The Clinical Law Experiment: Michigan's First Five Years, Steven D. Pepe
The Clinical Law Experiment: Michigan's First Five Years, Steven D. Pepe
Law Quadrangle (formerly Law Quad Notes)
Many Michigan law alumni continue to inquire about the Clinical Law Program, now entering its fifth year of fulltime operation. Prof. Al Conard's "Letter from the Law Clinic" in the fall, 1973, Law Quadrangle Notes gave a perceptive and entertaining glimpse into some of the case situations at the clinic and the types of learning in which clinic students are engaged. This article will sketch the development and operation of our clinical experiment in legal education. A future article will explore the goals, methodology, and problems of clinical legal education. A third and final article will focus on a particular …
Lawyers And Professionalism: A Further Psychiatric Perspective On Legal Education, Andrew S. Watson
Lawyers And Professionalism: A Further Psychiatric Perspective On Legal Education, Andrew S. Watson
University of Michigan Journal of Law Reform
In recent years, clinical teaching methods have played an increasingly significant role in the education of this nation's lawyers. With the consequential accumulation of data pertaining to various institutional experiences, it is now worthwhile to explore, from a clinician's perspective, some of the psychodynamics of this educational process as it appears to affect a student's future professional behavior. In addition to such an examination, this article will delineate methods for dealing with the stresses of a lawyer's professional life, suggesting ways in which the attorney may satisfy his goals as well as those of his client. It is hoped that …
The Sherman Act And Bar Admission Residence Requirements, Harvey Freedenberg
The Sherman Act And Bar Admission Residence Requirements, Harvey Freedenberg
University of Michigan Journal of Law Reform
This article will focus on the restrictive aspects of residence qualifications for admission to the state bar. Such restrictions are significant in three cases: initial admission to the bar, relocation by a foreign attorney, and multistate practice by an attorney admitted to the bar in another state. An attempt will be made to determine whether these requirements might be invalid under the Sherman Act and to analyze the case for their abolition. The commercial counterpart of professional entry restrictions has been termed "the very essence of monopoly,” and on this basis it is submitted that further freedom from antitrust scrutiny …

Aba Approval Of Law Schools: Standards, Procedures, And The Future Of Legal Education, Michigan Law Review
Michigan Law Review
Graduation from an accredited law school is a requirement for admission to the bar in most states. Although rule-making power with regard to bar admission lies in the state supreme courts, the courts give great deference to the American Bar Association (ABA) as an accreditor of law schools. Admission requirements frequently prescribe unconditionally that an applicant must be a graduate of a law school that has been approved by the ABA. Other states require either graduation from an ABA-approved law school or some specified alternative. The few remaining states require unconditionally or as an alternative that an applicant for the …

The Evaluation Of A Clinical Legal Education Program: A Proposal, Junius L. Allison
The Evaluation Of A Clinical Legal Education Program: A Proposal, Junius L. Allison
Vanderbilt Law Review
Even though the Code of Professional Responsibility sets only general standards for competency, the competence of individual lawyers is now an area of active inquiry by the courts. Likewise, Legal Services are subject to regular evaluations. While these evaluations have had poor track records, the fault lies with their administration rather than their concept. If the practice of law is subject to scrutiny, it follows that schools for training the lawyers, and certainly parts of their curricula, such as clinical programs, can be evaluated." Legal education on its most basic level is preparation for a profession, the 'public profession of …

The Myth Of Sisyphus: Legal Services Efforts On Behalf Of The Poor, Lawrence E. Rothstein
The Myth Of Sisyphus: Legal Services Efforts On Behalf Of The Poor, Lawrence E. Rothstein
University of Michigan Journal of Law Reform
In Greek mythology there is a story about the tyrant, Sisyphus, who is condemned to suffer everlasting anguish. Eternally, he rolls a huge rock up the steep side of a mountain only to have it roll down again just as he reaches the top. Such is the plight in which the poor person finds himself when confronting the legal system. If the poor individual is able to overcome the massive obstacles placed between him and full, fair litigation of his case, he finds that the rules to be applied to the case are stacked against him. This situation is not …
