In former years, an attorney was paid a fee "not as a salary or hire but as a mere gratuity which a counselor cannot demand without doing wrong to his reputation." These customs are long since past. The English rule that a counselor or barrister has no right to charge for his services and that he cannot enforce compensation no longer prevails in Ohio, for example, and in other states. Today, in most jurisdictions, an attorney's right to payment for services rendered is protected by statute. As of the end of 1955, thirty-one states had some form of an attorney's …

The average attorney has little interest in, nor does he realize the inadequacy of, the attorney's lien laws of his state—until he finds himself personally involved. Yet, a glance at the law reviews and pertinent cases indicates that the organized bar and its individual members should show more than a casual interest in the number and variety of problems arising in this field.

What constitutes the illegal or unauthorized practice of law by accountants in their tax practice? The popular conception of the practice of law is the appearance in courts by attorneys. This may be a very small part of the average attorney's law practice. he spends most of his time in determining his clients' legal problems other than in court. So the unauthorized practice of law concerns itself with activities of persons, other than lawyers, who give legal advice to clients in connection with the practice of their professions. Unauthorized practice of law is practice by one who has not been admitted to practice by the supreme court and who is not a member in good standing of the state bar association. It is now undisputed that the supreme court has sole jurisdiction over admission to practice and apparently may deal with unauthorized practice as an incident of its power over admission. However, unauthorized practice has also been the subject of legislative enactment. It follows, therefore, that the sanctions which are imposed to prevent the unauthorized practice of law in this state are of both judicial and legislative creation. …

Few topics are currently more at the center of both interest and need than that of Dr. Stumpf's new book. The ship of democracy is being tossed by heavy seas. Many are looking for a haven of faith. They tell us that the ship cannot stay afloat unless it reaches the well-protected harbor of religion. It needs at least to be overhauled, they say, and made more seaworthy in that harbor before it braves again the heavy onslaughts which it must necessarily breast. We have just finished our 77th annual meeting of the American Bar Association. This meeting has, of course, been unique and unusually gratifying in that it was the occasion of dedicating the American Bar Center in which is lodged the American Bar Association's new headquarters and the American Bar Foundation research and library headquarters. You have all heard of this glorious accomplishment and every one who was there, I am sure, was thrilled because of the dignity, simplicity, and impressiveness of the ceremonies.

The members of Lowell Bar Association brought a suit in equity to restrain respondents, who are not members of the bar, from holding themselves out as qualified to practice law, and from giving legal advice in respect to liability to pay income taxes and to enjoin the preparation and execution of income tax returns. The facts showed that respondents had advertised, by newspaper and placards, an income tax-service for individuals, including preparation of tax return and "counsel in handling income tax matters should any develop after the official audit by the U.S. Tax Department."
