Teaching For Change: How The Legal Academy Can Prepare The Next Generation Of Social Justice Movement Lawyers, Alexi Freeman
Teaching For Change: How The Legal Academy Can Prepare The Next Generation Of Social Justice Movement Lawyers, Alexi Freeman
Sturm College of Law: Faculty Scholarship
The call for “practice ready” lawyers has been heard loud and clear across the country. Legal education has overwhelmingly responded to that call, finding ways to help students gain more practical experience and better understand what it actually looks like to be a lawyer. Students intending to practice “social justice movement lawyering,” however, have been largely ignored, albeit with some notable exceptions. But, working in partnership to build the power of low-income communities of color and effect long-term social change requires distinct training and distinct framing.
This article proposes ways in which the legal academy can better prepare the next …
Crisis And Trigger Warnings: Reflections On Legal Education And The Social Value Of The Law, Kim D. Chanbonpin
Crisis And Trigger Warnings: Reflections On Legal Education And The Social Value Of The Law, Kim D. Chanbonpin
Chicago-Kent Law Review
In the same moment that law schools are embracing neoliberal strategies in response to the economic crisis caused by declining admissions, students in the classroom have begun to agitate for advance content notices (or “trigger warnings”) to alert them to any potentially trauma-inducing course materials. For faculty who have already adopted a defensive posture in response to threats to eliminate tenure, this demand feels like an additional assault on academic freedom; one that reflects a distressing student-as-consumer mentality. From this vantage point, students are too easily cast as another group of adversaries when, in actuality, students are straw targets who …

Wanting To Do More But Bound To Do Less: A Law Librarian's Dilemma, Paul Jerome Mclaughlin Jr.
Wanting To Do More But Bound To Do Less: A Law Librarian's Dilemma, Paul Jerome Mclaughlin Jr.
Library Faculty Publications
The role of the law librarian has changed from managing the contents of a library’s collection of books to knowing how to find information sources located around the world contained in a variety of formats, taking part in instruction, and participating in networking activities. Law librarians are constrained by legal and professional codes. If they are cautious, law librarians can assist, instruct, and reach out to public patrons and students while operating within the professional guidelines that govern them.

For the past twenty-five years, my academic and professional pursuits have straddled the line between business and law. I majored in business administration in college and then worked as an analyst in the Corporate Finance department at a bulge bracket Wall Street firm. After completing a JD/MBA, I returned to investment banking with a focus on middle-market mergers and acquisitions (M&A) and subsequently practiced law with a focus on private equity and M&A. Finally, in 2004, I found my current home as a corporate law professor. In my courses, which include Mergers & Acquisitions, Enterprise Organization, and Investor Protection, I …

The Career Path, Education, And Activities Of Academic Law Library Directors Revisited Twenty-Five Years Later, Michael J. Slinger, Sarah C. Slinger

In conducting this new study, our goal is to provide useful information to the profession and guidance to future law library directors. We also think that by examining the director position we can provide a window into how the profession of academic law librarianship is evolving. Some of the changes we uncovered we see as positive. However, other changes are of concern, including an emerging trend at some institutions to remove full faculty status from the director. This is alarming to those of us who think retaining full partnership with the law faculty is crucial for the future effectiveness of …

The Continuing Work Of The Bellow Scholars, Jeanne Charn
The Continuing Work Of The Bellow Scholars, Jeanne Charn
University of the District of Columbia Law Review
In November 2010, the University of the District of Columbia David A. Clarke School of Law hosted the fourth Bellow Scholar Workshop and subsequently published the work of two Bellow Scholars in Volume 16 of the UDC Law Review.1 I was privileged to contribute a foreword to Volume 16 in which I commented on thelegacy of my late husband, Gary Bellow, and offered a brief narrative of the origins of the Association of American Law Schools (AALS) Clinical Section's Bellow Scholar program.2 Most of the earliest Bellow Scholars had worked with Gary or had taken his courses. We understood that …

Scholars have argued that transactional lawyers add value by mitigating the potential for post-transaction litigation, reducing transaction costs, acting as reputational intermediaries, and lowering regulatory costs. Effective transactional attorneys understand their clients’ businesses and the industries or contexts in which those businesses operate. Applied to the start-up social enterprise context, understanding the client includes understanding the founders’ values, preferences, and proclivity for risk. The novel transactions and innovative solutions pursued by emerging social entrepreneurs may not lend themselves well to risk avoidance. For example, new corporate forms such as the benefit corporation are untested, yet appeal to many social entrepreneurs …

This is a pivotal moment in legal education. Revisions in American Bar Association accreditation standards, approved in August 2014, impose new requirements, including practice-based requirements, on law schools. Other external regulators and critics are pushing for significant changes too. For example, the California bar licensing body is proposing to add a practice-based, experiential requirement to its licensing requirements, and the New York Court of Appeals, New York’s highest court, is giving third-year, second semester students the opportunity to practice full-time in indigent legal services programs and projects. Unbeknown to many, there have been significant recent changes in legal education that …

Assessing Experiential Learning, Jobs And All: A Response To The Three Professors, Robert J. Condlin

Does clinical practice experience improve a law student’s chances of getting a legal job? If not, would it, if employers were given better information about that experience? And if not, are there other reasons to justify a law school’s decision to fund a clinical program? The answer to the first two questions is almost certainly no. For many reasons—the uneven and situation-driven nature of clinical practice experience, the Delphic quality of practice evaluations, the availability of more effective in-house training options, and the like—most private law firms prefer to trust conventional academic credentials more than practice experience in deciding whom …

Synergy And Tradition: The Unity Of Research, Service, And Teaching In Legal Education, Frank A. Pasquale

Most non-profit law schools generate public goods of enormous value: important research, service to disadvantaged communities, and instruction that both educates students about present legal practice and encourages them to improve it. Each of these missions informs and enriches the others. However, technocratic management practices menace law schools’ traditional missions of balancing theory and practice, advocacy and scholarly reflection, study of and service to communities. This article defends the unity and complementarity of law schools’ research, service, and teaching roles. (For those short on time, the chart on pages 45-46 encapsulates the conflicting critiques of law schools which this article …

Law School Based Incubators And Access To Justice – Perspectives From Deans, Patricia E. Salkin, Ellen Suni, Niels Schaumann, Mary Lu Bilek
Journal of Experiential Learning
At the end of February 2015, law professors, law deans, incubator staff and attorneys, and self-selected others gathered at California Western School of Law for the Second Annual Conference on Law School Incubators and Residency Programs. The incubators that are the subject of this article tend to focus on transition to law practice and access to justice, and some are also working to incorporate technology for the practice of law as a means of enhancing access to justice. As more law schools decide to host, sponsor or offer an incubator, and following our panel discussion at the February 2015 incubator …
