Asean Centrality In The Era Of Great Power Competition: Hedging For Survival And Prosperity, William J. Jones, Chanya Supakul Jan 2025

Asean Centrality In The Era Of Great Power Competition: Hedging For Survival And Prosperity, William J. Jones, Chanya Supakul

Journal of Social Sciences

The Association of Southeast Asian Nations (ASEAN) was formed in 1967 with the Bangkok Conference as a bulwark against the spread of Communism in Southeast Asia. In its 57 years of existence, ASEAN has proven to be a durable organization capable of organizational change. Furthermore, as the oldest and only standing regional organization with full membership of its region, or sub-region, ASEAN has a large degree of credibility in international affairs. With the end of the Unipolar moment where the ‘West’ led by the United States exercised hegemony and the beginning of a multipolar world, ASEAN and its member states …

Legislatures And Localized Resentencing, Ronald F. Wright, Kay L. Levine Jan 2025

Legislatures And Localized Resentencing, Ronald F. Wright, Kay L. Levine

Faculty Articles

Recent legislation, exemplified in statutes from California and Washington, creates new methods for resentencing defendants in old cases. These laws place controlling authority for resentencing in the hands of local officials, especially local prosecutors, and invite variation at the county level.

While some new procedural channels for reducing the sentences of people convicted of past crimes are mandatory, in that they entitle certain defendants to resentencing if they were convicted of certain crimes or were subject to certain penalty enhancements that are no longer valid, other statutes create discretionary resentencing channels. In the discretionary channels, the chief local prosecutor has …

Healing Communities With Police Divestment: Seeking Abolition Through Transformative Reform And Community-Government Collaboration, Jessica E. Gillson Jan 2025

Healing Communities With Police Divestment: Seeking Abolition Through Transformative Reform And Community-Government Collaboration, Jessica E. Gillson

Undergraduate Honors Theses

Concerns about the efficacy and sustainability of the U.S. carceral system have persisted throughout the country’s history, recently fueling renewed activism and bipartisan calls for reform. However, proposed solutions remain divisive. This thesis first defines the current status of our prison systems, then explores collaborative alternatives to incarceration and policing that support communities and break cycles of incarceration.

Focusing on partnerships among local governments, community organizations, justice-involved individuals, and law enforcement, this study examines holistic approaches to crime prevention, reentry, and reintegration. Using an interdisciplinary framework incorporating restorative justice, community resilience, and systems theory, it investigates how community-based strategies can …

Racial Disparities In Crime-Based Removal Proceedings, Emily Ryo, Ian Peacock, Weston Ley, Christopher Levesque Jan 2025

Racial Disparities In Crime-Based Removal Proceedings, Emily Ryo, Ian Peacock, Weston Ley, Christopher Levesque

Faculty Scholarship

Whether and to what extent racial minorities experience harsher treatment or face worse outcomes in court are questions of fundamental importance for any justice system. Questions of racial inequality are especially salient in the context of removal proceedings that are triggered by immigrants’ criminal history. Many individuals in crime-based removal proceedings are immigrants of color who face a host of legal disadvantages that are tantamount to double penalties for the same crime for which they have already been punished through the criminal justice system. This Article offers, for the first time, systematic empirical analyses of crime-based removal proceedings decided between …

The Role And Impact Of Forensic Evidence In The Prosecution Of Homicide Cases In The U.S., Afrah Dakhilallah A. Altubait

Theses and Dissertations

The role of forensic evidence in the criminal justice process is an important topic that is significant from both theoretical and practical perspectives. The present study is dedicated to a critical analysis of the role of this evidence in the U.S. criminal justice process with a focus on its significance in homicide cases. Specifically, this dissertation examines the implications of using DNA and fingerprint evidence for convictions in U.S. homicide cases by analyzing the role of DNA and fingerprint evidence in the prosecution of “hot” and “cold” homicide cases, discussing the main ways in which forensic evidence assists with prosecuting …

Why Domestic Violence Offenders Don't Give Up Their Guns, Natalie Nanasi Jan 2025

Why Domestic Violence Offenders Don't Give Up Their Guns, Natalie Nanasi

Faculty Journal Articles and Book Chapters

Perpetrators of intimate partner violence are barred by federal law and many states' laws from possessing firearms. While such prohibitions enjoy popular support, they are sporadically and inconsistently enforced, placing the lives of survivors at risk when offenders do not voluntarily comply. Many experts, including this author, have offered legal and policy solutions to increase the likelihood that perpetrators of domestic violence will either willingly relinquish their guns or otherwise be dispossessed of them. But these proposals may have been premature.

This Article is the first to take a step back and inquire why offenders do not surrender their firearms …

“People [Are] Not Dying Because Officers Aren't Following Their Training. ‘It's Because They Are.”: The Construction Of Police De-Escalation Of Individuals In Mental Health Crises In Canadian Media, Renée Haddock Jan 2025

“People [Are] Not Dying Because Officers Aren't Following Their Training. ‘It's Because They Are.”: The Construction Of Police De-Escalation Of Individuals In Mental Health Crises In Canadian Media, Renée Haddock

Theses and Dissertations (Comprehensive)

Police are often assumed to be the "de facto" response to people in mental health crises. Contact between police and Canadians with mental illness and in crisis is routine and on the rise (Livingston, 2016). Police responses to these incidences have been criticized after several, highly publicized and tragic encounters between police and people in mental health crisis and the overrepresentation of people of colour in these instances. Media outlets determine which stories are prioritized, how they are framed, and which information to include or omit (Fawzi, 2018). Notably, public knowledge of police activities greatly impacts community perceptions of police …

Examining Disparities In Pre-Conviction Detention: A Race And Gender Analysis Of Criminal Charging And Detention Practices In Ramsey Countyention Practices In Ramsey County, Gabriel P. Exman

School of Business Student Theses and Dissertations

Race and gender disparities in the U.S. criminal justice system are well documented, primarily in sources of national post-conviction data. However, localized and pre-conviction studies remain limited. This study examined race and gender disparities in pre-conviction detention outcomes and charge severity in Ramsey County, Minnesota, between 2017 and 2019. Using a descriptive, exploratory quantitative design and a retrospective single-cohort analysis, the researcher analyzed trends in arrests, charge severity, and pre-conviction incarceration duration across race and gender groups. Findings indicate disparities in both charge rates and pre-conviction detention durations, with Black men and Native American women experiencing longer periods of incarceration. …

Are We Safe In The Digital World? Why We Still Fall Victim To Cybercrime, Kevin Le Jan 2025

Are We Safe In The Digital World? Why We Still Fall Victim To Cybercrime, Kevin Le

Honors Papers and Posters

Cybersecurity has only recently gained press coverage as millions of individuals are victimized by cyberattacks. While current cybersecurity measures offer some protection, human error has been the number one cause of cyberattacks for the past eight years (Verizon, 2024). Cybercrime continues to evolve in complexity, leveraging advanced technology and human psychology to bypass traditional security systems. This study examines why individuals still fall victim to cyberattacks. It explores the psychological and cognitive factors that make individuals vulnerable, focusing on social engineering techniques such as phishing and pretexting. This study also analyzes factors from psychological theories, including Protection Motivation Theory, Routine …

The Csi Effect: Media Influence On Juror Perceptions Of Forensic Evidence, Toni Besselaar Jan 2025

The Csi Effect: Media Influence On Juror Perceptions Of Forensic Evidence, Toni Besselaar

Scripps Senior Theses

Can the media you consume shape your expectations in the courtroom? This thesis explores how legal media consumption influences jurors' perceptions of forensic evidence, focusing on blood spatter analysis and its potential impact on verdicts. Drawing on the CSI Effect, the proposed study will examine whether fictional crime dramas and true crime documentaries differ in their effects on jurors’ expectations and skepticism about forensic evidence. Approximately 150 jury-eligible participants will be recruited for an experimental study exploring the effects of media exposure and prior legal media consumption. Participants will view a legal scenario involving inconclusive blood spatter evidence after exposure …

Breaking A Criminal Mind: Leveraging Habit Breaking/Building For Crime Reduction, Dru Gerace Jan 2025

Breaking A Criminal Mind: Leveraging Habit Breaking/Building For Crime Reduction, Dru Gerace

Williams Honors College, Honors Research Projects

Criminal behavior is often shaped by a complex interaction between psychological processes, habitual actions, and neurobiological mechanisms. This research explores how habitual decision-making and reinforcement patterns contribute to criminal tendencies, integrating insights from neuroscience and psychology. The study examines how early-life experiences, cognitive biases, and environmental factors shape habitual behaviors that may predispose individuals to criminal activity. It also discusses the role of executive functioning, impulse control, and neuroplasticity in breaking maladaptive patterns. By analyzing contemporary theories of habit formation and their neurological underpinnings, this paper offers a multidimensional perspective on the development of criminal behavior. Furthermore, implications for rehabilitation …

Studying Repeat Victimization: A Consideration Of Measurement Issues, Christi Metcalfe, Robert Brame, Tara E. Martin, Angela R. Gover Jan 2025

Studying Repeat Victimization: A Consideration Of Measurement Issues, Christi Metcalfe, Robert Brame, Tara E. Martin, Angela R. Gover

Faculty Publications

Decades of research have recognized the phenomenon of repeat victimization and its policy relevance. Although there are continuing efforts to explain the theoretical underpinnings of repeat victimization, there are still measurement-related issues that limit our understanding of the topic and ability to inform interventions, including varying operational definitions, data constraints, and sampling and nonsampling error. In this article, we review theoretical advances in the literature over the past decade, propose operationalizations that can foster greater consistency across studies, comprehensively assess the data constraints around commonly used public data sources to study repeat victimization, and empirically demonstrate how one of these …

Internal Or External: An Exploration Of The United States Police Chief Hiring Process, Kayleigh Walker Jan 2025

Internal Or External: An Exploration Of The United States Police Chief Hiring Process, Kayleigh Walker

Williams Honors College, Honors Research Projects

This paper explores the hiring processes of police chiefs across the United States, focusing on internal versus external hiring practices. The goal of this research was to identify common trends, legislative barriers, and the impact of leadership on the hiring process through historical context, legal analysis, and case studies. The findings suggest that internal hires dominate chief appointments, though external hires are often sought during crises. The paper concludes with recommendations for future research and highlights the need to more fully understand this phenomenon. Understanding the processes and limitations surrounding the appointment of new leadership is critical to reform and …

Analyzing Car Theft Trends In Central Texas: A Comparative Study Of Waco, College Station, And Killeen, Daniel Njogu Jan 2025

Analyzing Car Theft Trends In Central Texas: A Comparative Study Of Waco, College Station, And Killeen, Daniel Njogu

Williams Honors College, Honors Research Projects

This study examines motor vehicle theft (MVT) trends from 2019 to 2023 in three Central Texas cities—Waco, College Station, and Killeen—using temporal analysis, geospatial hotspot mapping, and make/model data. In Killeen, thefts generally rose over the period, with notable peaks in October and on Mondays. College Station saw an overall decline in thefts but experienced a seasonal spike each March, and Waco’s thefts increased until around 2021 before beginning to fall. Local festivals—such as the Spirit of Texas in College Station and the Heart O’ Texas Fair in Waco—appear to coincide with these seasonal upticks. Hyundais and Kias were most …

Disentangling Safety And Accountability In Criminal Justice Policy, Benjamin Levin Jan 2025

Disentangling Safety And Accountability In Criminal Justice Policy, Benjamin Levin

Scholarship@WashULaw

In this Article, I argue that the U.S. criminal system and debates about criminal justice reform reflect an elision of two largely distinct social functions: ensuring public safety and imposing accountability for harmful conduct. Despite deep disagreement about the specifics, most commentators seem to accept that these are both important social functions. Abolitionists claim that the criminal system doesn’t keep people safe and provide accountability. Instead, it harms—and perhaps is meant to harm—people from marginalized communities and protects the interest of socially dominant groups. Reformers contend that the criminal system can and should serve the safety and/or accountability interests, but …

Abolish What?, Benjamin Levin Jan 2025

Abolish What?, Benjamin Levin

Scholarship@WashULaw

From leading academic journals to popular press outlets, abolitionist activism and scholarship have earned airtime in national debates about criminal justice reform. But what is "abolition?" When scholars, lawyers, and activists talk about abolition, they seem to mean very different, even conflicting, things. In this Essay, I focus on a core question that might divide different abolitionists-and different critics of abolition: what is to be abolished? Abolitionists argue that it's critically important to abolish something, while critics of abolition insist that something is necessary to a well-functioning society. Yet, it's not always clear what that something is-both for abolitionists and …

Crimes Against Humanity And Customary International Law, Leila Nadya Sadat Jan 2025

Crimes Against Humanity And Customary International Law, Leila Nadya Sadat

Scholarship@WashULaw

A draft text of a treaty on the prevention and punishment of crimes against humanity was finally sent to negotiations by the U.N. General Assembly on December 4, 2024, after six long years of advocacy by States and civil society. Questions remain, however, with regard to how crimes against humanity will be defined in the new treaty. On the one hand, some States have embraced a definition of crimes against humanity that tracks Article 7 of the Rome Statute of the International Criminal Court (“ICC”). Other States have rejected Article 7 as the basis for the new treaty, but theirs …

Ten Years And Ten Miles: Reflecting On "Ferguson", Benjamin Levin Jan 2025

Ten Years And Ten Miles: Reflecting On "Ferguson", Benjamin Levin

Scholarship@WashULaw

This Essay serves as the introduction to a symposium on the ten-year anniversary of Michael Brown's death in Ferguson, Missouri and the subsequent protests and uprisings across the country. The authors look back on the past decade—their own experiences and our experiences as a nation—to consider the impacts of the Ferguson uprisings and the landscape of criminal justice and racial justice advocacy, scholarship, and teaching today. In this Essay, I provide a brief introduction to the Volume and essays that follow. In Part I, I situate the Ferguson uprisings in the broader context of activism responsive to racial injustice in …

A Liberty-Balancing Approach To Crime, Sheldon Evans Jan 2025

A Liberty-Balancing Approach To Crime, Sheldon Evans

Scholarship@WashULaw

At its core, the criminal legal system is an ecosystem of institutions that seek to balance liberty interests. The insightful theories and complex practices of crime policy coalesce around questions on how crime impacts the liberties of individuals and communities to be safe, and how this correlates with the deprivation of liberty from offenders through our punishment system. But modern criminal policy, most often associated with the problems of overcriminalization and mass incarceration, has wholly abandoned any such delicate and nuanced balancing. Instead, the system thrives on sacrificing the liberties of offenders in a perverse and ineffective regime that leads …

Auditing Criminal Justice Minimalism, Trevor George Gardner Jan 2025

Auditing Criminal Justice Minimalism, Trevor George Gardner

Scholarship@WashULaw

If criminal justice minimalism is a shared principle among criminal law scholars, it can help to clarify the quality of our disagreements. Every normative proposal in the criminal legal literature can be held to the minimalist standard—audited, so to speak, to account for the policy author’s minimalist claims. To this end, this Essay proposes a four-step framework by which to evaluate adherence to the minimalist principle, where each step serves as a hub for pointed scholarly debate regarding the path to minimalist criminal justice.

An Anthology Of Interference In Law School Clinics, Peter A. Joy, Robert R. Kuehn Jan 2025

An Anthology Of Interference In Law School Clinics, Peter A. Joy, Robert R. Kuehn

Scholarship@WashULaw

An Anthology of Interference in Law School Clinics explores interference in law school clinics in the United States, addressing its long history and the legal ethics, academic freedom, and First Amendment responses to that interference. Law clinics have faced interference in their representation of clients from elected officials, business groups, alumni and, at times, even their own school administrators. This interference has targeted clinics for providing individuals and nongovernmental organizations with legal representation on important matters, including racial and gender discrimination, environmental issues, prisoner rights litigation, death penalty cases, and immigration and human rights matters. In each instance, the interference …

A Call To Action For Transport Justice: Exploring Transportation Disadvantages Faced By Justice-Impacted Individuals Reintegrating Into Rural Communities, Tarnika Edmunds

Master of Urban and Regional Planning Capstone Projects

This study explores the intersection of rural reentry and transportation planning, emphasizing the importance of Transport Justice in overcoming barriers faced by transit-dependent populations, particularly formerly incarcerated individuals. While urban transportation planning is widely discussed, this research highlights the overlooked challenges that rural environments pose for individuals reentering society. Through a multi-method approach that involved document analysis, participant observations, and informal discussions, this study uncovers a range of themes related to accessibility, reliability, vulnerability, and the quality of commuting experiences. The findings underline the necessity for transparency, accountability, and collaboration across sectors to address these gaps and inform policies that …

Constructions Of Serial Killers And Victims: Analysis Of True Crime Docuseries, Mira Dhaliwal Jan 2025

Constructions Of Serial Killers And Victims: Analysis Of True Crime Docuseries, Mira Dhaliwal

Theses and Dissertations (Comprehensive)

Stories of crime have consistently captured the attention of the public, with stories of heists, kidnappings and murder. The true crime genre receives enormous attention and serves for many as the primary source of crime knowledge, including who commits crime, how they commit crime and how law enforcement responds. Books and podcasts have been interrogated by researchers to understand the nature of the content but missing are the true crime documentaries and docuseries that have dominated streaming platforms in North America. The present study examined three true crime series about serial killers using social constructionism and social problems theory, and …

Victim-Offender Relationships And Their Influence On Crime Brutality And Sentencing Outcomes In Capital Homicide Cases, Samantha Jane Trowbridge Jan 2025

Victim-Offender Relationships And Their Influence On Crime Brutality And Sentencing Outcomes In Capital Homicide Cases, Samantha Jane Trowbridge

Graduate Theses/Dissertations

This study examines capital murder cases in Missouri from 1976 to 2022 to explore how victim-offender relationships relate to both the brutality of homicides and sentencing outcomes. It addresses three main questions: What are the different types of victim-offender relationships in these cases, and how frequently does each type occur? How do these relationships influence sentencing outcomes, particularly the likelihood of receiving the death penalty versus life without parole? And which types of relationships are associated with the highest and lowest levels of brutality? The study uses official court records and applies a coding process to analyze relationship type, sentencing …
