A Comprehensive Overview Of Prison Rape And The Impacts Of The Prison Rape Elimination Act, Kayn L. Bienhold

This paper will examine prison rape by exploring sexual abuse rates, the causes of underreporting, the gender-based prison and rape cultures, reasons why victims are targeted, and the impact The Prison Rape Elimination Act (PREA) has had on the issue. It draws on both qualitative research and national surveys. Findings have shown that sexual victimization is much more widespread than indicated by official reports due to high rates of underreporting, fears of retaliation, and flawed implementation and enforcement of PREA’s policies. This study critically examines how neoliberal social controls and school-based criminalization efforts emerged in response to a series of moral panics surrounding perceived increases in school violence and mass shootings. Largely, this response manifested in the form of rigid zerotolerance disciplinary policies focused on deterrence and retribution. However, research reveals the application of these policies produce racial and income-based disparities in how school discipline is administered, which contributes to the school-to-prison pipeline (i.e., a pathway for youth to be funneled out of education and into incarceration). บทความชิ้นนี้ศึกษากลไกการปรับตัวทางเศรษฐกิจและการเมืองของสาธารณรัฐประชาธิปไตยประชาชนลาวภายหลังยุคสังคมนิยม โดยมุ่งเน้นการอธิบาย “ภาคแสดงของกลไกการปรับตัว” ผ่านแนวคิดการประกอบร่วม (Assemblage) การอธิบายกลไกดังกล่าวศึกษาด้วยวิธีการเชิงชาติพันธุ์วรรณนา (Ethnography) จากการเดินทางร่วมกับรถบรรทุกน้ำมันเชื้อเพลิงข้ามพรมแดนไทย-ลาว ผ่านสะพานมิตรภาพไทย-ลาวแห่งที่ 1 และ 2 เพื่อสำรวจกลไกที่ประกอบร่วมกันในการดำรงอยู่ของรัฐสังคมนิยมลาว ระยะเวลาการเก็บข้อมูลเริ่มตั้งแต่เดือนมกราคม 2567 จนถึงเดือนเดือนกุมภาพันธ์ 2567 รวมระยะเวลาทั้งสิ้น 2 เดือน ผลการศึกษาชี้ให้เห็นว่า น้ำมันเชื้อเพลิงและสะพานมิตรภาพไทย-ลาวเป็นผู้กระทำ (Actant) สำคัญในภาคแสดงของกลไกการปรับตัวต่อความเป็นรัฐสังคมนิยม งานศึกษานี้เสนอว่า การเข้าใจกลไกการปรับตัวต่อความเป็นรัฐสังคมนิยมจำเป็นต้องพิจารณาการประกอบร่วมจากผู้กระทำอื่นนอกเหนือจากรัฐ ซึ่งช่วยอธิบายความต่อเนื่องของการคงความเป็นสังคมนิยมของสาธารณรัฐประชาธิปไตยประชาชนลาว

Thailand’S Alignment Strategy Amidst The Us-China Rivalry : A Role Theory Perspective, Wen Chou Han

This paper seeks to analyze how Thailand, as a middle power, navigates its alignment choices amid an intensifying US-China rivalry in the Asia-Pacific region through the lens of role theory. This paper also proposes several original mechanisms to operationalize the role theory in the analysis of Thailand’s strategy. To this end, Thailand’s foreign policy from the past decade (2012 to mid-2025) will be reviewed. The central argument is that Thailand is adopting a “soft hedging” strategy marked by opportunism and driven by its key goal of development, but is, at the same time, complicated by domestic political dysfunction (“fragmented centralism”). …

งานวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาบริบทฐานทุนและเศรษฐกิจชุมชนในสิงหนคร 2) วิเคราะห์และสังเคราะห์กระบวนการเรียนรู้โดยชุมชนท้องถิ่นเป็นฐาน (Community-based learning : CBL) และ 3) สังเคราะห์ผลลัพธ์ของกระบวนการเรียนรู้และจัดทำข้อเสนอแนะเชิงนโยบายและแบบจำลองการพัฒนาเพื่อยกระดับและสร้างคุณค่าทางเศรษฐกิจจากฐานทุนในพื้นที่อย่างยั่งยืน โดยศึกษาพื้นที่ชุมชนเทศบาลเมืองสิงหนคร จังหวัดสงขลา ใช้วิธีวิจัยเชิงคุณภาพ (Qualitative research) แบบการวิจัยเชิงปฏิบัติการแบบมีส่วนร่วม (Participatory action research : PAR) กลุ่มผู้ให้ข้อมูลสำคัญ ได้แก่ เทศบาลเมืองสิงหนคร กรมศิลปากร สำนักศิลปากรที่ 11 สงขลา เครือข่ายการศึกษาในพื้นที่ กลุ่มสตรี ผู้สูงอายุ กลุ่มวิสาหกิจชุมชน เกษตรกร ชาวประมง ผู้ประกอบการธุรกิจรายย่อยในพื้นที่ และกลุ่มภาคีต่าง ๆ

ผลการวิจัยพบว่า ทุนทางทรัพยากรและเศรษฐกิจที่สำคัญ ได้แก่ ผลิตภัณฑ์สิ่งบ่งชี้ทางภูมิศาสตร์ (GI) 3 รายการ คือ ปลากะพงสามน้ำ มะม่วงเบาสงขลา และไข่ครอบสงขลา ทรัพยากรในทะเลสาบสงขลา การรวมกลุ่มของวิสาหกิจชุมชน เช่น กลุ่มขนมโบราณ กลุ่มผ้ามัดย้อม กลุ่มมะม่วงเบา กลุ่มปลากรอบ ทุนทางวัฒนธรรมและประวัติศาสตร์ที่สำคัญ คือ ประวัติศาสตร์เมืองเก่าสิงหนคร (ซิงกอรา) และทุนทางสังคม คือ วิถีชีวิตคนพุทธ-มุสลิมที่กลมกลืน มีเครือข่ายการศึกษาและกลุ่มอนุรักษ์ทรัพยากรชายฝั่ง กระบวนการเรียนรู้ของชุมชนเพื่อการพัฒนาทางเศรษฐกิจและสังคมในพื้นที่ เกิดจากความเชื่อมโยงระหว่างภูมิปัญญาท้องถิ่นกับการได้รับความรู้จากภาครัฐ สถาบันการศึกษา ภาคเอกชน และอาศัยเทคโนโลยีดิจิทัลในการอัปเดตองค์ความรู้ ผลลัพธ์ของกระบวนการเรียนรู้ ได้แก่ การพัฒนาผลิตภัณฑ์ใหม่ 6 ชนิด จำนวนกลุ่มเปราะบางที่ได้รับการพัฒนาทักษะอาชีพ 93 คน กลุ่มวิสาหกิจจำนวน 19 กลุ่ม ที่มีรายได้เพิ่มขึ้นร้อยละ 10 และพัฒนาพื้นที่การเรียนรู้ จำนวน 5 แห่ง สำหรับข้อเสนอแนะ การวิจัยควรมีการพัฒนาอาชีพเสริม เช่น การทำขนมและการแปรรูปอาหารทะเลที่เชื่อมโยงเรื่องราวประวัติศาสตร์และวิถีชีวิตเข้ากับการออกแบบผลิตภัณฑ์ใหม่ และใช้การตลาดดิจิทัล เพื่อเชื่อมโยงเส้นทางท่องเที่ยวชุมชน ผ่านกลไกการเรียนรู้โดยใช้ฐานทุนในพื้นที่เป็นหลัก

ในปัจจุบัน สถานการณ์อาชญากรรมรุนแรงที่กระทำโดยเด็กและเยาวชนมีแนวโน้มทวีความรุนแรงและเพิ่มสูงขึ้นอย่างต่อเนื่อง โดยเฉพาะอย่างยิ่งในเขตกรุงเทพมหานคร ซึ่งนับเป็นพื้นที่ที่มีอัตราการก่ออาชญากรรมในระดับสูง การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาบทบาทและหน้าที่ของเจ้าหน้าที่ตำรวจในกระบวนการบังคับใช้กฎหมาย รวมถึงปัญหาและอุปสรรคที่เกิดขึ้นในการปฏิบัติงาน ตลอดจนแนวทางการเพิ่มประสิทธิภาพการบังคับใช้กฎหมายต่อกลุ่มเด็กและเยาวชนผู้กระทำความผิดในคดีอาชญากรรมรุนแรง การวิจัยครั้งนี้ใช้ระเบียบวิธีวิจัยเชิงคุณภาพ (Qualitative research) โดยมีเครื่องมือหลักในการเก็บรวบรวมข้อมูล ได้แก่ การสัมภาษณ์เชิงลึก (In-depth interview) กับผู้ให้ข้อมูลสำคัญ (Key informants) จำนวนทั้งสิ้น 13 คน ประกอบด้วย เจ้าหน้าที่ตำรวจ นักจิตวิทยา นักสังคมสงเคราะห์ และพนักงานอัยการ

ผลการวิจัยพบว่า เจ้าหน้าที่ตำรวจมีบทบาทครอบคลุมกระบวนการทุกขั้นตอน ได้แก่ การป้องกันการกระทำความผิดผ่านโครงการและกิจกรรมเชิงรุก การจับกุมโดยใช้มาตรการที่เหมาะสมกับสภาพจิตใจและพัฒนาการของเด็ก การควบคุมตัวในสถานที่แยกจากผู้กระทำความผิดที่เป็นผู้ใหญ่ และการสอบสวนแบบสหวิชาชีพร่วมกับนักจิตวิทยา นักสังคมสงเคราะห์ และพนักงานอัยการ อย่างไรก็ตาม การวิจัยพบปัญหาสำคัญหลายประการ อาทิ ช่องว่างของบทบัญญัติทางกฎหมายที่เปิดโอกาสให้ผู้ใหญ่แสวงหาประโยชน์จากเด็กและเยาวชน ความซับซ้อนของกระบวนการและข้อจำกัดด้านระยะเวลา การขาดสมรรถนะและความเชี่ยวชาญของบุคลากร ภาวะการขาดแคลนกำลังพลเฉพาะทาง เป็นต้น

การสื่อสารทางการเมืองของนายกเทศมนตรีในการบริหารจัดการอุทกภัย : กรณีศึกษาเทศบาลนครยะลา, ปุญญวันต์ จิตประคอง

บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษารูปแบบและกลยุทธ์การสื่อสารทางการเมืองของนายกเทศมนตรีนครยะลาในการบริหารจัดการอุทกภัย และวิเคราะห์ประสิทธิผลของกลยุทธ์การสื่อสารทางการเมืองที่มีต่อการสร้างการมีส่วนร่วมของประชาชน โดยใช้วิธีการวิจัยเชิงคุณภาพแบบกรณีศึกษา และเก็บรวบรวมข้อมูลผ่านการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลหลัก 8 คน ประกอบด้วย นายกเทศมนตรีนครยะลา ปลัดเทศบาลนครยะลา หัวหน้าฝ่ายป้องกันและบรรเทาสาธารณภัยเทศบาลนครยะลา เจ้าหน้าที่ฝ่ายป้องกันและบรรเทาสาธารณภัยเทศบาลนครยะลา ผู้รับบริการและผู้มีส่วนได้ส่วนเสียในระดับชุมชนและการวิเคราะห์เอกสารที่เกี่ยวข้อง ได้แก่ แผนการบริหารจัดการอุทกภัย รายงานผลการดำเนินงาน และข้อมูลจากสื่อสังคมออนไลน์ จากนั้นวิเคราะห์ข้อมูลด้วยการวิเคราะห์เนื้อหาโดยใช้กรอบทฤษฎีการสื่อสารในภาวะวิกฤต แนวคิดการสื่อสารทางการเมือง และแนวคิดการสร้างความยืดหยุ่นของเมือง ผลการศึกษาพบรูปแบบการสื่อสาร 5 ลักษณะ คือ การสื่อสารหลายช่องทางแบบบูรณาการ (ดิจิทัล ช่องทางดั้งเดิม และนวัตกรรม IoT) การสื่อสารแบบเรียลไทม์ 3 ระยะ มีการแจ้งล่วงหน้า 8 ชั่วโมง การจัดวางตำแหน่งของเทศบาลเป็นศูนย์กลางข้อมูลที่สามารถชี้แจงต่อสาธารณะ และมีการเปิดเผยข้อมูล ผ่านกลไกต่าง ๆ ประกอบด้วย สภากาแฟ การดูงาน และการประสานผู้ช่วยชุมชน 44 คน และการสร้างเครือข่าย Win-Win กับองค์กรปกครองส่วนท้องถิ่น 20 แห่ง ส่งผลให้เกิดผลสัมฤทธิ์ที่สำคัญ 4 ด้าน ประกอบด้วย การเพิ่มการมีส่วนร่วม (ตัวแทนครัวเรือน 10,000 จาก 25,000 ครัวเรือน อาสาสมัคร 176 คน) การสร้างความไว้วางใจที่สั่งสม 20-21 ปี การเพิ่มประสิทธิภาพการรับมือภัยพิบัติ (ตอบสนองรวดเร็วกว่าหน่วยงานอื่น) และการพัฒนานวัตกรรมอย่างต่อเนื่อง ทั้งนี้ องค์ประกอบของความสำเร็จเกิดขึ้นมาจากความโปร่งใสและการแสดงให้เห็นการทำงานจริง การเปิดโอกาสให้ประชาชนมีส่วนในการตัดสินใจ การคัดเลือกตัวแทนแต่ละหมู่บ้าน การแก้ปัญหาข้ามเขตตามหลักการ Win-Win และบารมีของผู้บริหารที่สั่งสมมา ซึ่งคุณลักษณะดังกล่าวสามารถนำไปประยุกต์ใช้ในการพัฒนากระบวนการบริหารจัดการภัยพิบัติในพื้นที่อื่น ๆ ได้อย่างมีประสิทธิภาพ

นายกรัฐมนตรีชินโซ อาเบะ ให้เหตุผลการยอมรับสิทธิการป้องกันตนเองร่วม (Collective Self-Defense : CSD) ว่า ภัยคุกคามต่อญี่ปุ่นกำลังทวีความรุนแรงรอบด้าน ทั้งขีปนาวุธจากเกาหลีเหนือ ข้อพิพาททางดินแดน รวมไปถึงการขยายอิทธิพลของจีนที่อาจเข้าแทนที่สหรัฐอเมริกาในภูมิภาค หากสถานะเดิม (Status quo) เปลี่ยนไป ญี่ปุ่นภายใต้รัฐธรรมนูญสันติภาพจะไม่อาจต่อสู้ได้เพียงลำพัง บทความชิ้นนี้ต้องการศึกษาพลวัตการใช้สิทธิการป้องกันตนเองร่วมของญี่ปุ่นในสมัยนายกรัฐมนตรีอาเบะ โดยศึกษาผ่านมุมมองการกระจายความเสี่ยง (Hedging) เพื่อตอบคำถามที่ว่า ญี่ปุ่นใช้สิทธิการป้องกันตนเองร่วมในยุทธศาสตร์อินโด-แปซิฟิกอย่างไร โดยเสนอว่า สิทธิการป้องกันตนเองร่วมช่วยเสริมสร้างการเป็นผู้สร้างสันติภาพเชิงรุกในเวทีโลก การกระชับความสัมพันธ์ด้านความมั่นคงกับพันธมิตรที่มีแนวคิดตามหลักนิติธรรมเหมือนกันนอกเหนือจากสหรัฐอเมริกา เป็นการกระจายความเสี่ยงโดยวิธีถ่วงดุลทางอ้อมให้ยังคงรักษาความสัมพันธ์อันดีกับจีนได้ ขณะเดียวกันก็แสดงถึงการกระจายความเสี่ยงแบบสองชั้นเพื่อลดการพึ่งพาสหรัฐอเมริกา และเล่นบทบาทนำมากขึ้น

This article explores how community and civil society actors in mining conflicts strategically engage with legal and technical vocabularies to assert legitimacy, contest exclusion, and influence mining governance. Drawing on an empirical case study of Thailand’s Chatree gold mine, the article analyzes how affected groups navigate overlapping normative systems, such as state law, transnational norms, and technocratic discourses, through informal learning and strategic appropriation of expert language. Framed through the conceptual lens of legal pluralism, the study highlights how actors interpret and mobilize diverse normative orders to articulate grievances, shape narratives, and attempt to gain access to decision-making spaces. Black youth may be even more vulnerable than other youth to admitting to crimes they did not commit in the context of police interrogations. In support, analysis of data from the National Registry of Exonerations indicates that 65% of people who were wrongfully convicted on the basis of false confessions they gave when under 18 years old are Black, whereas only 14% of the U.S. population is Black. Female-perpetrated violence has exhibited concerning data trends in recent years. Prior scholarship indicates that past victimization and trauma in childhood, known as adverse childhood experiences (ACEs), are highly prevalent among women offenders. However, the research concerning ACEs and violent females is scattered. This thesis provides a scoping literature review using the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) updated 2020 guidelines. A systematic database search was conducted using Academic Search Complete, SAGE Journals, Springer Nature Link, and HeinOnline to identify relevant peer-reviewed journal articles. Unsettling Colonial Automobilities: Criminalisation and Contested Sovereignties is a compelling interdisciplinary and multileveled study that sits at the intersection of law, criminology, settler colonial studies, and cultural analysis. The authors are well-suited to this task. They include Professors Harry Blagg, with expertise in First Nations community-engaged criminology; Thalia Anthony, from legal and carceral studies; Wiradjuri scholar Juanita Sherwood, who studies Indigenous health and community research; and Kieran Tranter, an expert in cultural legal theory. The rapid proliferation of incel-related content across digital platforms has raised concerns about online misogyny and its potential impact on women’s perceived safety. However, less is known about how exposure to such content shapes women’s perceptions of risk and emotional responses in everyday digital environments. This study examines the relationship between exposure to incel-related content and women’s perceived risk of gender-based violence and safety-related anxiety. This article explores scientific evidence that societies care more about the welfare and safety of females than that of males, and that this dynamic of "male disposability" is deeply entrenched in culture, and thus in law. The recognition and integration of male disposability theory would mean an evolutionary leap in modern theorizing about gender and the law, but it is ignored. Why? “Punishment” is an all-important category in criminal legal thought. Conventional scholarship adopts a narrow definition and focuses on justifying penal sanctions. Much critical work, in contrast, seeks to expand the category—defining more practices and institutions as “punishment.” In this Article, I argue that the focus on purposes of punishment and on what constitutes punishment distracts from a larger theoretical and practical issue—much of what the criminal system does probably isn’t punishment as such. This study examines whether frequently used correctional assessment instruments adequately capture the psychological impacts of maternal-child separation among incarcerated women. This research was conducted in response to growing criticisms that traditional risk and needs assessments fail to account for gender-specific experiences, specifically those related to caregiving roles and pregnancy. Older adults face growing risks of cyber-enabled fraud, yet scalable, evidence-based prevention programs remain limited. Guided by Cyber-Routine Activities Theory (Cyber-RAT), this study evaluates the pilot implementation of the Seniors Harnessing Internet Education for Lasting Defense (SHIELD) Training-the-Trainer program, designed to prepare law enforcement officers and community leaders to deliver cybercrime prevention education to older adults. This study investigates the personal accounts of both perpetrators and victims to better understand the techniques and strategies used in vishing and smishing schemes. It adopts a qualitative cross-sectional design across three Lagos slums (Ajegunle, Amukoko, and Ijora-Badia), using snowball sampling to recruit 20 victims and 10 perpetrators for in-depth interviews. Findings reveal that perpetrators impersonate trusted entities using low-tech tools (pre-registered SIMs, bulk SMS apps) to exploit trust. Selective morality emerges among offenders, with some repaying known victims due to guilt while exploiting strangers, alongside a mentorship culture where experienced scammers train newcomers. Cryptocurrency airdrop scams have emerged as a rapidly growing form of cyber-enabled financial crime, yet remain underexplored in empirical research. This study examines how transaction-level mechanisms and offender strategies influence variation in monetary loss in airdrop scam incidents. This study examined predictors of alignment between parents’ and caseworkers’ perceptions of family engagement in child welfare services. Using data from 2,274 Alternative Response (AR)–eligible families randomized to AR or Traditional Response, engagement was assessed across the domains of Receptivity, Buy-in, Worker-family Relationship, and Mistrust using a modified Yatchmenoff (2005) scale. Multinomial logistic regression models identified factors associated with agreement and discrepancy between ratings of family engagement within the parent and worker dyad. While both parents and workers valued engagement, workers were more likely to provide higher overall engagement ratings, although the direction of discrepancy varied across specific subscales.
