัมพันธ์ระหว่างจีนกับ TNLA จึงสะท้อนให้เห็นถึงบทบาทของจีนในฐานะผู้มีอิทธิพลสำคัญต่อความเปลี่ยนแปลงของสถานการณ์ความขัดแย้งภายในเมียนมา รวมทั้งต่อการเติบโตของกลุ่มชาติพันธุ์ติดอาวุธตามแนวชายแดน และทิศทางของรัฐล้มเหลวในอนาคตว่าจะสามารถฟื้นฟู สู่ความเป็นรัฐที่มีเสถียรภาพและความชอบธรรม หรือจะดำรงอยู่ในสถานะรัฐเปราะบางซึ่งเอื้อประโยชน์ต่อยุทธศาสตร์ของมหาอำนาจต่อไปxx

สารนิพนธ์ชิ้นนี้มีวัตถุประสงค์ของการศึกษา คือ เพื่อศึกษาแนวคิดการสะสมทุนเบื้องต้น แนวคิดการสะสมทุนด้วยการปล้นชิง และแนวคิดทุนนิยมทางการเงิน และเพื่อเปรียบเทียบการสะสมทุนผ่านการปล้นชิงของระบบทุนนิยม ระหว่างทุนนิยมอุตสาหกรรม และทุนนิยมทางการเงิน โดยใช้วิธีการวิจัยเชิงคุณภาพที่เน้นการวิเคราะห์จากเอกสารชั้นรอง ผ่านกรอบแนวคิดการะสมทุนเบื้องต้น และแนวคิดการสะสมทุนด้วยการปล้นชิง ผลการศึกษา พบว่า ในยุคเริ่มแรกของทุนนิยมอย่างในยุคทุนนิยมอุตสาหกรรม การสะสมทุนเบื้องต้นเกิดขึ้นจากการแย่งชิงทรัพยากร เช่น การยึดครองที่ดิน การขูดรีดแรงงาน เป็นต้น แต่ในยุคปัจจุบัน การสะสมทุนมีความสลับซับซ้อนมากขึ้น โดยเฉพาะทุนนิยมทางการเงิน การสะสมทุนมีหลากหลายรูปแบบ ซึ่งไม่เพียงแต่การขูดรีดแรงงานทางกายภาพเท่านั้น แต่ได้แปรเปลี่ยนเป็นลักษณะของการเก็งกำไร การสร้างหนี้ การแปรรูปทรัพย์สินสาธารณะ การใช้ทรัพย์สินทางปัญญา เป็นต้น โดยไม่ต้องผ่านการผลิตหรือแรงงานอย่างชัดเจน จึงทำให้ผู้เขียนได้ข้อค้นพบวิธีการสะสมทุนผ่านการปล้นชิงว่าได้แปรเปลี่ยนไปเรื่อย ๆ ตามบริบทโลก โดยเฉพาะอย่างยิ่งในยุคทุนนิยมดิจิทัล กลไก และวิธีการสะสมทุนสามารถทำได้อย่างแยบยลจนกลืนไปกับชีวิตประจำวันโดยไม่รู้ตัว ภาพลักษณ์เทคโนโลยี แพลตฟอร์มดิจิทัลถูกผลิตมาเพื่ออำนวยความสะดวก แต่เบื้องหลังได้ปล้นชิงแร่ธาตุหายากอย่างมหาศาล และปล้นชิงความเป็นมนุษย์ในการกดขี่ข่มเหงแรงงานในประเทศยากจน อีกทั้งยังถูกนำมาใช้เป็นเครื่องมือเพื่อหลอกหลวงมนุษย์ด้วยกันเอง จึงเป็นสิ่งสะท้อนว่า ไม่ว่าการสะสมทุนในยุคใดก็ตาม ก็ยังทิ้งความไม่ยุติธรรมแก่คนส่วนใหญ่อยู่เสมอ ซึ่งอนาคตการสะสมทุนก็คงกลายพันธุ์ไปเรื่อย ๆ และดูเหมือนว่าความไม่ยุติธรรมยังคงแฝงอยู่ในระบบทุนนิยมที่ดูเหมือนจะพัฒนาไปอย่างไร้ที่ติ

United Nations peacekeeping is experiencing a generational shift as several large missions downsize and close. Amid this change, this essay considers the future of the Protection of Civilians (PoC) mandate, which has been a priority of UN peacekeeping since it was first authorized twenty-five years ago.
