The Future Of Liberal Legal Scholarship, David Skover, Ronald Collins
The Future Of Liberal Legal Scholarship, David Skover, Ronald Collins

Earl Warren is dead. A generation of liberal legal scholars continues, nevertheless, to act as if the man and his Court preside over the present. While this romanticism is understandable, it exacts a high price in a world transformed. The following commentary is a reconstructive criticism written from the perspective of two liberals concerned about the future of "legal liberalism." The author’s present their views as a commentary to emphasize their preliminary character; they represent thier current assessment of where liberals stand and where they might redirect their energies. In Part I, they outline the reasons for believing that there …

The legal profession has undergone a revolution and incremental changes of enormous significance in the last two decades. For many affected by these changes it has been the best of times, for others it has been the worst of times. Some of these changes developed internally from forces within the profession, and some were generated by pressures in other institutions and in the larger society.
There is a changing culture in the workplace of law, in the law schools, and in the nation. But by no means does this mean that the changes are consistent. On the contrary, we are …

In United States v. Harvey, the United States Court of Appeals for the Fourth Circuit held that Congress may not constitutionally require convicted racketeers and drug traffickers to forfeit property used to pay legitimate defense attorney fees. To the extent that such forfeitures and related pre-conviction restraints on transfer are authorized by provisions of the Comprehensive Forfeiture Act of 1984 (the Act), those provisions violate an accused's right to counsel of choice as secured by the Sixth Amendment. This article argues that the court's holding in Harvey was more narrowly drawn than necessary, and that as a consequence criminal defense attorney …

Rico And The Forfeiture Of Attorneys' Fees: Removing The Adversary From The Adversarial System?, Tim Tracy
Rico And The Forfeiture Of Attorneys' Fees: Removing The Adversary From The Adversarial System?, Tim Tracy
Washington Law Review
Analysis of the courts' application of RICO's amended forfeiture provisions to attorneys' fees entails consideration of the language of the statute, congressional intent, and the requirements of the fifth and sixth amendments. That analysis leads to a conclusion that neither legislative history nor statutory language requires the inclusion or exclusion of attorneys' fees from RICO forfeiture. Likewise, the right to counsel provided by the sixth amendment, upon which some courts have relied, does not adequately resolve the issue. Instead, fifth amendment due process analysis provides the requisite constitutional framework to resolve the fee forfeiture issue. Fifth amendment considerations compel recognition …

Two Contradictory Criticisms Of Clinical Education: Dilemmas And Directions In Lawyering Education, Carrie Menkel-Meadow
Two Contradictory Criticisms Of Clinical Education: Dilemmas And Directions In Lawyering Education, Carrie Menkel-Meadow
Antioch Law Journal
This article reviews what legal education is attempting to accomplish in teaching lawyering skills and where, from my perspective as a clinician, I think it has fallen short. I then offer some suggestions for what both clinicians and non-clinicians might do to further our efforts directed at truly educating lawyers. The two critiques I will offer of clinical education derive from two of clinical education's principal goals - teaching students how to "behave"as well as "think" like a lawyer (a behavorist goal), and teaching our students to think more broadly about the purpose of their roles as lawyers in the …
